Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

Would there be lottery for H1B Visa 2015 ?

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

  3. I applied through consultency… mine is now in RFE.. i hope will go for stamping by december. I haven’t applied for my wife & daughter(1yr age)… once i go there planning to apply for them next year as a dependency… My Question is: will there be any problem in visa stamping regarding this… what should i tell if VO asks why you are going alone… ********** PLEASE SUGGEST*********

      There wont any problem in going alone.Normally you dont get that question in case if you are asked you can simply tell them that i ll take them once I am comfortable with the things around in US. I did the same and i was given a green :-D. All the best.

    • Better get it done for them when you are doing your H1. Don’t postpone it. You can take them later if you want. If you are there and your family is going for H4 interview later, they may need to carry additional document like paystubs, w2 if you have and other documents etc… which will be a bit of task for them to handle.

  5. I do not have a Registered/Court marraige certificate….Though i have Vedic Temple marraige certificate and My name is mentioned in spouse name of my wifes passport. Will i face any chanllange if i go for Visa Stamping

    • Mostly that won’t be a problem as rarely they ask for the marriage certificate. So stay confident and you guys will clear it. Good luck.

      In which era are you living? Leave visa stamping alone, in case of any other documentation, how will you prove you are legally married?
      If educated will behave like this then how can we expect illiterate to have civic sense.

  6. My H1B 2015 got approved and stamping is also done from xxx company. I did not travel to US till now. Now I do not want to go to US from this consultancy as I got better opportunity in another company.

    1) Can I get transfer for my h1b from xxx to yyy company without travelling to US from xxx company? I mean by staying in India itself, is it possible?
    2) MY Petitioner xxx will raise any problems or cancelling my visa if he comes to know about transfer?
    3) what are the original documents are required for transferring from xxx to yyy?
    4) How much it takes for getting transfer if possible?

    • Your visa will not be cap-exempt if you do a transfer without using the H1 at all.
      So if company yyy applies for a transfer, your application will be rejected as you didn’t use your h1 at all. If u need to transfer, you have to at least work for a week for company xxx and have paystubs for a week. Then you will be cap-exempt and can transfer your H1b. So you don’t have any option other than working for company xxx for sometime if you need your H1 to be cap-exempt.

      • Really is it true? From the other blogs, I read that, it will be cap -exempt, and I can get transfer to another company without travelling to US and working at xxx company.

        • Amigo is completely wrong. There was no such rule. Even with the new interpretations, there’s no such thing as: “Your visa will not be cap-exempt if you do a transfer without using the H1 at all”, which is outright bul sht. Looks like (s)he’s totally out of senses on this topic!! Where’s such a thing documented?!

          Attempting a transfer before Oct 1st might be problematic given the recent changes in interpretations by USCIS. However, most of those who applied before Oct 1st and got an RFE questioning cap-exempt – now seemed to have got approvals.

      • Incorrect. You can transfer your H1B to any company even if you didn’t work for the original petitioner. Though, I’m not sure if you have to get your stamping again.

        • I am not wrong. Go search for the rules and see what USCIS have mentioned. If u have not used your H1 at all, you can’t transfer for a cap exempt. Go read the rules and you will know where it is documented. If you are just believing those sugar coating comments from Karthik, then you might be in trouble wasting your H1. USCIS has documented saying, if the approved H1 is not used, that number will be used for another application against cap. At least you have to work 1 day and your h1 will be cap exempt for next 6 years. Good Luck

    Approved:4th Sep 2014

        • Wait for some more time. I got approval after 70 days from responding for RFE. Status changed to RFE response only after 40days sending the RFE response. Good luck.

    I came to USA last Dec in H4 and applied for H1B via a consultancy.My H1B petition got selected in lottery and later it went to RFE on 6th june. (RFE related to company) (Receipt Number: EAC141405****) My consultancy sent me a mail like “USCIS is asking for documentation from End Client. USCIS is extremely strict about processing H1b applications and they are denying several cases. If there’s anything we need from your side, we will contact you. There’s absolutely nothing else we can say about this at present. We will not be responding to any phone calls or emails regarding this matter. Please check your case status online by October 1st week.”

    I am loosing my hopes day by day. I was working in India and its very sad to know that i will not be able to work in USA.
    What happen if they donot replay to the RFE??

    • Lesson to learn…USCIS is not dumb. If you dont have proper skills, you cant run around consultancy like a rat and dream to work in US. Legit students who have graduate from good US universities are not getting chances because of person like you and fake desi consultancy in US. Good luck with your H1b scam!!

    Finally got my petition approved today. Such a huge relief.
    Receipt No. EAC141485*****
    Receipt Notice: Apr 10th
    RFE: May 20th(Employee-Employer Relationship)
    RFE Responded: July 20th
    RFE Response Review: Aug 10th
    Initial Review: Aug 15th ( went from RFE Response Review status to Initial Review with the message “Your address was changed”)
    Post Decision: Sep 4th

    Each stage was a nerve-wracking moment and this site helped me a lot for following each and every updates and to keep calm and focus on what I was doing. Didn’t have any idea when it went back to initial review. But I stayed positive. I thank all the people here for sharing their updates and helping others. I wish all the people goodluck who are still waiting for the update. Stay positive.

  11. Visa approved!

    Hi guys, I just wanted to share my experience as well as a way of gratitude to those that shared them and helped calm my nerves a bit..

    The waiting for killer because you usually keep watching people leaving and wondering what questions were asked, what situation that person was in, etc..

    Anyway, my turn…

    I went with my wife, she is Thai so we were sent to a VO that could speak some thai… as soon as he saw her passport he started trying to speak thai and making fun of how many words he already forgot since he’s been to Thailand. That made us definitely feel more comfortable since we were all laughing and talking about it. In the meanwhile he was checking stuff on his computer and asking for our documents (passports, I-797, wedding certificate and DS-160 confirmation page).

    Basically the questions he asked were:

    VO: What is the name of the company?
    VO: Where are you going?
    VO: This is a renewal right? (I think that’s what he thought initially, but it’s actually a new petition)
    VO: What is your current job?

    I think that was it. no questions were asked to my wife regarding the H1b. just questions about how to speak “left hand” and “right hand” in Thai, etc…

    He then printed something and gave it so we could pay a tax (by this time I read “Visa Issuance” on the paper and I already knew the visa was approved) and told us to pay it at the cashier and come back with the receipt.

    After the payment, he gave me my receipt back and said I was good to go.

    I honestly was always dreaming for the “Your visa is approved” word but that didn’t come out =P, no other documents were asked and I have been practicing H1b and H4 questions like CRAZY for the past days.. moral of the story: always be over prepared but things USUALLY go better than expected, just have faith and be confident.

  13. I got RFE on 10 July..I sent all required docs to my employer on 16 aug.. When i asked them about sending RFE’s response. Employer is saying that my documents have been sent for evaluation to USCIS. they can respond the RFE as soon as we receive evaluation from USCIS.
    As per my view, they should have responded the RFE as they received the required docs from me.
    Can anyone pls tell me what is the meaning of evaluation in RFE respond process?

    Please request someone to tell what happens for below query..

    My consultancy received RFE about to provide Client and Project details.

    and my consultancy submitted SOW (STATEMENT OF WORK) document on client’s letterhead and with consultancy director and client side director’s signatures. but he has not submitted the master agreement copy and he only mentioned the master agreement reference in SOW document and he is telling that is sufficient.

    Request some experts to tell abt – is SOW document is enough? will it be any problem as he didn’t submitted the master agreement?

My opt expires sep 14, and my case is still not approved or any rfe…just idle like that…. mine is not an IT job (so no question of fake desi consultancies), did masters from here, working in core engineering sector precisely in the field of my education… I have no idea why it is taking this long.. my driver’s license will expire along with my OPT, and if I dont get my h1b approved by then, I have no clue what to do to drive to work. Public transport sucks where I live.

        • Look for a rideshare in Craglist. There is nothing you can do except wait for USCIS to decide. By the way not every IT folks goes via Desi Consultancies!! If you are graduate from decent university no need to worry about all desi scam. Just saying!!

        • You can get your driver’s license extended with an acknowledgement copy of the visa, before approval. That’s what I did a couple of years back, not sure if things have changed now.

          I do understand that there are other problems. Be patient, it’s just a matter of time before you get the things settled.

      • Please don’t advice or judge unless you know the situation…i too live in usa and can understand the various problems when you are out of status, driver’s license is just one of the many problems for him. He already said his house is far from work place to adapt your moronic idea of running, cycling or jogging…mr. health expert.

    • same here…the status is ‘Initial Review’ since 10th april…employer is not telling any how long would it take…Are you in India or US? I am on H4 visa staying in US..

      • No timeline for that. My friend H1b got approved last year on January 2014. It mean 4 months later. We called USCIS many times but they said you just have to wait. We waited until Nov and received RFE and take 2 months to prepare for that. But they approved H1b after reviewing RFE very fast. Just be patience, we have no choice.

          I was a student at one of the top universities in US and my first attempt of converting f1 to h1b was denied in 2012 because of fraud employer…Now its my 2nd attempt…I am on H4 visa now…Life plays with you often!!!

          Anyways, I have to wait and simultaneously I am applying for phd!

    I am in waiting of Documents from my US Employer.
    My H1B Petition was filed on 1st April 2014, and then i got to know that my Petition is selected in the lottery selection.
    On July 3rd i got the receipt number, when i checked the status it was ‘Initial Review’.
    Then on July 7th, the status changed to ‘Post Decision Activity’.
    Since then i didn’t hear anything from USCIS or from my US Employer.

    Please suggest on what to do now and whom to contact?

    I have been a active follower of this forum for the last 1 year ever since I got to know that I am getting nominated for 2014 H1B by my employer ! There were lot of fear and uncertainties because of much feared lottery ! I was worried a lot about lottery and once I received the receipt notice I started worrying about the petition approval ! Once the petition got approved then there was fear about the Stamping ! Now its all over .I went for Stamping last week and got my passport back with Visa today ! But every time I was worried/feared about something I post the query in this forum and this forum made me feel better ! Thanks to all those experts here – in particular Lannister and SAS !
    Please find below my interview experience

    VO – GM sir.How you doing ?
    Me – GM.I am doing good .How about you ?
    VO – doing good sir ! May I know whcih Visa are you applyin for ?
    Me – H1B
    Vo – Which company are you from ?
    Me – told my MNC name
    VO – Who is your client ?
    Me – Told my client name
    (But he was unaware of my client and asked me what kind of client it is .I explained about our client in few words.Then he said ok )
    VO – what is your annual salary ?
    Me : answered as per the petition
    VO – Are you married or Single ?
    Me – Answered
    VO – Thankyou sir .Your visa is approved.Have a great day !
    Then he gave me a bunch of paper which explained my rights in US .

    Then I went home and checked my Visa status in CEAC site.It was shown as “Administrative Processing”.I got worried again but being a active follower of this forum I got to know that this status is a normal one ! After 2 days my status changed to “issued” and finally got my passport today !

    My Visa petition is in Response Review process. My husband had travelled to US last month. the problem here is, I have a 10 month old baby but didnt have a passport for him. We didnt add spouse name to our Passport as well. I want to stamp VISA for my kid when i stamp for myself.

    shall i wait till i get the approval and then add spouse name to my passport, then apply passport for my baby and then go to VISA interview?

    or what are the better ways i have? please suggest.

    • Hi,
      I have applied the PP for my baby last week. I had my spouse name printed on my PP.
      In your case, I would suggest that apply for your kids PP right away in tatkal. If you have spouse name printed, the only advantage you get is police verification is not required. Since your hubby is out of country, would suggest, apply for a fresh PP for your kid in tatkal and it will take max 1-2 weeks to reach you.

          I would suggest you to apply for ur passport adding ur spouse name first and then apply for kid. The same case happened when my husband left to US. I applied a fresh passport with his name added (mandatory if one parent lives in abroad) and applied my son. And one more thing, he had even sent me an affidavit from the Indian Embassy in US which is mandatory to provide for applying kids passport.
          Its easier to get kids passport if both parents are in India. Otherwise, spouse name addition and affidavit is mandatory.

            Select Tatkal and minor as required.
            In the next page, check minor check box. and then Parent(s) resident abroad option.
            What happens is, it automatically checks Parent(s) holding valid Passport with spouse name endorsed option.
            In that case, what SS suggested would be true.

            Or you can call the toll free number to clarify your doubt.

            Please don’t give false information. There is no rule to have spouse name to be added to PP. It can be done when you apply for new passport at the time of expiry. Yes for kid, you might need an affidavit because it required both parent’s signature.

            As long as you have marriage certificate, you are fine. It proves that you are married and both partners name will be mentioned in it.

            I m not providing any false information here. It is stated clearly by Passport Service Kendra. I had gone through this process and experienced it. So please check your facts before commenting.

            Whatever SS has mentioned is right. It is clearly stated in the FAQ section of the Passport Service Kendra website that spouse name addition is required if one parent lives abroad. Also I had gone through the same process and experienced it. Marriage certificate alone is not enough.
            FYI please have a look at Q.No 6 in the FAQ section.

            Q6: In case of minor’s passport, whose father is abroad, is it mandatory to obtain father’s consent to apply for the child’s passport? If so, what is the procedure?
            A: If parent(s) of the minor holds a valid passport, then attested photocopy of passport needs to be submitted along with the application form. Spouse name should be endorsed on the parent’s passport. If parent(s) hold a valid passport, but spouse name is not endorsed, then they must get the spouse name added in their passport. For this, they have to apply for re-issue of passport and get the specified change done in personal particulars.

      • Your Visa and baby passport are different items.even you want to come on H4 you need baby passport
        Here are the steps which I followed

        1.Apply your passport for including spouse name .probably you can choose tatkal
        2.Ask your spouse to go to SFO indian embassy (No other option,this mandatory step as one of the parent is residing outside india)
        2.Apply Baby passport after your passport is receive.(till then u can have all docuemnt ready)
        3.Hopfully till then you have approved visa stamp and you can go for stamping

    Please request someone to tell what happens for below query..

    My consultancy received RFE about to provide Client and Project details.

    and my consultancy submitted SOW (STATEMENT OF WORK) document on client’s letterhead and with consultancy director and client side director’s signatures. but he has not submitted the master agreement copy and he only mentioned the master agreement reference in SOW document and he is telling that is sufficient.

    Request some experts to tell abt – is SOW document is enough? will it be any problem as he didn’t submitted the master agreement?

    • same here…the status is ‘Initial Review’ since 10th april…employer is not telling any how long would it take… I was a student in US and my first attempt of converting f1 to h1b was denied in 2012 because of fraud employer…Now its my 2nd attempt…I am on H4 visa now…this waiting period is killing me…

    I have been a silent follower of this forum for the past one year . I am glad to inform all that my visa has been issues even though i has a difficult visa interview at the Consulate (chennai). I will pray for all of you .

    From the day my company started the processing of my Visa application i have been constantly referring to this site for clarifying many of my doubts about the H1B processing .   28. My petition got approved. I am planning to attend the stamping interview in October in Hyderabad, along with my spouse and kid.

    The question I have is, my wife old expired passport has been lost. She travelled to Paris several times with that old passport in her childhood. Currently she has a passport without any Paris visa stampings. As she is dependent, will this affect her approval? In DS 160, do they ask to enter all passport numbers of dependents too?

    Please let me know.

    • You should answer all the question honestly. Make it a point, you are seeking visa to a country that is legalistic. If your wife had ever lost her PP then mention it in DS160.

      Did u attend for stamping? Even I am waiting for my stamping. It would take another 15-20 days for my stamping…. could u please help me. And one more thing if embassy has taken ur passport then have a blast buddy… you got approved. If they gve u back ur passport then sorry 🙁

    At times we always worried like what if 221g we get. What it is and so on. I have extract out few information for us. May be not 100% completed. But give a really good details.

    U.S. Consulate, Chennai

    Blue Form
    The blue handout is given to the candidates from whom additional
    documents are required. When you have the required documents, either from the petitioner, from you,
    or from both, you should submit all the requirements either in person on given days and given
    times to the Consulate or drop them off at the VFS drop box. Specific
    instructions regarding which documents are required and how to submit them are provided in your blue form.
    These instructions vary on a case-by-case basis.

    Do not make an appointment. Do not contact the Consulate regarding the status of
    your case. Applicants with such cases will be contacted by the U.S. Consulate in Chennai when further
    action is required from the applicant.

    Pink Form
    If you received a pink form, you can check the status of your case online.
    The case status report is updated regularly.

    White Form
    Some applicants have received a white form at Chennai for 221(g) refusal. Contents
    of this form are exactly the same as the blue form. There is no apparent difference. It appears the form
    is printed on a different color, but means the same thing.

    After your interview, if you were found temporarily ineligible

        • 1) First Question: Friends reference is simple answer. You need not explain how many round and other stuff. Be specific to every question.
          2) Second Question: Employment in US is a blunt answer since the question is about your employment. My reasons for job in US are better salary and quality life. This is my honest reason to go US. You should also have some reason to go to USA.

    June 13 – status changed to RFE with last to submit the doc is 9sept.

    On AUG 5th my employer submitted all the requested docs but still my status is RFE only, ideally it should be RFE response review, is there any way to check whether my docs reached uscis, pls reply.

      Sorry to hear that but i just checked online about 221g samples. In most of the case it is not refusal. Its like they need more administrative time or more docs needed. (whatever is that, It supposed to be mentioned on your 221g)

    I’ll be going to the H1-B VISA Interview this week and some questions came up and I wanted to know if someone could help me clarify (please provide source where you got the information from if possible):

    1. My Passport will expire on July 2016 but the document it says that the H1-B will be valid until Oct 2017, Would this be OK to go for the interview or do I HAVE to issue a new passport?

    2. My initial salary will be 56k in NYC and I’ll be going for the interview with my wife (H4). I was wondering if this could be an issue since it’s a relatively low income.

    • 1) You are OK, no need to worry about passport expiry as of now. You won’t get a new passport because there is 10 more months for it’s expiry.
      2) Just tell the truth i.e. 56k. It’s VO’s discretion to determine whether to grant visa or not. No one can do anything on that.

        I just checked with some companies specialized in H1-B and you’re right.

        About the salary, I’m aware that the value is at least the minimum allowed in NY state and I also got some money in my bank account. I was really just wondering if they would be like: – “I’m sorry, you cannot afford both of you with THIS salary. Denied!” even though I lived in NYC previously and know that it is possible. Probably just me worrying too much.

  35. Iam going stamping sep 9.
    My wife still does not have passport and our kid is 1.5 month old. Even my kid does not have passport. My wife and kid planning to travel next year April. I heard that its recommended that it is preferable to take them along with me for stamping. But now if i apply passport for them it will take atleast 1.5/2 month for getting passport for my wife and kid. Want to check if i will have any issues if i go alone for stamping OR if my wife/kid go for stamping alone in next year April.

    I have a question regarding my rfe. I am from Sullivan university and work on my CPT from them. I was applied for my H1B visa through a consultancy. First my employer got an RFE regarding the client letter and then once I replied back we got one more regarding my CPT and educational details. Now my employer is not responding my RFE to USCIS. I have the receipt no on me. Now my question is whether I would be able to respond my RFE through an attorney other than my employers attorney or not. I will really appreciate any suggestions…

    • Your employer’s attorney is the person should be replying. H1-B is tied to an employer and it is his responsibility to take care of such situation. But, you should explore other options if there is one, talk to an attorney and see what he says.

    I have attended the interview on July 22nd and visa stamping was done on 26th August.During the time of my interview my spouse passport is in process .Now I would like to apply H4 for my spouse.Can i do this now or do i need to travel to U.S first and then apply h4 for my spouse by sending the pay-stubs.     • You can apply for your spouse before you go to US. I have seen many of my friends traveling US on H1 along with spouses. So, check with your employer and apply for stamping date of your spouse’s H4.

    • You can apply for your spouse visa anytime i.e. either along with your interview or at a later time. There is no requirement for H4, make sure she carries marriage cert and photos during during.

  39. I am trying to pay for visa stamping fees, but when I go to the payment page I see a very strange thing. Its tells exchange rate to be 1 INR = 1 USD and asks for a payment for 190 INR. Few days back it was correct, showing 62 INR = 1 USD and also showed a validity period for this exchange rate. I dont know what is wrong with the website. Also the visa fee info page:http://www.ustraveldocs.com/in/in-niv-visafeeinfo.asp showing incorrect information(open page->scroll down->look for excahnge rate).
    Anyone facing similar issue? Any one contacted customer care?

    I got my Soft copy of i797 document, in which they have mentioned that consulate as Hyderabad, so I was wondering if I can change the location because I heard visa success rate in Hyderabad is less when compared to chennai and Mumbai, please advise on the same.     • Have you seen any H1 with approved petition got rejected? I think, H1 B rejection is very minimal unless they really see an issue that could not be caught during initial approval screening process.

    • Don’t worry about success rate. If your application is genuine with the right company, you should not worry. If you have some issue with the application, there can be hurdle at any point all through.
