What is the H1B Visa 2019 season start date ?
Update : USCIS will start accepting H1B Petitions starting from April 2nd, 2018 as per their official update on their website. In general, USCIS starts accepting applications for the next fiscal year exactly 6 months before the start of the next fiscal year. USCIS fiscal year for 2019 starts from 1st October 2018, which means they should accept applications for FY 2019 from April 1st, 2018. As April 1st is a Sunday, USCIS should accept applications for H1B 2019 season from April 2nd, 2019.

What is H1B visa 2019 Quota for Regular and Masters filings ?
As of the date of writing of article, the H1B quota is as below. This is also called the H1B Visa Cap. You can read more at What is H1B Cap ? Regular vs Masters quota ?

  • H1B Regular Quota : 65,000 visas
  • H1B Master’s Quota : 20,000 visas. ( only US Masters eligible)

Also, of the overall 85,000 visa cap, every year 6,800 visas are set aside for the citizens of Singapore and Chile as part of the Free Trade Agreement with them. There were few bills part of Comprehensive Immigration Reform that are not active in Senate that were proposed from Obama administration days to change the cap count to 110,000 and Masters to 25,000, including potential to make H1B cap extend up to 180,000. But nothing has moved and all are dormant. Nothing new has been proposed by the new Trump Administration regarding changing cap count. Will there be Lottery for H1B 2019 season ? Lottery Predictions ? Filing Numbers ?
Update : USCIS had lottery for FY 2019 quota and received 190,098 petitions.

When is H1B Visa 2019 Lottery Date ? 
Update : USCIS Conducted Lottery for FY 2019 on April 11, 2018.
There are two things, one is when the H1B petitions are accepted for the lottery and second is when the actual lottery is done. H1B visa petitions for next fiscal year would be accepted by USCIS from April 2nd, 2018 for 5 working days until April 6th, 2018 to be part of the lottery. Now, the actual lottery date depends on various factors depending the volume of petitions and USCIS load. It can be anywhere in second week of April. For FY 2018, the actual H1B Lottery was done on April 11th, 2017 . We can expect anywhere around the same date like April 11th or April 13th.

How to find H1B visa 2019 Sponsors ? 
It can be very hard to find a good employer and convince them to sponsor H1B to work in US with major unknown like H1B Visa lottery. Anyways, you would be in one of the three scenarios, if you are seeking a H1B Sponsor. 

  • F1 Student in US : You can find an internship or co-op at an employer who can sponsor H1B visa and ask them to sponsor your H1B. You can continue to work on OPT once you graduate as well. You find the list of H1B Sponsoring companies using the tool
  • International Professionals  : If you are outside of US, it can be tricky with all the latest rules by Trump administration. Your best bet is to find an multi-national company ( MNC) and work through them to sponsor H1B visa. You may have hurdles inside the company with all the internal process, many waiting, etc. But, it is up to you to negotiate and ask them to take a chance. Many try the IT body shop route, where they ask them to file H1B. Rules have changed in the last few years and it is very risky move and can jeopardize your US hopes. What is H1B 2019 Filing Fee ? 
H1B visa petition filing involves USCIS fee towards certain things and attorney fees, which varies by company size, and attorney involved for the case.  As of FY 2018 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee.  In year 2016, for FY 2018, the H1B base filing fees, increased from  $325 to $460.     I applied for premium and it was received and status was changed on feb4th and we still did not get any decision. My attorney did contact USCIS, all we got is that the case is still under review.

    Anyone in the same boat. ? what else can we do ?

    This is the timeline in my case.

    1. My case received an RFE and the law firm handling the case started preparing a response
    2. My employer upgraded the case to premium processing and a receipt notice for PP was received.
    3. I found out that the law firm has not yet send the RFE response!

    If the case comes up for review before the RFE response is received. Is there a chance of rejection?

  4. Hi Admin, I am currently on h4 status which expires by mid of march. My H1b petition filed last year is still pending with USCIS and am waiting for my decision. Now if I file for an H4 extension, will this effect my H1 decision? In case, i get my H1- b approved before my h4 extension is processed, will my h1 status be updated with H4? Please help me understand this as I dont want to run out of status or jeopardize my H1 application in anyway.

    Can someone please help me clarify?

    I have H1B from a consulting company who had told me that he will arrange projects once I landed. I came here to US on December but my employer is NOT at all helping to get job. He is asking me to apply everywhere & get a job. He will only take 30% of my salary.

    I am getting calls and most of the time the respective company wants to transfer the Visa under their company. My question is,
    If I transfer visa to another company,
    1) How long usually takes to transfer visa to another company? Any option to premium & change within two weeks?
    2) Will my current employer come to know by any chance?
    3) If yes, is there any chance he can screw up my visa (like cancel or etc etc)?
    4) If my current employer will not come to know &, if visa transfer with new employer is somehow rejected, I can still continue H1B with current employer, right?

    Please help.

    Note: He has not provided flight charge & accomodation too. 🙁

    • 1. Currently, premium processing not open for transfers.
      2. Not really, USCIS does not inform anything. It is a technically new petition with new employer.
      4. Yes, as long as you are maintaining status with your current employer.

      You need to be very careful about maintaining your H1B status, when you are in US. You need to be paid and be working to be in proper status…

    Couple of days back my H1B Visa got approved and issued.

    Few questions..

    1) Actually LCA was filled NEWYORK but should i go and work TAMPA, amendment is required ?

    2) After travelling to us, with in how many days we can do H1B Transfer ?

    • 1. Yes up course.

      2. Any time. But if you have couple of (or more) paychecks or any documentation that establishes that during your stay at US you did maintained the status then that will be fine.

    My case was hit with RFE in Jan-2019
    RFE response has been sent and the case will soon be upgraded to Premium Processing.
    I am hoping to get an adjudication by 1st week of March.
    If there is a denial my employer will have to file a new petition for CAP 2020 cycle.

    My question is, does a new LCA have to be filed to prepare for this year’s filing?
    Does any other supporting document from the previous filing have to change?

    • Nothing. But if the two are related in some way (like sister companies, or same middle or end client) then you may receive RFE and denial. If both are entirely diff companies, like Google and Microsoft then nothing will happen. Each petition meets all the necessary checks of USCIS then you will get two approval. After that it’s up to you to accept and reject one or other. But it is recommended to inform the other one if you are not joining.

      Having said that last year some people reported that even if the two companies are not related (mainly staffing companies) they have issued with RFE to explain how these two are not related.

      Keep in mind that it is entirely legal to file two H1’s with two different companies but if it is morally/ethically correct is debatable and up to the individual. Also, I would urge you caution if you are planning to pay for the application because as per law that is not allowed.

      May be they are taking long time to compose 10 pages of denial notice by end of 15th day it will be Case denied 🙁

  9. I got my H1-B stamped. However currently I am in notice period, and will be joining a new employer soon. So Admin could you please let me know if I can transfer my H1-B to new employer ?

        • Yes. But one caveat is if the new employer files a transfer then it will get same scrutiny as a new petition. Meaning, the new employer needs to establish that (a) the job they offering is falls under specialty occupation, (b) they are not able to find US workforce after searching reasonable amount of time, (c) they are offering same salary (or more) as per Department of Labor metrics (wage level) and finally (d) the beneficiary (you) posses the specialty skills acquired through education, or experience or combination of both.

          My understanding is that USCIS will check the application in that order, i.e, even if the beneficiary has a PhD with 0 years of exp but the job is not falls under specialty occupation then the petition will be issued with RFE or denial.

          The only advantage you have is you can claim 6 years of your already approved petition without go through lottery and travel to US with the new employer(s).

            No.

            (2) FYI, mine is approved for 3 years, and not 6 years.
            Yes. Maximum period of authorization is 3 years at a given time. It may be less too. But the max is 3 years followed by 3 years of extension. if the extension is approved after 3 years then again you no need to go for a visa interview if you continue to stay in US. However you need to go for a visa stamping once you travel outside after 3 years.

  10. I need an information regarding client change post RFE.

    My petition was filed on April 2018 for new H1b with details of Client A. I got RFE in January this year and Client A doesnt have any requirement now. So can my company respond to the RFE with New Client details which is more than 50 miles away from Client A??
    Any help on this is much appreciated

    • My understanding is that is not allowed as per USCIS guidelines for first-time petitions. If it is an extension or amendment then you can simply file the second petition and withdraw the first. So, Just follow what your immigration lawyer is telling. Good luck and all the best for your approval.

  13. After 8 months of inactivity my case received an RFE in January.
    RFE response was sent this week.

    Can any of you comment about how long it took for USCIS to approve the case after the RFE response?

    • It depends. Some of them reported that they have received a second communication (approval or denial) within a week or two. But as per USCIS guidelines they will try to adjudicate within 2 months. if you are desperate then you may try for premium which is recently allowed for 2019 petitions (new) filed in last April 2018.   14. My H1B COS (from f1) got approved few days back. I am planning to change the company.
    1) Would that be okay if I change the company and initiate the transfer process without going to India for stamping.
    2) And also what will happen if start working for the new company as soon as the h1b transfer process has been initiated and gets rejected?

    • 1. Yes

      2. Then you could go back to the original company who filed the petition if they haven’t withdrawn the petition and willing to rehire you. If it is already withdrawn then I believe you will get 60days window to get new jobs and transfer again.

      At that point, you should consult with an experienced lawyer to because nowadays USCIS comes with diff ways of interpreting the out of status argument. Also, other main things to consider is during this time you should make sure that your i-94 is still valid.

  16. I am working for a client from Offshore and they are starting one project for which they have asked me to travel for atleast 6 months but to do that I have to go for an ammendment which it self would take atleast 6 months as premium is suspended.

    I am working from offshore for that new project but I have to work late night for the execution, life has become full of stress and no visibility of premium to get open even by 19th of Feb.

    This is loss to everyone, my clients loss ( as they can hire anyone for 6 months and as I am already working with them from last 5 years so know about the systems), us govt. Is losing taxes, my company losing revenue,

    People like me who have no plans to migrate to USA and have only business interest, they can come up with the option of taking affidavit regarding if the person has any intentions to migrate to USA. In case the person says no ,they should give him premium

    Just sharing s thought as no interest to leave my country and settle in USA.

    My extension is approved till Aug 2021.

    I am planning to go for Stamping by May 2019.
    My passport validity is till Aug 2020.

    If I go for stamping now, will they give VISA stamped till Aug 2021 or they will give only till passport Expiry Date(08/2020) ??

    Please help out.

    I can not renew my passport now, as Passport Expiry date is more than 1 year.

    • I think you will get the visa until Aug 2021 but an i-94 will be up to the passport expiry date. So, once you enter the US with new visa then you may get the new passport. With the new passport and old passport with visa you can get the new i-94 once you go out of the country (like Canada) and come back.

  18. My H1b got approved last week but my attorney said that she has not received the i797 and the approval notice for the same. Any idea what could be the reason and how long does it take to receive one.

    • It would take at least two weeks to four weeks. If you are not received after a month then you may request USCIS to send the copy the approval. If you request before 30 days then USCIS will not respond.

    Scenario: H4 to H1b (COS) approved in 2018 and working in USA without H1 stamping.
    I have converted from H4 to H1 and working in US for more than 1 year without stamping for emp A. New location amendment in progress with USCIS. Planing to go india and Join in Emp B. I have filled my tax for 2018 now.
    1.Can my H1b transfer initiated in india by emp B after i join there ?
    2.am i eligible for cap exempt filling by emp B ?
    3. what are the document emp b require to file under cap exempt ? I have only 797 copies not COS documents.
    4. any other important points to be considered.

      Yes.

      That’s enough. But it is better to keep all the paychecks, W2 etc in case USCIS ask for status related documents.

      4. any other important points to be considered.
      Since you are not stamped you need to wait the approval for Employer B. At this point there is no premium for transfer cases. So, that means it would take at least 2 to 6 months to get the transfer approval.

    Can anyone throw some light on the « progressive work » concept ? In the case we are using experience to prove equivalency of a foreign diploma : the 3 years of work = 1 year of study thing.

    • It is hard to prove that the equivalent of experience to 1 year degree. Any additional years of experience has some advantageous but if the job requires only 2 years exp and one petition has exactly 2 years exp and other has 10 years then the USCIS treats both the petition same. Similarly if the job requires 4 years deg it is very hard to prove that 4 years of work exp is equivalent to 1 years of education if you only have 3 year degree.

  22. H1B RFE rejected for 3 candidates for below reasons:

    For #2 CIS claims that all the evidence we provided from many other companies that have the same requirement as XXXX company, wasn’t really from similar companies. They are saying that Cisco, VMware, Capgemeni, NTT Data, Citrix, and L&T Technology are not similar to XXXX company.

    For #3 CIS claims that the diplomas and paystubs, along with a list of employees’ titles, of 80 other Technical Leaders, are not evidence that XXXX company normally requires at least a Bachelor’s degree in a specific field. We also submitted a job posting that XXXX company put online showing that it normally requires a specific Bachelor’s degree for Technical Leaders. But CIS totally ignored this evidence.

    For #4 CIS says it doesn’t appear from the very detailed job description that this position is any different from a typical CSA position so it doesn’t meet the requirement. It ignored the evidence of the type of work a TL does.

  24. Hi, I have H1B and working for a client here. My job is in first shift (6AM to 2PM). I see some job postings for part time. While I am working for a client for full time, can I work for another client for part time (4 hours)? Is it legal or Illegal?

    • It is illegal. you need to get additional H1 for that specific company if you want to work. H1 at any given time tied to particular company. Very rarely it is approved for two company’s concurrently but the total number of hours should not exceed 40hrs/week.

  25. Hi Kumar,

    I have an urgent question. I got my H1B visa approved on 13th Dec 2018 with company B as Change of status. I was working as a permanent employee with company A on L2 visa. Attorney told that I can continue with old company for 60 days after H1B is approved. After 60 days I have to compulsorily be on H1B visa otherwise it has to be withdrawn.

    I will join company B on H1B, 60 days after approval due to some unavoidable reasons.
    Do you see any issue with this for filing of H1B amendment or H1B transfer in future?

    • “Attorney told that I can continue with old company for 60 days after H1B is approved”. I am not sure that is correct. If your visa is approved as COS then the date they approved you are in H1. So, my suggestion is take an appointment with an experienced immigration attorney and get their opinion. Don’t take chances because in future USCIS reject the petition just for simple reasons.

    • It is not allowed for any “material change” before approving the new petition. So, it is better to check with an immigration attorney and follow their instructions.

    My H1B got picked in the Masters’ quota last year and here are the details

    -> Full Time Employee – Software Developer
    -> RFE Received – Sept 12th, 2018
    -> Had to travel back to India on Oct 20th and returned back in December due to an emergency when H1B was still pending.
    -> RFE Response submitted on – Dec 7th, 2018
    -> Received an email from a university on Jan 12th that my Change of status has been approved and my F1 Visa and sevis have been archived.
    -> Attorney Informed today that my approval notice has arrived.

    Now the question is should I go back to India for stamping in order to activate my visa? My F1 visa has been archived already. What if I go to Canada for stamping? My colleagues and friends suggesting me not to go to Canada since there are chances I might get 221G and would be forced to extend my stay in Canada until I get further notice and I cannot enter USA as I will not be having F1 or H1B

    I am sure this question would have been asked earlier. But please help me here.
    My Visa for H1B 2018 Cap had RFE for which my company has already responded. So the current status is “Response to RFE is received”. But I am uncertain on how long they would take to work on my case again.

    Given the uncertainty in the timelines can I go ahead and apply for H1B Cap 2019 as well? Will there be any problem with this?
    If my Visa gets approved (hopefully), company will withdraw the petition.

    I understand premium processing is open and I am trying to buy out the premium for my petition from my company. Again I am not sure if company would want to spend extra $1400.

    • If you are trying to apply from the same company then it would cost at least $5K or more depending on the company. So, it is better to g for premium and also keep the new petition ready. In case it (2019) is denied then you can apply for 2020 petition with confidence. You should get the result (approval or denial) within month if you upgrade to premium. Yes, you are allowed to pay from your pocket if you want to speed things up in case your employer is not willing to pay the premium fee.

    • It is your employer / lawyer that will receive the RFE detail letter, not you. Then, they will it share with you or not depending on if they need actions from your side ! Good luck 🙂

  32. Guys, What is the percent of 2019 lottery select cases which are still waiting for the first response and case shows as received ?
    All the cases which received response, i heard are 99 percent RFE . How long will this wait continue?

  35. What to do if you have two petitions one petition is pending but i already decided to take the other petition since i was already able to get my visa stamped from the second? Will the other petition be automatically denied?

    • No, it is not automatically denied. If you do not join, nothing will happen. Your other employer may withdraw the H1B, that’s about it. It wont impact your accepted H1B.

    As the premium processing coming back on Monday, Is it worth upgrading?

    Or it has the risk of getting another RFE?

    • Well, upgrading to premium does not mean you will get RFE, it all depends on the case. If there is a need for you to upgrade, go for it. It seems a normal RFE, you may upgrade and should not have any issues. Discuss with your attorney and then take a decision.

    I’m from CTS. Got picked in lottery 2018. I know around 20 people in CTS. All got RFE on Jan 17,18 and Jan 24. I guess USCIS is issuing RFE for almost all the cases. Usually they will issue RFE for Client letter or SOW but this time they are requesting only for Educational documents and Passport scanned copies. I doubt if our supervisors will informed separately to submit SOW, Client letter and MSA.

    Let’s hope for the best.

    • As they will not let us know the exact reason. they will collect all the information from us from the scratch.

      That is what is happening now. Passport / Edu details / Client letter / sow / Mgr letter.. etc.
