When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.     Hi XXX,

    Thanks for the follow up. I definitely know how stressful this time of year is waiting for the H-1 lottery results. I would not give up hope just yet, we are still receiving email notifications for case receipts. Last year we received notifications through the last week of April. Hopefully we will receive additional notifications in the coming days and may have some good news.

  2. Dear PP Aspirants,

    Do not lose hope and stay positive. It is common that some email notifications might bounce back/undelivered for AD/Non AD PP applications selected in Lottery. Hard copies of the receipt will be sent by post to the Employer/Attorney for the AD/Non AD PP applications. From yesterday many of the attorneys started receiving Hard Copies. Be positive and hope for the best….

    My premium processing check got encashed today, but I did not get any notification from Fragomen not the IHP portal of Fragomen got updated. Does that mean my application got picked in the lottery? Or are there still cases where the check could be encashed without getting picked in the lottery?

    • How do u check if your check has been cashed or not? Cause, PP check has been issued by my sponsor, so I would not have an access to the bank information. Did your lawyer notify you?

      • I had to pay for my PP as my sponsor was not willing to pay for PP. So I gave them a check and today I saw that it got encashed.

        • gg – It is illegal to pay for your H1-b’s application fee. I haven’t paid for my H1-b application. I only paid for the ‘Premium Processing’ fee which is $1225 and is legal for us to pay.

    • Fragomen typically updates during 4pm-6pm EST for the day. Keep your fingers crossed. However, check cashing and sending confirmation may not happen on the same day.

      • I m not sure if USCIS makes a fool out of pp fees as what i can figure out is they are processing all irrespective of pp or regular. Only diffetence is the pp are getting notified by email against the regulars being mailed

        • For PP, your petition gets approved/rejected in 15 days. for RP, it will take ages to get approved. If any RFE comes , then it will take 0-90 days for them to process the RFE. So PP is more preferred than RP. you will be relieved from tensions once your petition gets approved.

    • It seems like above number is from request for premium processing services, not initial application. I just checked a friend of mine who got picked in premium processing, in his it doesn’t say anything about premium processing. It just says case was received and a reciept notice was emailed.

    • You need to log in to your Fragomen profile to see it. They usually update the receipt number the same day evening (EST) they receive it. They do not mail you separately. Hope that helps.

      • Fargomen attorney worked on my case as well. AD PP CSC . I never received any email or updates from him.
        How do I create my profile to see these updates ? Could you please tell me ?

        • It may be different based on the employers, but for me I had to create a profile with Fragomen when I joined. I had to fill out a NIV & PR questionnaire at that time logging into that profile. I was also waiting for email from attorney/paralegal based on the discussions in this forums, but then one of my colleague asked me to check the profile. If you have never created a profile/ filled out a questionnaire, I think you should contact your HR/attorney/paralegal.

  5. I hope all applicants with single application only, especially those who studied in US and invested their time and money get picked only.
    Hope US government brings in a new bill, which gives higher preference to people who studied in US over people from Indian IT companies, many of whom have fraud degrees and fake work experience. I hope next year, h1b fees are increased further for foreign companies. Misuse of H1bs by Indian companies has to stop. There should be fixed quota for Indian companies every year – 5000- 8000 should be enough .

    • agreed bro..Preference should be given to MS grads who are from top schools only, not for the candidates who are not able to crack job interviews in india, who didn’t got decent graduate percentages, GRE and IELTS scores, who joined in worst schools jus to complete Masters in USA, who work for desi consultancies with fake resume, fake skills, fake interviews….

  7. Stop whining about multiple petitions guys. Entire H1B process is screwed up. A lottery should never decide who gets to keep his job. Everyone participating in a lottery is wrong in enabling to continue this process. If every one of us strikes, then Congress will hear the noise. That’s when they will decide to work on a bill to filter false positives.

    So, stop living in a fairy land where you somehow think that you are the one with a pristine self-conscience because you applied for H1B with only single petition. Just imagine, since killing is wrong, it doesn’t matter whether you kill one man or two men. Both are equally rotten.

    • How are people who studied in US at fault? They are more de.
      Only Indian IT companies are to blamed for H1b misuse. They spam with thousands of h1b applications, just to increase the probability of applications getting picked. Even with little visibility of projects, these companies file disproportionately higher number of H1b applications for their employees with fake client letters as a retention policy. Only a small percentage of H1bs are used by Indian companies every year. Rest are just used as buffer to get new projects. These should be annual limit of the number of visas issued to big Indian IT companies. People who have studied in US and invested their time and money are more deserving of H1bs. Even people from other parts of the world who aspire to work in US but can’t beat the odds due to Indian companies spamming thousands of h1b applications.

  8. Is lottery is 100% lottery?

    Is their any minimum guarantee for each company may be 1 – 5 etc?

    Is their minimum guarantee according to job like what if all selected or only one profession?

    Is their minimum guarantee according to states?

    I think looking at my friends h1b rate, the company which files 1 or 2 h1b get picked up. Is there any body who has their company filed 1-2 h1b and not picked up.

    Note: Threre may be chance that application is not filed properly.

    • Last year my company filed 3 H1Bs. Only one got picked.

      I don’t think H1B selection is anything but lottery. I am pretty sure USCIS would not involve in coming up with a fair regulation on their own.

    • My company file just one H1B last year for me (Non-AD/RP) and I wasn’t picked up.
      This year they have filed for 3 H1Bs and mine is AD/PP. The other two are AD/RP and Non-AD/RP. We haven’t heard anything yet.

      So I don’t think they look at companies. My company is not really a small company (6000 employees).

    • Every employer is given with equal oppurtunities. Random lottery will pick up each unique employer with some n percentage number of applications based on = available visas/Total petitions received. In this case this year going to be 36% of petitons from each unique employer will get picked in lottery.
      2014 my employer filed 1000 visa, got selected in lottery are around 850
      2015 my employer filed 400 visa, got selected in lottery are around 150.

      So hope for the best..

        A friend of mine asked me the same thing last year, as their employer said they will provide the LCA number to track the status. Turned out to be fraudulent!

        @Hope&Believe, I truly hope and believe yours isn’t one such but request you to be cautious if you have to pay the processing fees yourself next time!

    • Yes. The fact that only 2 or 3 AD PP receipts were sent out yesterday makes me think that it’s almost over for AD PP guys.

      They will issue receipt numbers for only selected PP petitions. The unselected ones should start receiving rejection laters in couple of months time.

    • You ll get notified via your lawyer or employer if your petition has been picked in the lottery. .lottery has already been conducted on 9th April. . Wait until 2nd week of May for the results. . All thegbest!

  15. What is the worst that can happen if we don’t get a US Visa. We might stay in our Motherland or we might go to Non-US country.

    Our life will go on and we will be more or less satisfied.

    Life is like Mutual fund SIP, in the long run we are going to get benefit out of it and the average profit will be 12% – to 15 %.

    So will it make a difference going to us

    • Yes, there are many, but irony of life is , so far we don’t know them, and even we know then it doesn’t matter.

      Be patient, RP just started last friday (a guess only) and there are AD/RP and Non AD/RP and have seen daily data entry rate of USCIS is 3-4k (in both centers) this includes non lottery petitions as well. so imagine the amount of time taken in data entry and postal mail, till your employer/attorney and then to you. Forum will be in action next Monday only.(Receipt flood is coming).

    We’ve filed H1B in Premium Processing with Advance Degree.

    I was told by my employer premium processing check has been cashed by USICS (knowing this news, I’ve celebrated :-P) one week back, I didn’t hear about the receipt number yet.

    Today after a week I tried to reach out to my university DSO to check if there is any update on my SEVIS, they didn’t provide me any information and they asked me to check with my employer 😀

    I’m not in a bad situation comparatively, as I’m confident I’ll get 24 months OPT

    But, I believe there are lot of advantages if we get H1B, personally and professionally.

    Can someone let me know what are my chances of getting my receipt and how long would the waiting time be?

      Ask the employer to look at the back side of the check. If it was cashed, then the receipt number should be on the back side of it.

        Thanks for your comments, I believe they’ve changed their process, USCIS is doing it electronically these days, previously it was manual deposits, where we were able to track earlier.

          How will they deduct the fees? Does it stay in an escrow account and USCIS charges it only after selection? If a physical check was submitted and USCIS cashed it electronically, its copies should be available in employer’s bank account and they can look at its back side.

            USCIS will open the filing packet only if your file is picked in lottery.

            If it’s not picked they don’t open the packet, they just mail back.

            I’ve read somewhere about receipt not entered on check lately, I’ll anyway check with my employer again, just to make sure.

  19. Look at ImmigrationGirl’s statistics. For AD/PP/VT, there’s almost no increase (from 49 to 51%) on 15, 16, 17 ,18.

    Does that mean VT processed 95% of its receipts in the first three days? Probably not. Besides, IG also estimate AD/PP should go up to 60%ish (last year AD/PP/VT was 70%+). So I won’t tell anyone to hold hope. But I know I will, at for the rest of this week!

    • Your logic is incorrect. If we have to go by your logic we have to assume that all premium processing petitions were filed by the office of Immigration Girl’s office.

      It’s quite possible that from their office only 51% of the petitions were selected for this year. From some other attorney’s office more petitions may get selected so that the average comes to around 70%. Got it?

      • Is not not about the number it reached, but it changing… That’s what happen every year, when these big firms stop receiving tickets means they are almost done with processing… Yes. It is a good indicative.

        A second wave os tickets shall start in a couple of weeks for RP. Good luck to all RP.

    Out of few hundred thousand people out there, only a few hundred PP applicants may smile from now on.

    Accepting the reality is very important!!
    Non-AD chance is 1/3.
    Knowledge about Past, present and future is the knowledge of GOD. Yes, future is only known by GOD. And it mostly depends on how you treats other human. if you are trying to deprive people from their right share, then may be you are bringing trouble for yourself. May Almighty keep us away from depriving other’s equal share.

    We have received email notifications in 51% of our cases filed as AD/PP/VT (Advanced Degree-masters / premium processing / Vermont Service Center) – I think there is still a chance this number could go up to 60%

    We have received email notifications in 25% of our cases filed as Non-AD/PP/CA (Non-Advanced Degree-masters / premium processing / California Service Center) – I think there is still a chance this number could go up to 35%

    We did not receive any regular processing notices in the mail today.

  23. I don’t know why regular processing people are so eager when people on the blog said it hundred times that still premium processing is going on. Specially non Ad people.
    Please let the premium processing finish.

          You have three processing centres, each processes about 2,000 a day, we started seeing the first email notifications on the 12th, and that ran until Friday the 15 (so 4 full days)…..makes……3x 2000x 4 = 24,000…..and with some regular people in it…..there you have your 20k!!!!

      USCIS does process both at the same time, but there is no SLA for regular processing petitions that they should have receipt by May 16th. In fact, some users have reported that they have received the receipt notice. Check Latest update on page .

    My OPT stem extension is expiring in July , What if I haven’t received a lottery receipt/rejection letter on my H1b by July. Will i be allowed to continue working under CAP gap till sept 30th? I know if you have filed your H1 and donot receive a receipt , your OPT is automatically extended till June 1st and if you receive a receipt your OPT is extended till Sept 30th. But what If i have not received either of them , will I be eligible ?

    FYI.. I am AD/PP/CA . I’ve heard from 3 of my friends that they’ve received receipts today – AD/PP/CA. Be hopeful and all the very best of luck to all.

    • No, I’m afraid you will not be able to work beyond your OPT expiration if you do not receive either rejection/selection email by then. I know this because I had to return to India last June. I received a rejection only in July 2015.

    • I believe if you have filed using Premium processing you should hear the result by May 16th. So you will not be in a situation where you don’t know what has happened to your petition when OPT expires..

      • You will hear the result by May 16th only if you are picked in the lottery. However if you were not picked in the lottery, the official rejection comes only late June of July.
