Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

    Please let me know will there be any problem during interview if the passport photo is different to my present appearance ? The passport was issued 7 years back and there is a considerable change in my appearance(Weight decreased and face becomes lil small as well)

    • Nobody here can be sure because we have not seen your current face and your photo on passport. This is main job of VO to verify the person and the details mentioned in the passport. If VO thinks that you makes sufficient resemblance with the passport photo, he/she will clear it. Otherwise she will ask you to get new passport. Do not worry they will not reject your petition. They may ask you to come with new passport.

    • No you don’t have to worry about that. They will take a latest picture of your’s during the OFC. So they will consider that picture for VISA.

  2. My H1 got approved on june 20. its almost 1 month. Still my company did not recieve documents. How many days on average does USCIS take to send documents to compnay. Please share your opnion.

    I got my H1B petition approved recently and planning for the final step -the interview.
    The concern is my passport is taken 7 years back and the photo in my passport is lot different to what I am now.I was so fat and huge in passport photo.Now I have reduced my weight and look different.
    Will there be any problem during interview ??

      • On second thought I believe you should change your photo. I remember seeing a couple of cases which were rejected because the photo was old. Please get your photo updated in the passport.

        • Oh My God !!! were they rejected in interview because the photos are old ? In India there is no process to change the passport photo ! I have already tried once .

  5. Hi All,
    I applied H1 thru one of the desi company. I just checked with them. They say that they haven’t got any update from USCIS nor packets not returned. cheques are not cashed. I need to cross-verify their answers. How can I do that?
    How many days will USCIS take to return the packets not selected in lottery?
    Is there a way that I can check the status of my H1 application?

    • Dude, I am in the same boat. I have a feeling they already have the receipt but they are not sure whether the RFE would be cleared. If it does, they will inform us otherwise they will just sent us a rejection letter with no name on it. This is just my guess. It might be the opposite.

        I am just adding one more point for this discussion.

        1:If you are H1B is picked for sure they will inform to you eventhough you got RFE because consultancy guys need to return more then half amount to you if it is not picked and If is picked but rejected means they will not give any amount to you.So from this point we can conclude saying if u r H1B is picked they will inform you..

        Unlucky2 can take this point if required..

      I too am in the same status. No update as of today. To answer your questions: – I don’t think there is anyway to verify your employer’s statement, you got to trust them.
      – Many have received the return packages and few are still hanging, so no one can answer on how many days USCIS will take to complete the process.
      – Unless you don’t have the receipt number, there is no way you can check the status.
      I know how difficult it is to wait as I am in the same situation, cannot plan anything as current state is not clear and the daily frustration, but I suggest you my friend to just patiently wait. These things are not in control for any of us, so try to utilize your time efficiently and wait.

  6. My status is under RFE response review for over 40 days and my case is RP.

    Is it normal to have such a huge waiting time for RFE review ? I have seen cases that had 14 days. My RFE was a pretty simple RFE.

    Any advises are appreciated.

    • Approval rate isn’t really a determining factor because each application is reviewed independently & fairly. So a company’s approval rate is rarely considered in this process. You can go through the previous posts in this forum where I answered this question in detail.

    • No, I don’t think USA would be a better option for someone who has done nursing. It’s all about money but this job dosen’t pay good overall irrespective of which country you are in. In USA, she would actually have to work more compared to India & get the same wages. Make a good decision.

    Can i consider my application will not come to RFE ? As I did not get this till this time.

    I got my petition number for 2013 application last year, it is in approved state. But still my employer is not providing me any documents, they said ..client project is in waiting state, so possible only if client is ready ..i have been waiting for almost one year …here, i want to know ..possible to change employer with only petition no and without dcouments. Also heard that, using Freedom Of Information Act we would be able to get i797 documents , but dont know how far this is true. please give your valid suggestion

    • I believe another company can file an H1 transfer using only the receipt number. I think this is the reason why other companies do not share the receipt number to their employees and just inform them whether they got selected, approved or rejected.

      Can you share which company filed that petition for you last year?

        • My company (one of top 3 in India) has a document for “out of cap” H1b.
          It states – You are eligible for Out of Cap H1b –
          “if you have previous approved petition (in last 6 years)
          – from this company or earlier employer
          – whether it is stamped or not stamped
          – whether you have traveled to US or not”

          so the above answer (by James) is correct as per information available to me

            guy “H1b approved” is telling he dont have approved petition but he has only Receipt number.

            Can anyone throw some light on this??

    • Lot of half baked information. An approved petition is of no use for transfer if
      1) Your passport is not stamped with visa.
      2) You are in India.
      3) even if stamped and if the sponsors or client changes, you may have problems at POE.

      You can only transfer if you have a visa and that also is quite a process if you are working in India. Only some good news is that you are cap exempt, so you can start working any time and dont need to wait for OCT 1 deadline.

    My Case Status changed to Post Decision Activity Yesterday(July 14th). I am very thankful to everyone posting useful stuff here. My Non AD/PP Case Number is EAC1413650***. Got RFE on 28th April. Answered in the 2nd week of May. Status changed to Initial Review from RFE on 23May. Since then there is no change in the Status. But it was my day Yesterday.. !!! Stepped up to “Post Decision Activity”. Wish everyone waiting still ends their Case’s workflow ASAP with a positive note…!!! One Day would definitely be yours…!!!!

  12. ll go for visa stamping in next few dayzzz with my family.. mine query is..
    i had passport with b1 stamping(visa issue date is not exactly known) but unfortunately lost my passport.
    Now filling form for visa stamping where there is column for any previous visas along with issuing date,i
    have filled in b1 visa issuing date(which am not sure exactly is)though i have mentioned same in comments
    that b1 visa issuing date is not exactly known
    will it impact ny h1b visa stamping??

    • Call/email to Embassy and let you know your query, they can track based on your passport and let you know the dates…

        • Did you called them or email them?? because few of the officers doenst know but they simply answer email will reach all the employees so they have enough time to verify that and revert back Clearly mention your old Passport number if possible give copy of FIR which you would have filed for lost of passport, CAN YOU CHECK your xerox copies or any where the visa number will be written or check with your travel agent when you book the ticket I guessyou need to reveal your visa, might be luck favors you…

          • I said Travelling dates refer to USA Travelling dates so when you book flight you have to give copy of visa…….It should be same..I just verified mines….The visa sanction date is 29/May + 10 years they are giving as 26 may…Not sure why 3 days difference…you need to double check when you are entering end date

    Could you please help on this. I cleared lottery for H1 and waiting for approval, hoping next stages go smootly. have following queries/doubts regarding my wife h1. She already working in MNC, most probably next year i.e., H1B 2016 she gets nomination. What are the better options for me?
    1. Shall I take her on H4?
    2. Shall I wait till she also gets H1?
    3. Is there any possibility or easy way of changing H4 to H1 for my wife?

    We are planning for H4, after she stays in US for few months and she joins the company in India, continues her H1 process. Are there any hiccups in this process? So she can converts H4 to H1. Will this work out?

    • This is tricky and there are lot of Ifs and Buts. There is some risk involved when you ask her to stop working and take her on H4. I understand that her company might retake back her, but how confident are you on that? Also, how confident are you on the thought that her company will again apply for H1B in 2016? And yes, conversion of H4 to H1 is always there provided she gets through lottery again. You need to weigh all these factors and then take a decision. However, if I were you, I would ask her to continue working till next year and then see if the company raises a H1B for her. If they do it and she clears the lottery (which most probably will happen next year too), you are fine. Else, you can then ask her to quit and join you on H4. Hope this helps.

    • Well my feeling is there shouldn’t be a problem, if her office is in USA you can take her on H4 and then work there un officially or remotely get paid Indian salary in usa …..salary might be less but she stays with you only..(Dont resign in India, if they are ok take her on long vacation if the above plan A doesnt works)
      then once they start filling her case as H1 its easy because her husband is already working there and already has H4 not a potentential immigrant…

        Neither she nor me are planning for her resignation.
        In our organization, we can take 1year of leaves with LOP without resignation. So, am planning to take her with H4 in March/April 2015, meanwhile her H1 also in progress parallel. We can stay together till her lottery results or stamping process happens.
        When it comes to her H1 2016 nomination, 90-100% assurance is there. Thats why we are thinking. Because if we reach there, very tough to find geniune employer or consultancy.

        So, while changing from H4 to H1, are there any issues?

        • I have come to US on LOP and on H4 status. I have applied for H1B for 2015.I was picked in the lottery and my COS changed to H1B.
          I dont think there will any issue when changing from H4 to H1. Only thing is she should have lot of patience as the petition will be valid from OCT1.

    • Lots of ifs and buts, lots of possibilities also. You can target working from December or so this year, provided you are also from Big MNC and everything works fine . Your spouse will have similar timeline if she gets nominated, say dec 2015. Best idea will be for you to travel which I hope will not be atleast by Jan 2015 and ask your wife to work here. Now answers.
      1. Shall I take her on H4? Yes, but will her office file for her if she s on long leave?
      2. Shall I wait till she also gets H1? That s the best option.
      3. Is there any possibility or easy way of changing H4 to H1 for my wife? You can change, but you have to rely on some unreliable Telugu consultancies there, who have no idea of ethics or morals. They moreover charge you for filing H1.

      So you go first, let your spouse also get a H1 and then come. Then she can easily do a transfer to big companies in her area of work itself. If you are a bachelor you can save a lot of a$$

      Also change your name to upper middle class Indian, if all these works out. 🙂

  16. OK, since the last couple of days I have a new problem with impostors. Impostors that end up using my forum name and post answers with half or no knowledge at all. After giving this a thought I have come to the decision that I will NOT be using the name “Lannister” moving forward. The name is being misused and people end up with wrong answers for their queries. I do not want this to happen moving forward. Whats in a name? I shall still try to reply to your queries to the best of my knowledge using a random forum name. I am not here to earn fame or name. My motive is to help people who are seeking information. I can always do that using a random forum name 🙂

    People come here to get their H1B Visa queries resolved. Anyone who knows the ‘correct’ answer can clarify their doubts. By ‘correct’ I mean to say a verified answer. If you have seen past cases or know about the proceedings exactly you can reply to the queries posted. If someone else also second you saying that your answer is correct, the person posing the query will end up trusting you.

    To all the impostors who end up using my forum name going forward, remember that you are feeding of my vomit. Period.

  19. Still waiting for update from initial review since April 10th. Is this a cause for concern or anyone is anyone else in my shoes. I also noticed most of the numbers around my series have been issued some form of decision. Please help anyone.

    • Anyone still waiting should give up all hopes now. It’s too late to expect any miracle to happen at this point. It’s better to wait until next year for the 2016 H1B quota. Maybe you will get it next year or sometime in the future, so please don’t loose hope.

  20. My wife traveled with me on H4. She was working in India and currently on leave. Her H1b is in initial review and she has to go back to India since her leave is expiring.
    Which would be better 1. Quit the job and wait for H1b approval or 2. Go back to India and quit when her h1b gets approved.
    Also if she is going back will she has to go for visa stamping if her h1b gets approved while she is in India or she can travel back on her H4 even if H1b is approved?

    Please provide you valuable suggestions. That would be a great help for us.

    My H1B is in RFE status from May 21st, had submitted the documents to my case manager and looks like now they have started working on it.
    1)Should I have to worry for the delay ? or should it have been submitted to USCIS by this time ?

    2) Though the questions were answered/docs provided by me, is there any chance of rejection by USCIS in case if they think that the proofs were not sufficient or will they ask me for further evidences?

    3) Will my case manager reviews my RFE evidences provided? Are they in a position to go thru my REF docs and ask me for more details if in case necessary.

    Need your help !!

    • 1.) No you need not worry for that. There is usually 90 day time period for you to reply for the RFE. So ideally that makes the deadline as somewhere around Aug 21st.
      2.) Yes, in case you missed a doc or fail to prove the authenticity of your job.
      3.) Yes, they can always do that.

    Anyone from TCS received ‘not selected in lottery’ mails yet?
    Or any info saying ‘there are no lists, all we need to wait is for not selected mails’ sort of update from FDFU??

    If not, do anyone of you have any update saying that there are few more lists to come? I am askin this cuz the numbers go this way..,

    1600 applications from Hyd location and only 400+ made it thru so far, which is 25%, if this is the final number, seems we are the most ill fated than all the other companies 🙁

    (1) USCIS is requesting evidence to prove that the offered position qualifies as a specialty occupation. ***CRITICAL***.

    Provide a detailed description of the Company project, and explain what the associate’s role within the project will be.

    I have done my engineering in Electronics and communication , which is nowhere relevant to Web developer role , but I have 4.5 years of experience in web development . I do not know how to justify the role as do not have degree of web developer .

    Can anyone help me in this regards ?

      • And don’t panic if he says the visa is not approved. As per the USCIS rules, a person can appear for a visa interview again if he is denied the visa the first time.

    • Dude, you dont need a web developer degree to justify your position. Your experience is more than enough here. If you read your RFE carefully no one asked about your degree. You are just being asked about your role in the project, responsibilities etc. Do not panic and provide all the information that USCIS is asking you. Sit and read your RFE until you understand each term and then get back here if you do NOT understand anything. We shall surely help you.

        • All the best with your RFE. Remember, do NOT panic and do NOT worry. That is a very common RFE and a solid document detailing everything (roles, resp, activities split up etc) should help you. Remember, be as **DESCRIPTIVE** as possible. Do NOT assume that the adjudicating officer understands the obvious. He is one hell of a dumb guy who absolutely do not know anything about IT and stuff. Consider him a layman and explain EVERYTHING to him.

  28. Just having one doubt, in above post Lannister(H1b Guru) has mentioned that we can apply for multiple times for Visa Interview in case of rejection, so is it true for all rejection or just for some particular cases.

    • And yes, the answer to your question is you can appear for VISA stamping as many times as you want in cases where your VISA is out-rightly rejected. If you are put under administrative processing you need to wait for decision and only then appear, in case of rejection.

      • Recently doesn’t matter. Historically, there are 1000s of cases where petitions are denied after people respond to their RFEs. If you are not able to convince the adjudicating officer it gets denied or is issued a NOID (Notice of Intent to Denial).

          But HR denied to give such letter. But I was notaries letter
          From my previous manager and given to employee. But
          Evaluater told me to submit letter which is having company
          Letter head.

          My question is that notaries letter is ok for the USCIS .

          • Your attorney needs to take the final call here. Theoretically speaking, that document should be enough. However, explain the situation to the attorney that you are unable to provide a letter from your previous employer. He will take a call based on it.

      You might want to look at other options. No one can predict the outcome of an RFE response review. You might have all the required documents but there are other factors that come into play. I hate to admit but luck plays a big role. I wish you all the best though.

    • RFE is not a devil to worry,its just that they want some more clarification and they seek more documentation from you.Ideally in 4-5 weeks time they must move your case forward.

      Note : uscis is there to give you visa,not to revoke it.They do it only when they feel you are not genuine.that’s why u see it biggies like wipro,tcs getting h1b visa stampings smoothly…This is my personal experience

        Someone used my name & replied to your post. The answer to your question is yes. Rejections in the past do impact your future applications. Your file is already with the consulate before you step in. Your past record reflects your intent to migrate to the United States which can easily affect your approval. Please Admin(Saurabh) help!

  31. Hi, my petition has been approved in July 2014 for 2015 cap. So visa will be approved from 1 st Oct 2014. I have couple of questions.
    1. Will it affect stamping if I delay interview date? If I go interview in 2015?
    2. What will happen if I get rejected in interview? Will I able to apply it again? If yes after what period and how?

        • No its not a problem. You can apply as many time as you want. But everytime you attend you need to remember the obvious fact:
          **Take more documentation or try to clear the doubts of the VO in order to NOT get rejected again** 🙂 Thats it!

  33. Hi Friend @N, one more advice, please try to file a petition thru a Non-Profit org. Such orgs are cap exempted. Then for sure you’ll get the Visa. And the consequence is that you have to do only charity work with minimal wages but sufficient for food and clothing.

  34. I am RP/non AD with 20 years of experience and info from my future employer that my h1b petition got selected and it is in initial review. My current employer does not want me to leave so they are ready to send me to work in US. Can they get the h1b transfered if I want to stay with my present company although I am more keen on joining the future employer who did everything to get me there. Please advise.

      exceptions : employer -client model ( employer xeclaring he is responsible for you)

      e-v-c ( scope for lot of questions)

        • As told above you need a client letter for EVC system. But you can check your luck ..who knows.. Either stamping or 221g.

        • I think if you are able to justify yourself and if you carry any contracts between client and employer and if employer is going to produce all the other required documents, I suppose that should also help you.

          • Client letter is a critical document for VISA interview. Period.
            However, just because you do NOT have one, doesn’t mean that your application is automatically denied. It varies from case to case. If you are from the big MNCs (which fall under Business Executive Program- BEP) then you are most probably not asked a client letter or for that matter a document in the first place. They pose you simple questions and you get to clear your interview easily. On the contrary, if you apply through a consultancy or those smaller employers, you need to show your client letter to prove the credibility of the job offer.

    • Client letter is difficult to obtain in case of EVC where projects are relatively short term . You can try though. Please ask for SOW, Project details etc and try.
