USCIS News : H1B 2019 Lottery Completed – 190,098 Petitions Filed

The most awaited number by many, with tons of calculations using LCA numbers and other correlations on comments, etc. have come to an end. USCIS released a press note indicating that they have received 190,098 H1B petitions for FY 2019 quota. Below is the press release summary.

 Summary of USCIS H1B Lottery 2019 Competed 190K petitions filed :

  • USCIS completed Lottery for H1B Visa FY 2019 on April 11th.
  • Total H1B Petitions received for FY 2019 quota – 190,098
  • USCIS accepted petitions for 5 working days from April 2nd to April 6th and announced that they reached regular cap of 65,000 and Masters cap of 20,000 on April 6th.
  • USCIS will reject and return all petitions with their fee for all the H1B petitions not selected in H1B Lottery, provided they are not considered as duplicate petitions as per the new rule. Check Sample H1B Reject Letters for Not picked in Lottery
  • Lottery Process used for FY 2019 :  USCIS conducted H1B Lottery for Masters cap first and the unselected petitions form that pool became part of the regular quota lottery.
  • USCIS  will continue to accept H1B petitions that are cap exempt or the ones counted for the cap in the past that fall under the categories of H1B Extensions, H1B petition for Change of employment terms, H1B Transfers to new employers, and Concurrent filing of H1B for second H1B position.
  • Also, they gave split of number for Masters and Regular quota on their H1B 2019 page, which is new. Some people are confused on where we got these numbers, it is on the USCIS H1B 2019 Updates page . I have put a screenshot for your reference.

What are our Predictions vs.  USCIS actual numbers ?  
Many were speculating less numbers for H1B FY 2019 as there were many new rules, changes and the political climate was not that great in the past one year… Despite all of these, our H1B 2019 Lottery predictions were from 170,000 to 190,000 . USCIS actual numbers of 190,098 is very much close to our predictions… Though our predictions were not popular among many that we were forecasting more numbers…but, the reality is that there is tremendous demand as seen with numbers…Hope our lottery predictions helped at least some plan in one way or other.

What’s the take on press release ? What’s Next ? 
The press release is not very different from previous years. Also, the process of H1B Lottery is not different from previous years and is same. As we know from previous FOIA request, USCIS selects additional 5k for masters and 10k for regular quota considering denials…Also, this year, they updated the number of petitions filed for regular quota and masters quota. This was not published in the past.

Now that lottery is done, the waiting game begins for everyone. All of you, who have been selected will get a receipt notice and it has a number that you can use to trace your case on USCIS site. Read Understand H1B Case Number

It is sad that many smart, talented students and professionals from Ivy League Schools, IITs, Many good companies like Google, Microsoft and many more have to go through lottery putting all their hard work and effort for luck to decide in lottery…Its unfortunate, but that’s life and reality…If you get selected in lottery good, if not, take it as another part of life as it comes and move on…don’t put yourself under pressure thinking about it, it was not in your control and you have nothing to do about it…

  1. Has anybody gotten away with a small mistake in their LCA? My employer made a mistake of writing 101 as opposed to the actual address 201, which I found out after they submitted the application. I received the receipt on April 14 but have not heard anything after that. Wondering if I will get a RFE or would it just slip the crack

    My H1-B extn filed 4 months back ( receipt date 27-mar-2018) and its still in received state. Any idea how long they take to process the extension under normal processing ?

    • In case if your I94 is expired and waiting for the approval, then make sure it should be within 240 days from the date of you I94 expiry, other option you can ask employer to file a new petition under premium processing. Don’t wait till the last minute, these days getting approval is not easy.

    I got my receipt on May 10 but when I enter my WAC in the USCIS site to check my case status it says cannot recognize the receipt number entered. Has it happened to anyone?

    • you have to wait for 2 months. This is same for me as well. i checked with USCIS and internal immigration team. same answer.

        I have checked both the sites, “https://myaccount.uscis.dhs.gov/” site says my case is approved but “https://egov.uscis.gov/casestatus/landing.do” site says the case has been received.

        Do you know what is happening here? Also, do you know how long does it take to receive that approval notice once after it has been approved?

  6. My SEVP got updated on 4/27, my DSO denied to print a new i20 for Cap-Gap, I had to request a travel i20 and my DSO did actually print one and I see a receipt number. I reached out to my employer and attorney and there’s no sign of a receipt yet.

    ANy ideas what needs to be done?

    • wait for a week. May be some mail delay or missed out talk to your employer once the receipt number is seen in i20 . They can follow up with USCIS.

    • Unfortunately there is no stipulated time frame. They process cases in random manner. So stay positive and keep tracking your case! There is no definite answer/time frame.

  8. My case tracker through my company shows “Closed – Closed – Pending Adjudication ”
    Anyone knows what this means? Till this date I still have not received any type of communication from USCIS or my lawyer. Is all hope lost?

    • Same here..not sure if we should still hope as all of colleagues who had applied with me have their receipt numbers..

    • If you are working for an MNC, it is common that they delay in announcing the visa results. So check with your colleagues on this too. That will give u better idea.

    • If somebody received a reject notice and do not mind to share I really appriciate that. I will do the same when I receive mine. Knowing that USCIS starts to send reject notices help us to prepare a next plan in our life, I want to know what to do with my rent contract, for example, which is due until august first and I should advise my landlord one month in advance whether I will stay or not. thank you!

      • Ram, is this typical? My case was received on April 19th, Case tracker still shows that the case number is invalid. My only solace is the USCIS myaccount site which shows case received. Should I be worried?

    Can you share some insight on why USCIS may issue RFE for following scenarios. As per different forums, people have got this:

    1) CPT exceeding 12 months: First at first MS and then at EMBA.
    2) CPT + OPT exceeding 12 months: Everyone with one MS, CPT, OPT and STEM will have this extension.

  11. Hi All,

    I have recently received emails and text messages with status updates from USCIS about my previously approved (May 2017) EAD for OPT. The emails and text messages say things like “Your case ******** is now updated.” “There has been a recent processing action taken on your case” and more. They’ve also provided a USPS tracking number but the USPS tracking says “Label not yet created”.

    Does anyone have any idea what this means? Is it related to my H1B application at all? Is it a USCIS bug?

    Has anyone else experienced this?

      Hi Guys,

      Got an RFE stating I exceeded 12 months of CPT on same level. It states since I used 6 months during masters A and I am now using cpt for Executive MBA, I might have exceeded the 12 month CPT at the same level

      It is requesting for:
      Submit a detailed statement, along with supporting evidence to explain the periods of time the beneficiary was granted practical training at the same educational level.

      Any thoughts on how to approach this please and has anyone gotten this question before?

      • My Notice date is April 17 and I still haven’t received any update. There is nothing to be done from our end except to wait. USCIS has no definite approach about issuing approvals. Others input is not going to help your immigration process in anyway in this matter. Wait till end of September! Good Luck

    • It takes time for processing. Please be patient and keep tracking your case. Since all cases are in normal processing, there is no definite time frame for approval.

  13. I didn’t understand! If I dont land up with H1 then joining college is the only option I am left with. I plan to get CPT after 8 months and then move ahead on OPT.
    I am still waiting for H1 lottery results.

  16. Has anyone else on here received an RFE? My case status was updated to RFE. How long does it take them to mail it out? Any experiences to share? What if my case is denied after RFE?

    • It depends on what is in the RFE and how your lawyer responds to it. If your case is straightforward do not worry.
      If and when you petition is denied, you should plan ahead, some people like to stay in the US on a dependent visa, some joint a school other go to their home country.

      • Thanks.. Honestly, I am not sure of my case. I did an internship for a while and I don’t know how unpaid work will look on my file. My husband is here on H1 so I have to figure out how to stay with him. I have an MS and an MBA and a good career so its very hard to give all that up if I have to. Really worried about the proposed new rules and what it will mean for me if I need to use CPT.. I have all the information on hand, just worried.. I heard that lot of people got RFEs and denials after RFEs last year. Thankfully my company is willing to pay for everything and resolve the issues ASAP. If premium processing opens up, they said they will pay. I heard from someone that if it gets denied I don’t have to go through the cap again? Surely, that is not the case?

          • Sure, I did my MS in Biotech from Johns Hopkins, did an internship briefly (few months) then got married. I had some issues with finding a job and wanted to do an MBA so went back for my MBA from here too. Then work here. They applied for my H1 before I even started. My OPT ends soon.

    • Some times the RFEs are also regarding where you were staying and whether the place was rented etc. Someone I know got such request.

      It will help if you can update here as your case moves on. Without your attorney getting any “paper” notification regarding what the RFE is for, please don’t trouble yourself with random thoughts.

    • It means your file moved from one center to another. It’s done for load balancing. By law, USCIS is supposed to notify petitioner/attorney about any updated w.r.t to the case/file.

      “Additionally, USCIS may transfer some Form I-129 H-1B cap subject petitions between the Vermont Service Center and the California Service Center to balance the distribution of cap cases.   20. Unfortunately if your checks haven’t cleared by now, because data entry was completed, it’s high unlikely that you have been selected in the lottery.

    Non-AD, 2nd time for H1B application. No reject receipt received yet however attorney informed me that check hasn’t cleared after data entry was completed so I have given up!

    • Yeah same here! Could be an issue with the uscis website. They told me to wait for a month max and get back to them if the issue persists

  25. Does the SEVP portal get updated when your STEM OPT gets approved? I saw some entries by SEVIS in the history tab on Monday. Checked the status on ‘USCIS Case Status’ and it says card was mailed to me. Nothing really changed in the portal though.

    • Hi! I received a scanned copy of receipt from my lawyer yesterday afternoon. Non-AD STEM. No update on SEVP even though my OPT expires before Sep. So there might still be hope!

      • If you have not yet noticed..then people have started getting approvals already…I am just asking for feedback so that I can plan. Even a small thing takes weeks to get done in my firm, so I have to plan as soon as possible.FYI…I did the same even when I was waiting for my receipt(in case I don’t get picked)

        I have been through this phase..and I understand what you are going through..this system is frustrating and unfair. But, no one achieves anything by taking out your frustration on other people. So chill…if you don’t like someone’s comment/query/concern you always have the option of scrolling

  33. Day-1 CPT. I have heard mixed reviews about it everywhere. I don’t need to use it but recently one of my colleague believes he didn’t get picked in h1B after 3 tries as he hasn’t received anything yet. We wok for very large tech company and have a big name immigration company representing us. They gave him three options to continue employment:

    1- Enroll in Day-1 CPT schools. They will provide list of schools that give day-1 CPT upon enrollment. This coming from lawyer, certainly makes is feel like there may not be legal issues for folks who have to take this route.

    2- O1 Visa: Almost impossible to qualify.

    3- Go back to india or other country when employer has offices and work from there for 1 year and reapply for H1B.

    So what it feels like to me if a well reputed immigration company provides you with Day-1 CPT option and list of schools to target , there certainly can’t be much legal risk to go with this option. Please take your emotion out and respond with facts and provide evidence if you believe otherwise.

    • Option 3 is the safest. If you won’t share the name of the immigration firm or the very big tech company, noone can help you. Because the premise of your opinion is based on the fact that because the advice comes from a big company it must be plausible. You are a special kind of gandu.

      • As i said, I don’t need to use any of those options for next couple of years. Also, i asked to present argument with facts and evidence but you failed to do so and stoop down to name calling. You are just hopeless.

    • Have you stopped to consider that your interests and the company’s interests are different? They just want you to be able to work currently within the country for next 1 year, and do not care the complications that would arise from using Day 1 CPT going ahead.

      Even if you somehow do get selected and approved and stamped, there is always a chance that this H1b will be rescinded later by the USCIS. It will obviously negatively affect your H1b extensions and GC process, if it comes to that.

      So, think carefully about the differing motivations you two have. Consult an immigration attorney on your own and see what comes up.

      • Thanks I am not planning to pursue any of options in next couple of years. Best case is i get selected this year [tiny it of hope] or next. 🙂 But it’s always good to know and evaluate your options down the road. Do you know any case(s) or someone, where H1B was rejected purley down to applicant using day-1 CPT? I am just trying to find out if day-1 CPT is really bad for your future as immigrant.

        • If your company has a remote office, I would advise to work overseas for the next year and re apply. If thats a no, and you still don’t want to go to India no matter what you could choose the Day 1 CPT. One of my close friend started Day 1 CPT last year and his H1 was picked in lottery last month. I am not sure whats the outcome of his petition is going to be, but you could take a risk if thats what you want. I have also personally seen someone who studied in such college and getting into trouble during their H1 extension (ultimately got the visa). But I feel this program had always been a burden to people and with the new rules theres going to be additional scrutiny. Good Luck !!!

        • USCIS has pretty much made it clear that Day 1 CPT is illegal and people doing so are doing at a massive risk. It issued a new memo recently about ‘unlawful presence’ in the country as well, and there is a good chance working on Day 1 CPT falls under that.

          As far as your case is concerned, I would advise you to not get ahead of yourself. USCIS is planning on revamping F1 and OPT policies going ahead, so we don’t know what else could happen.

          • Other aspect to consider is what will happen in the future? The guidelines in the future might explicitly make Day1 CPT illegal or do not provide an H1B to such folks or something along those lines. The ones on Day1 CPT at that time might face more complications.

    • I saw my SEVP update on 4/27, but I haven’t receive any receipt yet, no update from Employer and DSO says he’s not obligated to share any information…it just makes me think if this update correlates to H1 being picked. 🙁

  35. Guys, Case approved today when checking status. So here is my time line-

    Apr 14 – SEVP status changed
    Apr 18 – Attorney confirmed that the case has been picked in lottrey
    Apr 23 – Got copy of receipt from mail
    May 16- Case got approved as per online status.

    Still waiting for approval documents.

    AD/CA/3rd attempt – L2 wage and non- IT field.

    Quick question. Do both my employer and my lawyer receive a receipt notice? Or is it only my employer?

    I’m worried my employer will overlook the receipt as something normal and not notify me. He can be a bit forgetful…

  37. I am Non-AD. Last week(05/07/2018) I got my receipt notice (dated: 04/12/2018) from Attorney. I was checking my case from that day , it is showing as “Case was received”. My Attorney told me on this monday 05/14 my petition got approved (He will not share me the approval notice now itself). I was really surprised that it got approved with in a month. But when I check the case status online it is still showing as “Case was received”. I couldn’t cross question him. But does the case status tool of USCIS will not have updated status ? when can I expect the status reflected in case status portal ?

      even lca doesn’t show my name anywhere in that document.
