USCIS : 172,500 Petitions received for H1B 2015 Lottery. Selection Complete !

As you know, USCIS announced on April 7th that they received enough number of petitions for filling the H1B Visa statutory cap for the fiscal year 2015. Also, they indicated that there were more petitions received and there would be lottery/ random selection process for the same. Today USCIS did an official press release stating the count of petitions received and process used. The below article focuses on the same.

Summary of USCIS Press Release : 172,500 Petitions Received

  • USCIS received about 172,500 petitions towards the H1B Visa 2015 Cap.  They received more than 20,000 petitions filed towards the Masters quota cap.
  • Computer generated random selection/ Lottery was conducted by USCIS on the total H1B petitions received until April 7th.
  • Lottery/ Random Selection Process :
    • Computer Generated Random Selection process was used to execute lottery.( No need to worry about human process that can raise doubts )
    • USCIS conducted lottery for Advanced Degree/ Masters degree quota petitions and selected 20,000 from them towards the Masters degree cap completion.
    • The H1B petitions that were filed under master’s quota cap, but not selected in the first round of lottery were added to the regular quota lottery pool of petitions.
    • Lottery was conducted with the above combined pool to select 65,000 petitions towards the Regular quota cap completion.
    • USCIS will reject and return the H1B petitions with the filing fees that were not selected in the above lottery process ( No loss to the employer, only Attorney fees ), that were not found as duplicate. If duplicate, your money will not be returned !
    • USCIS will begin premium processing of the H1B Petitions no later than April 28th ( it means that they could be process early as well )
    •  USCIS will continue to accept petitions that do not fall under H1B Cap, especially petitions that fall under below
      • H1B Visa Extensions
      • Petitions that were filed towards changes in terms of employment
      • Employer change H1B petitions
      • Second H1B petitions for concurrent working of an employee
      • Petitions that are filed by Educational and research institutions

    A question for everyone who might know the answer. My school told me there is the cap-gap employment authorization and physical presence in the U.S. has been extended through 9/30/2014, with a pending Change of Status. But my lawyer said she cannot confirm anything because she has not got the receipt number yet. Does that mean I am selected in the lottery?

    I am an AD/PP/Vermont applicant. Thanks a lot and best of luck to everyone here still waiting!

      It is safe to assume you have made through the lottery based on your SEVIS update. Your attorney should receive the receipt number soon. Some PP cases have informed about receiving paper receipts instead of email receipt. That could add to the delay.


    OK, guys, you need MORE patience !!! Last year i filed under Reg/non-pp and didn’t get any news until 4/30! before that, no changed status on SEVIS, no check showed cleared! and it took almost a week sent from VSC to my lawyer’s office ! and some of my friends didn’t get their physical receipts until mid-May.
    Most of you guys will be fine! Cross fingers for you!

    Received an email for my case today.

    Non-AD/Premium Processing/California Centre.

    Apparently it was entered in the system yesterday.

    “On April 14, 2014, we received this I129 PETITION FOR A NONIMMIGRANT WORKER and we e-mailed you a notice describing how we will process your case.”

          Did you get notice from the lawyer prior to update in the tracker?

    So basically from what I’ve read in the past comments, the only cases that have gotten their answers are PP. As a non premium applicant I am still waiting and stressing as to I will get it or not.

    If any non PP has gotten their answers please let us know ASAP so I can stress some more 🙂

    the forum is not virtually divided into 2kinds of people: who have received their receipts and people who are waiting. for ones who have received theirs should stop gloating and start praying for the ones who have not yet got it. for people are still still waiting, please dont throw stones at body shoppers and multiple filers. I am not from body shoppers or multiple filers but just a Reg/Non PP.

    people want the best to come to them and are ready to take up doing anything. paying, forging etc. just pray for yourself and keep hopes high.

    I have applied – AD/PP/VT . No response yet. Almost all my friends have already received the electronic receipt from attorney. Just worried if it’s the time to give up hope. Or could it take longer?

    Date Received: 04/10/2014

    The California Service Center will adjudicate this case within
    15 calendar days of the “received date” set forth above.
    If approved, you will receive e-mail notification of such.
    If we require additional evidence, we will fax said request
    to the fax number provided on your completed I-907 Request
    for Premium Processing Form.

    This means, all premium processing cases selected in the lottery, are already in the process. USCIS is not going to wait till 28th of April to start the processing.

    I got a confirmation from my attorney that they received physical copy of reciept for my application today morning. However, they did not receive any email about my case. They still have not shared the receipt number with me so I do not know the validity of their confirmation.

    My petition was filed for AD/PP/VSC.

    I checked with my DSO and they said that there is a pending COS on my SEVIS but no receipt number for reference from USCIS. The pending COS notification on my SEVIS is showing up as of today morning.

    Does this mean that I was selected?

    Dear All,
    I received my number today. I am not interested in the employer who filed my H1B and want to transfer H1B for a different employer.

    Do I need to get stamping from the employer who filed my H1B?

    Any suggestion?

      Case 1. If you are outside usa – You need to get stamping on the petition approved by your filing H1B employer.
      Case 2. If you are in usa – No need for stamping .
      You need a valid petition from second employer in either case if you want to work for them.

    Hi guys,
    I just received an email from my employer saying that they got the notification email for Regular Cap- Vermont Service Center- Premium Processing. The date received was 4/10/2014 and the 15 days will start counting from that date.
    However on USCIS’s website the case status is not updated yet.

      It will get updated on Tuesday evening or Friday evening(EST), normally USCIS update twice in week but depends on the volume of case.

    As of now I didn’t hear anything from my employer about H1B lottery results… how many days i need to wait??? As per the discussion with employer by 15th April will get the H1B lottery result.

      it takes a while before attorneys can notify employers. and employers notify applicants. please be patient as attorneys choose to bundle up applications before mailing companies and applicants. keep praying and wishing for the best.

    It is early to say but I believe that USCIS has not received too many AD petitions over the 20,000 cap. It might be 23K to 28K just a guess based on what I have seen.

    If you are AD just hang in there you will hear good news.

    Got the confirmation email from fragomen attorney. He said they dont share the receipt number with the employee .
    Mine was AD/PP/vermont.
    Last couple of days felt like a couple of years. Good luck to everyone.

      That is not sure. I am with the same lawyers but dc office and gabe that info to me. Many other got. Check with your employer. They will be able to help you get that info.

    My wife got it approved PP/AD California. Few of her office colleges who had applied H1 also got it (all of them), all were AD. I strongly feel that acceptance rate of Masters cap(AD) is very high, say more than 90%. Even last year also it was very high.

    if you check H1B wiki on facebook, you will find out that a lot of regular processing people have gotten their receipts from VT – does this means there is no chance for PP anymore?? pls people, if you got your receipt with EAT under PP tomorrow – post the date your lawyer received it, not when he fw it – so that we will know if you still have a chance or not

      I doubt the validity of that data. Are you referring to the poll result? Remember, I can vote on any option even if I am not applying in the cap. PP cases are still going out and based on historical data, non-PP cases should start in another couple of weeks.

    Oh my god, I DID NOT get any email from Fragomen SF office yet.

    But I just checked the IHP site and I see NIV Receipt # !!!!!!!

        Fragomen sent me activation key automatically. You definitely need it in order to complete Questionnaire. Not sure how come you don’t have access to IHP website.

        Also then I emailed Fragomen office to confirm that I got selected, I got “Out-of-office” reply. Ha ha, these guys went on vacation right when we all waiting for theirs emails. My notice says that USCIS emailed on April 11th !!! And only today I saw my IHP upated, and still Fragomen didn’t email me official update.

          I did fill the questionnaire which my HR sent me. However, never received the activation code for the IHP site. I will have to inquire with Fragomen. Lucky you 🙂

            laywers at Fragomen have been extremely casual bout these things…… when asked if we received the receipt or not…. they blankly asked us not to mail for knowing the status….. this was rude and cold.

      You can send your petition to any processing center.
      Vermont or California doesn’t matter.
      But as per USCIS atlanta comes under Vermont center

    What if only premium cases are picked in lottery…..will it nt be beneficial for……I don’t know whom…bt think each case 1225 $ if atleast 66000 or 70000 pp gt selected in lottery…then how much money earned with just getting some application done quickly

    please answer this question guys. I am AD/PP/VT do I still stand a chance, or is it zero chance? i haven’t heard anything. Also, do they email me if selected, or the lawyer gets an email, and then he forwards to me?

      Hey dude, don’t wory, somebody posted a while ago , that last year it took almost more than 2 months for some people to receive their receipts, so don’t assume that you are unlucky untill you get the letter saying so. Best luck 🙂

        Just to put you at ease. I got my approval notice from my lawyer around the 29th of April. So I guess you can relax right now. There are atleast 2-3 more weeks for you to recieve your petition number,

      I talked to my attorney, she said, they are processing about 4 to 5 thousand cases every day. It will be a long process, so no need to worry. Premium processing got nothing to do with lottery. So do not worry. She also mentioned that there is a high chance that this year a lot of people have applied PP, but do not overthink people, I am sure our day is coming soon. Good luck to everyone. If all of you are worried about this, think about my situation, I have three family members (I and my siblings) going through this, this year and not sure if all three of us will get. SO chill and whatever happens, happens for the best. Good luck to everyone. I totally agree with blessed (just below ), it can take upto 2 months.
