When will the H1B visa 2017 season start ? Date ?
Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016. The H1B Visa 2016 season started on April 1st of 2015. Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year. As of now, below are the H1B cap number for fiscal year 2017. The below numbers are confirmed in press release by USCIS on Mar 16, 2016.
- Regular H1B Quota : 65,000
- H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
- Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.
There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000. No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa. Unlike, if you are coming from outside US, it can be tricky. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA. Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. Also, one key change is that, there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ?
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.
- H1B Cap to be increased from 65,000 to 110,000 per year. Also have provisions to have it up to 180,000 in case of extreme demand.
- Advanced degree from US cap quota to increase from 20,000 to 25,000
- The Filing fee for H1B could go up to 10,000 USD ( Part of this came up as the fee increase in Omnibus Bill )
- Additional H1B rules to avoid H1B Visa fraud by employers
- Mandatory LCA posting for 30 days before it is certified.
The current status on all of the above are basically “No updates”, there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.
What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS. It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016. But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th. USCIS may process the petitions early as well, but officially their clock starts on that day.

Gotta a doubt. Say if 4/10 got selected from a team, does that mean rest 6 cannot expect anything in the second list?
There is no second list from USCIS. The second list is strictly an internal list. The majority of the people who are selected are already intimated. The next list might or might not have selected candidates. It does not mean second list is the selected list and the list after that is rejection list. As days pass by the chances diminishes, but until you get “Rejected In Lottery” its not over, so keep praying and wait and watch.
So, even if I was not notified about my selection yet, I have chance?

I do agree with your comment that ,there is no second list as such…. May be very less number of people get intimation in the coming days…. All others have to think about PLAN B( what is there in their mind)… I am loosing hope day by day….. If we think about next year, there ll be very less chances to get through as the number of applicant will be very high( nearly 4 lakhs)…….There is a very less hope for another 2 weeks…..After that the game is over……

Nothing like that..it’s a true lottery which means all remaining may be selected or none of the remaining 6 may be selected….Just that, with USCIS having sent out all the receipts a few weeks back, Infy should have received it and updated it on 19th May…If however, there is a delay in collation and internal update from Infy’s side, then the remaining receipt nos. may come in 2nd update, however chances are going down with each day….

So far from the case numbers of my friends I know, first 3 letters are either EAC or WAC. FYI – Case numbers can start with LIN, SRC, EAC, WAC, IOE etc as per the location they sent from. So, do any of ur friends has case status starting from the remaining three ?
Does the case numbers differs depending upon the work location for which the visa is been initiated for? As far as I know people whose visa is been initiated for Washington, New York received their file number.
For H1B the cae numbers only start with either EAC or WAC. There i no LIN, SRC, and others.
So, all he applicants will have either EAC or WAC.

I have got my receipt number and the status on my employer’s portal shows RFE received. The case status on USCIS website however says
“On April XX, 2016, we received your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number EACXXXXXXXXXX, and sent you the receipt notice that describes how we will process your case. Please follow the instructions in the notice. If you do not receive your receipt notice by May XX, 2016, please call Customer Service at 1-800-375-5283. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.”

Not sure where your employer portal is pulling information from. However, from USCIS status message, it doesn’t look like RFE but Case Received or Initial Processing stage.

Out of 10 in my Project, three ppl got the Receipt number. One of them have status as “Case Received” and remaining have status as “Case Transferred To Another Office”. I have around 9 years of experience.
Is there any chance that after this status I can get RFE?

No! This does not mean that ull get RFE..all it means is that due to heavy number of applications being processed at vermont center, some of the applications are being directed out to another center for processing which in turn lowers the burden on onr center and also helps with faster processing of applications! ! Good day!! 🙂
everyone seems to be very anxious. From my point of view, if your application is LEGIT and you don’t have anything to HIDE, you have nothing to worry about. Your best bet is to understand it literally. You don’t have to imply because you’re not an USCIS officer.

From B’lore location. We did not get any mailers stating RMS will be down. It’s updated in the Portal itself. May be the maintenance activity is scheduled location wise(Just a guess though).
Anyway, how do you know that it was on Monday last time? Did you initiate last year too ? If so, could you give me an Insight how the communication would be ? Will we be informed even if our file is not picked in lottery ?
Ya i saw that status on RMS portal, I checked later. I believe this downtime is globally applicable.
Last year my petition wasn’t filed, however, my collegue’s was. Accenture will inform you in case of rejection as well. If your package is not received by company then they would provide you status status as “On Hold”. You shall receive communication over the email. Also RMS status will be updated. Please Let me know if u receive any news or updates. I’ll also keep u all posted.

In CG for everyone it shows as RFE in their internal Portal. Get the Receipt number and check on the USCIS portal for the correct Status. They will update the CG Internal portal soon.
It’s not an RFE. Its’s just that the next status on the CG Portal is RFE Received and Pending. Focus on the “Pending” part. Everyone who has their application picked up in lottery will see this status for now. I have the same status, but if I check USCIS status, it just says my case is transferred to another center. Nothing to worry.

If you are able to check the case status online, then that means receipt notice was received somehow – through receipt notice or receipt number printed on behind on cashed check. How do you know it is your receipt number?

Receipt number can be known either through receipt notice or through cashed check copy. Not sure how your employer came to know about the receipt notice. Do you have concerns that the receipt number may not belong to you? If not, then it shouldn’t matter if receipt number was known through receipt notice or otherwise.

Yes, the receipt notice will have the receipt number, your name and employer name mentioned on it. Having access to this notice will confirm for sure that the receipt number belongs to you. Until then you are relying on what they just tell you.

First the petition needs to be approved. Only once it has been approved, you can appear for visa interview. Follow the petition status online to track its progress.

On 16 may when I checked my company’s system, it showed documents obtained for validation under processing status.
But today when I checked again it is showing ”RFE Received” under processing status . what does that mean ? Is my case picked up in lottery ! Dont worry. Your application is picked up in lottery. I am assuming you are from CG. Check the actual status in USCIS website. That will give you the actual status. Ignore the RFE status for now.
Please contact with mobility team. they will clear your doubt. provide your EMP ID and ask for status

IBM blore – For Two particular Accounts that i know of. Roughly 60 people have applied, and 5 of them got their receipts until last week Friday 5/13.
The receipts have come in hoards and the team at onsite has been ratifying details and collating a list / report. We would update as soon as we have a clear list from these sorting or receipts received at our US office. There would be emails sent to those whose cases have made it to the lottery and receipts received by us. There on the updates will reflect on the individual GICS records (File Number will be updated and that means selected in lottery) For all the record where file number is NA, that means we are still awaiting result (Selection or rejection). Please keep a track on GICS record as if we receive a return check, record will be invalidated or if we receive a receipt notice then file number will be updated in visa details.

Do you know if H1B for VT unofficially complete. I work for a small-sized US company – applied on AD/RP/VT. The attorney said they have not received a receipt as yet but wanted to wait till mid-Jun or later to confirm.
However I have to get my son enrolled in school in India if I do not get H1B this year. If it is already 99% certain I did not make it into the lottery, I want to get my son into school and looking for another job in India. Thanks in advance for your advice

Well, we are currently in USA – currently working on OPT. If my H1 is picked up, me & my family can continue here and do not need to travel to India. That is why I was asking if unofficially H1B lottery receipts are done.
Only in that case, it makes sense for me start planning for his school in India or me looking for a job in India. Otherwise the travel & school will be non-required expense.

I would say chances of getting receipt now are pretty low. So it is better to start working on backup plans. The attorney may have asked to wait till mid-June as they are waiting for rejection letter, which will officially tell that you didn’t make through the lottery.

Yes you can still travel on B-1/2 before you appear for visa stamping. The trip should be for a valid reason (tourism or business) and should not involve any productive work being done for an employer. If the trip is short, you may not be asked about it during stamping. However, for a long trip you may be asked about the details as VO would like to ascertain no B-1/2 rules were broken.

Hi All, I am from Infosys, please help me with my situation. I have applied for h1b in 2015 from a private consultancy based in US. Got picked in the lottery, however, I went for stamping and they denied to stamp as my consultancy couldn’t provide me with all the right papers(client letter etc). Now they sent my petition back to USCIS for review, and it is stuck with them for more than 6months now.
I have recently learnt that I can get my petition transferred to other companies(without going through lottery). In this scenario can I approach my management to consider transferring my h1b to Infosys, or does the Infosys policies wouldn’t accept my case altogether?
Really appreciate if anyone could throw some light on my case.

No, they don’t do such transfers. Also check with attorney because, some says its possible to get the transfer without Paystub and some says its not possible.
Paystubs are needed to show the maintenance of status, if you’ve never been to US on H1B, then no paystubs are required.

Application picked up in lottery. I am ok H4 and have applied for extension. My H4 will expire on 3 Sep,2016.
1. If USCIS issues RFE for status proof till 1 Oct and I don’t have the approval of H4 extension by then but have the receipt number, will the receipt number of H4 extension suffice to respond to the RFE?
2. How much time can it take for H4 extension to be approved if applied now?
My opinion is, H4 extension depends on the H1 end date. The extension oh H1 took more than 6 months for my friend. He ended up chaning to premium to make it fast.
If you applied H1 as COS, you might face RFE.
But if you applied as normal counsellor notice, you will need to get a visa and reenter in October.
I am in same situation like u. H4 to H1, got picked up in lottery and H4 getting expired on August 30th.
Have you applied for H4 extension? My visa is consular and not COS, so I will have to get it stamped by going back to India. Though I have also applied for H4 extension. Not sure if last approved rule applies here since my H1 is consular.

From your message it looks like no COS was applied.
1. No RFE would be issued for proof of status as it is w/ consular processing.
2. H-4 extension would be I-539. You can check the processing time for your service center on USCIS site. Typically it is few months (4-6) but exact time would be determined based on timelines published.
This is for all of them who are getting frustrated by GI team’s act of not showing any transparency in sharing the news for next batch of H1B file number release.
I also fall in the same category, but then I thought that they might be doing it intentionally; releasing the successful H1B cases in batches so that people (who have not been selected) wait till their rejection letters are out.
If I’m thinking right, the batch which is already out had the maximum number of selected cases. And certainly there will be a second or more batches coming up with very less number of selected cases.
So yes, you can still hope for your name to be selected, but you need to be the luckiest person from the group of all the unlucky ones who didn’t get their name in the first batch 😉
With that said, I would suggest, whether the new batch is coming up or not, just don’t get frustrated/depressed and don’t let it affect your work. Just plan your next move wisely.

Last year I applied through a small company and none of the petitions made it through despite the average probability. So better don’t keep your hopes high and think on plan B.
It might be valid, only if you are talking about batch/list within your company (mostly due to internal politics). And mind that only 33% of any company will be selected due to lottery numbers.
USCIS finished all its notification and PP applicants started receiving approval/RFE notice now.
That is not how it works. That is not how any of it works. Mind that only 33% of the entire application lot will be selected. Not 33% of the company. Scaling it down to company level and team level doesn’t make any sense. 33% of the entire lot of applications will be selected and that might mean a 100% selection rate for some small companies and may be 10% rate for some bigger ones. This is not a logical lottery and so there is no way that each company is going to get a 33% selection rate.
True that….if we only had some data though…Last year Infy applied almost 24k applications….Someone mentioned it has applied for 8k this time…. Seems too less IMHO
I too have heard some people saying that we can still expect a few hundred receipt numbers of the selected cases. That’s it, not more than that.

RFE means Request for Evidence which your employer need to submit the required supporting documents to get it Approved.
Please ignore the RFE status. Its just the next possible status for your application. for the real status check USCIS website with your receipt number.
CG statuses are confusing. I was in the same boat as others. But after checking the actual website USCIS…there is no RFE. Its just a stupid status which is confusing everyone at Capgemini.
