What is the H1B Visa 2019 season start date ?
Update : USCIS will start accepting H1B Petitions starting from April 2nd, 2018 as per their official update on their website. In general, USCIS starts accepting applications for the next fiscal year exactly 6 months before the start of the next fiscal year. USCIS fiscal year for 2019 starts from 1st October 2018, which means they should accept applications for FY 2019 from April 1st, 2018. As April 1st is a Sunday, USCIS should accept applications for H1B 2019 season from April 2nd, 2019.
What is H1B visa 2019 Quota for Regular and Masters filings ?
As of the date of writing of article, the H1B quota is as below. This is also called the H1B Visa Cap. You can read more at What is H1B Cap ? Regular vs Masters quota ?
- H1B Regular Quota : 65,000 visas
- H1B Master’s Quota : 20,000 visas. ( only US Masters eligible)
Also, of the overall 85,000 visa cap, every year 6,800 visas are set aside for the citizens of Singapore and Chile as part of the Free Trade Agreement with them. There were few bills part of Comprehensive Immigration Reform that are not active in Senate that were proposed from Obama administration days to change the cap count to 110,000 and Masters to 25,000, including potential to make H1B cap extend up to 180,000. But nothing has moved and all are dormant. Nothing new has been proposed by the new Trump Administration regarding changing cap count. When is H1B Visa 2019 Lottery Date ?
Update : USCIS Conducted Lottery for FY 2019 on April 11, 2018.
There are two things, one is when the H1B petitions are accepted for the lottery and second is when the actual lottery is done. H1B visa petitions for next fiscal year would be accepted by USCIS from April 2nd, 2018 for 5 working days until April 6th, 2018 to be part of the lottery. Now, the actual lottery date depends on various factors depending the volume of petitions and USCIS load. It can be anywhere in second week of April. For FY 2018, the actual H1B Lottery was done on April 11th, 2017 . We can expect anywhere around the same date like April 11th or April 13th.
How to find H1B visa 2019 Sponsors ?
It can be very hard to find a good employer and convince them to sponsor H1B to work in US with major unknown like H1B Visa lottery. Anyways, you would be in one of the three scenarios, if you are seeking a H1B Sponsor.
- F1 Student in US : You can find an internship or co-op at an employer who can sponsor H1B visa and ask them to sponsor your H1B. You can continue to work on OPT once you graduate as well. You find the list of H1B Sponsoring companies using the tool
- International Professionals : If you are outside of US, it can be tricky with all the latest rules by Trump administration. Your best bet is to find an multi-national company ( MNC) and work through them to sponsor H1B visa. You may have hurdles inside the company with all the internal process, many waiting, etc. But, it is up to you to negotiate and ask them to take a chance. Many try the IT body shop route, where they ask them to file H1B. Rules have changed in the last few years and it is very risky move and can jeopardize your US hopes. Green card is sponsored by employer. If your new employer is not willing to sponsor green card, you cannot stay beyond 6 year completion on H1b. You need to find a new employer who will sponsor your green card
But my previous employer was filled and it crossed 2 stages it will not used for me to extend

It is normal but in previous years USCIS reinstated the premium processing option at around September first week. Since that option will not be available until at lest Feb 2019 this year, we should expect further delay.
Well, I guess, it is definitely slower because of all the new regulations and additional things they check now…The official processing times, reflect the same.

I recently got an RFE for employer-employee relationship and worksite. My attorneys have not yet responded to the RFE. I have travel plans to India in mid oct due to a family emergency. Any advice would be really helpful. I am in a bad situation. I haven’t booked my return ticket yet. Not sure when to come back to USA.
FYI – I am a FT employee with a valid EAD until 2020(f1 visa OPT STEM)
Your H1 might have been filed as COS (change of status) as you are already present in US.
H1 is filed as Consular-Notification if someone is not present in US.
As much as I know there is an option to convert application from COS to Consular-Notification. Basically if you leave US right now, you will have to convert your application from COS to Consular-Notification.
Please talk to your attorney. He would be able to advise you better.
Correcting my statement.
Filing H1 as Consular-Notification is optional if someone is in US already i.e. it can be filed as COS as well as Consular-Notification.
The difference is H1 gets implemented immediately after approval if filed as COS and one has to go to home country for stamping if filed as Consular-Notification to get it implemented after approval.
Okay lets assume I am in india and still I havent recieved my h1b approval. If I travel back to the USA and after that if it gets approved what should I do? Should i immediately depart USA for my stamping or is there time period?

My understating is if it was approved while you are in India then it will only approved as Consular even though it might have requested as COS. This is because there is nothing to change the status due to you are not present in US at the time of approval.
OTOH, If it is approved after you come back to US then it will most probably approved as COS as requested unless the original petition itself requested as CP. In very rare cases it may approved as CP as well event though it was requested for COS.
In case it is approved as CP then you may not required to travel immediately as your F1 STEM Opt is still valid till 2020. Good luck and all the best for your visa approval and also safe travel.

I was confirming with my college about the situation after Sept 30th and I found from my DSO that my case was approved on June 19th for EAC18********. We both were surprised because I haven’t heard anything from the lawyers neither my dhs account or my case status showing me approved. Do you know what case it might be?

Interesting…Check with your attorney and ask them to reach out to USCIS on the same. Maybe some systems are updated, some not…It is weird, but online systems have shown inconsistent info in the past, so should check with USCIS on the same.

Happy to see the rejection of those who applied multiple petitions and hijacked the lottery systems…..because of you people ,most of the deserving candidates are still waiting for the results.
I think USCIS already factored in such cases – that’s why they selected 117K applications in the lottery as against the 85K limit. Those extra 32K have to come from somewhere, right? So statistically speaking, I don’t think any deserving candidates got left out.
That said, I do not like people filing multiple petitions. It just hurts the image of all H-1B people and the H-1B visa system itself.

Even if you withdraw the application at this point, it will be taken into consideration to make the decision.
First of all I would like to congratulate for your RFE for all applicants. I believe you might have done this with 3 different desi consultancies and at least 2 are paid one. Neither one of them would be willing to respond to your RFE coz they feel like you betrayed them. I am very happy for you to see in such a situation. This is a nice example for applying multiple petitions. This is one of abusing done by applicants other way we all know is done by companies. It doesn’t matter you are AD or Non-AD, output and abusing is same. No matter what, this is one of the reason USCIS is reacting like unfair.
Who ever was successful in abusing welcome to the H1b suffering. You are still a lucky guy in this way.
I think that as a educated and hopefully aware person you should know better than to file multiple petitions. And if not, then the appropriate first step is to consult a lawyer and really understand the meaning of multiple petitions.

I am a teacher. Is it possible to apply to two different schools and have both schools apply for you h1b?or is that considered multiple applications? its two different schools.
As long as they are not related in any way, they are considered independent and do not fall under duplicate petitions.
If both schools fall under same school district, then they might consider as multiple applications as they are from single entity…as long as they are different, then they are treated as different applications..

Some status are intermediate that are updated as part of system updates and sometimes may not be consistent with the actual status. As long as your attorney has a physical copy of the approval, it is the final status. You can call USCIS to validate the same as well.
I have my few friends in TCS,CTS and in Wipro and i am from HCL. I came to know that not a single approval came for any of the person mentioned above Organizations. It seems it is a deliberately move and something is surely going on in UCSCIS. Not sure but they may reject major chunk out of these applications. How could this be possible that no one got approval yet from these 4 big consulting firms. I checked around 7-8 application no ahead from my WAC167***** and backwards.. I am surprised to see 90% of the petitions either approved or in RFE status but around 1 or 2 still sitting on “Received status”
To come to a conclusion like that, you seem to know like 10,000 people who filed H1 from those 4 firms.

You are saying that “My H1 received intent to revoke” . Petition can be revoked only by employer not by USCIS. USCIS can issue NOID (Notice of intent to deny). Just double check the notice from USCIS.

Is there any experienced person who knows how the last year trend was? Did all the approvals happen before Oct 1st ? If not how long did the new petitions take which were picked up at the end (for this year it is mid may).Is the process made slow this year ? Almost hopeless as my start date is approaching and the case is still received.
Last year, Premium Processing had kicked in in early September- so a lot of the cases were resolved. That’s not the case this year.

For the cap-gappers planning to transfer to international offices (and in effect moving from COS to consular processing) –
Let’s say you get your approval while you’re outside US. Then you get your visa stamped based on an offer letter from your company’s US office. Do you know if it’s possible to file a transfer to a new employer before the 1st day of your H-1B visa?
USCIS has suspended premium processing. Even if you apply for a transfer after your H1b approval, it may easily take around 6 months to get the decision.

Yes, it is usual to USCIS for taking these long waits to process the applications. I was on same boat last year For (H1B 2018) April 2017 application i got my final update on March 2018 almost a year.

I assumed and accepted I’m not going to be back in October for sure, but I am wondering how long can this take, without any news at all… My receipt day is May 5th.
What do yo guys think? September is almost done, and I’m afraid this wait could maybe last full October, November… maybe more?

I verified some other site (http://www.worktheme.com/#/welcome19 ), from CA center they have not started verifying, with my case series, around for 700 applications I am seeing only 35 RFE and 140 as approved rest all are showing Received state.
I know this is not going to approved so soon, but unable to stop verifying my case status. Everyday I am verifying to see the same status “Case Was Received” 🙂
This is very painful waiting.
I checked my series, it says:
Received: 350 RFE Req Mailed: 28 RFE Resp Recv.: 21 Transferred: 0 Decision Notice: 7 Approved: 255
Well… not that bad, right? Haha I just want someone to tell me I’m going to know soon and feel I can trust that… xD
Also, based on that site, it seems that last day there was a lot of movement in both EAC & WAC. Maybe we are close to know something, guys. The website gave me some hope… haha Thank you!

Received NOID from USCIS for multiple petition in my name. Both are genuine from two high paying consultancy.

Why they issue NOID instead of RFE ? This is not fair.

It should not be filed for the same location or same client.
Also there are several factors considered.. if there is a relation between employer a and b based on the contracts.. common applicants.. previous client letters etc. I could not frame this correctly but USCIS have notified early March on how they would classify them as duplicate or multiple petitions that can lead to denial. If you are still confident try MTR which would sometimes work but that has to be filed within the first 30 days.. you can get 30 more days for documentation once filed..

I don’t think, now the companies who filed for your H1b will do anything after knowing that you had applied from multiple positions……

I have also heard in one of the facebook live of IG is that this year all multiple petition has been picked up. Not sure how true it is.
Some people also told that both of their petition certifiied. There must be something related between the two if they have given NOID.

I am currently on Cap Gap till Sept 30th and my H1B status is still in Received. I am planning to apply for H4 and H4EAD in the meanwhile. If my H4 or H4EAD gets approved prior while my H1B status is still in Received or pending, do i have to file an amendment with H1B saying my status is now changed to h4?

My husband is having H4 visa till Aug 2019 and he was in India when his H1b was filed and picked up in lottery. So far, we have not received any update on his case.
Now he wants to travel to US on H4 visa,
1) Do you see any problem if his case gets approved while he is in US?
2) Is there anyway we can know if his H1B filed with Change of status or Consular processing?
FYI, We have his I797C(Receipt Notice) and Consulate/POE is empty.

1. His status should not be an issue for approval, it is independent.
2. Your employer / attorney can tell that info.

It shouldn’t be problem while travelling in H4 Visa. Once it’s approved you can change the status from H4 to H1. But only one point I want to mention here, In Port of Entry suppose if a question is asked that you have filed H1 your answer should be yes and still pending with approval.
What if he goes to India back for stamping after approval, since he has to go back to resign from his current employer. During stamping, do you see any issue like they may ask while you were in US why you didn’t start working and all that stuff etc.
There should not be problem because your husband current status is H4 and H1 B just picked but nor approved. But as soon as H1 b will be approved then H4 will automatically be revoked because person can hold on visa (either h1 b or H4 or anyother).
At same time if your husband in India and H1 B gets approved in that case he will have to travel on H1 b with stamping in India.

Two weeks. But if it is taking more than 30 days then your employer/attorney are allowed to contact the USCIS and ask for a copy. If you try to inquire before 30 days then they will ask you to wait at least 30 days before contacting them.

I can see my status as “case received” in myaccount website and error in e.gov website

Got my H1B approval last week, no RFEs and received the H1B approval notice today.
My L1B visa expires May 2019 & my H1B approval notice is showing valid from Oct 1st 2019 – May 2020 – i.e. they gave me a H1B visa for exactly 12 months only after my L1B expiry. Anyone I have asked has never seen this before. Wishing everyone else luck

6 yr H1B quota will count the time spent in L-1B.. so if you have already used up 5 yrs of L1, you’ll get approval only for 1 more year.
