- May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
- April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?
USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.
What would be the Cap count for H1B Visa 2015 quota ?
No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.
- Regular H1B Quota : 65,000
- Masters H1B Quota : 20,000
- It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

What would be the H1B Filing fee for Fiscal year 2015 ?
There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014. The H1B Visa 2015 filing fee can range anywhere from $1,575 to $4,325 based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet. But, lets say, if it gets passed, the below changes may happen.
- Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
- The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
- H1B Visa fees can up to USD $10,000.
- More stringent rules on H1B visa adjudication.
- Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

My friend’s visa petition got rejected last year because his wife gave diffrent answers for same questions asked to him. So if you are taking your wife along with you. Make sure that you both attend interview together .

As far as I heard, once the petition is approved, it will be very less chance to get rejection. I was suggested and also saw in many forums that, it is always suggestible to attend the interview along with spouse and children.
Don’t worry, you already crossed a major hurdle. Be well prepared for the interview.
Don’t be panic and be confident when you answer the questions. And more important, be specific to the answers, I mean, answer exactly what VO asks. Don’t try to give more information. Arrange the documents in an order so that you can easily give those to VO whenever he asked.

I have got an RFE for my application. I got to know from RFE notice letter that my Employer has submitted incorrect Contract agreement letter(with incorrect Client name) to USCIS. This document is to establish employer-employee relationship.
The client for which my H1B has been filed and the client name on the contract agreement is different.
Is there scope of corrections here? Will there be a problem if the corrected document are submitted now?

I have received RFE for my application. After looking at the RFE notice I realised that my Employer has submitted incorrect Contract document(Document to establish Employer- Employee relationship) to USCIS(Client name is incorrect in the agreement)

I applied H1 this year and got my packet returned today! my wife has applied last year, another one this year and has not been lucky enough to get through the lottery. We lost all the hope and was getting ready to pack up listing our stuffs online for sale.. I have applied for L1 extension which i did not have much hopes for approval, but luck played in my favor this last time when we needed it the most!
This has been a great forum for all the news and information about visa processing and you guys have been very supportive through out. It has been a frustratingly long wait for most of us leaving it to a lottery system to decide our fate.. I wish there had been a better system that picks people based on merit than just luck. With the immigration reforms on the table, there could probably be a better chances of getting through the processing next year for all those who are waiting for the next year window! As a person who is waiting for my petition to get approved just like everyone else (assuming that you are one of us), I just don’t understand why this anger and offensive words are necessary over here. Yeah, we all are tired of waiting and checking our emails and statues every five minute. And I get that you are frustrated, but being ugly like this on the internet is not going to change anything. Plus no one wants to hear you whine/complain.

I do not support Sandeep for using such a language towards the whole nation, but there is definitely a truth behind every statement what he said. I am here to track the status for my wife. I am in this country for last 9 years and I truly believe in what he said. I have spent over 15000 for my Visas and Green card and I am tired of waiting for each and every step. It’s not only about lottery. They really do test of our patience. If you cannot believe in me just wait for few more years and you will believe in what I am saying. If people are waiting for the packets to be returned, it can be returned right away, it has been over 3 months and many of them have not received the packet. The approval process is random (in no sequence). They show the average process takes 2 months. It has been 3 months not even 50% processed. After thanksgiving, the whole system is virtually shut down until 2nd January. No question why they have over 6% unemployment being a developed nation. If the department have budget people with be making overtimes on 1n a half billing rate. If they do not have budget, they will fire people. Strange country.
Paying money for visa itself is wrong, you have committed a serious offense and claiming that this country is not doing things properly since u have paid 15K, i have seen ppl who got GC who never paid any penny!!! get a life! stop complaining, instead of bringing shame to your nation, do something useful, you can always go back to your country and serve. It is also not about complaining, but there are some facts and you have to learn them sooner or later. I came to US from a big fat indian company and since then I change 4 companies. I was wrong when I said that I have spent more then 15K, I meant my employer has spent, but dude all this money eventually is your cut. When I ask a raise, they say that they have been spending so much on my immigration and the conversation ends there. No one is serving here for free. And as I mentioned in my previous comment, stay here for over 6-7 years and you will be tired of waiting for everything (The immigration process is a money making business for congress). And never preach when you do not know anything about the process and country. I am not saying the country is bad, but just because it is a developed nation you cannot say it is all good.

What about some Americans being happy with making $14/hr working at a grocery store? I won’t have to wait a few more years to believe what you said because I lived in the U.S. for 9 years (graduated from high school and college there) and know how the whole immigration stuff works. You say that the waiting is tiring, they work slow/inefficiently and so on. But the thing is you obviously think that it is worth the wait so you can work and live in America because you are still there and waiting. You probably would’ve left the country if it wasn’t worth it, right? So how about just being appreciative of the opportunity that you’ve given in the U.S., instead of defending some ignorant person on the internet who doesn’t know what he’s talking about?

As I mentioned earlier I do not support Sandeep for his comments and that was my wrong that I said his every statement is correct. But believe me or not, if this country go in the with the same pace there will be lot of problems in future.
The immigration has a big problem here. If you allow me to come here and apply Green card then why 10-20 years of wait and stick to one employer. You cannot change your employer and they take your advantage. You have to pay over $4000 (I mean new employer- for me it is same thing) to transfer and then same story goes on and on.
The medical sucks in this country. At one point for two years, I was paying $1400 per month for my family for medical insurance.
Kids do not go to college and then over 80% population turn towards working at subway and stores and here what sandeep mentioned is right, they feel proud in what they do.
I live near to a well known high school (10 rated) and I am ashamed to see when I see the 15 yr old girls in short torn dresses kissing the boys. Because their parents do not worry about them as they are more busy in drinking beer and watching football matches.
Believe me I am not speaking as I am an immigrant here. I am speaking because I will be a GC holder soon and will become a Citizen in another few years, I own a house. This is because I feel bad when I think about my kids. I am sure you will say that why the hell you stay here go back to India. The answer is there are bigger problms back in India.

It is written in the USCIS web site (My tracking number web site) that :
” You should expect to receive a written decision or written update within 60 days of the date we received your response”
For RFEs. This means that maximum by the end of 60th day USCIS needs to make a decision on my application? Or it can take months for reviewing my RFE response ?

Its rare to get rejection for B1…. you must be giving wrong ans…. talked to people and analyse your ans you gave for B1…
don’t know what wrong answer i have given..because they don’t ask many ques..It was for tourism purpose only since my brother lives there..I have been to many other countries but don’t knw why got rejections from US embassy.
You might not have convinced the officer that you are NOT a potential immigrant. This is one of the major reasons why B2 VISA gets cancelled. And No, your B1\B2 rejections will NOT affect your H1B stamping chances.

It’s B2 for Tourism Purpose
USCIS is no longer approving B1 visas after the fraudulent caught by the some XYZ software giant from India. Its not you. No oneis getting B1. They are also not approving any L1. So I dont think rejection of B1 will any way affect your H1 stamping.
One small correction, B1 Visa is not petition based, so its provided by the Consulate (High Commission) and not by USCIS, i know B1 visas are still getting approved if you are not from Big Firms who misused it a lot in the past, most of my junior staff have got B1

Ok just an update. I just received my petition approval notice from my employer today. It exactly took him 14 working days (excluding weekends) to receive the approval hard copy. Next is VISA stamping and I would let everyone know my experience once I am done with my VISA stamping :).

You need to raise a VISA stamping request once you receive the hard copy. I believe CTS has an internal process for this. Please check with the respective department.

My H1B visa is in process currently and it is in initial review. But I am going to Sweden for one week for tourist visa. The tourist visa for Sweden is granted for 90 days but I will return in one week.
Will sweden tourist visa affect my h1b approval?

Not exactly. My employer is a BIG firm and he did notfiy me as soon as he received the update. It all depends on the org policy and it varies from one org to the other.
Can anybody tell me how much time it requires to know the result after submitting document for RFE…also is it true that this year stamping interview will only start after October 2014
It might take anytime between 15 days to 6 months after submitting the evidence for RFE. This year stamping has already started. You can start attending anytime after 3rd of July 2014..

RFE can take from 3 weeks to months…there is no definite time…it depends on the processing officer, i’ve seen cases where it took 7 months to review an RFE, for stamping you can appear for the interview anytime before 90 days from Oct 1st…

Nope. RFE has got nothing to do with stamping. However, your employer profile is the only thing that matters. If the history of your employer is fine, then there is nothing to worry about.
By history I mean previous H1B petition cases filed by your employer and their stamping status

Yes you need to fill a separate DS160 form for your kid. I do not know the answer for the other question.
Its always recommended to appear for the interview with your spouse, why do you want to create unwanted scenario all by yourself??….later if ur husband goes for the interview, there may be question that why he did not attend the interview with you….it wont be a big deal…what i am saying is, if you become nervous, then the consular has the upper hand during d interview, your attorney also will suggest the same…
I’ve already submitted my ds160 and my husband is travelling out of station for a week during that period. Can’t I tell them the same thing? Basically he is also through lottery and he is waiting for his approval. So he doesn’t want to come for H4 unless something goes wrong with that. Kindly suggest me what move I can take now.
Sorry, I do not know the right answer for your query. However, I believe you can proceed for stamping for now without your husband and inform the VO that he is out of station (in case of any query which I doubt the VO would pose).
You can tell the consular the reason for your husband not attending the interview!, but surely there will be a question to your husband when he goes for the interview but not a deal breaker!

It has been 25 days since my petition got approved and there is no response from the company( through which i applied for H1b) regarding the receipt of hard copies of my approved petition, even after my inquiry mails to them. I have learnt that it usually takes 15 days for the copies to reach the concerned company after the USCIS approval. So, i am really apprehensive since last week.My petition is nonAD/REG/VERMONT of series 141405****and got approved without any RFE.
Please throw some light on this issue if anybody around has an idea of this situation.
A friend of mine is also in the same boat. He still did not receive the hard copy yet. Nothing to worry here. 4th of july is a long weekend in US and I believe there is slight delay because of vacations and holidays. You should receive it shortly.

Always welcome. BTW, you have already crossed the major hurdle i.e. petition approval. It is a cake walk from here (VISA stamping only) and you are pretty close in realizing your american dream :).
My petition was approved on 28th April. Still have not received any hard copy. I believe it will be sent to the attorney/employer who is in the US and then they’d send those to me to INDIA ?

My H1b Visa is approved through a Company X in India. I live and work in India.
Based on that company LCA filing status I can say 10-20 % approved petitions are withdrawn (I hav checked these in myvisajobs.com). If a company withdraws petition after approval what are the options for me ?
?Can I go H1b tranfer ( I dont have approved petition copy. I do have receipt no)
? Can I come under Cap Exempt

Please know the fact that, LCA is not the actual H-1B petition, even an employee who gets transferred, the old employer will withdraw the LCA and also the LCA can be denied if the offer is less than the actual defined wage by DOL….nobody has the real data of H-1B petition by an employer…have a look at Infosys and many others…dont believe the myvisajobs stats (its not the actual H-1B count)….
if you are going ahead with the transfer, your current employer should not revoke the petition, if he revoke it before Oct 1st, then u will not be cap exempt…
if you wait till Oct 1st and then a new employer can file a cap-exempt petition for you….(this suggestion is based on the assumption that you are out of US and having approved h1b petition for 2015)

OFC experience:
I went for the OFC appointment on 1st july 2014.Process took hardly 5 minutes but i got to make few changes in ds160 so total time got stretched by 45 minutes.
Problem in ds160 was that, my wife Surname field was blank in passport but while filling up ds160, i put her surname there..So the people at OFC asked me to resubmit the ds160 form with ds 160 ‘s First Name field as FNU and last name field as the Given name field in the passport.. (FNU is first name unknown).
Internet ppl there charged 250 bucks for that but we dont have any option so we opted for that.
Visa interview on 3rd july 2014.
I went with my wife. Consular just asked my employer name and the designation and no questions were asked to my wife and within few seconds my visa was approved.
I went to hyderabad consulate.

Here’s my situation, my wife and I went to the US twice on a J1 for cultural exchange program (2007 and 2008), years later I went for an internship on a J1 in 2012 for 1 year, but my wife got her tourist visa denied when she tried to visit me in 2012.
Now the same company I was an intern in 2012 in doing my h1b. Hopefully my wife’s situation won’t be a problem.

No, this was the first time me and my wife went for h1-h4.
For your case, i dont think it will be problem. I would suggest u to go with your wife .This will further minimize the chances of any such questions to your wife.
