- May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
- April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?
USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.
What would be the Cap count for H1B Visa 2015 quota ?
No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.
- Regular H1B Quota : 65,000
- Masters H1B Quota : 20,000
- It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

How soon should I start planning for H1B Visa 2015 ?

How do I find Sponsors for H1B visa 2015 ?

What would be the H1B Filing fee for Fiscal year 2015 ?
There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014. The H1B Visa 2015 filing fee can range anywhere from $1,575 to $4,325 based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet. But, lets say, if it gets passed, the below changes may happen.
- Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
- The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
- H1B Visa fees can up to USD $10,000.
- More stringent rules on H1B visa adjudication.
- Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

I got my petition approved this year. Now, I work for a big MNC and they didn’t reveal the receipt number yet. I don’t have a valid US assignment yet, will get probably in March. I havn’t received any documents till date, just the approval email. Now, I’ve got a really good offer in another company. Any way I can switch and keep my VISA ? I have heard if I leave the company, they withdraw the petition, any way I can re apply with Cap exemption ?
Does it make any difference in such situation if I know my petition receipt number ?
I believe an H1B transfer can take place only when you’re in the US. So, you will have to get the visa stamped on your passport based on the current sponsored petition, travel to the US, and then get the visa transferred to the new employer. Your first employer does not need to be informed when you’re making this change. However, you cannot change jobs before that.

I heard that, H1B filed from good MNCs will have very less rejection chances in Stamping, is it true?
I was not picked up in lottery for FY-2015.
So i used an approved 2008 petition (never got stamped nor traveled to US on this petition) and made my employer to file under Cap-Exempt (premium Processing) with old cap number after my 2015 petition was not picked up in lottery. Now I am soon going for stamping. You can also utilize if you have an old approved petition. All the Best !
Your visa wont be approved in this case and you are most likely to get intent to revoke notice on your h1b.
Then how come USCIS has approved my new petition against the old cap.
Its totaly a grey area, some say possible and some say not and some even get their visa. So there is no harm in trying, all the best.
no gray area, no matter what if you have a approved H1B petition number in last 6 years you are cap exempt. travel to USA does not matter.

I am very very unlucky girl. My H1B petition got selected in lottery and later it went to RFE on 6th june. (RFE related to company) (Receipt Number: EAC141405****) My consultancy sent me a mail that under certain circumstances, they are unable to move forward with my H1B petition. They now dont reply to my mail and dont even respond for call. And last date to respond for RFE is Sep 1st. My hopes went down all of sudden. I was working in India and its very sad to know that i will not be able to work in USA.
This is my story and i am feeling very bad for the ones not selected in lottery. I will pray to god that my situation should not happen to anyone else.

What do you mean by “2008 it was approved and due to employer reason it is rejected”. Do you mean you got your H1 approved by USCIS and later on becalue of employer your H1 got revoked by USCIS. or you are just trying to state that your petition was selected in lottery and later on your employer developed cold feet ?
I also got rejected in lottery for FY-2015.

My case is also similar to yours. I came to USA last Dec in H4 and applied for H1B via a consultancy.My H1B petition got selected in lottery and later it went to RFE on 6th june. (RFE related to company) (Receipt Number: EAC141405****) My consultancy sent me a mail like “USCIS is asking for documentation from End Client. USCIS is extremely strict about processing H1b applications and they are denying several cases. If there’s anything we need from your side, we will contact you. There’s absolutely nothing else we can say about this at present. We will not be responding to any phone calls or emails regarding this matter. Please check your case status online by October 1st week.”
I am loosing my hopes day by day. I was working in India and its very sad to know that i will not be able to work in USA.
How much consultancy charged you for filing H1 ? I am sure its a fake consultancy without any end clients. and many time they run on extra $1500 charged as attorny fee from ppl like you.

I have attended on 26th 10 PM slot . VO took my passport and asked me only 4 questions.
1)Client
2)City
3)Salary
4)Married or Single
He asked my I797 and checked and gave it back.
Then he said my visa is approved and asked me to wait for 30 secs to update it in system.He also gave me a bunch of paper and asked me to go thru it before entering US and said these are my rights in US.
My interview was over in less than 5 mins.
But my status is showing as “Administrative Processing” for the last 24 hours.

Read through the form carefully, if it is not a 221G then must be about the rights of a labor in the US. Check your passport status, it will give you better idea.

All, My petition is in initial review since April 10, RP & NON AD
Me and my friend applied from a Indian consultancy, and they applied for same client
My friend opted for premium, so he got approval and went for interview. VO asked few questions and returned him 221G. Yesterday, he got VISA rejection mail for USCIS stating that “Office doesn’t exists in the specified location”
So now I am worried, what would happen to my case, as client address is same for my petition too.
Please somebody suggest/provide help…
Ask your consultancy to find a genuine client, then get your LCA changed. Once it is done, then you go for Visa interview. These are just my suggestions. Alternatively, you have an option to change the employer with direct clients.
Can we change the LCA?
By the way my petition is still in “Initial Review” stage, so my doubt is, will my application gets approved or rejected?

If the problem is with client then you can try for other offer is US, Get client letter and then attend Visa interview, additional charge of around $300 are charged that too you have to be ready with genuine explanation for change of Client(I inquired and this is what I got to know, may be am not 100% correct)
If the problem is with your sponsor then the sponsor only can help you.

Your case status was RFE on July 19th, after that have your attorny/employer received RFE documents and have they replied to RFE questions ? Once RFE is issued unless you reply to RFE questions status wont change to anything expect if their is no reply in next 90 days the USCIS will reject it. so if your attorny/employer has responded to RFE then status will move to RFE Response review. and do you see any change in date mentioned on USCIS site when your RFE was issued ?

Mine is in RFE since 6th June. There is still no update. My employer says that they have even not received any communication from USCIS yet! So buddy, you are at a much better position. There is no other remedy than to wait…
mine was in rfe since 21 june. i asked my employer and he told they didnt receive any rfe hard copy. then i told him it may be lost and never reached our office.
on 21 july he raised SR with USCIS and on 5 august USCIS again sent the rfe notice which reached him on 21 august
and the last date by which response should reach USCIS was 14 September.

when my employer called uscis, they said, if you have a receipt and its not rejected yet, that means it is under processing, and they cannot say when they can make a decision. Everything is legit in my case, have a masters from USA, working on opt stem extension now, in a legit core engineering company (not computer or IT) exactly in the field of my degree. I really have no idea why it is taking sooo long, or what is it they are looking deep into in my application. e-request states that you are still under processing time and hence the e-request cannot be made.
I don’t understand this, since the website says normal processing time for vermont is 2.7 months, and its been more than 4 months since the petition is filed.

I know IBM very well, you are in safe hands. case manager ask only that much information from employee which they really need from employee. If other questions in RFE are not related to you or they already have answers to other questions then they dont ask from employee. you can ping your case manager on sametime and ask him/her about number of questions in RFE.

90 days is the time period.
It’s 90 days from when? My employer says that the time limit starts from the day the RFE details reaches the employer. In my case, the employer says that they have not even received any RFE communication from USCIS even after two months of the RFE status!
mine was in rfe since 21 june. i asked my employer and he told they didnt receive any rfe hard copy. then i told him it may be lost and never reached our office.
on 21 july he raised SR with USCIS and on 5 august USCIS again sent the rfe notice which reached him on 21 august
and the last date by which response should reach USCIS was 14 September.

max 90 days and ususally 60-78 days, I advice follow up with your employer , even if it is 90 days in your case you are not very far from last date. Exact date by which you have to reply RFE is mentioned on the RFE doucument itself.
My case status changed to Rfe reponse review on 31 st july still
the status same Im worried about the approval, my question is any rejection after reiew response ???
It will take atleast 15 to 25 days, even 2 months. So dont worry surely yours will be approved. All the very best…

My petition is in RFE and its about Employee-Employer relationship. I hear/read posts about USCIS denying petitions that received these kind of RFE’s of late. My employer is planning to respond to it this week.
Please any of whose petition got approved after having dealt with an RFE related to employee-employer relationship help explain the documents that need to be sent by employer to increase the chances of approval
My Attorn/employer sent a document (6 page document) explaining emplyee-employer relationships and how employer will have full control over employee, non-disclosure, non-competing clause , hire/fire right and other policies of company in case of any dispute, work hours, change of work location, notice period, salary, technical trainings etc etc.

Never mind, is your employer a Consulting firm? The reason being the outcome of the RFE response is purely based how good your employer/attorney is at documentation and also their past record in handling RFEs
Thats right, mine is a consultancy and my employer even shared the details of attroney that they have retained for last 9 years. and no doubt that attrony has avery good repute and track record in his area when I searched online about him. another thing my consultancy really has projects with end clients and employer himself is a very known professional in his technical field.
RFE got on July:1st till now no updates from employer. plz let me know by when employer respond to USCIS.

It must be 90 days flat. Employers itself will respond to the most of the RFEs. Dont worry, they will take care of the RFE unless and untill they need any doc from you.
nopes flat 90 days is not the case many times. I myself saw few RFE with 45-78 days . 90 days is max , but correct response time is always what is mentioned on the RFE document, dont go by 90 days.
in my case it is approved in 8 days only.

Replied RFE on Aug 1st
Status chaned from RFE to Revieww on Aug 1st.
Status changed to Post decision activity on 22nd.
Last year am unlucky in the Lottery and this time, god gave me a chance.
