H1B 2018, 2019 Season is over, H1B 2020 Season Starts on April 1st, 2019.  Check out H1B Visa 2020 – Start Date, Fee, Lottery – FAQs 

If this is your first year of H1B visa filing, you must read What is H1B Visa, Requirements, Process . Not to scare you, Last year, there was lottery for H1B season and for FY 2017 USCIS received 236,000 applications .

When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017. 
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017.  But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017.   If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017.  You may read USCIS Press release for H1B 2017 Start Date 

What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ? 
Update : USCIS confirmed the below quota cap numbers in latest press release for FY 2018. 
To get some background, read H1B Quota – Regular vs Masters .  There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in.  The total H1B Quota as of today is 85,000 and it is split like below.

Regular H1B Quota  65,000
Master’s H1B Quota ( Only US Masters Degree Eligible) 20,000

Out of the above 85,000 quota, 6,800 are set aside for Singapore and Chile citizens as part of the free trade agreement between them. Also, check out the article with history of maximum H1B Cap from 1990 to 2017 

H1B 2018 Lottery Predictions ? 
It used to be a speculation whether we would have lottery in previous years, but in the past 4 years, lottery has become common. It is very likely that we would have lottery aka random selection for H1B 2018 season.  We have been writing predictions over the years and all of them have been accurate so far. Update : USCIS Received 199,000 H1B petitions for fiscal year 2018.  H1B Lottery was conducted on April 11th, 2017.

When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially  on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
  • Other H4, L1 Visas :  If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.

  • If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
  • If you are professional planning to arrive in US from outside America,  it can be really tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ? 

The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS.  There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary from FY 2017 quota.  If any changes, we will update this accordingly.

H1B 2018 Lottery Results – Checks Cashed, Receipts : 
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date.  To put things in perspective,  last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017…  Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018.  Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?

We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Check out USCIS New measures to report, prevent H1B Fraud  . Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. There are many speculations on how H1B program will become tougher with higher wages, quota limits, etc… but, nothing has been officially signed. We will update the article as new updates come in.

Various H1B Bills  in US House and Senate  – Will they be passed for FY 2018 ?
There are few bills that are introduced in 2017 and at various stages in both house and senate. There are many confusions regarding the same bills like the minimum wage will go up to $130,000 USD, etc.  Fact is that nothing has passed and there are very slim chances for them to get passed before start of FY 2018 season.   1. Hi,

    My husband has applied for H1 B visa(2018) through his company and also applied for H4 EAD for me . Yesterday I got an acknowledgement from USCIS saying that they received my fees. Does it mean that my husband got his H1 B visa? I’m just curious because they don’t deduct the money unless you are selected. Can anyone share your insights on this please?

  3. My wife(H4) received i797c last weekend, with the receipt number in it, I checked in USCIS website and it shows “case was received”, but I haven’t got anything yet, should I be worried? Thanks!

    Just wanted to check a few things. I contacted my DSO about my SEVIS record. They replied with “an indication of change of status” pending on my SEVIS. It has a receipt number as WAC1714***** marked against it.

    I haven’t heard anything from my attorney yet, but is pending change of status an indication of petition being picked in the lottery?

    • Bro WAC stands for center name. The next two digits 17 stands for year. the next three stands for day and the next five is actually your case number. Since you have WAC17 ….which means its 2017 an if you haven’t filed any form for change of status then its definitely h1b.

    can you tell me whether the receipt no will only be shared after it got picked up in lottery?

    Is it possible that my employer hasn’t received the receipt number for my application yet ?

    • Receipt numbers are assigned to those petitions that are selected in the lottery so yes you will only receive a receipt number if you got picked in the lottery. As many of you will argue there is a receipt number for rejected petitions too but that happens in june end to my knowledge.

        • No problem man. FYI : A lot of people commenting on this forum about getting picked is just a small number in 85000 Quota. Also if you guys are looking at immigration girl statistics then keep in mind they have received 45-50% receipts on the cases they filed but who know how many they applied. If they applied 10 petitions for AD 50% of that is 5 petitions and lets say 10 for non and 50 % of that is 5 too. So over all 45% and 50% may seem like a big number but in reality its a handful of petition. Still a good chance for you my man.

          • Did you saw the image that immigration girl had put up twitter, those were approximately around 300~400 and that accounted to only 10-15% of her total application, so based on that her firm would have applied easily above 2500 petition.
            so i guess her number would be correct and not mere 5-10 petition as mentioned by you.

          • Bro 2500 is still a handful. 10% of 85000 is 8500. So 2500 is ~3 to 4% of 85000 quota. Not all 2500 are selected so lets say half is selected which is 1250 which is close to ~2% of total 85000 quota. There you go (% might not be too accurate just did it in my head).

    • As you mentioned you already got picked, why do you care about lottery results anymore. But anyways May 2nd to may 11 is the estimate time period you are looking for.

  7. Guys on this forum there are only 3000- 4000 people commenting at most. So don’t give up because we all made it. Sooner or later we are gonna receive the receipts. I already booked my apartment for next year and that’s my friend is called confidence.

  9. Hi, I have a quick Q..

    I have been following up with our finance team (since the manager is my friend) to see if my checks are cashed?

    Tell me something does check is given from the company or in the name of lawyer & only the lawyer office will know the check is cashed or not.
    The finance manager doesnt know in whose name the check was given since the HR sent out the details to the lawyer.

    • Contact HR in that case as both company or your attorney can send the check for your application. In my case attorney did but in some other cases on this forum the company did.

  10. This is my 2nd attempt. Before applying for h1b i never felt that i am not lucky…But from last year i am losing all hope..I don’t know the reason behind this and i am not so desperate to work in US..but don’t know feeling so unlucky…
    Though i am non AD i lost my hope already

      Worked in MNC’s in India and Australia now presently working with Indian consult. having 11 years tried and applied 6 times, one genuine app. whenever i applied its lottery, this year too no luck… waiting until mid may.. Don’t loose hope.

  12. One of my frnd after 4 years of trying H1b , this year he filed from 3 employers.
    2 of them already picked up and got reciept.
    Is this fair or not ? Or Am i being jealous just because I dint got picked up ?

    • USCIS WILL pick your application if you tell them that your friend cheated the system by applying 3 times to the H1b visa. If I were you I would do that… you can report it here: E-Verify@dhs.gov or by calling to USCIS.

        • It is illegal and your friend has to be reported. USCIS award you by picking your application because you helped them uncover fraud. If you don’t do it, I will do it for you LOL

    • It is in fact fair if these two employers made him genuine offers. If two employers are somehow related or one of the positions is fake, then it is not just unfair, it is simply illegal and it should be reported to USCIS.

    • They some how filter duplicate application when none of them are selected. This way they don’t return the filing fee.

      So why not follow the same procedure when a application is picked in lottery who has applied multiple times??

      If found that a candidate has done multiple filing, the simply reject the selected lottery slot. And also if possible, make the candidate not eligible for applying for H1b going forwards.

      The solution looks simple and straight forward. Why not follow it?

      Its totally unfair but totally legal as well. Since the employers are different, it wouldn’t be called duplicate fillings. But yes, if any of those employers are desi consultancies/body shoppers/H1B sellers, whatever you call them, you MUST report it to the agencies. You don’t have to mention your friends name, just report the names of the employers. Go through this link.

      However, even if you don’t report, I believe, if latest EO is really in effect, your friend will receive an RFE and eventual rejection.

  15. When USCIS says it has finished data entry, what does it mean? Does it mean that they have also finished dispatching mail (whatever the result of the case is) all the employers?

    • USCIS Data entry??,

      It means all selected petitions have been assigned receipt numbers and same has been mailed. It could take 2-3 weeks for employer/attorneys to receive the paper receipt notices from then (SLA is 30 days).

      They haven’t even disclosed if any one case was filed or not.
      As Gini (IBM CEO) is very close to Trump, she would do her best to please him.

            With questions in the number of nominations reduced at last minute with/without the notice to associates, I am not sure how they will release the results.. in single batch or multiple..

          • I heard this news from my manager..

            Earlier I heard from a reliable source..so I called Manager and he also confirmed that.. By God’s grace, he said I am in. He added, everything are not normal, we should wait until we hear receipt num or negative thing.

            Am also confused a lot on this 🙁

          • We have a tracking ID given and while checking on it , we have the CASE ID provided to us by cognizant. So in tat case, we can say that our case has reached filing. So all the applications which has a tracking ID provided should be filed.

  18. Today I receive my wife’s H4 receipt. It was sent to my home address. Does it mean my H1B cap has been selected ? My attorney has not inform me with my H1B cap situation yet. Thanks a lot.

  19. To All CTS TCS WIPRO INFY associate, they have tweaked h1b clause similar to l1b blanket this year. So chances of selected H1b during RFE or during PA are more than last year if you are less experienced. So don’t desperate about H1b and concentrate about your career.

  21. 3rd attempt: AD..Finally! Received a notice from lawyer today. It was such a wonderful feeling.

    I completely feel the pain and anxiety about all of you guys who are still waiting. Coz I have been through this and it sucks. Just have a faith, surround yourself with positive people and just be optimistic. Its very easy to say but hard to keep up with this attitude. I literally used to feel like to kill someone whenever they used to say ‘You will get it/ Ho jayega’..I kinda get it what they are trying to say but I used to get very mad. In my mind I used to be like ‘Stupid, Shut the hell up’, you are not god. But in the end, it is sheer luck guys.

    You do not get anything before the time. And everything happens is for a reason. Just take a second and just look back, the people you met and the decision you took coz of H1B was not selected. You may not find the reason now but if you look back to this time after 7-8 years it will make sense.

    I have experienced this. At the time of my F1 visa back in 2010, I had a 40K scholarship at one of the best schools in California but my visa was denied 3 times. At the 4th attempt I got my visa for the different university in Boston. I graduated and landed in California for the job with 6 figs salary in reputed company. I still remember that, I used to cry during these failed attempts. But if I look back to those moments now, it makes sense as why it was destined to happen..and it was for good..

    My H1B did not select for the second time. I was very frustrated, obviously. But I took certain decision coz I had no H1B that led me to do something that I have never done. I completed Ironman race in 7 hrs (swam 1.2 miles, biked 56 miles and ran13 miles in Oceanside CA, 70.3 IRONMAN race). For the very first time in my life I competed.

    The point is…EVERYTHING HAPPENS IS FOR A REASON…just DO NOT GIVE UP…If you fail, try again…fail again..fail better…but just do not give up…That makes you true warrior…

  22. Just a random question. I Understand that receipt numbers are getting issued on different date, but should the check get cashed once lottery is completed ? Or do they get cashed on different days ? I am Non-AD and it’s my third year trying my luck in H1B. Do you genuinely feel Non-ADs should keep any hope if their check is not cashed yet. More the delay, Less the chances of getting selected ? My attorney got 5 checks cashed today for non-AD, but no update on my case
