If this is your first year of H1B visa filing, you must read What is H1B Visa, Requirements, Process . Not to scare you, Last year, there was lottery for H1B season and for FY 2017 USCIS received 236,000 applications .

When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017. 
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017.  But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017.   If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017.  You may read USCIS Press release for H1B 2017 Start Date 

What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ? 
Update : USCIS confirmed the below quota cap numbers in latest press release for FY 2018. 
To get some background, read H1B Quota – Regular vs Masters .  There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in.  The total H1B Quota as of today is 85,000 and it is split like below.

Regular H1B Quota  65,000
Master’s H1B Quota ( Only US Masters Degree Eligible) 20,000

Out of the above 85,000 quota, 6,800 are set aside for Singapore and Chile citizens as part of the free trade agreement between them. Also, check out the article with history of maximum H1B Cap from 1990 to 2017 

H1B 2018 Lottery Predictions ? 
It used to be a speculation whether we would have lottery in previous years, but in the past 4 years, lottery has become common. It is very likely that we would have lottery aka random selection for H1B 2018 season.  We have been writing predictions over the years and all of them have been accurate so far. When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially  on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
  • Other H4, L1 Visas :  If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.

  • If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
  • If you are professional planning to arrive in US from outside America,  it can be really tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ? 

The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS.  There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary from FY 2017 quota.  If any changes, we will update this accordingly.

H1B 2018 Lottery Results – Checks Cashed, Receipts : 
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date.  To put things in perspective,  last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017…  Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018.  Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?

We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Check out USCIS New measures to report, prevent H1B Fraud  . Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. There are many speculations on how H1B program will become tougher with higher wages, quota limits, etc… but, nothing has been officially signed. We will update the article as new updates come in.

Various H1B Bills  in US House and Senate  – Will they be passed for FY 2018 ?
There are few bills that are introduced in 2017 and at various stages in both house and senate. There are many confusions regarding the same bills like the minimum wage will go up to $130,000 USD, etc.  Fact is that nothing has passed and there are very slim chances for them to get passed before start of FY 2018 season.   1. With so many of Indian students coming out of so many substandard universities in USA, I am sure this executive order is quite detrimental. How on earth are they going to show 6+ years experience. This i believe is only going to force AD guys towards consultancies. Trump has nothing to show for his 100 days in office and he is picking h1 b issue for some air time.

    • Dont think anything will happen this year. The executive order is instructing on finding ways to stop fraud and abuse. They cant just do something like that quickly.

      It will definitely have ramifications next year. They have already picked this year’s lottery winners. If Trump wanted to have an effect this year he should have announced it before April.

      • Don’t underestimate the power of executive order. Remember when Trump issued EO on travel ban? That was effective immediately and people are denied at airports. Well they had visa issued to them too.

        Even with lottery done, the EO can still do a lot of damage. After all these cases have not been reviewed or approved yet.

        • The EO is to research and improve processes. It doesnt say anything concrete or give specific directives.

          If it said something like “Stop all abuse and fraud right now”, it might have affected this year’s result. All it says is something like “Find ways to improve quality and prevent abuses….”.

          I wont count on anything changing this year other than increased scrutiny. They still might open all the applications to make sure one person doesnt have 10 applications for the same thing. But that will be the extent of it.

  2. I belong to the H1-B, Non-Advanced Degree Category for this year from a leading US MNC, working in India.

    Can anyone in the forum tell me, if it is possible to know, using your LCA Case Number: I-200-16XXX-XXXXXX, that if the check has been cashed or your picked in the lottery ?

    Let me know, if there is any other way to find it out, without having got the receipt number.

    [NOTE: Even my Case Manager has confirmed & I have checked with my case on INS Zoom , it shows as “Filed”. Thats the only piece of information I have.]

    Any inputs will be highly helpful !

    • I think I also belong to the same mnc but for me there is no update in the inszoom tool…my us case manager has sent me an email during march last week… that the case is complete and is ready to be filed.Interestingly when I checked with the India immigration team they were towing the same line and were directing me to account leadership for filing status…not sure whether they filed it or not

        • INS ZOOM is a third party tool and it does not belong to any one company as you mentioned. I am from IBM and we also have INS ZOOM.

          So please get your facts right before posting.

          Its an individual’s choice where he or she wants to showcase his or her company’s name.

          So better we should concentrate on H1B, rather than these silly stuff !

  3. I know some people are checking their SEVIS status to check whether they are selected in lottery or not.

    I found the online ICE status check for I-901 (SEVIS) but not sure if this is right or enough information to determine the lottery check.

    • That is fee status of SEVIS when F1 Student goes to visa interview initially. Only DSO can access the actually current SEVIS system

  4. Has anyone from any of the Companies, who belong to the Non-AD (Advanced Degree), got any news of yours/ of your friends (whose LCA was filed), received any acknowledgement of the H1B receipt numbers.

    Correct me if I am wrong Saurabh/Kumar. So far I have not seen any of the Non-AD cases Receipt numbers being shared on this forum.

    If anyone has any kind of information or receipt numbers having received for the Non-AD category, kindly share the same.

    This will wipe out BS degree holders h1b aspirations unless they meet salary range as MS degree holders.

    Entry level MS degree holders will be in trouble unless they meet salary level as Tier 1 companies.

    This process will again force MS students to approach desi consultancy to show 7 yrs fake exp to get client letter/SOW and apply visa as highly paid professional.

    Indian MNC guys have to look for other geographies accounts otherwise quit current every three yrs with 50 percent more pay so that atleast by 8 yrs you can get a chance to travel US.

    Dont fall prey for the carrot given by Manager/Supervisor .

    CTS has 75 percent US revenue so chances for a 6 yrs exp travelling onsite is very minimal from next year

    TCS US revenue is 55 percent and they have more UK , Canada and Europe accounts.

    Hope process will be get cleaner soon and paves way for experienced or highly paid professionals.

  8. According to WSJ (https://www.wsj.com/articles/new-york-educators-fear-losing-a-coding-whiz-1492377131), in 2015 the % of AD in H1B RECIPIENT was 54% (check the pie chart in article). So let’s reverse engineer the % of AD in APPLICATIONS:

    Let AD=X, then NAD=233000-X. So in the second round, we have X-20000 AD, and 233000-X NAD. Among all final recipients, 46% or 39100 is NAD, and 45900 is AD. So in the second round, NAD/AD=39100 /25900. IF the second round was RANDOM, then (233000-X)/(X-20000)=39100 /25900. Solving the equation, we have X=104872

    So even back in 2015, we had over 100K AD. I guess this year we’ll have even more. You can get the chances for AD from this starting point.

        All I can say is that if it was 104k in AD, then the probability of selection would be 44%, not 54%

        Around 60k AD for 2015 leads to 54%

    I am on OPT and due date is April 24.This is year applied for H1-B and wanted to check on cap gap requirements.

    Do I need to submit any documents to my DSO to get cap gap extension? or it Will get extension automatically?

    • Arun,

      If petition is selected in lottery, and duly filed w/ COS, then cap-gap should be automatic. In some cases when its not updated automatically, you will have to show your receipt notice to your DSO.

  13. For somebody interested in probability…

    Last year applications were 236000 and this year they are 199000.. (reduced by 37000)

    Assuming all that reduction attributes to applications from Non-AD (India) owing to TCS, Infosys etc filing less.. (Masters applications will not decrease due to the amount of students came one two years back + last two years rejections added)

    if we assume last year masters were 35000 (15%) (which may be higher), then this year masters should be 35000 + 37000…. = 72000

    probability for a masters student… 20/72 + (52/72)* (65/179) = 54%…..

    nothing but a coin toss….

    • adjusting for Chile, Singapore.. (65-6.8 = 58.2)

      20/72 + (52/72)* (58.2/179) = 51%…

      we may also need to adjust for Masters from Chile, Singapore….

  14. So this is my fourth attempt and all of these been through genuine companies(tier 2)

    I seriously don’t have any hope left for this year. And not as impatient as last three years where in every hour I use to check for updates.

    I guess with last three unsuccessful attempts have realized that h1 is pure luck nothing else matters, be it your skill sets or overall work experiences and expertise.

    I wish all others here all the best and hope deserving candidates make through this time.

    Back to class XII, permutations, combinations and probability.

    Assuming 20% are U.S Masters (as suggested in the article)

    so:
    Round 1: AD ONLY
    39,800 applications
    20,000 spots
    = 0.50

    Round 2: AD leftovers + Non-AD
    179,000 Applications
    65,000 Spots
    =0.36 Chance

    TOTAL PROBABILITY for AD:
    0.50+0.36 – (0.50*0.36) = 0.68 or 68 %

    TOTAL PROBABILITY for NON-AD: 0.36 or 36 %

    Looking better than expected.

    • Since, we do not have information for No. of masters, that’s the conservative estimate of probability for masters.

      • No it is not! Let me calculate worst case for master people. Let’s say 100k master and 100k regular (its clearly impossible ). so probability is 20/100 + (65/180)*(80/100) = 48.8% (selected in master or not selected master * selected regular)

        Your number lower than the worst case!

    • You have calculated the probability wrong it should be (20K/The Number of AD applciations)+(65K/199-The Number of AD applciations-20K) for masters

        if no. of AD is 30,
        then 20/30 + 65/149 > 1..
        probability cannot be more than 1..

        but worst case prob is 42.7%

        • Stop embarrassing yourself.

          Where did you get the denominator 149 from? It should be 199-20=179. Why would you subtract the number of AD (30) from 199, as unselected ADs come into the non-AD pool and get a second chance?
          Also, you need to multiple 65/179 by probability of AD not being selected in first round (10/30=33.3%).

          so AD = 66.7%+(65/179)*33.3%=78.8% for your example

    • will see. if petition from dependent company is selected doesn’t mean that it won’t get RFE. it doesn’t mean that it won’t get DENIED. it doesn’t mean that visa would be denied. so if such petition was selected – this place was wasted. wasted with other waste cheap labor

    • I have 9+ years of experience with AD (also an IIT alumni) currently working for Tier-1 software company (FB/MS/Google).
      This is my 2nd trial. According to my calculation (given that it is random for all with equal probability) – My chance is 55%.
      If each year’s chance is 30% then it will take around 13 attempts to get probability of winning to 99%

      • It’s my calculation. We can agree to disagree though.
        I’m already in US. Last year, I could co-relate my calculation with my friends’ results who got their H1 in 2nd or 3rd attempt (as my equation predicted due to higher chances with more number of attempts.)

          I think your calculation should be in the ballpark.
          However, there are some 6k H1s reserved for ppl from singapore, chile etc.
          SO it is not really 65k

            Agreed. We don’t even have entire 65K seats. Try replacing per year probability to 25% and check your chances.

    • I don’t think this is correct. If there are more than 20000 applications for AD, then the remainder are added to the 65000 CAP, which eventually reduces the chances for Non-AD even more.

      i.e 199000-20000 = 179000 (this contains AD + non-AD)

  18. Just heard from one of my friend, that some of his friends who applied through multiple consultancies got picked in lottery. Definitely USCIS did not scrutinize any applications for lottery. Consultancies wins again.. Feeling sick!

    Dear xxxxxxx,

    I see in SEVIS that your change of status is currently pending with USCIS and you are eligible to request a cap-gap extension.

    A cap-gap extension is a regulatory provision which extends an eligible F-1 student’s status to bridge the gap between the end of F-1 status and start of H-1B status, thereby allowing the student to remain in the US during the “gap.” The cap-gap extension is available to students who, as of April 1st were either on approved OPT or in their 60-day grace period and have a pending or approved change-of-status to H-1B petition filed with the USCIS prior to the expiration of their OPT or within their 60-day grace period.
