- May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
- April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?
USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.
What would be the Cap count for H1B Visa 2015 quota ?
No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.
- Regular H1B Quota : 65,000
- Masters H1B Quota : 20,000
- It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

What would be the H1B Filing fee for Fiscal year 2015 ?
There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014. The H1B Visa 2015 filing fee can range anywhere from $1,575 to $4,325 based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet. But, lets say, if it gets passed, the below changes may happen.
- Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
- The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
- H1B Visa fees can up to USD $10,000.
- More stringent rules on H1B visa adjudication.
- Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

Just thinking. If all these companies applied for the visa, they must have paid in bulk n not the entire amount would have been encashed which would give tham a concrete number of visa applications accepted. Based on that these companies can even say that x more people would get it right?

apr 28 is for 14146 as i saw some and mine is from that series…i believe it shd be apr 30 or the working day 2 days after assuming it was in series..

If you are already in US working on h1b then you can apply multiple h1b transfer petitions.

What I am understand from the link you provided is, If a consultancy will do multiple petitions for same person,then it is illegal.But my question is Applyling h1b with different employers for same person is legal or not?Could anyone clarify my doubt

Yes, With multiple employers. it’s not at all problem. There are lot of people in this group itself got selected in lottery thru multiple employers.
Although, i personally don’t like this practice because it abuse the system but USCIS allows it.

USCIS already rejecting the applications which are found to be arrived from different consultancies for the same person. Application will be rejected even if it has got selected in the lottery. Once all the duplicates are excluded, certain process will be followed to give chances to others whose application not selected in lottery. As a result, complete lottery result announcement will take till June 3rd 2014 week. Dont lose hope.

We all hope this is true. Measures should be taken by USCIS to punish those who applied more than 2 copies this year. It makes sense if you apply from two companies. But it definitely does not make sense and is obviously a fraud of H1B if you apply 3 or 10 or 15 copies to USCIS.
We should unite together to fight for justice!

@ Padma & uscis – multiple petitions will be approved if it’s different employers without any issues..recently one of my friend both petitions got selected in lottery & in the one petition already approved & in post decision status & the other one is in initial reviews currently .. So no worries..

Don’t worry if you get ‘Case Not Found’ in USCIS case status. I was also concerned about this and my attorney said that there is a glitch in USCIS database because of which some receipts cannot get tracked.
I got my receipt on April 21 with a notice date of April 16 – EAC151365****
However, I could not track my receipt in USCIS case status until May 22, 4:45pm EST. I was getting ‘Case Not Found’ until May 22 and then suddenly, my status changed to Post Decision Activity.
So, hang in there. You will be able to track your receipt once they approve it 🙂

He got approval so check is obviously cleared. He didn’t do anything else other than emailing lawyer about receipt.
I asked these questions because:
– Some people got their check cleared long time back but did not get a receipt for a while (several days).
– Some employers/attorneys hold the receipt for a long time before releasing information to employees (mostly IT consultants).
– Some saw a change in SEVIS, but did not get a receipt.

I want to travel outside US on unexpired OPT. I have received an approval notice for H1B. Can I travel before Ist October (effective start date for H1B)
or should I travel after Ist October
If you applied for COS then don’t travel – as the COS will become abandoned
I think you should not.
I am in the same position as you.
Plus now the OPT is not valid for more than 6 months since you have a COS. And i believe to reenter on OPT and I-20 , it has to be valid for more than 6 months.
So AVOID.

They informed me on may 21st that my case was picked in lottery and said they happen to know it the week before they informed me and said i would receive my receipt this week. I have not heard from them till now.
I dont know why they are not sharing receipt numbers? In other blogs I have learned that if cheque got en-cashed if you check your bank account they normally update the receipt number, I’m not sure how true is that, anyways we got to wait 🙁

Before or after stamping, you can’t use petition from one employer for other employer. It has to be transferred before you can start working for the new employer.
You cannot switch with approved petition, you should maintain status
My employer filed 17 and he got 7 receipts as of now.. and that makes 41 %, which is inline with this years caps/applications percentage. So looks like i need not to wait anymore with sleepless nights. Dont understand why am i feeling happy now.. probably its something im relieved of this whole 2 months tension… i spoiled my kid’s summer vacation as well. Now i will take a complete week off …

I am a non-AD and my case has been filed under PP. website shows “acceptance on April 14” but there has been no updates since then!! It has been more than 30 days past 28 of April and there were supposed to come up with a decision in 15 calender days for PP, but nothing so far (WAC14134xxxxx).
Any idea what could be going on? any body in the same boat?

In USCIS tracker for your receipt# search for the word “E-Mailed” if exists in the entire text. This indicates yours is filed under Premium Processing else they simply mention ‘Mailed” indicates regular processing.
If filed under PP, but no progress yet then USCIS will refund the PP fee of $1225 and your employer/attorney should have received by this time.

BTW, in this case how long does it take from them when a case comes out of PP and become regular (just because they have not processed as they PP)?

One of my classmate here in us got job in a company in san mateo by lying on his resume and mugging up common interview questions. He got fired after probe period of 3 months.
I hope all the people with fake resume and poor skills meet the same fate. You might have equal chance in a lottery but not in battle of skills.

I would suggest to ask your attorney/employer to call USCIS and check on the case status. Just to ensure that your case in not void for some reason.
My employer & the attorney will not call USCIS. The attorney said it is normal and you need to wait till October. My colleagues got their approval though.

What do you mean by Sevis record update? If you mean cap- gap extention, then yes, it has been updated and I even received my new I-20. The problem is that it has been almost two months since my employer filed my H1-B, and I did receive the notice on April 21, and yet my case is not found on USCIS website!!

My employer told me that they dont file more than 5 per year and as they found my resume appealing with long career with single company, they wwanna offer me and asked for security deposit. luks like Im fallen prey. But when i check the visadoor website, i see more than 20 petetions files under 2014 for this company. does this mean are these petetions applied for H1b this year. i dont understand the submitt and certified date for each ID.

There is nothing we can do/any of our colleagues in our office can do other than wait for either the receipt or the rejected package(Let it be GIT Team in Wipro or some other Team in other company).

one reason for delay could be that some selected applications in lottery get rejected due to duplicate application or without proper application, then uscis will pick the pending applications, so just wait. You might get lucky .. !!!
