H1B Visa 2014 Quota Cap Reached – USCIS Official News Update

Well, folks, we have a breaking news update from USCIS saying that H1B Visa Cap for Fiscal year 2014 has been reached.  The human psychology has kicked in and many employers rushed to get their H1B petitions ahead of their schedule due to the press release by USCIS indicating that it expects more petitions. Here is a summary of the news release by USCIS on the cap completion for FY 2014.

News Summary by USCIS  on H1B 2014 Cap Completion :

  • USCIS has received enough number of H1B petitions for fiscal year 2014 under regular quota, which is 65,000 petitions.
  • USCIS also have received enough number of petitions for masters quota cap, which is 20,000.
  • USCIS will not accept any petitions for H1B Visa 2014 after today, which is April 5th, 2013.
  • USCIS will conduct lottery or Random computer selection to pick the cap subject petitions filed for FY 2014. The lottery system will be exactly like we described earlier in our blog. Read  H1B Visa 2014 Lottery Process – Step by Step.
    • USCIS will conduct lottery for Advanced quota petitions and pick 20,000 petitions from that pool
    • For all the masters quota petitions that are not selected in lottery will be placed into general quota pool
    • A lottery will be conducted on the combined pool of petitions to pick the 65,000 petitions that are eligible for the FY 2014.
  • USCIS is not providing an exact number to us today as they are still processing petitions received for FY 2014 that were received today.
  • USCIS will give us more detail update next week, stay tuned.

      • Did by any chance get any updates from case manager other than formal email… I do not find them online.. 🙁
        I dont know but I guess they might already have the updates from USCIS but seems like they are not in a mood to share it with us.. might be waiting for USCIS to declare the end of H1B receipt generation.

  6. I just got Informed by my company that I have been selected in the lottery. My petition number is WAC131361xxxx. How do I confirm that this petition belongs to me.

    Thanks a lot for all the help guys here. All u guys gave me a lot of moral support to me. We had a decent bit of fighting here and there, but overall it was a great help to be a member of this forum.

    • There no way to verify online that the petition belongs to you. When your employer or lawyer would send you the receipt copy, then you can see your name on it

      • Thanks, I just even tried calling the USICS help line but got no response from them either. They told me to file for a info pass appointment. Any idea what is that?

    • @ Vivek Congrats dude. Ask your employer/attorney to provide you I797 C. It has your name, receipt number and other info.

  7. My employer told me that I got selected in the lottery and they got the receipt on Tuesday.However they are not giving me the receipt number since its their company policy.

    They told me that the status is Initial Review.

    Any advises!!!

  8. Both myself and my husband applied for H1B on the same day by the same Employer. But myself got the receipt (i.e WAC13138****). But for him No Updates. Is there any possibility to get the receipt from USCIS ???

    • I can completely understand the way you feel right now. I am also in same situation as you are. My wife she got receipt on 15th April and yesterday she got H1 approval also. And I yet not got anything. still waiting. We had also filled the application on the same day and same process AD/RP/VSC. Yup strange thing she got her approval that fast even in the RP also.

      So waiting is only remedy at this time for us (Husband). 🙂

    Is USCIS processing H1B in naming order? Lastname/Firstname ??? If so I am worried as my friend whose name starts with ‘N’ got his receipt whereas I am left in air(my name starts with ‘D’). We both filled our petitions under same employer on same date. Suggestions please. Am worried a lot.

    Isnt it interesting that we have so many folks getting the receipt , but not a single guy from Indian IT companies (TCS/Wip/HCL/CTS etc ) have posted any success. even when its conceived that majority of the visas are bagged by these companies.
    Is it a fact that USCIS has devised some process of selection for these companies or is it that the Immigration teams have collectively decided not to disclose anything to its employees.(which is crazy)

      Seems like employers have learn something from their exp in year 2008.. so employers might be keeping us hanging till they USCIS stops generating it…

  12. Most of the comments coming from people about not receiving H1B receipt could be from employees of IT giants like Infy, TCS, Accenture, Wipro, IBM etc because these big IT companies could have process that they are following…
    They must be waiting for USCIS to finish all the H1B receipt generation and then these employers must be sending receipts to all employees for whom they have got the receipt in one day.
    This could be just to avoid any panic in the employees.. e.g. suppose USCIS sent receipt for XYZ person on 18th April (XYZ is employee of lets say Infy) to Infy and Infy VISA team sends this number to XYZ say on 19th April then there is high possibility of lot of panic for others who did not receive the receipts..

    So HR/VISA department must be taking this thing in consideration and can send receipts at one go…

    I am also waiting for my receipt.. 🙁

  14. My friends and myself send the petition from the same employer/lawyer. But one of us received the receipt ( RQ/RP/WAC , WAC13139*****) . For others did not receive any information. Any possibility to receive it later.

    Any updates? One of my friends got his H1B rejected. In visa tracker form, its showing as rejected. He didnt get any mail from TCS.. I guess they might have failed submitting the petition on time. Do you guys have any idea how it happened?

    • Based on this, probably by April 30 all the receipts will be sent and those who does not get paper mail by May 8th, can be deemed unlucky 🙁

    • @RAM, Assuming 30% are non cap reciepts by today or tomorrow all CAP reciepts would be entered in the system based on daily your counts.

    From 124000

    From what I have been noticing on forums, it seems USCIS is currently in the process of issuing receipts/email for the premium processing cases (normal and advance degree) from both Vermont and California.
    Its surprising that they still haven’t announced the break up of 124,000 cases into the normal and advance degree filed cases.

      Why you want to need the breakup? Its of no news for regular h1b, only for masters it will help.Since, anyways lottery will take place for 124000-20000(master cap). Masters are in better position since 2 chances of lottery.

      I’m too normal processing/regular. Read somewhere that it may take as long as end of may to know if we are selected :-/
      So chill… btw my fortune cookie today said “Every flower blooms in its own sweet time”
      very true and aptly said. Things will take it own course… Another pic I saw in FB said

  18. Here is what i got from my attorneys news letter. Dont ask me for proofs. Believe it or not.

    1. The USCIS began the process of data entry of the H-1B cap cases. Premium processing cases are being entered first and should be completed by April 15th.

    2. Non-Premium Processing cases data entry will begin only after the premium processing cases are entered. Non-Premium processing case data entry will not be completed until at least the end of April and will very likely not be completed until sometime in May. Please note that when the cap was reached on the first day in 2008, the USCIS did not complete the data entry and issuance of receipt notices until June. Therefore receipt notices for non-premium Processing cases may not be issued for everyone until May.

    3. Rejection notices for cases not selected in the lottery may not be sent until June after the receipt notices are sent out for selected cases.

    4. Premium processing adjudication will begin on April 15th for all cap filed premium processing cases. Mr. Neufeld commented that the USCIS did not receive a larger than expected number of premium processing filings to prevent adjudication (approval, rejection or Request for Evidence) of the premium processing cases within 15 days.

    5. Non-Premium processing cases can only be converted to premium processing cases after a receipt notice is issued.

    6. Mr. Neufeld refused to provide any goals for processing times for non-premium processing cases. He stated that the USCIS may publicly announce a processing goal in the future

    • This sounds right but in 2008 when I filed my H1B regular (regular processing) I got the receipt # on Apr 25th. I just saw it in my approved petition. This time I filed it for my wife.
      In 2008 we had 164000 applications, this year we have 124000, so may see the receipts coming as early as 20th for regular/regular.

    Have you talked to HR, Recruiters, Univ and or leadership if they have any contingency plan in place?

        • Also AD/PP… still waiting… despite yesterday’s statistics, Fragomen said today not to loose hope yet. Receipts are still coming, even for AD/PP

        • @AB. Yes, they will start processing of PP candidates from Monday. But If you have’nt received the receipt doesnt mean that you have not been selected. I am a programmer and would not talk without any solid source to my statements 🙂

    • I received it, yesterday Vermont. regular PP, they are processing nearly 5 thousand applications per day, for premium, they have to enter in to the system, it takes a while, still lot more to enter into the system

        Could not believe my employer, as per them it may take 3 weeks more!!

          Most probably next week we may start getting some responses dude, Though i came across few people claiming that they have recieved some postive acknowledgements fom yesterday, which is good.

          Yeah i know, even my lawfirm says it may take 2 weeks , i personaly think they were presuming this time period based on the last years info but , apparently we can see that USCIS was clearing with good pace this year.

          Lets hope for the best and chill out..

    • for regular processing, will not receive any email, they will send to you postage mail, so it take atleast 2 to 3 weeks, first they are prcoessing PP applications, because its PP processing, then on regular. wait for 2 weeks if your not receive anything then it means your selected.

  21. How do we know that we can stop waiting, i.e. not selected in lottery(as opposed to selected)
    At least knowing one was not selected in the lottery allows to get on with life.

Seems like California Serv Center is still processing applications….and when I browsed throught the receipts numbers..(WAC 13 131 5XXXX)….I see many applications already in the premium processing and lot of non PP are also there. I am waiting for my app status. I am in the Regular Cap/Premium processing category…..hoping to get thru the lottery…its a tense situation. Good luck to all….

    First, thanks for all your comments, it has been very helpful it these difficult times… I am under regular processing, still waiting…
    Does anyone here know if the lottery accounts for the 10-15% of H1B refused each year because of incorrect filing, mistakes, etc.? Meaning that they could select in the lottery around 95,000 petitions. Or do they select exactly 85,000 petitions?

  24. Hi Guys

    All those still waiting please make sure your Lawyer filed a G1145 form ( which is the form for sending out e-notifications). This form is not required for filing H1, so many lawyers skip filing it. You will not get a e-notification unless G1145 was filed.

    I just found out mine did not file a G1145, so actually relieved that I did not get notified yet.

    • But hen for people who did not send this form will not recieve e-notifications, They have to wait for hard copy of reciept to get to them.

      Previously I have filled this form with my OPT applications and have recieved text messages.
