Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

Would there be lottery for H1B Visa 2015 ?

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

    • Please help,
      RFE is common nowadays. So don’t panic. Your employer and attorney will work together and will respond the RFE. If the response is appropiate and if all the required docs were submitted, there won’t be any chance for rejection. Good luck

    My Petition got approved and I got soft copy of I797 from my employer.
    But still waiting for Hard Copy and there isn’t any updates from my employer for the same. What could be the reason for this delay ?

      You have to trust your employer as they already sent you the soft copy. Just wait for the hard copy as they may be sending it out soon. If you are from India, they will definitely send you as you need it for the interview. So wait patiently and you will get it. Good luck

    • Hi Krrish/Lenister – I got a RFE. How long does it take to reach RFE letter to employer/attorney once status is updated on USCIS website from “Intial Review” to “Request for Evidence”?

      They may ask anything from your employer related docs to your docs. Your employer should be getting the details and ask him if they need anything from you. Once your employer and attorney works on that and responds, it may take anywhere from 15-days to 2 months for approval. Good luck

    • Congrats! You need to go through my previous posts where I have mentioned everything in great detail. Proabability is 50/50. I have just heard that embassy is rejecting a lot of candidates this year. Hope this helps!

    My petition got approved. I am in H4 and in US now
    I have few questions about COS.
    1. If my employer has applied for COS, does it require a separate approval other than H1B
    2. Is that a separate process other than H1B approval. I mean COS application is consider only after H1B approval by a different team?
    3. How long it takes for COS approval?
    4. If I travel to India after COS approval, what is the impact like visa stamping etc..

      Congrats on your approval.
      1. No. It doesn’t need any separate approval.
      2. No. Its a COS approval already.
      3. N/A
      4. If you travel to India, you have to schedule an appointment and get the visa stamping before entering US again.

    Just checked my petition status now. It turns to Post Decision Activity
    It says below:

    On July 15, 2014, we mailed you a notice that we have approved this I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.
    For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

    I guess It is approved. My receipt no. is EAC141475****

    After how many days I can take appointment for stamping once I will receive the documents from Employer?

  11. Friends, my petition was approved on 26th July.. and the case status changed to Post Decision Activity. Today I the status flipped back to ‘Accepted’

    “On July 16, 2014, an amended notice on this case was mailed describing how we will process your case. Please follow any instructions on the notice. This case is being processed at our VERMONT SERVICE CENTER location. If this I129 PETITION FOR A NONIMMIGRANT WORKER is still pending, you will be notified by mail when a decision is made, or if the office needs something from you.”

    I’m waiting to hear from our Attorney. Out of curiosity, any one have some idea?

    • Yet to catch up with our lead HR. One of the folks from his team says they received employer copy, but not mine. Fingers crossed.!!

    • No one can guess with certainty what the situation really is. My guess is the petition will still be approved, but the notice is being modified. One possible scenario is your employer didn’t ask for COS, but the officer assumed COS and issued I-94 incorrectly, or vice versa.

    I need a help, actually for this year my petition has been approved and now I am going to fill the DS-160 form but the problem is my previous petition, for fiscal 2013 my petition was approved and I got 221G during the visa interview at US consulate Singapore. Till now there is no update for old petition.
    Now guys could you please let me know if I have to mention my previous case in either of below columns by selecting as “Yes” :

    1 .Have you ever been refused a U.S. Visa, or been refused admission to the United States, or withdrawn your application for admission at the port of entry?

    2. Has anyone ever filed an immigrant petition on your behalf with the United States Citizenship and Immigration Services?

      • 1) You have not been refused visa yet. 221 g is not a denial . So please just mention the Petition numbers and dont hide that information. Please try to get the case information on your previous case for your reference .

        2) Also no one has filed an immigrant petition for you. H1B or I 129 is an non immingrant petition.

          221(g) is a refusal only, very first line of 221(g) clearly states something like this
          “You application has been refused under section 221(g) of the INA. ….”

          Please stop giving wrong information. I’ve first hand experience of it.

          @Please Guide for DS-160 form
          You will have to mention the following

          1) Select Yes and give the details based on the 221(g) issued you. If they have requested additional info then mention
          “Issued form 221(g) seeking additional information”. This is just an example and you are the best person to know what actually was the intent of 221(g) issued to you.

          2) Select No.

  13. How much Time are the USCIS people take to process the H1B Visa Applications?

    Since on this site https://egov.uscis.gov/cris/Dashboard/CaseStatus.do

    The time mentioned is 2 months from 30th April , and it has been more than 2 months still applications show “Initial Review”

    Is there any hope of the Status getting changed from “Initial Review” to “Post Decision Activity”?

    It is frustraiting because some people in Normal Processing have got result within 2 months and others are still in “Initial Review”….

    My H1B visa was approved in the first week of June. But my interview date is not scheduled yet. My attorney said she has send documents to USA embassy in india after which when we get the confirmation we can go for interview. My query is Is there such kind of procedure? I have my I797 with me. Kindly suggest

    • I can tell you my experience:

      My petition is approved and I contacted my employer to get the docs. They inturn contacted the attorney. Now i am working with my attorney to complete the application. My DS-160 was submitted yesterday. The attorney got my dates to schedule an appointment. Now, they will schedule the appointment and will send me the package that i need to carry for the interview.

    • Ask the employer for documents which they sent to USCIS while filing the petition. They cant send anything to the embassy directly. You can fill the DS 160 form directly, pay the visa fees online, get the receipt MRV number and schedule an appointment directly. They just need to send you the documents to get you going. In fact you dont even need teh original I797 or I129 document, a copy of them would do at the embassy.

        Who told you that you don’t need original I797 notice of approval for visa interview? Just try it in your case, you will be asked to go home if you don’t carry original approval notice.

    My H1b is approved for 2015 fiscal year. While applying for h1b i worked at company A and petition filed by company B.

    Now i left company A and working on my own product form last 2 months(mid of april), so theoritically speaking i am un employed. Now if i attend for h1b visa interview saying currently un employed, what are the chances of rejection ? and how to handle this situation?

    Please advice….Thank you…..

    • Hmm 1) In DS-160 Form you need to mention are you currently employed or left already
      2) So you definetly mention about Your unemployement
      3) Tell them the reason I just taken a break to make myself available and also some personal research for the international projects
      4) They certainly ask your financial status, carry your properties which will be helpful in worst case…Good Luck.

    It is not based on case number. No pattern involved in the order of approval.

      • Register your mobile/email id with USCIS and forget it. Continue your work. I didn’t check the status every day. One fine mrng, txt popped up. There is no difference if the case is approved on May 1st (PP) or Sep 1st. If we have good exp. and enough supportive docs., you are always good to go.

    • Mine approved 7/12/2014 after one RFE . WAC1413654XXX. Be patient. Getting selected in the lottery was the biggest hurdle. Now you have to worry about how USCIS looks at type of employment you’re engaged into. Full-time job no issues. Contract positions are trouble. Hey!! remember you made the choice for type of employment.

    • ask for financial statements and educuation evaluation etc. Basically whatever was sent to USCIS as part of filing, carry them. . You carry your offer letter, copies of all educational originals etc.

      Usually employers won’t share the RFE details if it is related to them.
      If they need anything from you, they will let you know. Last date for RFE response is 90 days usually for all the cases. So assuming your RFE date as June-18, your employer got time till Sep-17th. Just wait for the employer to share anything with you. Good luck

  27. Dear Brothers, My attorney is finding it difficult to upload the digital photo i sent them for DS-160. I tried different ways with instructions given in the Dept. of state travel. And finally, here is what i heard back from the attorney,

    ” Yes, I cropped it too but wasn’t able to make it small enough/system wouldn’t let me save it. Now the system simply gives a statement “photo will be taken at ASC” – you’ll have to have your photo retaken in the process of the appointment anyway, so we’re fine now. ”

    My question is: Would I be required to inform someone in the consulate or they’ll drag me to the photo session ?

    • Don’t panic. It’s not the end of the world. The worst that can happen is your H4 stamping will get rejected. But that won’t close the doors to everything.

      Not at all a problem if ur wife is not understanding english.If we tell them when we go to visa interview they will arrange translator..that is how our parents are comming here eventhough they dont know english.

    • Ramu garu, you have an option to choose any other language other than English as the medium of interview. Not a problem at all.

    • As far as I know, while filling DS160 for your spouse, it will ask for the language, in which you want to attend the interview. Otherwise at the consulate office, you can ask to arrange a translator.

      In other words, it is not at all a problem. Don’t worry.

    • Doesn’t matter if your spouse is well versed with English or not. You can choose the language she is comfortable with while filling the DS-160. there is no hard and fast rule for spouse and parents to know English for visa interview. Embassy/Consular office always have local language officer to take care of such cases. Not knowing English will not be a case for the visa rejection.

    Maximum how long it will take for PP?
    If PP, is it possible to work before 1st of Oct?

    • Irrespective of PP or not, you cannot work before 1st Oct. PP application takes upto 15 calendar days to get the decision.

    • In the current scenario with more than 170, 000 applicants, you will get a decision within 1 month. Normally, it only takes around 2 weeks to hear back from them. Regarding your the other question, there is no way to start working before Oct 1st. That is the earliest you can start. Hope this helps!

    I am in US currently on L1 visa and have got RFE on my H1B. I need to submit Client letter and SOW. I have both the document. Only problem is that my current SOW is set to expire on 09/30 and new SOW will be signed in month of Sept. However my client letter has contract date mentioned as Dec 2017. Please advises if this will be a problem.

    Only 4 questions asked, here is the excerpts of my interview once my number was called.

    Me: good morning
    VO: good morning. Can I have your passport.

    Me: Gave her my PP as requested.
    VO: Petition please.

    Me: Gave her I797 notice.
    VO: Oh!.. So you will be working for so and so company.

    Me: a smile 🙂 , yeah.
    VO: what will be your salary.

    Me: xxxxx USD.
    VO: What is your highest level of education.

    Me: BE Computers.
    VO: Where do you work right now?

    Me: So and so company.
    VO: You had applied for the similar category of visa earlier too, what happened to that?

    Me: I didn’t pursue it due to some personal reasons.
    VO: Your visa is approved. Please read through these pamphlets.

    Me: Thank you very much and have a good day.
    VO: you too.

    The end!!!!

    She didn’t ask for any documents after looking at my Petition, I had a huge bunch of papers that was filed with USCIS for my application. Never thought it is going to be that easy.

    I was issued 221-G white sheet during Feb 2013 asking additional documentation when I applied through a small time desi consultancy. I didn’t pursue that case any further though.

    One this is for sure, it doesn’t matter if earlier you have been denied visa, if you employer is a good one then you can be sure to get through the stamping. Thanks and I wish all the best to everyone who are waiting for visa interview.

    Honestly provide all the correct information while filing form DS-160, don’t hide or falsify any details.

    • Do you had submit any hard copy of digital photo? also would like to know scanning(OFS/ASC) and the interview can happen on the same day?

      I did not attached my photo copy while filling up the DS-160.

      • You don’t have to submit any document or photo while submitting DS-160 or scheduling the appointment. Photo will be taken at the time of OFS along with the finger prints. So no need to worry. You had to mention the petition number while filling DS-160 it and that’s what is required.

        I don’t know if you can do both OFS and Visa Interview on the same date. Information from OFS has to be available with the Consular officer for you to attend the interview. It is advisable to have OFS and Visa interview on the separate dates. Better call VFS customer service and find about it, they will guide you.

    • 1) Form DS-160 Confirmation Page print out.
      2) Visa Appointment confirmation page print out.
      3) Passport
      4) I797 approval notice and the full bunch of document that was sent by your employer.
      5) Educational certificates.
      6) Experience certificates.

      Do Not carry the following
      1) cell phone
      2) Back pack or any bag
      3) Lip guard or other gel/liquid based cosmetics

      Just have your documents in a file and put them in a good carry bag. That’s all you need and can carry inside the embassy.

          There is no hard and fast rule for what to ask and what not. If VO finds everything OK then you will be through if not then s/he might seek additional information and ask you to submit them in the stipulated time frame.

    • It is 6 years. It does not mean you can work for six years straight. Irrespective of the type of application, the employer has to file another application before the end of the 3rd year to renew your H1B for the next three years.

      • You should not answer without actually knowing the answer, dumb moron. Who told that you cannot work for 6 years straight? seems like you got no brains after all. All you need to do is extend your petition and you do not need to a file a new one. And who told you that all petitions will be approved for 3 years? you dumb f. It varies from case to case, petitions can and will be approved from a few months to a max of 3 years for which you need to apply for extension every time the end date is approaching.

        • Actually my intention was learn how long I am cap exempt since I have petition approved in 2008 althought I dont know my case number etc… (there was a mail in my hotmail but I lost the account )and never been in usa since 2008 pls suggest some idea

    • For regular petition, it will always issue from 1st October. For PP i do not know but for any case both can not be same.

      Yes, visa issue date is same as the date of the interview at consulate/embassy. Since the petition for 2015 cap are valid from 1 Oct, 2014, in the visa under “Annotation” they mention the something like “Not valid until 21SEPT2014”. That means one can’t travel to then US before 21st Sept, 2014.

      Just a note of clarification, USCIS issue petition notice whereas visa is issued by Consulate/Embassy.
      I797 Petition notice is a legal document that allows an individual to work for a stipulated time in US but it is not a travel document(You can’t travel to the US with it).

      Visa is a travel document, allows to you enter the US.

        • Hy Dude are you from Bangalore or chennai? good to hear you got visa approved….I am applying from small company I work for SAP Projects, will they believe that small companies having SAP Projects is my question and also one more thing is it good idea to carry Spouse ?? so the number of quesitons will be reduced if we carry spouse??

          • carry 10 kids also . LOL. No worries as long as documentation are good. Usually the big thiefs like Infy and all will have no worries and they get stamping rightaway. People going with smaller companies always have this worry.

            Now to your question, as long as all the documents are in place and your employer has been doing valid business, there won’t be any issue getting visa stamped. If the VO has the smallest of the doubt then he might as for additional documents/information. Make it a point in life, things that you don’t have, you should not worry about loosing it because you never had it. Go with an open mind, things will fall in place. Be presentable and confident.

    Request your kind help with a dilemma that I am facing.
    My petition was filed by an IT mnc while I was working in an insurance project. In april my project was changed to a banking one (the insurance proj ended).

    My question is do I fill in old client address/onsite POC in DS160 or fill the new client address/onsite POC.

    The LCA will need to be changed as the new client address is more then 50 kms away from old client work address.

    Also during visa stamping interview, will this pose a problem and my visa be denied? as my client has changed post petition filing and my IT mnc (Who filed petition on my behalf) will issue a letter stating the same.

    I have a gut feeling that US VO might deny my visa on these grounds.(who knows?) that new LCA was applied and during petition I applied for one client and during stamping I am showing another client. I heard they closely scrutinize place of work and LCAs
    I am very apprehensive about this. Please advice….
    Appreciate your help.

      • you should fill the new client address and information in DS160 form. do not worry, it happens all the time. They will not denied visa. They will simply ask you to submit relevant documents if not present at the time of interview. Do not give any false information at any point of time of visa process.

          In the event of client (project)change, what are the relevant documents that one needs to carry?

          Do we need to carry client letter and SOW during stamping interview. My organization is not ready to share SOW, as they say its a confidential document.

          My project changed in April (banking)and petition was filed through another project(Insurance). Both these projects are in the same IT MNC who applied for my visa petition

          • Deepika , you need a new LCA from the banking client and an amended petition from the new Sponsor. Stamping is never a problem for people from big 5, they are very good at documentation and they will take care of all you need. The SOW would be something very generic since they would have already shared it for others who have travelled for the same client earlier.

      My LCA was changed due to change in location. I did my stamping only after receiving the new LCA and filling DS160 with the new details.
