Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

Would there be lottery for H1B Visa 2015 ?

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

  1. Gaurav, which company did you file from and what is your receipt date? Is it like, USCIS generated new receipts in place of rejected /duplicate applications or its just your employer/attorny who delayed to convey you the good news?

    • For regular, Generally the average is 2 months.. and ranges from 2 to 4 months…

      but sometimes they approve randomly and many have got approvals in 15-20 days also..

      For premium, it is max 15 days

        What was the RFE about? Please could you share it if that’s not an issue? My employer got my receipt dated April 28th and i havent heard anything from since then . I processed my application under RP

    • Just now talked to GIMS, they suggest to wait till 2nd week of June.
      They havent received any updated from past one week and expected in coming weeks.

  7. Even I got the good news yesterday. I strongly suspect on positive side that receipts started coming in again. Earlier my company announced on 13 May that status is not available for my case.

    • Look for alternative plan. No receipt.
      My attorney told me she doesn’t think there is a waiting list.
      I know it is hard to swallow and it is bitter, especially for AD. No OPT any more unless you go for PHD. It is just this stupid lottery system abused by the Indian.

  8. So I know that my employer has filed H1b petitions for many people. Is there a way to know how many of them has been selected. I can see it for last years but can I know if I am the only one whose petition did not get selected.

    Just randomly checked this number at uscis website, it says “On April 10, 2014, we received this I129 PETITION FOR A NONIMMIGRANT WORKER, and mailed you a notice describing how we will process your case….” that means uscis still generating 1 or 2 receipts for CAP cases….I wish…

      • 166 is the day of May 28th (today), so the one with April 10th date is a CAP case h1b, others either h1b cap exempt, transfer or renew

          • that means, there are 2 more lucky guys whose receipt has been generated today and they will receive it in next couple of days…

          • Almost all the application will have the same receipt as 10th April because that is the day when lottery is conducted. Receipt number is based on the notice date and not the receipt date.

            So, wac1416650560 is showing correct info only. Receipt date as 10th April and Notice date as 27th May.

  10. This is the note I received from my Lawyer this afternoon

    “We have not received and receipt notices in the last week or so; informally, we have heard that rejections will start to go out later this week. We will keep you posted, and will let you know as soon as we have anything either way.”

    • My attorney always directs me to the paralegal. And my paralegal is the rudest person I ever knew. I was the only one that my employer filed H1 for. They are completely oblivious to this “lottery”!

    Did not get the rejection packet yet. However, my lawyers told me that it is very unlikely that my case was selected, and will be able to give a final rejection confirmation only after receiving the returned package.

    Anybody here on the same boat?

    I have been closely watching this space from the very first day of the 2014 visa processing. I had lost hopes of getting through the lottery until I was informed that I had got through the lottery today. It’s been a painful wait and I really feel sorry for those who are still waiting. All the best friends, there is still hope of making it.

    I have been a silent reader of this forum for a very long time.

    I work for an Indian MNC and currently based out in the US. Came here a couple of years back, currently working for a big 4 company.

    My visa is ending soon and my bloody company is not willing to do extension on the visa due to lot of rejections. Applied H1 through a consultancy, the friends who applied with me all got accepted. I am the only person stood out of the lucky crowd.

    Feeling really bad, have to go back to India soon and start working on night / afternoon / morning shifts – horrible… God, give me a chance, I know many people in this forum awaiting for something from USCIS – miracles do happen.

    I am waiting until the next week to see if something happens, else will have to start working on something else. The wait has pi”sd me off.

    No concentration on regular work, no proper workout, no no no nothing proper. Feeling so bad. If I had used these time in something else apart from waiting reading forums, refreshing email – i could have used the time in something else.
    Everyone who were working with me will still be working here in the US for long long time to come.
    US will be US for the next 10 / 15 years. Going back to India working our ass’s off there is not an option.
    God, show me some luck – I am waiting to see an email from my consultancy – we missed to send your receipt 🙂

    • Just been in US for 2 years, and u start complaining about the rest of 25+ years that u lived in India ????? Dude , grow up !!

      When you come for an onsite assignment, concentrate on that and enjoy the period given. Try for some extensions, but do not be soooooooo ——- to complain or crib about going back to what was actually NORMAL….

      this 2 years, was temporary!!! Not anything else…

    Finally today my manager called me and told that my petition was not selected in lottery and he got an email regarding this from the GIT team. ..
    wait over. .Now have to work on plan B.

  19. I am holding the Bachelor degree(B.C.A) with 9 yrs experience. I did not go through the lottery. I heard that the chances are very less for Bachelor Degree and high for master degrees such as MCA., MSc and etc?
