When will the H1B visa 2017 season start ? Date ?
Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016. The H1B Visa 2016 season started on April 1st of 2015. Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year. As of now, below are the H1B cap number for fiscal year 2017. The below numbers are confirmed in press release by USCIS on Mar 16, 2016.
- Regular H1B Quota : 65,000
- H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
- Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.
There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000. No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.
- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa. Unlike, if you are coming from outside US, it can be tricky. If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA. Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. Also, one key change is that, there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ?
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.
- H1B Cap to be increased from 65,000 to 110,000 per year. Also have provisions to have it up to 180,000 in case of extreme demand.
- Advanced degree from US cap quota to increase from 20,000 to 25,000
- The Filing fee for H1B could go up to 10,000 USD ( Part of this came up as the fee increase in Omnibus Bill )
- Additional H1B rules to avoid H1B Visa fraud by employers
- Mandatory LCA posting for 30 days before it is certified.
The current status on all of the above are basically “No updates”, there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.
What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS. It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016. But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th. USCIS may process the petitions early as well, but officially their clock starts on that day.

In most of the cases there is some missing information which they need. Till now i haven’t seen any of my friends getting rejection after RFE, though it may take time.

Chances of approval depend upon how your employer/attorney addresses the RFE. It could be a simple RFE like missing document or signature; or could be complex one like proving specialized knowledge, employer-employee relationship etc.

It depends on your company or consultancy.Last year i got RFE for my case.Seems the company Continental technology solutions inc from Texas was doing some malpractices and my petition was rejected.So,the USCIS decision based on your company and how they respond to your RFE.
For the benefit of all H1B applicants, I would like to share my experience regarding lottery results. I am working in a top tier MNC company and got selected in lottery. I came to know the status through my Delivery Manager and confirmed it via Client Account Manager(Sponsoring Employers Account Manager).
The lottery was shared by USCIS to my MNC on May 18 itself but the immigration team of my company is not sharing it with the all of the employees. If contacted they ask us to wait till end of June. The main reason is that the management is afraid that the attrition rate may increase and the project deliverables may get affected if they share it now.
To all those who wait for an update from Immig team, I would advise to know which employer has sponsored you and then to contact the Delivery Manager or point of contact of that client/Account manager and get the status. The immig team would have shared the lottery results to all the sponsoring employer accounts.
I was able to know my status this way and hope this helps few of you.

Yes, you haven’t made through the lottery as all selected petitions have been notified by now.
Saurabh my employer still didn’t get hard copy of receipt. Once check was encashed they gave me receipt number. So i think employer should look for check encashment

I am planning to apply H4 for my wife and the first available appointment is august 30th 2016 and I am getting married on June 22nd and supposed to take my wife along with me on July 08th. Since the available time is august 30th, can I apply visitors visa for my wife where the next available appointment is June end and make her travel with me and then apply H4 and take interview on august 30 th. Please key me know.
I can understand your anxiety, it is normal to want to take your wife with you after marriage but tell me if she will go with you on visitor visa will you again come back for H4 interview in August?

If you hold H-1 then your wife should appear for H-4 and not B-1/2. Here is a recent experience where someone tried this and received rejection.

1.My Own passport is going to expire in feb 2017- My company has told me to hold on with renewal till my approval comes in. Does it matter to renew/not renew till my approval comes in.
2.My Wife’s passport :Also going to expire soon. But do i need to wait for renewal of her passport or go ahead with her renewal with my name endorsement. Does my H1B waiting for approval has any issue with her renewal.
3.My Son’s passport:I have to freshly apply for my son’s passport. Should i first endorse my passport with wife’s name and then her passport with my name and then after getting our new passports,apply for son’s passport.

What’s the validity of your ration card?
As long as it is valid, passport is a secondary requirement

1. IMO, it can be renewed even while petition is under process. However, if employer thinks otherwise, then you should go w/ their opinion.
2. She can renew her passport now. No issues
3. I don’t know if it a requirement for parents’ passport to have each others name or not. If it is, then you should get your passports renewed and updated first, and then apply for son’s passport. If not, go ahead now.
To add to Saurabh, for 3. Yes, it is mandatory to have the parents name endorsed for issue of passport of child. You can apply for your kids passport and get name endorsed on the same day. Check Spouse Name Endorsement Minor Passport Experience

Maybe the employer hasn’t received the receipt number and making-up stories to buy time. If the cash was really cashed and he hasn’t received the receipt number, then he should be calling USCIS to trace it.

Dear Anti-Con(sultancies, not all the consultancies are fraud. Upto my understanding people who applied for h1b , more than 60% have been gone through the consultancy only. Its the applicants greed who chose the wrong one or misguided by friends or someone. Even mnc also didn’t updated the results properly to the applicants, so what would you call them?
Dude, MNCs are not taking money from you. My personal opinion is, they have zero responsability since they are already paying for your work.
I hear from friends that they are being cheated by mncs, moaning like gov employees. I tell them to just change the company if you can for better salary and life style.
Making bad decisions and blaming others is not going to yield any results.

Yes. Because the concept of Computerized Random selection with emphasis on “Random” means there is some kind of a preference for some over the other.

There is no preference when it comes to selection in lottery. However, chances of approval are higher for MNC than a desi consultancy.
FYI, a lawsuit has been filed against USCIS to provide more information about the lottery. At the moment the process is like black box and the lawsuit forces USCIS’ hands to clarify how the process works.

Is there any differentiation between PP & RP while sending rejection packets? I am PP and have not heard anything till date i.e. not selected but also have not recd. rejection packet.

I don’t think there is any difference b/w the two when it comes to sending out rejection packages. PP checks are not cashed for non-selected applications. So why would USCIS give them any preference, if they are not charging for it.

Will they prioritize the petitions originally applied at their office? I mean, if they transferred my petition from Vermont to CA, will my petition be adjudicated after all the petitions originally filed at CA are finished?

I don’t know if they will adjudicate all CA petitions first, but my guess is that you would retain the priority order from VT.

Mine still says case was received also Non-AD/RP/VT and starts with EAC16146, I been wanting as everybody to change (to approved of course) but with people getting RFE’s I think I don’t anymore… good luck just try to get the info requested back to them so you guys get your visa approved, at least you know someone is already reviewing your case 🙂 cheers!!!

1st stamping should be always be in home country unless there is a good reason which I don’t see in your case. I suggest you to wait for appointment in India. Project can always wait.

How did you check available slots? You need to pay visa fees to be able to see availability. The wait times shown are inaccurate when I asked a few people. I am travelling to India and need to know availability as well. I have an existing H1. Can someone confirm available slots for Mumbai in July? This is frustrating because I already made the travel plans and figuring out whether I need to change them. But I cannot see availaibility until I pay the visa fees.

1. Selected in H1b Last yr & after couple of RFE’s it is now in Security Clearance. Came to US on H4 in Sept 2015. What might happen if I travel to home country now? If it gets approved in while I am outside US, can I get stamping done there? Or is this a case of rejection?
2. Applied this year also with COS, through a different employer. No update as of now. Now, what are the possibilities of going to my home country in this situation, assuming will go thru this year’s lottery.Will it create scope for RFE/rejection?
Feel like I am trapped in here. Please suggest. 🙁

1. The petition’s outcome doesn’t impact your travel plans. If approved while you are outside US, you can appear for H-1 stamping. However, the wait times at consulates in India is average 2-3 months.
2. If you haven’t heard anything about this year’s petition; then there is a high chance that it didn’t make through the lottery. You can assume the worst (i.e. non selection in lottery) and continue w/ your travel.
My employer a consultancy just said “your h1b picked” on april 28th after that no news. Is this the attitude of all consultancies? will they share info only after approval?
Ask them the receipt number..

I don’t think it will cause an issue. Going forward, you should always list all your previous names.

My H1B visa got approved on Nov2015, but my company(US Employer) has not sent for h1b stamping due to lack of projects. They told to wait till the situation comes to normal. What are the options I have now apart from wait and watch?
a. Can I know for how many years this H1B is valid without stamping.???

h1 is valid for 3 years and can renew 3 more years
direct answer is NO, as you got h1 picked its better you come through same employer
you cant do h1 transfer now,you can only do once coming to US that too after having few months payroll.
end of the day simple answer for your current situation is you have no way left.only you need to request your employer.
Your best option will be to find another employer who can file a cap exempt h1b petition. This normally called transfer.
Since you never used your existing h1b petition, you may get an RFE… but mostly in good shape if your new employer is genuine. It depends on your luck too.

Your H1B petition is valid for 6 year and you can use anytime between that time frame. Also. once you start using it, it will start counting for another 6 years.
Regarding Transfer, you can do transfer without Pay Stub.

H1b transfers are always possible. My close friend got h1b from infosys but was not stamped, and next company he moved to did the h1b transfer and got the visa stamped. So do not worry. Find a new employer who can do the same. All the best

It is one of the loop holes that the US government has to address. Spamming H1B applications should be banned for capped cases.
This won’t help – it’s companies, not employees, filing the petitions. If USCIS prohibits people from filing multiple petitions even for different employers, employers will find people to fill the gap, there is more than enough people in the world willing to come to US. The only way to fix this bottleneck is temporarily raise the cap, as they did in past.

Filing through different multiple unrelated employers is allowed. However, there is a chance that USCIS will issue RFE asking for proof that employers are not related and didn’t schemed to filed multiple petitions. If one of the employer is big firm like Google and other is a consulting company, chances of such RFE are reduced.

RP approvals started couple of weeks earlier. This is not the first one. I saw couple of approvals on May 23.

More or less its the same timeframe. We still don’t have enough data to gauge what their speed is, and whether they would be processing all ADs first prior to non-ADs.
As of now, i have not received receipt and check has not been cashed. OPT period is running out. I believe only GOD can help.
Are you eligible for OPT extension? This was my first try. I haven’t heard anything so didn’t make it. Just wanted to know if most people get H1B while being on OPT.
I am on 17 month opt extension and not eligible for additional 7 month. 🙁

Because my OPT is going to end very soon, if I change my status from F1 to F2, do I need to do anything about my current H1B petition ? What if after I file the change of status from F1 to F2 and I receive the H1B receipt number, am I still eligible for the H1B? Do you have any suggestions ?

There is no action required on your pending H-1 petition. By miracle, if it gets selected now, they would most likely issue RFE asking for proof of F-2 status. You can then submit the updated documents. This would be a RFE which can easily be addressed.

My company is planning to apply L1 for me. However, my H1B is got selected this year from other party consultancy.
So,
1. Can a I have a both valid L1 and H1 visa’s with different employers on my passport. I know it will not be case, but just wanted to confirm.
2. If I go for H1 interview, will they cancel my L1 if I already have a valid L1 .
3. Or if I go for L1 with my current company where I already have H1, will they cancel my H1.
4. If I travel on L1, can I attend for H1 in US with different employer.

1, 2, 3. It will be visa officer’s discretion whether to cancel the previous visa or not. At times, they can let both remain; but other times they would cancel the old visa stamp.

1. My responses 1,2,3 hold true irrespective of whether H-1 is stamped first or L-1. (4) makes the assumption that the person has H-1 petition approved and then travels to US on L-1 visa.
2. Yes, doesn’t matter if H-1 is stamped or not. Petition approval matters.
3. A person can stay in US on L-1 for at most 5 years. So this needs to happen prior to that. If the H-1 petition is still approved and you want to move to that H-1 employer, then only COS is required. If the petition has expired or you want to move to a different H-1 employer, then COS + H-1 cap-exempt is required. Usually it needs to happen within 6 years of original H-1 approval, but USCIS seem to be going easy on this requirement.

There is no option to attend interview in US. It has to be attended at a consulate outside US, preferably home country. When inside US, COS is the way to change visa status, which is what I explained in my response earlier.
One is eligible for dropbox only if the person has visa stamped in same category which has expired not more than 1 year ago.

I dont think they have released the 2nd list in June, selected cases were announced May itself.
My friend from Infy got lottery selection in June.
They won’t get the lottery selection in June. They would get it by May . Infy holds it till June, July or till whenever they seem fit based on the case and then let you guys know. So if the same thing happens this year, it does not depend on USCIS but it depends on Infy alone.
