USCIS Official News – Cap Count Update
- May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
- April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website
- April 11th : USCIS announced that it received about 172,500 petitions for the H1B Visa 2015 Quota. Read USCIS : 172,500 Received – H1B Lottery Summary
- April 7th : USCIS released official press note saying that FY 2015 cap reached today. For details, read : USCIS H1B Visa 2015 Cap Reached on April 7th.
- April 6th : USCIS non-working day. Weekend ! Will NOT have any update.
- April 5th : USCIS non-working day. Weekend ! Will NOT have any update.
- April 4th : No official update from USCIS ! If you have to file second petition due to courier delivery issues, you need to do it soon by Monday as per AILA note.
- April 3rd : USCIS update to AILA ( American Immigration Lawyers Association )
- USCIS has updated AILA team that, if there were courier delivery problems to USCIS office for the H1B petitions filed, USCIS will accept a second H1B Application for FY 2015 under certain circumstances.
- What it means to you is that, if your petition is delayed by your mail carrier, you can submit a new H1B Application with New Fee and Explanation for the delay including a requisition to withdraw the first petition. If there is no explanation and you file a new petition, USCIS will consider it as duplicate petition and deny/revoke the same and not refund the filing fee.
- USCIS is monitoring the situation and update us with more info. Check AILA Updates
- April 2nd : No Official USCIS Update today on the cap count
- April 1st : USCIS starts accepting applications. NO official update from USCIS yet.

Yes me to waiting for update, any one from Infy. throw some hope
My employers law firm says few slots opening up from double receipts with same SSNs.One of the receipts had been sent RFE and no reply meant slot opened up.But such cases are in single digits at each location so fingers crossed.Employer has yet to receive 25% of petitions back.

Double application does not mean two application for an individual and both applications have same SSN#.
It qualifies to be duplicate only if an employer has filed two application for the same individual. If USCIS receives two applications from the same employer for the same individual, then the slot opens up and either both the applications are rejected or one. But you do loose fees for both your applications.

i am from TCS, i mailed to FDFU team,
i got the response like ‘awaiting the response’…. does it mean not selected because my other team member got reply as selected and i am not getting clear cut reply…..
should i assume it as Not selected and move out.

Wait till June 10th , TCS will release its second list of selected candidates.If your name not there in this ,you can assume to be not selected in lottery.

i got the receipt number 2days back but today when i checked my status it is RPE can any one tell what is the probability of getting it approved.
It means RFE – Request for More information. That means you need to submit some more documents as requested by USCIS, contact your immigration or person who applied this for you.
RFE – Request For Evidence. It means that the skills you have shown and the experience you have portrayed, USCIS are not content with it. They want you to tell them that you are what you are claiming to be in terms of skills.
You need to expand the description of skills you have, elaborate your experience, list down all the professional trainings etc.
Not to discourage you or anything, but be prepared for extended delays in case of an RFE. One of my colleagues got an RFE and they kept him waiting for a whole year. Usually they do respond to information provided after an RFE within two months or so.
All the best buddy, take your time and put in as much information, client names, references, experiences, skills as you can.
They are definetly not ..we totally 4(including one guy from US)+you..so total 5 ..out of 5 we have not get for any one..Sieraa guys said that we can keep our hopes alive till June end..Don’t worry..have faith in GOD..all he’ll take care..

I spoke to Sierra last night, they told me that they have got receipts for 20 out of 55. They are expecting few more receipts since they have not received any packages back.
They have asked me to wait until until 31st May by which they should have some update.

I see the number of posts on this forum has reduced drastically this week. Does this means game is over. I have a good offer from another company in India, but I was waiting for H1b to get approved so that I can move to USA. How much time should I wait more before I accept the offer.

Was planning for H1 application many days, my employer was keep saying go for H1. on 29th of March just 2 days before my H1 application my employer / company and attorney told me it will be a very tough/hard call to go for h1 application as i have no work experience in this field ( though i send all my documents certificates CV payment in January ) I just passed my graduation in Business Information Technology (3yrs) from University Of Greenwich ,England. Now my question to you all people will they reject my application coz of my Graduation which is 3 yrs instead of 4 years and no experience in I.T field ? please reply me cant sleep whole night !!
Yes, in your case it seems difficult. Your case is 15 yrs of education and no experience. People with even 5 – 7 yrs of experience can’t be sure.

My Employer applied my H1B Cap petition (AD/PP/CA) this year 2015 but till today i didn’t heard anything either rejection or approved..Is there any hope in my case as my STEM OPT is going to expire on 06/13/2014 ..I am very tensed in this situation.
Better to focus on other plans as you have hardly 1 month left…. so, look for other options like if you are already married COS to H4 or F2 (If your wife is student). Option 2: Get admit in other universities for second masters next year definitely you will get your H1 so chill and focus on other options rather than still waiting… before that just conform with your employer that whether you Check processed or not and take wise decision based on your comfortable levels… All the best.
My advice to you is to plan actively for backup options (F1, F2, H4), if you don’t want to go back to your home country.
Your STEM OPT will end of 06/13 and you have 60 days grace period (to legally live but not to work). You need to complete change of status by 08/13.

Yes, I agree with CTS-Pune..
If you have a valid H4, you can come and go as much times as you want. If your petition is under review, it does not impact your ability to travel on basis of H4.
Do not transfer your status from H4 to H1 while you are in India. Or you will have to go for stamping to return to US.
I believe since you applied for COS, once it is approved, your status will change from H4 to H1B and your original H4 visa even if valid will get cancelled for all practical purposes. In that case, you will have to go for an visa interview in india to stamp your H1B before coming back to the US. I believe you can go for stamping approximately in the month of September since you can start working only on Oct 1st. The problem with leaving now is that you may have to wait till at least September to come back.
This is my educated opinion. Please check with your firm’s immigration attorneys for a more legal answer.
If you are on H4 now, then you have two options.
1. Travel back to USA before Oct 1 on H4 and file COS again in USA which will cost you money approx around $1500.
2. Travel back to USA after Oct 1 on H1B, you need to get your H1B stamped in India for this.
This is what I know, recommend you to talk to your attorney on this. Hope this helps.

I spoke to them yesterday, they said the same thing about June end. I don’t know what they are doing. There should be a provision to track your application and whether it is accepted or rejected.
I don’t think they must be receiving anymore acceptances from USCIS anymore. But they have the upper hand more insight into the process, what can we do?

Any one from Persistent here? Our org said rather useless non-immig dept said that they will collect result for all and then annouce.
They shud announce it individually as and when get update since people are waiting for it.
This is my second year of wait, i work in a MNC and most of team mates got the reciept(RQ/RP/Vermont).
I hope everything is over now. Waiting for my package again.

Folks am from TCS, awaiting lottery results for the past two years. Internally the visa portal said ‘awaiting response from immigration office’ since March 2013 till Jan 2014. I was asked to cancel that application and redo this Feb 2014, it went to same state this year too, I guess I have to wait till next Jan to cancel it.
On top of this we have a freaking policy in TCS that every IT employee should be at level 1 (system engg) to get their visas applied, if you are promoted to level 2 or 3 (ITA, AST) then BANG, you can’t get your visa applied at any cost. So Ppl investing their career here in TCS for years have to just see new joinees travel onsite, coz TCS have to pay more to L2 candidates per LCA norms, in turn they get paid even for L1 and L2 by their client.
I myself worked several companies like CTS, WIPRO, IBM etc have abt 8yrs of experience in my core technology, joined TCS with this ‘visa promise’. I train new joinees within my project in TCS. Among which good looking chicks whom I train get their visas processed, they go onsite and control me as onsite leads. From my point of view candidates who are to be given visa are being given visa, there are no deviations, this lottery concept to me is just an eye wash. IT giants already settle the available visas within themselves in an auction or something and process applications for only to whom the project points.
I was recruited in L1 in an error and I was to be given L2 on the next month of my onboarding, but my project management pointed out that I am super skilled and have to board a rocket and leave onsite asap, so they wanted me to choose between visa or L2 promotion, fate wanted me to go mirage. I waited in same level for 1 year for being able to apply for a visa. Then for the past two years I was virtually tied with this visa chord whenever I went to ask for promotion, my salary would have easily crossed over the six digit mark each month, if I opted for my promotions atleast, blame me. All my home, marriage plans got drilled on a rotatory axis in a linear motion (screwed) due to this visa gamble.
We have an internal visa work flow in tcs that shows my petition is filled, no register number will be given to employees whatsoever. When I went to check my status with the visa team in tcs, I was told about 40k petitions are filled with USCIS from TCS. That was the best joke that my common sense ever witnessed, 40K X 325 USD = 13million USD (80 crore rupees approx) non-refundable out of which hardly 6k petitions will go through for TCS. So is TCS so very generous to apply petitions for all 40k applicants? They cant merely pay the L2 guys a few more dollars and reject their applications, inturn choose freshers to pay few pennies less.
Well I would take this lottery gamble sh*t at the least if it was genuine and wait for my luck. But in reality this lottery process helps IT giants to say “Hey, we have done all that we cud do, your petition was not selected in the lottery sweet heart, our a*s is clean, smell it yourself”
So folks don’t go by the internal visa work flow or lottery, it’s just a manipulated tool to apply toothpaste and brush your hope. Beleive in what Note: Not written with any frustration, but just a thought to see if anyone agrees to my point.

I know how u feel, tcs also applied for.me in 2008_ never stamped my visa, later in L2 never applied L1b saying there are rejections and again started applying h1b for freshers ….these bastards should learn the hard way….write your story to USCIS

Please internally this might be a case, but I believe if this has top be resolved we should get to know some ID by which we can know if it has been filed or not. God knows if it has been filed or not. If you are not satisfied keep moving out, dont wait and give more opportunities or devised strategies work for them.

Ask your employer to mail the notice of the receipt number. In that notice you can find your name, status and the receipt number.

Ask your employer for the receipt. Employers recive it from USCIS . It has your name, employer details, receipt number .

Hello All,
USCIS has finished data entry, which means following.
1. Data entry is done for selected candidates.
2. It has informed employers / attorneys about the results.
So that means now it is left to Attorneys and Employers to reply to candidates
about the results. Since the list is so huge hence there will be delays in sending the results. So please request your attorneys and employers to update you.
Please have faith and wait, we have waited so far why not for the last mile.
If you still have confusions go back to your immigration team.

Yes, you are selected in the lottery but you are selected in the lottery does not mean your H1 is approved. They will review your profile and gives their decision
for acceptance or denial. This may take 2 months

The last comment says “USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. ” This means the data entry has already been completed for the selected candidates and they have already got reply with receipt no. So who didn’t get any response yet from the USCIS, they have not been selected….
