- May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
- April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?
USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.
What would be the Cap count for H1B Visa 2015 quota ?
No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.
- Regular H1B Quota : 65,000
- Masters H1B Quota : 20,000
- It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

How soon should I start planning for H1B Visa 2015 ?

How do I find Sponsors for H1B visa 2015 ?

What would be the H1B Filing fee for Fiscal year 2015 ?
There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014. The H1B Visa 2015 filing fee can range anywhere from $1,575 to $4,325 based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet. But, lets say, if it gets passed, the below changes may happen.
- Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
- The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
- H1B Visa fees can up to USD $10,000.
- More stringent rules on H1B visa adjudication.
- Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

R u sure few lists are yet to come? What i heard is that there is only one final list which will be shared before this month end. I dunno whts the intention of TCS in sharing the lists phase wise like this. Even if its phase wise, why dont they have a regular interval like once in 2 weeks or so, rather than giving us surprises and killin people with panic…grrr

I would think twice doing that, one person I know did the same for his spouse and u**is found out that the consultaancy was doing it for money and put a life time ban on the spouse frokm coming to us and now the guy has to leave everything and go back to stay with his spouse.
I have seen people getting rejected to L1 and ban for h1 too just bcoz last year there was trend of L1 rejections….risk is always there…I will think thrice before applying…I just want to know if any1 had positive experience than I can atleast look for those consultancies…

Though the H1B is a temporary work visa, it is a dual-intent visa, meaning aspiring to emigrate on this visa is not illegal.
However, do remember that you will only get a few minutes at the window, so your answer to the questions must necessarily be “yes, I intend to return at the end of my H1B”.

I’ve just completed my masters. I’m expecting my OPT in the next couple of weeks. I have a full-time job offer from Company A and looking to join them once I get my OPT. However, another Company B has filed a H1B petition in April 2014 and it is in process. I do not want to join company B. Here are my questions:
1. I want to understand the options to get the H1B transferred to Company A and the best time to do it.
If my H1B is approved at least a month before 1st Oct, 2014, I can get the visa transferred in premium processing. But, what if it is approved after 1st Oct, 2014? I cannot leave company A even for the premium processing time of 2 weeks if my H1B is approved after 1st Oct, 2014. So, please let me know my options to do the visa transfer.
2. If I travel outside the country while H1B is in processing after I start working with the company A on OPT, what would be the impact on the H1B which is in process?

Which center?
If you are in STEM why don’t you apply for STEM extension? And to answer your other question, yes you can apply for green card but its a long process. It will not help you on short term.

I think you can. Talk to your comp representative and attorney. Last year happened same with me and my comp want to proceed with Green Card which I declined. Anyhow the point is I have experience offshore for 1 year and in USA I had experience of years, and still they wanted to go for green card processing. I don’t have much info about green card process but its a another option to consider.
Any updates from TCS FDFU? I heard that another list is going to be there by next weekend (20th June) and it will be the final list. Source : Chennai FDFU. I heard that there were 3 candidates who got to know that their petition is selected in lottary. Till yesterday, their status was awaiting lottary status.

Hey TCS guys pls check with your project’s PMO or lead to know what weightage was given to your application internally, if it’s 1 then chances are very bright, coz the lottery results that were announced were for applications that were purely meant for lottery.

As of today we have not received yours, but note that we are also no longer receiving receipt notices. At this point we would be fairly certain that your application has not been selected for the lottery, and can look at other potential options with XXX upon authorization.”

they send you your “paper application” back. It was a set of documents along with the check for the filing fee that the attorney mails to the USCIS. If it wasn’t picked up in the lottery, the application “package” is returned as-is to the return address i.e. the attorney’s address.

I don’t think they’l be sending receipts either this week. I guess they lied about it. When i called them they said “don’t take it in another way but we will be sending receipts accordingly”….don’t know what the hell does that mean!…they don’t even bother to give an explanation.

I understand the situation but be patient. Just don’t panic!!! and also please don’t give out wrong information or assume yourself. I spoke to them now, he clearly stated they are informing the candidates (not-selected) about the returned packages first and then ‘ll send the receipt numbers to others (selected) very soon.

I just now called them asking receipt number, just they are informing soon I’m going 2 receive, I told last time you promised with in this weekend, no response from him, just he told I m going to get recipt number soon.

Hi, There is no other way we can know our receipt number unless shared by our employer. Don’t know when splendtek guys will be sending our receipt numbers as they have not mentioned any specific or particular date and time. However they’l be sending receipts to everyone at once. We have waited very long and we could wait few more days.

I dont know whether to say “Dont loose hope”…but one of my colleague received the receipt just two days back ( it is backdated around 10 Apr but received 2 days back only ) . Found in RFE status. I am sure it was Non AD, REG but dont know about center.

Nothing is backdated as such. All the application selected in lottery has the same receipt date as April 10th, 2014. There is another date called notice date that is when USCIS generates the receipt notice and mails it to the petitioner.
I was wondering how the order for approval process works. Is it like, the approval is done for candidates who currently resides in US first and then for candidates outside US.
I got my receipt on April 26th, EAC14145* series and it is still in Initial review stage. I am from India and a couples of my friends applied who were based on US. Both of them got their approvals, but mine is still pending. Could US resident status be the logic behind the approval order?
This does not seem to be true. I am based in India, and my petition (EAC14142) RQ/RP got approved two days back. To me , it looks like there is no specific order in which they are approved, and it is once again “random” 🙂
I feel its the series in which the applications are being approved..
your number is EAC14142 and the above is EAC14145.. the same is for me mine is EAC14148..
so first they are taking series 14142 than may be 14143, 14144 and so on..
I am not sure but just my guess.. 🙂

There were many approval for 14145 series before others and there were many approvals for 14142,14143 etc. when many of 14138, 14139 are still showing in initial review.

I dont think that they are following the order.. Mine is EAC14142***. But still in Intial Review.
There is no sequence in the approval process. It all depends on the how well the application is filed with all the information. If USCIS finds the application fulfills all the prerequisites for approval, then they approve it, otherwise they take extra time to study the application to take call whether to approve or ask for additional info i.e. RFEs.

Depends how the info has been furnished to USCIS in the application. Details about the application can only be provided by the company’s attorney. Not possible to speak on someone’s application but this is an important aspect for getting the petition approved without any hassle.

I guess, Even if we got select they are waiting to get it fully APPROVED (without any RFE) to share the receipt numbers. But last year, they have shared the receipt numbers by May 20th in e-mail.

On Apr 5th -2014, HR has sent an official mail with all information after the file was sent to USCIS also my frnd has received his receipt last year on May 20th from Splendtek.
Even I tried but never received any reply from HR. It’s good that they are replying to ur mails. Can u please send the mail ID if it’s different from the HR one.
