When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017.
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017. But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017. If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017. What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ?

There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in. The total H1B Quota as of today is 85,000 and it is split like below.

When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.
- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
- Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
- Other H4, L1 Visas : If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.
- If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
- If you are professional planning to arrive in US from outside America, it can be really tricky. If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies. The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ?
The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS. H1B 2018 Lottery Results – Checks Cashed, Receipts :
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date. To put things in perspective, last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017… Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018. Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?
We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. No, it isn’t . Even if you have a 2 year Master’s in Engineering and a 4 years Bachelor’s, even then you cannot be considered in AD.
AD is only for those who have a Master’s in the United States (either one year or 1.5 years or 2 years).
Nope. If you are talking about MCA in India, it is already equivalent to BE/ BTech. Its not an AD in US. I doubt even ME/MTech comes under AD. AD is for masters completed in the US only.

Bro- No one for sure know that except USCIS, but hopefully by may 11th your friend should receive it or his attorney. Just be happy that your friend’s check got cashed. If that doesn’t give you piece of mind ask him to check him sevis id which should clearly say h1b- pending status…. something like that.

I talked to my DSO on my SEVIS record. He replied me saying he didnt see any update yet about H1B. Does it mean my case didnt selected in the lottery. I clearly got to know from friends that usually sevis will be updated with pending with receipt number if the receipt got generated. I cannot get any details from attorney because my company wont agree for asking details like check deposit.

Bro sevis is not updated for everyone selected in the lottery. It’s work in progress and uscis is updating it everyday . Give it time. I am waiting for the my sevis id to update too.
If you are a NON-AD you still have very good chance of selection. All these sevis update you keep hearing about on this forum is related to advanced degrees. Good Luck
SEVIS updates will take time don’t lose hope. My H1B application got selected in lottery under AD and got receipt number but still, my SEVIS record doesn’t show anything when I checked with the university. So, Wait until data entry notification from USCIS and check with your DSO about any change to SEVIS record.

Why can’t infy/TCS,Wipro hire international students with masters? They anyway have to sponsor visa, if non-AD visa is not selected then they lose on resource.. If they hire AD people on shore, they have more chances of not losing resources and also over all count of applications reduces.
Because it was cheaper to hire a resource in India, train the person for 2 -3 years and then send onsite. Masters student from an average university is no better a BTech pass out, plus companies have to incur the cost of training, maintaining them on bench in $$. It is very difficult for them to attract any students from good universities. Now that the equations have changed they are looking into the local hiring, and they are better off hiring an American citizen than Indian master student.
Those who are on-shore are not cheap labor. Why do you think these companies are exporting thousands from India?

I dont think so. I dont think they check if their cheques were cashed until a lot later.
I believe their practice is they will send an email if there is a update (receipt) and eventually update the online portal.
They updated mine online portal that they sent my application 2 weeks after the email was sent confirming that it was done. No point in checking their portal for up to date info in my opinion.
I don’t think they update often. They told me it would be only by May they would know if mine is picked or not. No news is good news for me as of now.
Just wanted to add my two cents here. I see many AD guys consider themselves as a superior workforce who has lot of talent and they are the only people in this world who truly deserves H1B by downgrading indian MNC guys. Believe me there are lots of talented and skilled people across the board.
Being a masters student, AD people are getting two lottery chances for the same year where as an indian MNC guy has to wait for two years to get two chances. So, it looks very fair and what on earth AD guys are still expecting to be done? Do they need full 85K under their name without giving chance to others?
During F1 interview 100% of the students would have told they are going to return once the studies are completed, but the question is how many are genuinely following it? Guess it’s flat 0%. So, before questioning or downgrading others its better to question ones own integrity.
There’s good everywhere with the combination of bad, so people shouldn’t generalize statements based on that, be it a qualification, country or race. So, requesting all to behave in a matured way and keep this forum moving. For everyone’s information, even I am an AD guy awaiting lottery results who doesn’t support unhealthy discussion.

Yes, they are more deserving coz they study here, work their ass off to land a job in US, fight the competiton, pay college fees and taxes here. They will and should have an edge over those IT guys applying for visas through MNCs and ready to work at minimal wages.

Well what do you think of the MNC guys?? Just because you get an AD makes you high skilled all of a sudden? thats rubbish…our company has hired a couple of guys from a reputed university in Colarado and to be really honest, they are not even half good as my offshore guys when it comes to programming, which makes me wonder why they think they are highly skilled when they are merely highly qualified …and at the end of the day, visas are meant for the highly skilled and not for the highly qualified!!
Invests 20lakhs and two years of your time doing masters leaving all your commitments,then you can get an edge in Lottery with two chance every time you apply..,

There is something called as L-1 visa in place for you. People with AD do not replace american worker like ~100 % MNC workers do. AD people are recruited by companies as there is a scarcity for high skilled talent in US in engineering fields. So no way it is justified for MNC people and AD people to be on the same boat. IT guys from MNC’s have tarnished the image of Indians in US as a whole. We all now come under the same ‘tag’. Because of people like you! Don’t tell me that 100% of IT guys coming from MNC’s are pro at programming! I am not justifying nor am I saying that all AD degree candidates are geniuses. All I am saying is that for the level of effort, time and investment we put in US, we deserve to be treated better than this. We should not be in the same pool as the IT guys coming from India. It is not about being rich / poor. It is not about being well qualified or not. We spend time in this country, learn about the way things work, do everything legally and it is frustrating to see that we are treated the same way like MNC people who are ready to work for 25-30k salaries. We could very well sit within the comforts of our homes in india and apply year after year. I am glad trump is working towards giving higher priority to truly talented people. It will be clear in the coming years who are more skilled!

I believe all the AD aspirants are eligible for the 1 year OPT which is extendible for two more years. 3 years are sufficient to repay your student loan.
As someone said above, you do not express your intent to stay here when you appear for your F1 interview. Still the United States gives you a chance to repay your debt by working for three years in OPT (not much of taxes, no h1 transfer hassles,etc)
And if you are “highly” skilled, you eventually succeed in getting some TA/RA in Universities which reduces your cost too.
Even after this, all AD students(irrespective of the University) get a dual chance in lottery.
If “investment” is considered to be the reason for the AD students to have an upper hand, then I think H1B is the wrong category you are considering. They altogether have a different visa category for investments (unfortunately India is not a part of the permitted countries).
So any discussion which boils down to a point which says AD should be given more preference because they spend money here, is incorrect.
P.S I’m totally against the bulk of visas applied by outsourced MNCs and fake organizations.

There is no restriction for EB5 , investment visa .
I appreciate your view, being an AD yourself. Some say they (AD) spend money, study for 2 full years without any commitment. Few of friends are well settled here in India. Couple of my friends parent have their own company. People like them have the liberty to do what ever they want. Frankly speaking they have no commitment at all.
I actually feel sorry for the guys who work their ass off in Indian MNC and still not get a shot at the lottery due to internal politics. Not all guys in the so called Indian body shop company do non sense work and those who complete AD are braniacs. Please understand that.

Just have one confusion regarding Check Cash: The check cash will happen on lottery selection for the application or once that application gets approved post lottery selection.
It will happen on lottery selection, irrespective whether your application approved or rejected.

Check is cashed for all lottery selected petitions. However, if you are asking about the timing, then I think it happens after the receipt number has been generated as they mention the receipt number on the backside of the cashed check.

I hope nothing … Being a bachelor’s degree holder with 6 years of experience in India.. I hope that trump executive order will be difficult to get approved as If he introduces merit based system it will be very difficult to implement since

Yes it does and they have data for average salary for each field. They can simply say that for H1B visa, you only bring in people in wage level 3/4 only. No more entry level.

Not really. The average salary for small companies for software engineers at entry level is close to 100k. For Tier 1 companies (Google/FB/Amazon/Microsoft/etc), it is much more with their stock options and bonus. Everyone pays decent salary except the Indian consultancies.

This isnt necessarily bad for US. They have been doing this for a long time. At the end of the day, they own the work/product, so they get the most benefits. This has the effect of helping another economy as well. They will only keep the highest paid positions in their country. So they get to work on the cutting edge product/research. Same model as the physical products which are designed elsewhere but built in China cuz of cheap labour.
Even if they said that there will be visas for only 100k+ salary positions, they will still find enough people to fill their 85k slots and most would still be from India. It will only affect the Indian consultancies whose business model is to pay less than market wage because they take advantage of the engineers willing to work at a lower pay for the chance of moving to US.
I am not saying about companies giving 100K. Actually many companies are not able to find employees required to their needs .. It simply not that since you are an US citizen they can provide you the job you need to be qualified.. when you make selection based on wages many small companies will disrupt . I can remember obama administration was also threatening like that in the end of the day nothing happened ..
Yes there is an obvious shortage of techinal skills in the US. Hence H1b.
Doesnt mean what all these companies who pay minimum possible salary are doing the right thing. These people deserve a lot more salary for what they are doing.

Like with any change, the proposal (whatever that would be) will involve lot of lobbying effort. Talking about salary – there is no one size fit all solution. It will have to be catered according to location, job category etc just like LCA.
Was just wondering if after lottery selection and while approval if we get RFE and Denial for the application, whether the fees was taken by USCIS or returned. This happen with me last year my 2017 application was rejected after RFE so was thinking if my consultant was charged fully or not for that and accordingly i can get my deposit back. Thanks.

If check is chased you petition was selected in the lottery. It does not mean your company or your attorney received the receipt notice unless they told you they did. Don’t worry its on the way. Congrats.

I believe by end of next week , USCIS will announce that they are done with data entry(same as last year). having said that, receipt notices or check clearance should have started now(or this week). for non ad.
NON AD with 14+ years from Pharmaceutical Industry . No receipt number received yet. Checked with my attorney yesterday and she indicated that, she haven’t heard back from USCIS on a single application from the applications submitted by her firm for Non AD..
Brother 14+years of experience and all doesn’t matter at this point. The lottery is a random selection using some sort of computer algorithm. Be patient stop crying and stop acting like a victim with all that 14+ years shit and you are deserving and all. For everyone decision is on its way.
Also since you have 14+years of experience you are a grown up adult in late 30’s i guess and you still don’t understand that this lottery or selection does not change anything. You success in life does not depend on this lottery or the orange guy who created all this chaos.
Fun fact : there are 195 countries in the world. Looking at your desperation you don’t want to work in India and lets say you are unlucky this time then US is off the plate too. As per what i learned in 4th grade 195- 1(India) – 1(US) = still 193 countries remaining to try your luck.
If you are indian you are probably married by now with kids (you know we get married before we hit 30’s). You have more to worry about than just a lottery.

Hey, Its not Non AD , I checked with my attorney and she said she haven’t heard anything yet for any application of AD too yet. She told me that its weird this time and she even checked with all her peers and none have updates on their applicants. So don’t need to panic, it takes time, just relax. Don’t get panic by people reporting Cheque’s cashed , they wont cash all cheque’s on same day.

This is my first H1B application experience and I am saddened by the condition young Indian engineers face int he US. We live for higher studies aiming for a brighter future abroad and dreaming some day to get a Green Card and settle in the US but the question we need to ask ourselves that is all this worth it ? Today US has a right wing government which hates all people of colour and non-christians. Australia also bans their work visas and when the UK prime minister visits India, Modi negotiates with them to allow Indians to work in the UK. I mean common why is that the talent of an Indian engineer is only put to use serving the interest of the developed world ?? Same can be said about the numerous IT professionals working in India who develop software intended to be used int he West and not for India. We work 9 to 5 for some company in the developed world while we do not strive to achieve technological innovation in India. India today has lots of problems to solve and it is upon us all the Indian engineers to solve them. Today even though India has highest number of engineers in the world yet we beg for technologies from the western world. Consider the example of Israel, a nation with a population of just 8 million but still India imports weapons technology from them all the while when it produces 1.5 million engineer each year. That’s total of 50 to 60 million engineers in the work force which is equivalent to entire population of UK, Germany or France and still we don’t have our own technologies. Why ?? Because we only dream about getting a job in a developed country, settle abroad and then say India will never improve and the salaries will always remain low there. . . Today, when my H1B application is under process I feel scared and vulnerable as nobody knows what going to happen to the entire H1B system in the future. All this ought to change and we as a collective force have the power to change it not by pursuing H1B or Green Card dreams but by aiming to do something worth while, some new technological disruption which has the potential to improve living standards of millions of India. I hate the fact that today the Indian IT companies have billions of dollar in revenue and they still have to lobby Trump through NASSCOM for keeping the H1B. Why do we want to continue producing software cheaply for other countries ??? Why India only dreams about IT and all the other fields are not even competing in the international market. This needs to change and for that we engineers need to see India from the vision of an engineer and a problem solver. There are plenty of profits to reap if one is successful in India but first we need to change our attitudes for that. I really really hope that India’s gets on to a fast track in the technological innovation race and becomes a developed country by 2040. I really hope an engineer graduating in the 2040 from India will not dream of going to Silicon Valley for job but will dream of working in a multinational company based from Mumbai, Delhi or Bangalore. It’s high time we create our own silicon valley.
So all the negative comments about H1B not getting approved fear not.I for one have stopped bothering about H1B now. Embrace home and embrace India, we have the power to change the fortunes of million Indians. I know not every one of us will be successful in starting our own start-ups, but we can always join the once that are successful and making disruptions in the Indian market.

You will need 12 year from H1 to get green card . Better do good where you are and start your life . You will not be able buy house until you get greencard and when you get greencrad house price will be 10 time higher and you H1 live lousy life .

Could it be, that he signed it so late on purpose? I mean, the lottery has been conducted. Let’s assume (this is really a dramatic assumption) that 50% of the chosen ones will not pass the new measures (whatever they are specifically). That would mean, since they will not conduct a second lottery, that approx. 30,000 visas are going to be unused with no replacement. If he would have signed the order earlier, the pool wouldn’t be clogged with 199k petitions of which probably many won’t meet the requirements and 85,000 visas would have been issued as normal to the deserving people. But this way he might have signed it so late, so they can deny half of the visas = lesser immigrants. What do you think?
After the disastrous response to the travel ban, he probably was not ready for more court cases and lobbyists.
By safely passing an order after the lottery, he avoided any possible retaliation by big tech firms (fb, google, apple, amazon etc) as well as by bodies representing IT industry (nasscom) etc. Companies like Infy, tcs and other wholesale H1b shoppers will get 1 year lead time for working on a backup plan.
No one would ever know which candidate was screened, if at all. guidelines are generic too. So in short companies are happy, lobbyists are happy, foreign governments are happy, bodyshops are happy and above all clueless american public is happy. Well played trump.
If we look on the other side, maybe USCIS had the Intel that Trump is going to sign the executive order on H1b, so to avoid too much work (new EO will make the water more muddier), So, USCIS did the lottery even before he signs the EO. So they will have enough time for next year to implement the new EO. Meanwhile, it’s an EO, so it also needs to be approved my congress to stay in effect in future.

1.) Remove premium processing
2.) Release statement on 31st match that computer programmers with low wage not eligible.( obviously all applications were ready to be submitted by then so no one would make changes.
3.) After lottery is done, now Executive Order of clearing out massive underpaid workers ( So now as premium processing is gone they have enough time to filter candidates)
So in the end out of this years lottery quota, only highly paid workers get picked which would be nearly half.

He doesn’t even care about highly skilled/highly paid workers… otherwise they would have clearly stated what’s going to happen. If the process/requirements would have been clear in the beginning, only people who meet those requirements would have handed in their petitions. He just let it happen for everyone to apply > the lottery picks the ‘wrong’ candidates > many petitions land in the trash bc they don’t meet the requirements > good for Trump, bc even lesser than 85,000 foreign workers. If he really is supporting highly skilled/highly paid workers, he would have gone a different strategy. He just doesn’t want foreign workers whatsoever.
I just think this whole process is not fair to all the companies and people who handed in their petitions in good intention without faking anything. It is just nerve-racking as hell… Even if you are amongst the chosen ones… you can now almost be sure to get rejected.

Hi I am on OPTx and filing H1b this year. Last week I requested the new I20s for my wife (on F2) as she is traveling out of country this week. Got the new I20s today and its showing the H1b visa request (Change of status/Cap-gap extension). Status is pending. Receipt number EAC171365xxxx. However I cannot check the case status online yet. Is it safe to say my petition got picked in the lottery?

Anyone know how this whole salary thing works ? A person in Cali have much higher chance of getting a salary around 130K because the cost of living over there is high but an individual working in a smaller place for example Delaware wont get 130K for the same position.

You are questioning something for which you have already mentioned answer in it by your own. The answer is “cost of living”. In USA, prices are different for the same thing based on the states, for example, milk, gas (petrol) etc. Also if you are in California and you want to rent a two-bed room apartment, it would be approximate $2200 (or more) per month but if you go in other state and find the same quality of the apartment, you may end up getting in $1200-$1500 per month. Also, there is fixed minimum wage is different in each state
In my area the minimum wage for a level 1 worker (Mechanical engineer with BS degree and 3- years of experience) is so high but the area is low profile (not too expensive to live) , i don’t think even my manager gets that much which confuses the heck out of me.

There are many variables in the process:
1. As you are Mechanical Engineer working in Delaware, I believe your employer is most likely not H1B dependent, so as long as they are paying you equal to minimum wage required in your area, you should be good.
2. As of now, there is no bill or EO has been passed or signed which sets the required salary for H1B to 130k.
So my advice is to wait and see what the new EO brings to the H1B process and then if you were lucky enough to get through the lottery this year then it would be reasonable to worry about other parameters.

That you are SO scared of the upcoming exec order is the proof that you guys are just cheap labor, not high skilled individuals.

If these people were really “high skilled” as the h1b visa intended them to be, these tech companies would hire them directly, not outsource the jobs to their contractor companies. They just do the junk work that real skilled workers don’t do as cheap as these people do.
You need highly skilled people only to replace highly skilled people or to do highly skilled work… If you are ordinary and have ordinary work then you will get ordinary people only… apologies if it hurts… but that’s the reality !!!!

Second, the work that is done by outsourcing companies is debatable, but you cannot undercut american workers for what they are worth. Period, and that is what gets the goat of us here.
If something is worth $10 , and someone sells it for $2 that is unfair competition and trade practice. If a DBAs job is worth $100K in local salary, and you undercut it by getting the same resource for $40K, that is unfair competition, because of the unfair advantage of currency manipulation.
Fair competition is when you get me a better DBA who is 10 times as skilled at $100K, which is purely not the case here. Don’t get me started on making Americans train the cheap replacements, which is testament to the fact that the replacement is a useless body.
Third, for heaven’s sake wrap your head around the fact that H1B was created to bring in highly skilled people we could not find here at all, and not to make it a cheap labor tunnel, which unfortunately the indian ChopShops have made it.
So till the time Indians compete on cost, lets stop the conversation, when you start showing us skills that are 10 times better, lets talk.

Who is outsourcing jobs to India? Who benefits from slave labor of H1B? It’s all logical what you say. However, when Americans get into leadership positions in a big corporation they actively lobby to bring in hordes of H1B / L1 visa to drive down cost. More work done in less cost equals more bonuses and profit. No one will ever call these Americans out as sell outs. It’s easy to blame H1B holders.
It doesn’t matter what H1B was intended to be. Living in USA, I realized everything serves corporate interest and military industrial complex. They could break the link between H1B and employer so that H1B visa holder can move to any company, thereby creating freedom of labor and fair competition. But what good is cheap labor if it has freedom? USA was built on slavery and indenture servitude, H1B is a modern day indenture servitude. H1B holders, especially Indians and Chinese, would hold on to a underpaid crappy job for 10+ years just so they can get a shot at green card.
The way I see it, there is illusion of representative democracy in America. It is not in interest of elected officials to serve the people.

As far as h1b holders are concerned they come and they go.. they dont replace anyone permanently.. its only politics and bullshit. Second, they are the educated ones, coming to US for work, pay taxes and live peacefully.
And few of those high skilled h1b holders who apply for greencard – they have to again wait for over 10 years if they come from india or china. While, a shady person coming from countries such as Syria, Haiti etc can get it in few months or immediately through DV lottery. So much for getting high skilled people -Go figure.
Look at the broken immigration system that allows people from small but dangerous countries (no offence) to get green cards easily through multiple channels and keeps real high skilled people out with lotteries and unnecessary wait times. What these body shops are doing is exploiting the loopholes. But you are the one allowing them to do this repeatedly. There are high caliber people with perfect GPAs coming from top universities in US with $150k salaries leaving the country just because you awarded the visa in lottery to someone coming from a third class college with an undergrad degree and fake experience.

You need to understand that there was a time >15 years ago, when there was genuine talent deficiency in the country , and the visas were fine.
However, we are having citizens being laid off and having to train the replacements. I follow the movement of labor across the world closely, and in your country India recently Jet airways union employees asked expat pilots to be gone, in fact said they will not fly with expat pilots.
No country in their right mind will want cheap labor to kick their citizens out. If you read back on this forum, I have mentioned time and again, I am not against IITians, and other scientists coming here at all.
We want the H1B to be used to bring in experienced and highly talented people, who would even make more than local americans in pay. We just dont want it to be a cheap labor conduit.
Yes, everyone is in this defeatist game together but its like the war on drugs. We prosecute the drug lords and not the drug addicts, same way we will kick out the cheap labor chandlers from India, and not the American companies who actually use them.

Our laws simply state that not more than 7% of green cards should go to any country, because otherwise we would have had only Indians here in this country or from some other populous country. If you want empirical evidence, look at the H1B visas allotted in the past years. >80% of them go to Indians, and sorry we dont want another country coming in and taking over as permanent residents with unbridled immigration.
I hope you understand that this country is a Litigious place, and the only transparent and tenable way to distribute something oversubscribed is to do a lottery.

There should be preference given to applicants who have studied in United States from Tier1/2 Universities. There is a reason why these universities are world renowned.

I am highly skilled. Students intern while studying here and understand the market the way things work here. That is a very important experience to have, at least according to me. But that’s never counted towards H1B applications. H1B is not focused towards quality but saving money.
We are not scared, Most of the IT companies used to identify H1b people 6 months before filing date, so we have been waiting more than 6 months to see the results. If they announce new rule at the end of waiting period, it will be hard to accept. So, we are expecting that they should announce atleast prior to filing…
That’s a bit of a sweeping generalisation – personally I welcome this, it’s just a shame that I’ll probably have to wait another year if I’m not selected in the random lottery this year. Wish this order has been earlier in the year and would have affected the FY2018 cap…

The cold hard fact is that you are not competitive at the global level anymore. While we talk about micro impacts in people’s lives, lets not loose sight of the bigger picture.
Protectionism is a sign of a failing education system and work ethic that causes the country to stop immigrants from taking jobs. It just goes to show that Americans cannot compete at the global level anymore. In trying to stop foreign workers from coming in, and companies from leaving, you create a pseudo ‘high employment’ environment which will collapse the moment other countries raise competitive companies with the retained skill-force.

There is a reason why certain markets are called growth markets while others are called saturated. Please do some basic research on what companies consider as ‘growth markets’ and where they are expanding their product base. I’ll give you a hint – it is not here.
Speaking of bubbles – that is what is being created here. To pay a DBA a salary of 100k where someone is willing to do that job for 50k is called living in a bubble. How long can you prop up an economy like this? It will cause inflation and currency devaluation. Yes – in 20 years you will still be paid a 100k, but that will get you half of the lifestyle you can afford now. Back to the basic supply and demand.

Yups growth markets that keep growing ever without any meaningful propulsion. The economies in these growth markets have been fueled because of the middle class consumption. Where does this middle class get their economic power from ? Because of the western companies that have given them high paying jobs, compared to other sectors.
India’s 9% GDP is built on outsourcing, so much for being an economic powerhouse or an emerging market.
Once foreign capital takes flight, the middle class will be high and dry, because the jobs will disappear, and then see where the engines of growth go.
Hence I term it as a bubble, because the engines of growth you are talking about, are not running because their source is local, but because of foreign investment.
That apart, please go back and build your high growth companies, and once you have them we will talk. Its like linux threatening to win the OS wars.

Sorry Sir, the market forces correct themselves. In this case the market correction happened because of the misuse of the H1B and other visas to undercut american workers due to certain unfair advantages, which drove down the wages. Without these visas the tech market would have 11% more jobs and 5% more wage growth, which in terms of raw numbers is big.
Please rest assured we are going to close all those loopholes right soon, and then you can be happy !!
As regards your theory on inflation, sorry this country is not India with >7% inflation averaged out.
Today the dollars made by Indians are going to India, which is causing the dollars value to do down, since the indian Forex reserve is propped up by these remittances, as they were exchanged for labor vs exchange for INR.
If the same money is made by americans, the dollars will stay right here, and will be spent here propping the economy up further.

All this cry and spending a lot of time arguing that the candidates who are applying are to be blamed? How do you in your language differentiate between highly skilled and poorly/low skilled graduate?
American Private Companies will take their decisions to their benefit and look for margins and precisely this is is the reason why no private company ever failed so far.
American Private Companies (Clients) do not have an obligation to hire someone based on religion, caste or citizenship. They are making a deal with the Indian Outsourcing companies to get a better deal so that Clients can save too.
There are many republicans who want the cap to be increased as they know how this benefit American companies and government too.
Please don’t show frustration on the actual H1B applicants, if you have guts fight with the American Private Companies to hire either Indians with GC or Indians with US citizenship or the actual Americans and they should have 80% of these people in every company.
Please be aware that there are really talented H1B applicants who wish to work out of USA proudly but they can’t dictate their salaries. Indian Outsourcing companies and Clients (American Privately held companies) work on win win situations.
Come out of your thinking within the box and you will know the reality, it is harsh but can’t blame H1B aspirants.
Unfortunately I think it is too late for this EO to affect this year’s result.
I dont know why Trump would wait till after the lottery is carried out and announced to do this other than to not affect this year’s results.

I agree with you Mr April Fool to some extent.
But, when i checked the LCA count in the DOL (Department of Labor) website of USCIS, it indeed did showed less LCA certified for this year for all these Indian companies, when compared to previous years.
But, what makes me agree with you is that, had the recent turn of events actually impacted them, as it did for a few of the companies (when they finally ended up filing a very few of the LCA’s, earlier CERTIFIED) & if they would have “ACTUALLY” FILED LESS LCA’s, then this Magic number of 199K, would have fallen down further.
But, I also sense something fishy here on the part of these big Indian companies.

Nobody knows at this time, again his action today is to ask DHS, USCIS to come up with ideas to overhaul the H1B, they will mostly have six months to submit their reports, after that a bill need to be passed if the report contains significant changes to the current visa program. Average bill pass time is 263.57 days, median 215 days, minimum 1 day. Once the bill becomes law, yes it does impact new / extension / amendment / cap-exempt petitions.

I would only be speculating right now, as the President still needs to sign the order. Once that has been made public and signed, the blog will update the post with relevant information including who all are impacted.
