Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

Would there be lottery for H1B Visa 2015 ?

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

    OFC is a straight forward procedure … my slot is at 14:30 ,i reached there by 12:00,many people might say dont reach so early always better to be there early to avoid last minute rush.

    Just carry ds160, Visa appointement sheet ,all passports ( not only the new one,take a note of it)

    Its a 1 minute process inside,straight process

    Day 2:

    Things got delayed in consulate and huge rush developed,I can say i got a feel I am standing in tirupathi queue.

    So many queues,so much of waiting..I lost all my eager,good that it eased the situation

    Queue 1 : all the people wait here,to get into main queue..no place to sit but the side road is beautiful with trees all around.

    Here a guy will scan your bar code and will move you to one moremain line

    Queue 2 : Here they will stamp you ds 160 ,will do security check and then send u inside

    Queue 3: You are supposed to wait outisde the main office line,( L1 blankents,senior citizens,people with small kids) are not required to wait here.

    Finally they will allow u inside

    Queue 4 : Now u will wait for ur finger print confirmation and passport scan

    they wil route you to main hall and u have lot of seats to sit there

    Queue 5 : Frustatignly that day,therz no token stystem and they are sending peope randomly

    We can see a lot iof students there,and the environement is very lively…

    Queue 6 : now the wait area before officer, please dress well and appropritae no one says u need to dree like this an mandatory but it is always a best practise

    Interview will last for any where between 30 sesonds – 5 Minutes case by case

    This officer is taking 2 seconds for bsuiness visa ( straight rejection) , 1 minute for L1 visa and 30 seconds- 3 minutes for H1B visa …

    Suggestions :

    BEP company – pre approved visa E-C Model : If no client letter carry SOW ( minimum one year validity must be there) E-V-C Model : Just carry more documentation to establish the relation

    They might not ask you any thing but carry every thing( document possible) tax returns,pay slips,offer letters,work exp,marks sheets,resume and what not when he asks u must be able to pick up and 99.999999 % they wont ask any document….

    Who received RFE – No worries with docs they will suerly apporve ur petition.it takes 4-8 weeks more

    Whose passport delivery is delayed – No worries u can easliy wait 7-12 working days,as compluter glitches happened and theres a lot of back log

    Who feels about company is not reputed- No worries carry their Income tax returns,balance sheets,photos you are good to go .

      • I heard lot of people got it approved. When I called RMS on monday, I got to know mine is in Initial Review.
        Only way to know is to call them.

          • I called RMS today after looking at some of the comments in this forum that they have been telling the application status. But for me Mobility team told me that “it’s under process and will notify by mid of August”.

          • This means you are in same boat as I am in. For the status “Initial Review” they say that its under process with USCIS. If it was approved, they would have informed you.
            Not a thing to worry though.

          • I too called people mobility and they said that mine is still under “Initial Review”. I asked them is there any timeframe by when I can get it approved, they said by August.
            Lets keep our fingers crossed and hope for the best 🙂

      Actually, for some of the petitions, they might already be in “approved” status if we check the status online ….however since Accenture doesnt disclose the receipt number…we cannot do anything.
      RMS team will keep telling you its is under “initial review” and not “approved” even if they see it is “approved” until they recieve the actual copy from USCIS

  3. Got it approved yesterday July 28th!!!!

    Two questions:

    1) On average how long does the I-797 approval take to get to the lawyer?
    2) My Wife also applied for COS to H4. (We are both already in the US with TN/TD visas). But her receipt still shows as Initial review, are dependents not reviewed at the same time than the principals?. Should I expect the H4 to be approved soon?. As a note we submitted the official change of address on June and that is the last comment on the USCIS case check for her.

    • Congrats dude. Could you please share the receipt no. series ?
      1. On average, it may take 5-15 working days.
      2. No. They consider H4 COS as a separate process but since you got your approval, you can expect her status to change anytime. If you check USCIS processing time, it is 2 months for H1 and 2.5 for H4(I know its more than that). But it takes more time for H4 but you will get the approval soon. Good luck

        My H1B petition status has been in RFE status and my employer is responding to it some time late next week. The query is about the company’s tax documents and account related information(This is what i understood from what my employer mentioned). Please could any of you help understand the chances of my petition approval after responding to RFE

        Has anyone got similar kind of query and do you how has your employer dealt with the RFE and what are the documents that were submitted to USCIS
        appreciate each one of your time!

        P.S This is the first time they have filed H1 for foreign candidates

    • USCIS has announced that only people who are worthy enough to be in the US will be getting a response. Rest is all junk & should stay in India. No offense to anyone.

    My case went to RFE(client related docs) on June 19th.. Employer received notification on June 27th.. employer responded on July 16th and its approved on July 28th:). My receipt no is WAC14145** series

    My visa approved and am planning attend interview but my employer mailed me that they are moving from current office location to new location and til the further instruction they want me wait for stamping interview.

    Will it be a problem for stamping?
    do i need to carry any additional documents?

        • sunny be specific ,is he moving to a different city/state?? see in all probabbility while procuring ur LCA,place of intended empployement will be written and it is assumed that you continue your employement there..frankly sepaking with in city is no danger however moving away from that place required new lca to be procured..bcoz lca denotes the prevailing wage rates…. so dont go by employer words go with paper i.e, LCA any thing against to that requires just procurement of new lca that’s all.. its a simple thing and nothing to worry at all

My visa is approved on 22nd July ( visa officer told your visa is approved),till date I didnt get my passport and while checking status it is showing passport still with post and visa status as “Administartive processing” now I am worried ..are there any issues with my visa? usually it takes 2-3 business days.

    • “Administartive processing” means they need to do additional checks on your visa application before they issue a visa to you. minimum time frame is 8 weeks to complete “Administartive processing”, max is anything. Just wait. Generally this happen for ppl having degree in chemical, Bio-scienece, metal etc. sometimes they want to run a check on employer also. they should have issue a pink form mentioning “Administartive processing”.

      • @long time ibmer did u go thru his query properly ? 🙂 his is a straight case and that too its only 1 working day i.e,Monday…how can he get his visa now ..administrative processing in his case means the process o stamping visa is taking this time nothing else ,he can easily wait till another 5-10 working days,with visa system glitch..it is completly different issue that what u r saying u r assuming it for 221g

        • you are right, and I also hope she gets her stamped PP. I thought about one week delay, she faced interview on 22nd and today already EOD of 29th. But if she has not received any pink form then she is mostly safe and can wait for some more time to get her PP. I wish she gets her PP soon.

          Note: I have seen PPL getting into admin processing even though no pink form was issued and officer saying your visa is approved.

  12. Got RFE july 10 with 7 questions…employer told me that one is for producing control letter/offer letter and rest are related to employer.
    I am on H4 and has 2 years gap because I moved to USA. In inda I had IT exp with top UK and USA IT MNCs.

    1)person/Entity paying for your Trip : SELF or US PETITIONER
    I am working in INDIA,i have applied through US Consultancy/Small Company,but they are not paying for the TRIP,but if we keep SELF,VO may feel in differently rightt?please suggest which can i keep here?
    2)Intended Date of Arrival : 15 september 2014

    My H1b Approval petition Duration is from October-01-2014 to september 2015, shall keep like Inteded date of Arrivala : 15 september 2014,please suggest?

    • Mention the following

      1) US Petitioner.
      Never mention SELF, VO is say you have paid for the petition too.

      2) Mention 2nd Oct, 2014.
      15th Sept. 2014 is not an acceptable date for 2015 H1-B cap petitions. Petitions will be valid from 1st Oct, 2014 and one can only travel just 10 days ahead of the validity date. If your visa is approved, under Annotation, it will have a statement “Not valid for travel before September 21, 2014”.

            I am worried what it might be. I am an accountant, medium size company. Not IT, not an Indian, or Chinese, other asian. My co-worker, from China, same position was approved a long time ago. Mabe they think too many accountants for a not so big company. Any accountants out there?

  19. What are the petition rejection chances from RFE stage.
    Although I have submitted all crucial documents like exp letters , client letters as well, dual name affidavit as well while filling the petition.

      • No not yet.. status got changed from Int Rvw to RFE on 24th July only, so have to wait for the actual reason. But I think these(Exp Letter, Client Invite Letter) are main reasons for RFE ,that’s why mentioned those.

        Anything else you know which may trigger RFE???

        • dont worry over RFE, from IBM side your are fully covered, they can produce any document demanded by USCIS , unless RFE is not your credentials i.e. your exp and degree etc.
          just do proper followup with manager and with case manager on Insxoom.

            Also from my side I do have all the documents, but I think Exp Letter could be the culprit because its regular Exp Letter having designation, start date and end date mentioned only.
            But lets see what comes.

  20. My H1B got approved few days back. I am planning to go for Visa interview in couple of weeks time. I have one question – If you are working in india, do we need to carry IT Returns Forms along with pay stubs to Visa Interview?

    • If you have IT returns, take those. But pay stubs are important.
      It is required to carry all the documents whatever you have, but arrange them in an order so that you can easily handover it in quick time when the office asked for it. It is purely depends on the interview officer. He/she may ask any document to show during the interview.

        • Yep, you can show them. It is very very rare that the officer asks about IT returns. I have seen so many forums, where they stated that, pay stubs may be asked. If possible, carry your bank account statement too.

  21. Hi, my project documents submitted during visa application show 31 Dec 2014 as last date of my project. But its now extended till Feb 2017. Will there be a problem regarding the visa last date when its issued as the documents with the officer will still have Dec’14 as the last project date? Should I show the new extended SOW during the interview?

    • As long as the date extends, there is no problem. During the interview, show the new document to the officer.

      • insxoom team takes good time to send papers, they are already busy with RFEs. Mostly you should get your papers in 2 weeks time. Keep checking your xoom account , before sending hard copy they upload scan copy to portal.

    Me : Its a consulting company

    vo : its a IT staffing company
    me: Infact a staffing company requires complex sap systems to carry their business

    vo: talking some thing to his collegue

    vo : Again ,explain me what roles u will play and why are u the only one choosen

    And the big twist @ Website it is showing administrative processing..dont know what exactly it means…all the best folks

    • administrative processing … Do you have your passport with visa stamping in your hand ? administrative processing means visa is not yet issued and can be issued only after further processing. Did they gave you any other form to fill ? administrative processing takes minimum 8 weeks to complete , max time can be anything…..

      but if you have PP with visa in your hand then its a glitch in website record key-in.

    They have asked me to resend my educational qualfications certficates stating those were not detailed enough , is it some thing to be worried about , Im a B.E graduate with proper educational background without any backlog , is it some thing to be worried about…

        • Is there a possibility that your h1b occupation and bachelor degree is not matching? In that case you need to provide documents to correlate them.

    • Success rate would be around 30% or less. They reject a lot of people. Try another embassy office for interview if you can

        • There are many consultancies working in Delhi for higher education. This report came out in the newspaper once where each consultancy was asked about issues such as visa success rate & other stuff. Search for this article in TimesOfIndia.

          • These are h1b visa. dont mess it up with F1 or B1/B2. If you have some reference that consultancy is rejecting valid h1b approved petitions provide us the link. Else just stop spreading rumour

    • I don’t think the success rate is based on the location, but on your specific situation. If your documents are all good there’s no reason to be afraid, your visa will be granted.

    • On second thought, this seems to be a tricky situation. They might be reluctant in giving you a visa because you seem to be a potential immigrant. Like they might ask you, why did you start working for a small organization? Why not big? They just want to know if you are worthy enough to go US.

My visa is approved on thursday (24th July), when I was checking the passport delivery status it is showing ” your passport is still with post” and on website it is showing ” Administrative processing”,does this mean they are going to issue some 221g’s after approvals??? can some one clarify please.

      • No it doesn’t mean that it’s a 221g. Till the time passport gets ready, the status is shown like that. You should be getting your passport in a couple of days.

  34. Yesterday I went for H1B interview

    2 L1 visas 2 business visas rejected in our counter ,next is mine ..

    Surprisingly I was asked only a single question( I am wearing my company tag)
    VO: You are from XXXX right
    Me : Yes sir,that’s right

    VO : Client
    Me : XXXXXX

    Handed over the rights form and he said your visa is approved …

    YOU SHOULD TRY SO HARD TO GET AN H1B REJECTION..IT IS AN APPROVED VISA AND ONLY IN RARE CASES WILL REJECTION HAPPENS
    (E-V-C model is an exception to the above statement)

  36. Mine is still in ‘Initial Review’ since Apr 10. It seems all receipt nos nearby my number are either approved or in RFE status. My receipt no. is EAC1414654***.

    • Two of my friend’s status was like that till yesterday and one got his approval yesterday and one got today. Their series were EAC14146*** and EAC 14148***
      Theirs were in initial review till yesterday. So wait patiently. You can get approval or any update any time. Its normal. Good luck

    Today I got my I-797-B approval notice. The work permit is only valid till end of December 2015. I need to be in the US to file an extension . What is the latest date by which I should travel to US in order to comfortably file an extension? Any idea what is the % acceptance rate for extensions?

    • Hi,

      Did your employer showed the length of the project as 1 year? If so, then they would give only for 1 year. If your employer has mentioned 3 yrs needed in I-129, it would have been for 3 yrs? Please clarify so others can get some help. Thanks

  39. Receipt date 10 april, last activity 30 April. No update as of now, all my friends have received approval or rfe. I checked +/- 10 from my receipt number, each and every one of them have received some kind of update, its only only my application which is still under initial review. Is there some thing to worry about?? Any one in the same boat? Receipt number EAC 141485****. Please share your views

    • INSZoom won’t update real time, It will take 2-3 weeks time to Immg Team to receive the approved or RFE Petition from USCIS. Then only they’ll update in the INSZoom.

  44. Hello Experts,
    This is regarding RFE issue on my first ever H1B visa !I have submitted the SOW and manager letter through my employer to USCIS. The problem is our projects are subject to yearly renewals and hence the SOW validity is till Dec 2014 only.The contract will be renewed by this year end only and so we had no other option other than submitting this SOW.The manager letter explains that my requirement is needed till Dec 2015 and I am not subject to any particular SOW since our employer opearates many projects where I could be employed.I would like to know whether this SOW validity till dec 2014 invites rejection :(…..

      I don’t think this will be the reason for rejection. IF SOW is yearly then VISA get approved for 1 year or so. This is same with my friend, He has to renew his H1 every year because of yearly contract of SOW with client.

    When I asked the service charge fro the end to end to get visa interview , one the consultant asking us to pay 1000 USD ! . IS that normal fees ?

    and only for consultation they asking 250 USD !

    please advise whether this is normal fees ? or I need to go with other consultant ?

          • Mine is also from the same series EAC141445 and in initial review since April 10.

            I randomly checked around 60 series all of them either approved or in RFE status. Only 2 are in initial review. I noticed last rfe was issued on July 14.

            Hope all petitions gets approved soon.
