What is the H1B Visa 2019 season start date ?
Update : USCIS will start accepting H1B Petitions starting from April 2nd, 2018 as per their official update on their website. In general, USCIS starts accepting applications for the next fiscal year exactly 6 months before the start of the next fiscal year. USCIS fiscal year for 2019 starts from 1st October 2018, which means they should accept applications for FY 2019 from April 1st, 2018. As April 1st is a Sunday, USCIS should accept applications for H1B 2019 season from April 2nd, 2019.

What is H1B visa 2019 Quota for Regular and Masters filings ?
As of the date of writing of article, the H1B quota is as below. This is also called the H1B Visa Cap. You can read more at What is H1B Cap ? Regular vs Masters quota ?

  • H1B Regular Quota : 65,000 visas
  • H1B Master’s Quota : 20,000 visas. ( only US Masters eligible)

Also, of the overall 85,000 visa cap, every year 6,800 visas are set aside for the citizens of Singapore and Chile as part of the Free Trade Agreement with them. There were few bills part of Comprehensive Immigration Reform that are not active in Senate that were proposed from Obama administration days to change the cap count to 110,000 and Masters to 25,000, including potential to make H1B cap extend up to 180,000. But nothing has moved and all are dormant. Nothing new has been proposed by the new Trump Administration regarding changing cap count. Will there be Lottery for H1B 2019 season ? Lottery Predictions ? Filing Numbers ?
Update : USCIS had lottery for FY 2019 quota and received 190,098 petitions.

When is H1B Visa 2019 Lottery Date ? 
Update : USCIS Conducted Lottery for FY 2019 on April 11, 2018.
There are two things, one is when the H1B petitions are accepted for the lottery and second is when the actual lottery is done. H1B visa petitions for next fiscal year would be accepted by USCIS from April 2nd, 2018 for 5 working days until April 6th, 2018 to be part of the lottery. Now, the actual lottery date depends on various factors depending the volume of petitions and USCIS load. It can be anywhere in second week of April. For FY 2018, the actual H1B Lottery was done on April 11th, 2017 . We can expect anywhere around the same date like April 11th or April 13th.

How to find H1B visa 2019 Sponsors ? 
It can be very hard to find a good employer and convince them to sponsor H1B to work in US with major unknown like H1B Visa lottery. Anyways, you would be in one of the three scenarios, if you are seeking a H1B Sponsor. 

  • F1 Student in US : You can find an internship or co-op at an employer who can sponsor H1B visa and ask them to sponsor your H1B. You can continue to work on OPT once you graduate as well. You find the list of H1B Sponsoring companies using the tool
  • International Professionals  : If you are outside of US, it can be tricky with all the latest rules by Trump administration. Your best bet is to find an multi-national company ( MNC) and work through them to sponsor H1B visa. You may have hurdles inside the company with all the internal process, many waiting, etc. But, it is up to you to negotiate and ask them to take a chance. Many try the IT body shop route, where they ask them to file H1B. Rules have changed in the last few years and it is very risky move and can jeopardize your US hopes. What is H1B 2019 Filing Fee ? 
H1B visa petition filing involves USCIS fee towards certain things and attorney fees, which varies by company size, and attorney involved for the case.  As of FY 2018 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee.  In year 2016, for FY 2018, the H1B base filing fees, increased from  $325 to $460.   2. My employer is ‘A’. Then there are layers ‘B’, ‘C’, ‘D’ and then the Client. I got RFE of Employer-Employee relationship. We got MSA and PO between my employer and ‘B’. We also got a letter from them mentioning my employer and ‘B’ has a contract. Layer ‘C’ also provided a letter that says it has contract with ‘D’. We got MSA and PO between ‘C’ and ‘D’. I couldn’t get MSA and PO between ‘B’ and ‘C’. ‘B’ company said they will provide a snapshot saying that they are working with ‘C’ and ‘C’ is a supplier for ‘D’. I also got the Client letter that says they are working with ‘D’. Is this enough to prove employer-employee relationship.

  3. Finally received RFE…Non AD.

    The RFE is about
    1.) Providing the detailed Job Description at onsite with percentage break up.
    2.) Degree evaluation from an expert (Mechanical, 12 years of IT experience from all big IT companies)

    I am preparing the docs but the worst part is I have to wait for another 4 months/

      Everyyear by oct end will get some info about our cases either rfe or approval or denial this year due to new rules it may extend to december i guess.

  7. My H1 receive RFE intent to deny coz of multiple name in three application.

    But USCIS asking RFE question like – ‘prove all three employer are not related’.
    How we can prove this ?

    Should all 3 send separate or together ? I ask 1 emplyer to revoke but I want at least two application to forward next step for better approval chance .

    Anyone else in same situation with multiple filings ? What employer will respond ? I am very tense.

    I am thinking Day 1 CPT to kepp status alive. Please helo. Help with inputs.

    • we’re sort of in the same shoes. i received REF notice of Intent to deny as well due to having two applications picked in the lottery. this happened because my premium petition was sent in before premium processing was suspended. my lawyers sent in another application under regular processing thinking that USCIS will disregard the first and return it. USCIS instead put both applications in and both were picked in the lottery. now i have an RFE NOID and the lawyers have responded noting that under USCIS guidelines, applications received under premium processing when premium processing is suspended will be rejected. USCIS has confirmed receiving the response to their RFE and we’re still waiting for a decision. in the meantime, i will be departing the country to await a decision as my work authorization expired on september 30th.

    • What is use of creating multiple accounts??? They are not updating periodically and few ppl case got approved but in the web site, they didn’t updated the right status..

    • Not sure, if that is possible…it is usually tied to the user account I believe. Just look at it, your employer can track your case and you also can track your case right ?

    One of my colleague finally got the approval after the RFE but we just found some discrepancy in it as follows:
    1. Colleague 1 got the RFE, replied to it and then got the approval. But in approval letter I797-A the receipt number is different that the earlier times. Is this normal/possible.
    2. Colleague 2 who never received any receipt at all suddenly gets the approval letter one day apart, but the twist being he gets the approval with the same receipt number as my Colleague 1.
    3. so basically C2 got assigned C1 exact receipt number. Is this possible. Both work for same direct hire company.

    Very confusing. Thanks for all the answers in advance.

    • It is really confusing to hear that. Usually, receipt numbers do not change. Check with the attorney and follow up with USCIS, if something is a mistake.

  12. Hi Kumar,

    I’m working with reputed US client in CA( employer-vendor-client model) and visited India for family emergency. I had H1b visa stamping interview yesterday at Chennai and got 221g(yellow) asking about employer details, client letter and some more. and told to send those details via email.
    My passport and i797 were returned back.
    Now i’m confused what to do with this situation.

    1. Can i travel to US on H4( my previous status was H4 then converted to H1 and worked for 3 years and got H1b extension for 3 years, this is 5th year of H1b) ?

    2. If i come back to US on H4 , what happens to my H1b 221g status?

    3. If 221g is cleared after i come back to US on H4, do i need to go back to India for stamping or i can resume working with same client?

    4. If 221g is not cleared then can i apply with other client in change of status? in that case also do i need to travel back for stamping?

    5. Generally how long it takes to clear 221g when we have to respond only via email? they told me not to send physical documents.

    Please guide me how do i go ahead? Your advice will be helpful

    • 1. You may travel to US on H4, if you have valid H4 visa. But, you cannot work.
      2. Well, if you do not respond, nothing happens as you have your passport.
      3,4 : It all depends on, if you choose to respond. You may ignore it and it will expire Your form should say that it may expire after certain period of time. You can discuss with an attorney on the options like doing COS once you are back in US from H4 to H1.
      5. It is hard to tell, sometimes days, or week or months…
      I suggest you speak to your attorney and discuss all options at your hand and then take an informed decision.

My post completion OPT expired on 30th sept 18.My H1B is still pending.My SEVP is locked and my DSO is unable to unlock the same.But DHS SEVP portal manual says that,when OPT is inactive/completed,SEVP can be seen but no changes can be made therein.The manual further says that DSO would not be able to unlock in case SEVIS in ìnactive.But my DSO says that my SEVIS is active and my COS is “RQUESTED”. Could it be that USCIS has not updated the SEVIS record properly?

    • Well, systems sometimes may have issues. You need to go with DSO’s word. It is better to ask your DSO to work with SEVIS system technical support, if it needs to get a Data Fix.

  15. I am not sure if my expectation are too high for rfe processing. Here are my time line:
    Receipt : EAC…
    H1b selection notice: April 12
    Rfe issued date: 05/15
    Rfe response date: 08/08
    After this I have not received any updates. I am non AD with 12 yrs of Software development exp and case is filled as CP.

      • Nope this info of 1 month to reply to rfe is not true. In my rfe they gave me 3 months to reply. The reason to take almost all three month is I created very detailed job responsibility document of all my work which I do and how its a special skill . All the job responsibility mentioned in the initial application, I have provided detailed description for each. I am surprise to hear 1 month for rfe response because couple of my friends got rfe but they have 3 months to reply.

  16. I have been a silent follower of this site for the past 3 years.
    This was my last attempt at H1B and I got my approval letter today.

    Receipt series: WAC18148*****
    Degree: AD
    No RFE
    In EGOV site: Case was received: 04/12
    In DHS site: Case was received: 04/21
    Case Approved: 09/25
    Attorney’s received the documents on: 2/10
    I received the documents on: 4/10

    In the egov site: https://egov.uscis.gov/casestatus/ my status still is: “Case was Received”!!
    However, the university I studied at sent me a notification that my SEVIS record was updated with my COS as of 10/1 and that’s how I got to know about my approval.

    I later created an account in DHS to verify the case (https://myaccount.uscis.dhs.gov/) and it did state that my “Case was Approved”. A couple other friends have had the same issue where EGOV website states “Case was Received” while they got their approvals a few weeks back.

  17. Are we just going to wait for the approval/RFE everyday? With the way they are processing about 100 applications a day, they would by not be able to comolete it even before april 2019 and a new batch of application would be ready to process? This will create a severe backlog for H1Bs as well just like green card. What the hell

    • The way things are going it might very well be possible. Its a very strategic move by this administration to frustrate both employees and employers so that they give up and just leave. I am reading and coming across many instances where the employers have just stopped hiring on h1bs because of all the uncertainties. Which shouldn’t be surprising at all.

      All this will change in coming years but before that happens there will be many casualties. But whatever happens it will not be the end of the world.

      So relax and enjoy!!!

    • The Worktheme data is very much inaccurate for H1Bs, I would never trust that data as it includes everything that is used for I-129 form and you cannot tell based on that data.

    Me: I told her about my first Masters university and degree
    V0: Did you read the pamphlet and do you have any question
    Me : yes and not question
    V0: Visa approved

    No documents or question were asked about cpt

    • please dont encourage fake exp certificates if someone says to u bcoz of this uscis making rules tougher causing everyone suffer.

      instead you do some certifications on technology u r working on your will cv will have more value and your confidence levels will be more . simply dont follow wrong path

    Need your advice on the below.

    My current OPT ends by Jan 21st 2019 and I am waiting for my H1B to get approved., expecting anytime within this month. My query here is that if suppose it gets denied at Consulate while stamping – consider it happens before Jan 1st week. Am I still be allowed to travel back to US with the existing OPT and trigger my OPT extension.

    Also please let me know whether we can continue working with the OPT extension receipt number even before it gets approved.

Once it was approved as COS means you can’t go back to F1 again unless you are applying for new F1.

      (2) We can continue working with the OPT extension receipt number even before it gets approved– Yes. It is valid for 180 days I guess (240 days for H1B cases)

        • You need to check with your employer or attorney about this. Usually, during the original application submittal, prior to April, the employer decides with a concurrence from the employee .

          If the employee already in US (like you) then they most likely have filed as COS. This allows the employee to continue to work on October 1st without leaving the country if the approval comes before October. If it was applied as CP then your H1 becomes effective only after getting a stamping at the consulate.

    I have 15 days left in my cpt and if I fail the course, can I still stay in the country based on the h1b receipt or will I be out of f1 status?
    Or Should I just leave the country after 15days when my cpt ends and wait for approval in home country? Since I am abandoning my 2nd masters, will it have any impact on h1b stamping?

    • Talk to attorney.. first nothing is related to cpt.. It’s your f1 and sevis that matters.. if your sevis is gonna complete as your masters end.. you have 60 days to leave.. However you do have option to enroll in a college and wait for the result indefinite period.. Ideally if you have job you should enroll in additional course and continue with cpt or just take additional courses.. see the possibility of RCL.

    • Unless you are in OPT Cap Gap waiting for H1B receipt, you cannot stay in country. I am not sure what you mean by fail and relation to CPT ? If your GPA falls below certain points, then you will go on to probation and you need to work with your DSO on the same for next steps. Check with your DSO on the GPA requirements to maintain status.

    • Why ? are you the guy giving approval ? Already most in my working circle in Infosys receive Straight Approval and some RFE from – both action only from EAC. No action from WAC other than lot of RFE.
      No one targeting indian company. They targetting all cases.

      • It is Infosys guy who came to US on B1 and they screwed him to work long hours.. This guy gathered all the information how they abuse B1, L1, H1B and reported to USCIS back in 2013 where all this shit started.. stringent rules.. seeds of extreme vetting are sown

  28. Hi Everyone
    Seeking advice from you guys out there. I am on L1b valid till May 2020 and currently in MI USA. This year employer A has filed H1B for me which got selected with work start fate Oct 1st 2018. But so far status of my case if Just showing as received and now employer is kinda concern as may hire someone else.
    Considering above what would happen when my H1b gets approved? will my status change automatically? My friends advised that I should leave the country and come back again on L1b status to continue with current employer. If this is true then within how many days do I need to leave the country once I hear back over H1b approval?
    Or is there any other way so that I can maintain my L1 status after H1b gets approved without leaving the country?

    • Check with the employer who has filed your H1b asking if he has applied for consular processing or Change of Status.

      If it’s consular processing, your status will be L1, till you go back to your home country, get stamping for H1 done and come back on H1.

      If it’s change of status, your status will automatically change from L1 to H1 the moment your H1b gets approved. If your current employer has filed change of status, there is nothing to worry. But if your current employer with whom you are on L1 and the employer who has filed your H1 are different, then you cannot continue to work with current employer after H1 approval as L1 is no longer valid.

        Yes the current employer and the one who filed H1b for me are different.
        But I believe after receiving H1b approval I can leave the UA and come back on L1b status again.

        I have a couple of friends who had been in the similar situation earlier and did the same.

        • If your intention is to stay in US on L1b visa, better ask your new employer to file h1b petition in consular processing instead of change of status. That way you can stay in us till May 2020.

  30. I got RFE. The reason is Employer-Employee relationship and specialty occupation. I have B.E. in Electronics and M.S. in Electrical. I have 3 yrs. IT experience in U.S. I have around 2 yrs. experience in India. But that Indian experience was as an Electronics Engineer. My company said they need experience letter from India of at least 2 years. That should be IT experience. If I get that they will submit it to an evaluation agency and then Specialty Occupation RFE will be resolved by education and experience evaluation. Is it fine if I tell my uncle to give experience letter. He has IT firm in India. Or this needs to be handled differently

    • An RFE on speciality occupation generally means that they want the employer to show that the employer needs somebody with a masters/bachelors degree to perform the job. It has nothing to do with years of experience. Focus on the job description submitted and provide proof that it really needs somebody with bachelors/masters in electrical to perform the job. This RFE is issued only when the job code submitted on the LCA, does not list bachelors as minimum as per Department of Labor guidelines.

    • Well, creating any sort of documents that are not true can create issues in the long run…you also need to go for visa stamping, and also go through POE, so there are many checks…Keep it genuine and submit your experience letters that are true. Speak to your attorney and get their advice on how best to handle it.

  32. Hi i receive no news about tcs approval till now. I receive Rfe till now, same as three other colleague. No news when lawyer will reply for rfe. Tcs not even giving any progress update. Is it same for you ?
    Anyone else tcs or Infosys or wipro receive word about approval and date to start project ?

    • If you know your receipt number, you can go to https://egov.uscis.gov/casestatus/landing.do and check what’s the last date for responding to rfe? This may help you to get some clarity.

  33. Hi All..Can my spouse who is on F-2 visa stamped until 2022 from my previous university travel to India and re-enter USA with a new F-2 I-20 from new school ? Will it create any problem at POE ?

    • Raj,
      In my view, it is similar to F1 visa and should be quite possible, if you have transferred to other school and I20 is properly transferred and you maintained proper status. You should check with your DSO at the new school, just to be sure before you proceed.

  34. FYI, The date shown in processing time table is the receipt date of the application for which you can enquire with USCIS as it crossed processing time.
