Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

Would there be lottery for H1B Visa 2015 ?

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

  1. Hi All,
    I got selected in the lottery and it is in initial review. They were not ready to share the receipt # though.
    I would like to know when the status is changed from initial review to any of the next phase will USCIS notify the employer with email or is it via mail? How up to date is the tracking url? i mean whether a change is first reflected in the tracking system and then a email/mail by USCIS?

    • The tracking URL is real time. Once they are done with your petition the URL, the same is updated immediately. If the petition is PP, then your employer would first receive an email and then the notice in standard mail (takes 2-3 weeks). If it is RP (regular processing), then he would only receive a standard mail.

        I am contacting the company for the updates. I don’t think there is a way to track it until we have the receipt number.
        Any idea why few companies have such policies.

        • Most companies do not reveal the receipt number until you appear for VISA interview. This is in order to ensure that you do not try to change the employer.

  2. Dear Brothers, Please help me with my question below:

    I work as a consultant from India to a company in the US. The company do not have any offices in India and so I work from home. when i fill the DS-160, what should be the employer address should i update ? If i put the US address of my employer, it looks like i am already there in the US. I cannot put an Indian address as my company do not have an office here.

    Attorney suggested to put a local address and it can be explained in the interview. I need your valuable thoughts before i change anything ?

    • This seems a bit tricky. How can you justify any local address which does not exist? In case USCIS wants to do some administrative check and then realize there is no local office for your company, it would cause more trouble for you. I suggest that you should mark the US address ONLY and then explain to the VO in case of any questions. However, for mailing address in DS160 I suggest you to mark your home address.

        Though i work for the US company, due to remittance/service tax issues, my salary is passed through a Indian company. The indian company just credit my salary and my contract is signed with the US company.

        Can I mention the indian company address (that JUST credits my salary), as my current employer? I have pay slips and form 16 from them. They are a good partner of my US company and i’ll have all support from them for sure.

        Suggestions ?

  3. From my attorney for a petition that is initial review stage from April 30th…

    USCIS has continued to reported that it is processing H petitions in two months for some time but we have consistently seen actual processing times (based on the hundreds of petitions that we file) vary from 3 to 6 months depending on the time of the year. As 85,000 H cap petitions were all filed and receipted in April, it is not realistic for them to actually adjudicate them within 2 months. We are receiving approval notices every day for cases filed in April, but we are also receiving Requests for Evidence (RFEs) daily for the H cap petitions filed in April.

    Every year there is a spike in August and September in the requests to upgrade the April filed H cap cases to the premium processing (15 day) service to secure a decision prior to the October 1st start date. Many of these cases are issued RFEs as the government struggles to cope with the increased volume. This often results in further delays for the cases in the normal processing queue. This cycle has occurred most every year when there is a lottery because of heavy H-1B demand. I would suggest waiting until early August to see if we receive the approval for your case and if not, then you can consider whether to upgrade the petition to premium processing.

  6. Hi… I have some questions. My petition has been approved against client A…but my employer has told me that sow of client A is expired so fill details of client B in DS 160 form…since now petition and DS 160 both have different client information and location…do I need to carry any supporting document while going for interview? I asked my employer but they told me there is no need to carry any supporting document…but still I am having doubt…it will be great if someone answer… Thinks…

    • You do not need a supporting document at this time. However, later a change of client requires you to file an amendment to get approval from USCIS that you are working for a diff client and in a diff location.

    Can anyone pls answer for this?
    My husband has applied for H1B. He got selected in lottery and his petition also got approved. Still his VISA interview is not scheduled. I am also working for an IT firm in AUTOMOTIVE domain. As there are some openings in U.S in my company itself and depending on my performance, in my company they are planning to apply L1 for me.
    Whether this will affect my hubby’s H1B VISA approval? Please provide the response.

    I had been to the Chennai Consulate yesterday (10th July) and it went on well. I had been there along with my wife & kid, and all our visas were approved.

    Thank you all for your valuable inputs. This forum has been a real help. I am posting my interview with VO so that it helps others who are going to attend.

    Interview got over in less than 5mins. Here it goes
    Me: Good Morning Officer
    VO: Good Morning, How are you doing?

    Me: I am doing good, Thank you. How are you?
    VO: I am fine.
    VO to my wife: How are you maam?
    Wife: I am fine. Thank you.

    VO: Can I have your passports?
    Me: Handed over the passports

        I have a similar case where I am working for company A (MNC) and My VISA is approved which is applied from Consultancy B.

        is the company which you are going through is also a desi consultancy?
        What is the employee strength ?
        I know your VISA is stamped , but what additional preparation you did or care you took ? It will be helpful to me and others.

          Ensure that you have all the documents which show that your experience, your employer and the project from your client, are all genuine.
          Be confident and there is nothing to worry.

  9. I dont know why people are worrying for H1B, will you die if you dont go to USA, can’t you earn and live in india, stop all stuppid worries if you dont get VISA and go back to work.

    • Its not that they die if they don’t travel to US and work there. Each of them here have their own dreams & they have an aspiration. May be someone’s suggestion would help them in getting their visa stamped. That’s the reason people from different places are chatting on this forum.

    I work for MNC. My pettion got approved Last week. When applying for H1 I was working for Different client and Location. Now I moved to other client and Loction also differs. Is that will affect My Visa stamping???.. Is ther any other Process to follow for change in Clent and Location??? What question will be asked in Interview??? is they ask about change in Client???

    • GOLDEN RULE – ANY THING AGAINST LCA MEANS IT WILL BE REJECTED ..U NEED MODIFCATIONS ETC / EMPLOYER,ADRESSS,SALARY EVERY THING IS LCA DEPENDENT.READ LCA THOROUGHLY DIGEST EVERY PINT AND THEN ONLY TRY FILLING OUT DS-160 ETC ETC

    I’m currently on L1 extension valid until 12/31/2014. ..Applied for H1, selected in lottery ..EAC141455XXXX….inital review since April 10th

    Does anyone know what is delaying the decision? OR L1 to H1 COS are least priority for USCIS as of now and will be processed in the last spell?

    • Nothing like that from my experience. I’m also on L1B extn valid till Jan, 2016. I got my H1 approval 3 weeks back in regular quota. My series is EAC14146….

    • Your case is not in initial review from 10th April. It is the date when the lottery was done. Your petition is logged into the system around April 25th.

  13. Hi folks, Still I’m not aware of the selection or rejection of my application for H1B in lottery. I work with Wipro.

    Does anybody knows – why it is getting so delayed? Company is not even disclosing the receipt number as well.

    And is there any hope of approval now as I reckon most of the people has already got the results and they jumped for the next level of interviews.

    • Until unless your application is picked up in lottery, your case will not be assigned with a case number. That is the reason why your employer is not able to share you the same. However, you should not have any more hope in this case as it is too late.

        • This might be possible that your company got the rejected package but they do not want to disclose it you yet. Employer has more reasons to not let you know about the status of the petition then US immigration.

    • They requested for additional evidence (RFE – Request For Evidence) in the form of organization charts-reflecting your supervisor, Work Orders, Job Description, list of tools, end client letters etc..

      You can ask your employer to provide those information as needed,

        • You must have SOW/MSA to establish the nature of your work unless if it is an in-house project. This will speak about your contract, client information and the work order that offered for the employment.

    My petition is in initial review state. I do not know about SOW and MSA. Can I check these documents in my petition ? Is any petition can go in approval state without these documents ?

    • SOW (Statement of Work) and MSA (Master Services Agreement) are required to prove to the adjudicating officer that you are applying a H1B for a genuine job opportunity. They are required from case to case basis and not mandatory for everyone applying a H1B. For instance, if you are working in an in-house project you will not have a SOW and MSA which is acceptable. In case you have a client for whom you are going to work, you need to provide SOW and MSA to establish the nature of your work.

        • I do not think so but I am not sure. The aim of visa interview is to ensure that whatever information you had given at the time of filing is true or not. The approval status of petition shows that Immigration guys are ok with the documents you submitted.The interviewer “should not” ask any new documents.

          • Raj, as Atul clarified no new documents will usually be asked during the VISA interview. However, based on your employer profile, a variety of questions will be posed asking you to prove the authenticity of your job opportunity. Be prepared for them.

        i too have the same question as Raj. My visa has been initiated for an in-house project and it has been approved. Do i require an MSA or SOW . Since my visa is approved can i proceed for visa interview with out these documents.

        • Yes you can. However, you might have other questions posed by the VO asking about the authenticity of your in-house project. Be prepared for them.

      • @Lannister , what if SOW is valid till 31 OCT , is there any chance to get approved the petition ? My colleague got RFE yesterday regarding SOW and we have submitted same documents , so will I get REF too ?

        • 1.) SOW should be valid for atleast 4-6 months starting from Oct 1st. Else, you are simply stating to the officer that you do not have a job after 31st of Oct.
          2.) You never know. You may or may not end up with a RFE. I feel sorry to use the word, but ‘luck’ does matter 🙂

  19. I have question regarding Visa Interview AND DS160. I am planning to go for Visa stamping (H1B) in few days. I am working in India with old employer(Company A) and GOING TO WORK till October. My Visa petition is filed by Company B.

    In DS160, there is question about current and previous employer(s) (last past 5 years). My question is whom can I mention as present employer, Company A or Company B? If I say Company B as present employer then I will need to mention Company A as past employer, in which case they ask in DS160 for start date and end date with past employer. Please note that I have not yet resigned with Company A. Also maybe they can ask during visa interview about work experience letter from Company A? If I mention Company A as present employer then they may question during visa interview when I am planning to resign and may ask more?

      Your current employer will be company A. If they ask the question as, Since how long are you working with company B, then you answers will be : I have not joined the company B yet, Once i get the visa then i will be joining the company B.
      Last year i had the interview and asked the same question to me. This year i am here for my spouse visa.

  21. I have a query regarding SOW and MSA . My colleague and I have submitted all the documents along with SOW & MSA , but SOW is valid till 31 OCT for on going project . She got RFE yesterday to submit the SOW . I need to understand why she got RFE , though she had submitted the SOW & MSA . Since I have submitted same documents as we work for same client , then will I also get the RFE or is there any change to get approval on it ?.

    • My friend also got RFE for SOW. Immigration team wants SOW at least valid till JAN 2015, otherwise petition will get rejected.

    First of all congrats to all who made it in to H1-B 2015 , I have seen ( Spl ppl from India ) who’s Visa is approve & now they have mixed feeling of interview ( Stamping ) .

    ” DON’T TAKE A VISA INTERVIEW LIGHTLY ” as any 221G & rejection leads to catastrophic effect to your journey but I am not here to scare you . I choose that word’s because of my Stamping experience .

    Prepare well , be specific n to the point the question asked by VO & if bring family along with you make sure they too have through knowledge about prime applicant..job .location , DOB , Salary etc;

    Read your DS 160 at least twice before going to consulate . All the best ..!!!!

    My employer said that he doesn’t have a specific client for me now, his plan is to get the H1B and then put me in the market….

    I got a RFE, they are asking about MSA, contract, or SOW..and more questions about the client… the location, start and end date stuff like that…

    do you think it will be a problem for my employer to reply to the RFE??

    • I am sorry to say this but you are in trouble now. The best your employer could do now is to show an in-house project and get your VISA approved. Even then, it would raise many questions from the adjudicating officer and later from the VO at the embassy. I do not mean to panic you but there are high chances for your petition to be rejected. All the best.

  28. Hi All,
    My employer filed my H1B in anticipation of a new project from one of the existing client. Unfortunately, project did not come. However, I was selected in the lottery and It went into RFE. Now USCIS needs SOW, MSA which my employer does not have as the project still is not there.
    Now my query is, we do have one other existing project of the same client. So can my employer submit SOW/MSA of already ongoing project and get this approved ? If yes, the other query is, while filling for H1B, the approval is requested for 3 years but the already ongoing project SOW/MSA is valid till 2015. This way is there any possibility of getting this approved ?
    I know this is complex question, any help would be appreciated.
    Please help!

      You are good with the ongoing project’s SOW/MSA. When my employer filed my petition in 2011, my project had SOW till 2012 but I got my visa till 2013.

    • Even i got the same RFE.. our internal team asked for the project details. But the project which i submitted during the petition filing is ended in april 2014. Now i gave the new project details which is having a signed SOW till june 2015 as suggested by the internal operations team.

      Have to wait and see what will happen.

    Anyone got RFE requesting for paystubs? How many months paystubs does USCIS usually require in RFE? Or they request to render all of the paystubs in US? And anyone being requested for W2?

  30. Hi everyone,

    I learned that I wasn’t picked in the lottery a few weeks ago. I haven’t recieved my rejection letter in the mail (or email- I was PP) so I contacted my law firm about it.
    My law firm- Fragomen, said that they recieved my rejection letter but is not “authorized” to forward it to me.

    I thought this is very sketchy since I have no proof whatsoever that they actually sent in my application. Is anyone else on the same boat? Are rejection letters normally distributed/forwarded back to the applicants’ address?

    • If they are not sending you the returned packet, you should go to their office & verify it there unless your attorney is in a different country

    • The processing time depends on case by case. USCIS does background verification before approving the petition. Sometime it takes time depend upon the case.

  31. The processing time for h1b visa is usually 2 months for vermont center. Can anyone please confirm, if the two months are by calender or by working days.

      My case filed on 10th April 2014 , still is in the initial reivew. can you pls let me know how many still it make for approval .
      My below number and after number are in decision and post decision phase respectivly .

      • U should be worried if it is RFE( RFE is also not a worried thing,provided you give the docs thye require),any time your status will shift to approved,once logged in to system as initial review ,if you have all the docs and necessary explanations ready,no one can stop you from getting visa stamped.

      • Around 30% petition of my series ( around 100 serials) EAC14147** are already approved. rest of them under RFE or initial review. mine is under review 🙁

      • Deepika, the results have been declared a couple of months back. You should contact your employer immediately to know the status of your application.

          Yes am very new to this process and our petition has been filed in april and till date we have no news about the lottery whether it has been selected or rejected.

          We have been following with the attorney and they said they have no news yet.It has been applied through vermont center in april

          Please advise.
