H1B Visa 2014 Quota Cap Reached – USCIS Official News Update

Well, folks, we have a breaking news update from USCIS saying that H1B Visa Cap for Fiscal year 2014 has been reached.  The human psychology has kicked in and many employers rushed to get their H1B petitions ahead of their schedule due to the press release by USCIS indicating that it expects more petitions. Here is a summary of the news release by USCIS on the cap completion for FY 2014.

News Summary by USCIS  on H1B 2014 Cap Completion :

  • USCIS has received enough number of H1B petitions for fiscal year 2014 under regular quota, which is 65,000 petitions.
  • USCIS also have received enough number of petitions for masters quota cap, which is 20,000.
  • USCIS will not accept any petitions for H1B Visa 2014 after today, which is April 5th, 2013.
  • USCIS will conduct lottery or Random computer selection to pick the cap subject petitions filed for FY 2014. The lottery system will be exactly like we described earlier in our blog. Read  H1B Visa 2014 Lottery Process – Step by Step.
    • USCIS will conduct lottery for Advanced quota petitions and pick 20,000 petitions from that pool
    • For all the masters quota petitions that are not selected in lottery will be placed into general quota pool
    • A lottery will be conducted on the combined pool of petitions to pick the 65,000 petitions that are eligible for the FY 2014.
  • USCIS is not providing an exact number to us today as they are still processing petitions received for FY 2014 that were received today.
  • USCIS will give us more detail update next week, stay tuned.

      I am VSC and almost waited for 1 month and did not her back anything from my employer. Really killing me and i am unable to concentrate on other things too. As per the blog what I understood is May 10th will be the last date and incase didn’t receive your receipt number then assume we are not selected in lottery. That is my perception and assumption.

      Any body from VSC?

      After the case is approved, USCIS will send out approval notice (797) to the employer/attorney. They can then send all the required documents including 797 to you for stamping.

      Stamping process varies from country to country. In India, the process is outlined on the US travel docs website. In general, it involves submitting fees, taking biometrics, completing DS-160 form and appearing for interview on the scheduled date. If approved, you can travel to US as per the start date. If you are put in administrative processing, then it can cause some (minor/major) delay.

    I finally received my receipt number but when I go to the USCIS my case status this is what I see: Your case can not be found at this time in My Case Status. Please check your receipt number and try again. If you need further assistance, please call the National Customer Service Center at 1.800.375.5283.

    I tried calling several times but didn’t got though 🙁 And yes I correctly entered my number.
    Any suggestions? Does did happen often? Any experience with this? Not sure what to think of this, except that it keeps me from celebrating my possible good news.

    Please give advise!

    Actually, for which form we are awaiting receipt no ? I mean, is that I-129 which gets selected in lottery and do they mention receipt no. on I-129 form OR that is something different form ?

      I-129 is the form employer files w/ USCIS as part of H-1 filing. When USCIS issues the receipt, they will send out form 797C which will have the receipt number.

  5. Hold on guys, I got my receipt today, WAC131345####, candidates filed through Frag… taking long time or USCIS is taking time to send mail…….Checked with my school DSO last week, receipt # was reflected on my SEVIS since 23rd April. Good Luck.

  8. The received dates have to be the 8th of April. If they are some other date then they can be ext h1b or even possibly wait list people from Lottery (not sure about the last statement). My Boss called the USCIS today and I was not in the system which means I was not chosen in the lottery. The officer or rep told us that all receipts for lottery people have been sent out. They have finished processing lottery picks. He then told my boss that the only way to know if you are on the wait list or not is if your checks cash or the package is sent back to you. This is info is straight from USCIS I sat in and listened to the phone call that took place with my boss.
    So over the next few days some people will get receipts but this is from snail mail. NO NEW RECEIPTS are being done for lottery winners. Unless you get on the wait list good luck. I am one person now moving onto hoping I have made the wait list.

      • No they did not say what the wait list numbers would be. But I did read online that USCIS rejection rate is around 14-18% of processed Visa’s. So that means that they may keep around 15,000 applications if the math is right. I also spoke to a Lawyer who said that anyone who submitted an application without a letter from their future employer was being rejected even if it was picked in the lottery. So if you were applying through a consultancy firm with no ties to a company then they were rejecting them. The consultancy company must show a letter of Job offer from your employer so that USCIS knows you are coming over to a secure job. This may be one of the reasons we are hearing such high numbers as 60% being rejected. take it for what it is worth.

  14. We all send petition from the same employer / lawyer on same date, but some of our friends got receipt from USCIS on April 22, we filed under RC/RP/WAC. Is there any chances to get the receipt from USCIS ?? Please explain me…

    • Yes probably your notice of acceptance might be in mail and reaching to your employer. You can wait until May 7h.

      Once USCIS has sent out receipts for all selected petitions, they will start returning the packages. People would continue to receive back their packages in May and June.

      • How could you be certain? The receipt might have been generated on Thu/friday last week and sent over by snail mail on Thu/friday and it reached today…. So it still might be true that they stopped sending from last week. Only if some one receives something next week can you be certain that they still have not stopped!! Or if someone hears from their employer that their checks go cashed sometime this week….

        • Till we start receiving a “not selected in lottery” letters, we can be hopeful that they are still issuing receipts.
          Any other interpretions are purely people’s guess
          I am just asking people who did get any response so far to be optimistic

  17. My employer told me that “They have received I797C form” corresponding to my H1B application and will provide the receipt number by next week.
    Do USCIS provide receipts number after I797C form?
    Does that means I am selected in the lottery?

  18. I’m yet to receive any news for my H1B application but unlike many of you I’m wishing that I don’t get selected in lottery!!!! Coz, if I’m not selected, I will ask my employer to apply for L1 and my wife will get to work too!

    • For your kind information getting L1 is toughest task in current scenerio. This has changed in last couple of years. These days companies do not even attempt to do L1 unless you have done some patents etc showing your great specialization in technology which are only grown by your company and not known to other world.

    I was informed by my employer on 24th April that Cheque given for my H1B petition was cleared by USCIS. But I did not get the Receipt till now.

    Could you please tell me how long will it take to get the receipt from USCIS?

    I am eagerly waiting for the receipt.

    • I got news from my employer that my cheque has been cashed and receipt number will be provided soon.
      So please my friends , keep hope alive, they are still processing and issuing the receipts.

          • If there are multiple checks cut from single account for many applicants, its not possible for employer to know who got selected using check encashment method. Some times USCIS use ACH debit using the check and it does not leaves lot of information on check number encashed etc unless you contact bank and ask them to dig.

    WAC is still processing… so, little hope is still there…

    waiting is the tough part… and not getting through the lottery after so much wait… too much.

    I checked WAC1314650050 and it says that on April 25 2013 they received the I129 ……….? How can they receive on April 25th?

    On April 25, 2013, we received this I129 PETITION FOR A NONIMMIGRANT WORKER, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or contact our customer service center at 1-800-375-5283.

    All petition should say April 8 as lottery was done on April 7th and they are saying “On April 8, 2013, we received this I129 PETITION FOR A NONIMMIGRANT WORKER…….”

    Any clue?

      • All lottery picks have stopped. Its done. They have now moved onto H1B ext and other applications 2014 H1B has finished.

          • All lottery cases will say “On April 8, 2013, we received this I129 PETITION FOR A NONIMMIGRANT WORKER” others are Extensions or status change requests. They are not feeding new receipts for lottery cases. What ever entered so far will be on the way in mail ot will be in waiting list.

          • This is definitely not correct. I am a new applicant, RQ/PP…i got my visa approved on April 18 and my status initially said…on April 9 we received…
            One of my friend received her receipt yesterday (RQ/RP) and her status says on April 23 we received…
            It is the date that they enter your info in their system though all the lottery was done on April 7. They are slowly picking up the application and entering in the system from the day they start processing…

          • Thanks, quite helpful. I have been watching this site for sometime and I think “panic” is the word that comes to my mind when I see all the comments. I too am waiting and I know exactly how everyone in the same boat are feeling, but when things are not in our control “panicking” is of no use. USICS must sure have been busy with PP case to meet the timeline on PP and they were in no hurry to close the regular cases. I am sure there is more time for them to close on the reciepts fro regular quota.

      • what ever they create today will reach to you in another 5 days. or what ever was created last week should be reaching this week. Vermont created heavily till Friday and coninued till Monday i Guess. California is almost done creating as of Friday last week – receipts might be in mail and dispatch process or some in wait list.

  26. I don’t know how credible this source is, but a high rejection rate of 60% for Indian IT companies might be helpful for people who are on OPT and on a waiting list. Personally, I don’t think it is true because there is no way they can find out what the rejection rate is so early on in the process.

    • 60% means 55,250 rejections out of 85,000 quota. Process has just started only few decisions taken. Not sure what this is based on. Its not realistic at all.

    • This is what I posted earlier on another blog page:
      If they are basing the rate on a sample, then I am really interested in knowing the sample size. Mostly PP petitions have been adjudicated by now, and I don’t think IT companies prefer to file it in PP (money saving technique).

      In addition, the data for FY-14 is not public yet. So as part of their sampling, they would have combed through online blogs or contacted companies/beneficiaries about their petition statuses neither of which is an effective method. Even when USCIS publishes the rejection rate, it doesn’t break it down by company or country.

      To me, this news article is more about sensationalizing the report and showing how wrong it has been done to Indian IT companies.

      Petitions that didn’t make through the lottery will be returned in May-June. That is what happened in both 2007 and 2008.

        According to this link, things are already heating up.

        It is highly likely that USCIS has a pretty bad opinion about the Indian IT giants already. Even this forum had one microsoft recruit unable to join because of this problem. I also read another article which included information implying close to 30K visas were bagged by the IT giants (Infosys, TCS, Wipro, CTS etc) this year, I would definitely not be surprised if 60% of that were denied thereby keeping the waiting list still alive and more fair (you cannot have 50% of the regular quota for 4 companies. That is just ridiculous). I have known cases where the premium fee was refunded and were told that their cases were adjudicated as regular processing a few days back. (It is highly likely that this was because they were wait-listed and were reconsidered after denials.). Given the way L1B is misused by some of these companies and the fact that USCIS has already denied a lot of the L1Bs, they all flocked into H1B’s. I would still think that it is very highly likely that everyone from these giants who got their receipts still have a very high chance of being denied.

        • I am not arguing the fact that some/most of them may get denied eventually. That may or may not happen based on submitted information/documents. What I am arguing is that they have come up with 60% rejection rate after 1 month of filing. And that is why I am interested in knowing their sample size or method of calculation.

          A good news report will always publish their method of getting the rate especially when it not publicly available. Sensational news report will like to publish what sells rather than what’s true. And that’s my problem with this story.

          US senators have been accusing IT giants for several years now and it’s nothing new. Now, when someone says 30K petitions are bagged this year by IT giants, that someone will have already combed through all selected petitions. Again, think about it – is it possible to know in April itself that 30K petitions from these companies made through the cap. The top 4 did file close to 30K petitions last year, but no one knows about this year. Another interesting fact, top 10 bagged close to 60K petitions last year.

          Let me reiterate – I am arguing how the news report is sensationalizing the evil USCIS and US government is doing to Indian IT companies w/o knowing the facts or the basics.

          • I agree with you as far as fact that the sample is vital for any kind of prediction. The sample mean might be far away from the true mean per the hoeffding inequality and is dependent on the sample size too. I also agree with you that any inaccuracies in the collection of sample data might also aid to inaccurate predictions.

            To be honest but blatant and audacious, 250,000 employees in one of the big IT companies are considered Specialized knowledge workers… IMHO if there are 250,000 employees, then it is no longer specialized knowledge and they do not qualify for an L1. Given the fact that L1B rejection rates have sky rocketed specifically this year, P(apply for H1|L1 Denial rate), this conditional probability is definitely closer to 1. If the top 4 according to you had applied for 30K last year, conditioning it on the fact that L1 Denial is incredibly huge, I think it is a fair bet that P(no of petitions top4 applies this year>>>30000) = 0.99 and atleast 30K made it through the cap is highly possible. Time does not even matter.

            No disrespect to anyone but H1’s should be given to people who are incredibly specialized workers, not to everyone who find their way into an IT company in India. If they do, good for them and they should consider staying in India and working from there. That is USCIS’ beef. (not mine mind you)

            I have seen a huge number of cases personally who have been denied L1Bs and the reputation of the IT giants has gone from bad to worse. One has to realize that USCIS has started to act on it and the recent increase in the L1B denial count is testament to it. Having considered all of this, there is a possibility that USCIS might have anticipated such high volume from the IT giants and also might have been vocal about the possibility of denying them (although not publicly) and news insiders might have gotten a sense of it. Since this would also mean that their waiting list from the other people who truly are specialized (like the microsoft guy who did not make it in the lottery) would be impacted, I would not be completely surprised if the approximate prediction of 60% expected denial rate would be that far away from reality at this juncture.

            Although there might not be an actual sample dataset on which the probabilistic inference was run on, to me it does not seem far less likely given the recent trend. Although the media might sensationalize it (in their own annoying way), it is reasonable to expect a higher volume of denials and I personally no longer feel that the acceptance rate for these IT giants for an H1B is still going to hover at the high 90s anyways. I would be really surprised if that were the case!!

          • I concur. Knowing that there is a good chance of lottery happening this year, some of these companies may have just filed in bulk in hoping at least some may go through. This definitely deteriorates the quality of workers. As a full disclosure I used to work for one of these several years ago (not in US but in India). At the time, visa was filed based upon seniority and closeness to the manager than by actual talent. Don’t know what the situation is now.

            My other concern is that lot of times their employees don’t know how much less they are earning in US. If you compare US salary to Indian salary, then they may be making more (and saving more). But if you start comparing US salary of these companies w/ US companies, then that’s no where comparable. And that’s where the argument of cheap labor comes in and disrupts the H-1 program. Again, I don’t know their current salaries in US, but some years ago they used to offer 5K USD per month, which is pretty low in areas like San Francisco, New York etc.

            The new bill has several provisions to make these companies start abiding the rule and paying their employees fairly. Desi consulting companies in US also pay in similar range. It’s just that their numbers are outweighed by Indian IT heavy weights, but hopefully this should also get corrected with the passage of bill.

    I have applied/tried H1 B visa through a ‘ Desi Consultant’ . He is saying i did nt get picked in lottery . IS there a way I can find out if he has applied my Visa .Does USICS sends some letter to all those not picked in lottery ? .

    Please advise . I am having a sad feeling that he did not applied my visa and just fooling me or many folks like me .

    • Yes USCIS will send back the packet. Aslo You can ask for Fedex tracking from your employer for the application he sent for you. If he has sent it individually for each one then you should have your name on the tracking. That is how you can be sure.

    Today my attorney received my receipt number. My last name starts with ‘R’ and five digit of receipt no (EAC13140xxxxx).

    Don’t lose hope friends, I’m sure everyone will get it. Pray god, he will make it for you all. Still USCIS is generating receipts for both PP and Regular processing (For PP cases, couple of friends got back PP amount and USCIS considered their petitions as Regular). Please be relax and you will get it. I will definitely pray for you friends.

        I’m not holding student visa, I’m working here using L2 EAD. My employer paid H1B fee, did not check with them about the checks were en-cashed. I did not call USCIS, just followed my attorney.

            i said it looks like h1b forms entry to databse is stopped..if u want u can go to uscis site and check the series starting from EAC1314950001 I.e for today u can see most of them are not for H1B.

            if they finished entering the data for h1b yesterday,,even there are chances of recieving the recipts for another 5 to 6 days as they are sending recipts through snail mail…

If I was picked up over the past two days, the check would have cleared and my employer would have notified me.. so if they have not, then I dont think I made it which is what scares me. Thank you for the information though. It is always better to know the hard truth rather than just “hoping” to make it through. Plan B should now become Plan A… Well, life goes on!!

      First of all congratulations for getting selected in the lottery. Even I am on same boat RP/RQ and still waiting for the receipt. Actually my employer has filed 20 RP/RQ only 5 of them got their receipts. I waiting desperately for the good news. Hope you will get your H1b approval soon. 🙂

        My employer filed visas at same time but got the response within time gap, so you will get through for sure. Just a matter of patience(i know now its easy for me to say that but i have had the worst few weeks of my life so far)
        If your employer is co-operative, check your status with USCIS through them. since its snail mail it will take a couple of days to reach your employer.

        DO NOT LOSE HOPE, i am sure all will get it.

  38. Hi, I have been a silent reader of this blog (and the past blog), but wanted to inform you guys that I just received my application receipt notice from my lawyer. My application type was RP/RQ/VSC and my receipt number starts with EAC13-144-*****. I wanted to share this news with the people visiting this website, since this website has been helping me a lot with valuable information and also reminded me everyday to not lose hope. I am hoping that my post can give some hope to people who are still waiting out there.

  40. are RQ/RP mostly done getting the receipts. is there any hope left for regular processing this week?
    I mean is the USCIS done sending out the receipts? or they are still in the process of mailing the receipts??

  41. Both myself and my husband applied for H1B on the same day by the same Employer. But myself got the receipt (i.e WAC13138****). But for him No Updates. Is there any possibility to get the receipt from USCIS ??

    • Anyone from Infosys …RP/RQ/VSC got any receipt yet ? AIMS shows no updates …but all other company has already started sending updates ….to employees ….did anyone from infy get any update yet ?
