When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

  • April 12th, 2016 – 11:50 AM CST ( Unofficial Update ) : It is reported on blog by attorney ( immigrationgirl ) that they have received about 40 email receipts of Premium Processing.     • me too same situation, consultancy applied to me with in house project, so it got denied after RFE, so they re opened(MTR) the case , but no response so far…

      Regardless, TRUMP came, so no hopes, he will restrict H1B’s like he will propose wage 100k for h1b holders, so no company recruits h1b holders , eventually ppl dont go USA, that is the strategy behind that….

      he posted that his petition got denied, but USICS themselves re-opned n process means with out employer intervention.. not sure but he is too lucky..

    I filed my H1B visa through company A and it’s picked up in lottery.Got the receipt number from them.Now,the status is showing as RFE on USCIS site.

    Please suggest if H1B visa can be transferred to company B if the status is in RFE from company A.

    I am in USA on H4 visa and wants to change my status from H4 to H1.

    • Shivani..it can’t be transferred when its in RFE…it can be transferred once the case is approved.
      Even I have posted the same question few days back..got the above reply.

      Since you are on already on H4..not sure exactly.

      • Not possible for a transfer when it is on RFE state. Once it is approved, you can transfer.
        But did you file COS(change of status) also ? if COS is filed then legally u should immediately start working on company A upon H1 approval. Once you get adequate payslips with company A, you can change to company B. If COS is not filled, you are safe. once you get approval, you can transfer to company B.

        The key thing is you need to submit payslips to prove your status for h1b transfer. If your current status is H4, payslips of your spouse.
        if it is H1(COS in this case), your recent payslips on h1b.

    I have question related to stamping. My Petition got approved for XYZ Location in USA. LCA has XYZ address mentioned same in I797B. Now client said that I have to work from ABC location in different state in USA.
    While going for stamping what should I mention in DS160 form?
    If I have mentioned new address ABC in DS 160, do I require Amendment petition filed and approved or New LCA would be enough here ?
    What could be best and quick way to get VISA stamped for new work location ABC in USA?
    Could you please help with situation here ?

    • FYI, the H1B is based on your client and client_location. Any change in that might need new LCA and amendment (close to applying new H1B). If you dont do that, you are violating law. I know a friend tried to do that got deported at point of entry.

      With Drump, you will need to be more careful. Hope you understand !

    I have my SOW valid for 3 months , so got 1 year approval. Is the stamping based on petition validity ? If I will show Long term SOW at the time of stamping , will it be helpful to get more years?

  6. At the time of RFE, I’ve submitted a SOW which valids upto Nov’2017 and can be extended for 2 more years based on agreement, and my case got approved after that.
    Now my project it getting changed with same client and same location with new MSA, the new MSA is also signed and valids upto Dec’2019.

    During interview if I shows my new MSA will they questions me.

  7. I appeared for interview today, they kept my passport and put me into administrative processing. The guy was asking about I797 approval, which ingave him orignal but he asked me that it should be on green paper however mine one was on white. He asked me to get it from my petitioner otherwise at port of entry they may refuse entry. Please advise which document he was asking because i was sure that the white document was orignal.

      If you had never been to USA, you will be issued I 797B form which is original and have a green tinge, otherwise you just have a duplicate copy of that. If you have a I 797 C, that is issued in white color and is intended to keep with and employer not for the employee.
      Please ask your employer for original I797A/I797B copy, as it will have a detachable I-94 in 2nd portion.

    I have got an RFE. My employer said they submitted the response of RFE on Oct 1st. Please let me know If the status should have changed in USCIS website something like ‘We have received the response of RFE …’ , or it will only get updated when they will work on my case?

    Currently it is showing as ‘Request for Additional Evidence was mailed’.

    Please clarify this.

        My employer is a small consultancy. And they didn’t shared the RFE with me. They just sent the response. I guess their might be something with Employer end (I hope so).

        I’m just waiting now cuz I can’t do anything other than that. Hope it will get approved soon. Don’t know how long it will take more 🙁

    after approval of I-129 ,how many days it take for getting I-797.and also after approval(for RFE) how many year of visa alien normally can gat?is there any ruly.can somebody can reply confidently?

    • It takes about 2 weeks for 797 to be delivered. The validity depends on client requirement but I am not very much sure. All the best!

    My case was approved today and I’m obviously ecstatic. I have MBA from one of the top B Schools in US and worked for an year in bay area in one of the largest e-commerce firms but had to pack my bags in June 2015. MBA students getting just one year of OPT did not help at all. Those were real hard times as I was wondering where I am headed in my career when I have done nothing wrong. There was no respect for real talent that we bring to the table and everything was based on pure luck.

    But things changed today!!

    I got my H1 filed from a lesser known employer for an in house project. I am putting down timeline so that you all can get a good idea!

    H1b Notice On: 19th Apr
    H1b Receipt #: WAC16140*****
    Case Type: Regular Processing, Masters quota
    RFE Date: 26th July
    RFE Response Date: 18th Oct
    Approval Date: 9th Nov

    About Trump becoming a president: I do not really care what policies he comes up with and how hard he makes for people working on H1. One thing I know for sure is – If you have a REAL talent in this world, you will be recognized with some hard work and luck along the way.

    My wife got H1B visa on this january month (till March 2018) and not worked due to personal reason and went to india on end of January month. She will not work another one year because of take care of our kid. We are thinking to apply H4 visa and will come to USA on end of Feb 2017. Is possible to convert H4 visa to H1B visa next year end?
    Or apply new H1B visa petition ?
    If apply new H1B petition then it will goes to normal lottery process or any exception/other process?

          No one is born lucky or unlucky… It all depends on how seriously you want things and how well you take failures… Unfortunately indian schools put too much focus on success. Jobs had bad love life, bad relationship with kid, struggled for money and in the end came out on the top. Walt Disney scavenged the bins looking for food. He went bankrupt once before rising…life is not a bed of roses neither it is full of thorns.. You just got to enjoy the site of roses which is hope and wear shoes to insulate yourself from thorns…..

          H1B is not end of road and may indian colleagues were doing better than their NRI counterparts… Every failure has a reason.. find yours and beyond all this find peace… H1B is for 3 years, work is for lets say 30 yrs and peace is for life…

  17. there are some startups in india who raised millions of dollars so easily. i think its dead easy to raise millions of dollars here than trying for H1B in time and pressure perspective.

    Its good for India, All smart people now stay (i know 80% h1bs are not smart) here and venture their own companies

    1- Reduce immigration
    2- Better trade agreement
    3- Stop terrorism

    His main point is to bring back American jobs… First 2 point includes impacts on H1B. Infact he carried few American IT guys in his meetings who were asked to train their H1B replacement to raise awareness…

      Moreover new H1Bs also affects people already waiting in GC line… Creating job insecurity and no salary increment or promotions for people with family here.

      Greedy corporates keep bringing new H1Bs to blackmail existing ones…

      • I hope you also should have entered through this H1B program.
        H1B is a a work visa and not to settle their with your family for lifetime.
        Companies can bring H1B workers for their requirments as per law.
        Accordingly to me H1B is bringing only gains to USA.
        I don’t think Trump will eradicate H1B before he put some restrictions for immigrants from other countries for the growth of Americans.

        Can you please tell me if I can go for a visa stamping once I receive my I797 form from US office.If I get the stamping once & I want to go for another client do I need to re-stamp the visa with new LCA or I can carry the new LCA during port of entry?

    Last week I received approval notice, and consulate is specified as “Amsterdam” (Netherlands).
    But as my contract is getting over I am travelling back to India this week.
    Can I select any consulate in India for stamping?

    • Yesterday once of my friends got 221g pink slip at chennai consulate. During interview, they asked him to wait and after 2 hours issued 221g. He saw nearly 50 people got 221g .

      • Yea. Crossing the interview at consulate is a big thing. Many of us were happy to get the petition approved. But there is high chance of rejection at interview. Please prepare well and carry all the employer & employee supporting letters(client letter, project description, employer-end client contract, work-premise photo…)

    Please provide your comments for below questions.

    I have 2 H1B petitions approved from 2 different employers, A and B for 2016. I had attended interview for both and got offer and accepted both offers. But planning to join the one where the visa gets stamped.
    1. Can I go for visa stamping interview for both A and B employers, with a gap of say 2 months?
    2. Once stamping done with A gets rejected/blue slip 221g, can we go stamping for other employer B?
    3. Once stamped with A, can we go for B stamping as well?
    4. Visa gets stamped for A, Can I join other employer?

    My employer informed me they received RFE on September 15th and they will answer it on 15th November.But in uscis site the case status is still showing as “Case was Received”. Is that possible ?

    • I am not sure if this really happens … Somewhere I read a persons petition Approved yet online status was showing as received.

      Even I’m in the same situation. Employer says there’s an RFE on my petition whereas USCIS site still shows status as “Case was Received”. Really confused.

    Recently my H1B petition got approved and my ER informed that they gonna send the required docs ASAP in order to go for stamping.
    I have couple of questions here.
    1) I am going for stamping initially and my family will join later. So, will there be any issues if I say the same when that question comesin during interview?
    2) Currently I am working for ER1 and my H1B was filed by ER2. So, if they ask an question since when you have been working with ER2, what should I answer?

  30. Its almost end of 1st week of November my status is still showing as Received, is there still any hope? looking at the comments looks like now only RFE cases are getting updated. Its really frustrating long wait.

    I got a RFE, RFE says ” we need to do experience evaluation” what it mean, i have 10+ years Experience in India. my attorney asked me to send Relieving, Experience and Appointments letters, i sent all my docs.

  33. Recently my H1B petition got approved and received approval notice from USCIS. my question here is that in I- 797B form it says Hyderabad consulate. But from last 2 years i’m working in Mumbai.Can i attend interview in Mumbai or need to give at Hyderabad consulate ?

    • Technically you can attend any where. But make yourself a strong reason to attend there. Mostly they will ask why are you coming here instead of the place said in petition… And expect a solid answer. You must be fine…

      I belong to Chennai division… But once attended B1 visa interview in New Delhi and got the visa approved.

    I have taken a break from last 3 months and my last working day was on sep 15th. I have applied visa from a consultancy. Is it fine to have a gap at this time?. I saw some questions in visa interview asking how long you have been with the employer. Is it ok to say that I will start working for them when I travel to US?.

    Any suggestions is highly appreciated.

    • Mine RFE Resp. Received on Sept. 11 still now no update.. Why it is so slow right now maybe because of the upcoming elections.. Hope I get a response before the long holiday..

    • they acknowledged my response on Sep 1st, but till now no update. People who responded Sept mid got approved with in two weeks.. Not sure whats happening.. even i’m waiting eagerly..

    • yeah man, i am in infy too.My RFE response received on Sep12th and no update. My other friends who sent the response at the time got it approved some 2 weeks back.

    • I think you should get it by 15 – 20days..i.e what Visa Cell is telling. Did you followup with them recently ?
      Even my case was approved 10days back, they told me that it will take 15 to 20days.

    • i think you have low knowledge on this approved doc, n number of people waiting still from 45-60 days for approved doc still,grace period 60 days for uscis.

    • Ideally it should be recieved within 2 weeks, there are cases where people have received within 3 days too ….. and otherside it took a months time …. but no exact timeline as such … bottom line is ….
