It is a painful wait for many awaiting H1B Visa 2019  case receipts after the H1B Visa lottery some have been lucky and some not…for those lucky ones, who have heard from their employers or attorneys may be wondering, what does each of the H1B Case Status mean and what is the typical processing cycle. Every day I see many of our readers asking questions like, “ I checked USCIS website for status and I see the status ‘Case Was Received’,  does that mean I am selected in lottery ?”. This article is meant to clarify each of those status questions and explain the overall flow.

H1B Case Receipt Number – Selected in Lottery

Firstly to make it clear, if you were selected in H1B Lottery for this fiscal year, then your employer/ attorney would have got a case receipt number for your H1B petition. They may have shared that case number with you as well.

What’s the H1B Case Number?  Processing Steps at USCIS, Previous H1B Case Statuses and Steps?

The H1B receipt number is a 13 character alphanumeric string that is given by USCIS. It typically starts with EAC or WAC. You may read Understanding H1B Case Number Details, to know more info.  For high level understanding of how each H1B petition is processed at USCIS, you should read the article H1B processing steps at USCIS adjudication center. Also, in the past, USCIS used to assign many statuses like Acceptance, Initial Review, Decision, Post Decision Activity, etc.  Some of these have been changed with the new system this year. To get an idea of the past flow and statuses, you may read H1B Old Case Statuses and Flow.  Below information corresponds to the latest H1B statuses available on USCIS website for a H1B petition.

What are the typical Case Statuses of H1B Visa Petition?

  • Case Was Received and A Receipt Notice Was Emailed
  • Case Was Received
  • Request for Additional Evidence Notice was mailed
  • Response to USCIS’ Request for Evidence Was Received
  • Case Was Approved And My Decision Was Emailed
  • Case Was Approved
  • Decision Notice Mailed
  • Error : The application Receipt Number is invalid
  • Name was updated.
  • Fees will be Refunded
  • Withdrawal Acknowledgement Notice Was Sent
  • Case Was Transferred and a New Office has Jurisdiction.

USCIS Status ‘Case Was Received and A Receipt Notice Was Emailed’

USCIS emails receipt notices to petitioners, if they filed their petition under premium processing.  All this status indicates to us is that the petition with this case number was picked in lottery and was filed under premium processing. A receipt notice with case number and details about processing was sent to the email of the attorney/ employer. Below is the screenshot for the described status. For H1B FY 2019 season, premium processing was suspended until Feb 19, 2019. So, you may not see below status, if you filed petition for H1B 2019 quota.

USCIS H1B Status ‘Case Was Received’

USCIS only emails receipt notices for premium processing applications. For H1B petitions filed under regular processing, USCIS will send out the receipt notices via traditional Mail/ Post.  All the above status indicates is that the petition with this case number was picked in lottery and it was filed under regular processing. The receipt notice hard copy will be sent to the attorney/ employer’s postal address on how it will be processed. Check below for screenshot of the described case status.

H1B Case Status ‘Request for Additional Evidence Notice was mailed’

The above status indicates that as part of the adjudication process of the H1B petition, the USCIS adjudicator of this petition, with this particular case number, needs more information to make a decision on the case. To get more information on the case, the adjudicator issued a Request for Additional Evidence notice, which is commonly called as RFE (Request for Evidence).  The employer/ attorney will get an RFE notice from USCIS indicating what documents they need to submit for further processing the case.  It has an expiry date and employer/ attorney has to respond to that request by that date. USCIS will NOT process this particular case until they receive a response from the employer/ attorney with the requested information.  Below is the screenshot of described status.

H1B Case Status – Response to USCIS’ Request for Evidence Was Received

This status corresponds to next status on the case with above RFE notice.  All the status tells us is that USCIS has received the response for the issued RFE Notice on the particular case with that case number from the employer/ attorney.  The response from employer/ attorney could be either documents or any other supporting material that was requested by USCIS supporting the H1B petition. If your petition is in this status, it means that USCIS will start processing the case as they have received their requested documentation. The status also tells the petitioner that when you can expect a decision/ update on this case. Check below screenshot for RFE response status.

H1B Case Status – ‘Case Was Approved And My Decision Was Emailed’:

This case status indicates that the H1B petition with this particular case number was approved and the approval notice was emailed to the attorney/ employer. This case status only appears for the H1B petitions filed under premium processing. Below is the screenshot of the status.

The above case status indicates that the H1B petition with this particular case number was approved and they have send the receipt notice to the employer/ attorney by traditional post/mail. This case status appears only for petitions filed under regular processing.

H1B Status  – ” Decision Notice  Mailed”

Not every H1B Application gets approved.  Typically USCIS will issue an RFE and then review the evidence before making the final decision. If USCIS is not convinced with your petition’s supporting documents, they will deny the H1B petition and the case status will be shown as ” Decision Notice Mailed”. Your employer will get a notice indicating why the petition was denied and they can act on it as per the instructions, if they want to challenge the decision by providing additional documents, etc.  Below is how it looks.

Status – Error : The application Receipt Number is invalid

If you do not enter a valid 13 character string, USCIS case status website will give you the above error message saying that the application receipt number is invalid. All it means is that, either you have taken the receipt number wrong from your employer or entered it wrong in the box…or maybe your employer did not give you the correct case number.  Below is the error screenshot. USCIS Status Error - The application receipt number entered is invalid

USCIS Case Status : Name Was Updated

This is one of the very confusing statuses that USCIS online system gives, when there is some activity happening on your case. The status “Name Was Updated” can be very confusing and misleading everyone at times. It may be genuine that the name was updated due to a clerical error, but not always the case.   It definitely means that some activity is happening on your case and your case is being worked on by USCIS.  There is a perception among users that this status will lead to rejection/ RFE, but it is not necessarily true.  So, when you see something like this status, it is best consult your employer/attorney to check further on your case. No need to panic or get confused.  It looks like below

USCIS : Fee will be Refunded Status

One of the others status some of the petitioners see is that ‘Fee will be refunded’. What it means is that the employer/attorney has filed extra fees that is not required and USCIS is refunding the same. It can be for a host of reasons related to fees. As you can see below USCIS would tell that it will not impact the processing of the case, so do not panic when you see this, work with your employer, it will be fine.

USCIS H1B Status Withdrawal Acknowledgement Notice Was Sent:

If your H1B employer plans to withdraw your H1B petition or for some reason you believe that you do not want to work for the company and resigned the job, then your employer would withdraw your H1B petition from USCIS. It is not really automatic process, your employer has to request for it. If your H1B case number indicates the below status “Withdraw Acknowledgement Notice was Sent” for I-129 petition, then it means that your H1B was withdrawn by your employer and USCIS is acknowledging the same with the status. USCIS Status Withdrawal Acknowledgement Notice was sent I-129 petition

USCIS H1B Status: ‘Case Was Transferred And a New Office Has Jurisdiction’

Depending on the load of H1B petitions received and processing times at any service center, they are moved to different locations to expedite processing or balance the overall processing loads. If your H1B case was transferred to different location for some of these reasons, you would see a status like below. It tells the date when the petition was transferred and when you can expect a physical copy of notice indicating the same. It does not really change anything in terms of how it is adjudicated, it is just for processing times balancing, nothing to worry. USCIS Case Status - Case was Transferred and A New Office Has Jurisdiction

      Normally people who receive RFE for their petition get their approval only for 1 year. They will then have to apply for extension (max. stay allowed in the US is for 6 years) while they are in the US.

    Waiting for 13 days after H1B case was upgraded to premium processing at Vermont Servicing Center. I haven’t even got an RFE or anything. Anybody else waiting or waited for this long to hear back?

    I received “Request for Evidence Review” on 24th July 2015. Since then it’s the same. This wait is so frustrating. I guess it’s too late for Premium Processing also.

    My application was picked on 18th of June and after that Status doesn’t change so far. When can I hear from USCIS. My receipt number starts with EAC. Please respond… waiting is really hard.

      This is the most unfortunate part of regular processing that you don’t know when you will hear and the status updates won’t tell much… you should also pay them to hear a definite answer very soon!!!

    Is it like, RFE cases will be entertained once all the other(Premium as well as without RFE) cases got cleared?
    I have seen none of the RFE cases are moving a single inch… 🙁

      Well, I do not think so. Just logically RFEs take more time as there are logistics involved. For instance, RFE issued letter takes couple of weeks to get mailed, then the attorney has to get required docs, it can take few weeks or more, then they mail back…so, the minimum time for an RFE response is few weeks…thats why you may not see them move much.

        Guess ter s some stall happened in rfe cases. Cause I replied to my rfe on July 1st. Uscis received it on July 1st. It’s been the same status since then. And I dint see anyone comment after their case moved to rfe too.

    My case was in received status from Apr 13. Since then I have been waiting patiently for the case to be approved. But now I got tired of waiting, So I pushed my employer to upgrade my case to premium processing and they did it. Now it’s been upgraded and is in initial review status. I hope to get an update within 15 working days.

        I have been waiting from past 5 working days and still no change in the status. I hope it gets approved soon. The case status should be changed within 15 working days so you should get some update in 2 working days. Let’s wait and hope for the best. 🙂

      Manny, Initial evidence is something that should be submitted as part of required documents, which is typically given by the USCIS in list of docs to be submitted. For instance, it could be your degree certificate or education evaluation documents. Whereas, Additional evidence is something that is not required by the instructions, but submitted to clarify at later stage. It is just the way USCIS treats it, but from the attorney perspective, it should be the same. Read Official USCIS Definition( scroll down to the last )

If you do not receive your notice by August 29, 2015, please call Customer Service at 1-800-375-5283.

    I am in the same boat dude,”My case was received” and that’s it for a long time, I contacted the employer and they said, this time USCIS is taking longer to process. I am getting tensed day by day. Anyone know, the maximum time of wait, in previous years.

    I don’t know what’s going on but I am still waiting for my case status change.. I recieved the receipt in May and from then it is still showing case was recieved… Any other in the same boat.. My receipt no.. Is EAC 15147****..vermont Centre..

        Relax… There is nothing to loose hope! It’s just the process of validating that is getting delayed. If you see more cases on WAC have status now… this indicates they are working on it and its only Aug 16… There is still 45 days more and anything could happen.. Just relax man!

    I got RFE on 6th Jun and on 24th Jul the status changed to “Response To USCIS’ Request For Evidence Was Received”. It is in WAC. How long it will take to process?

            No, not true. They do NOT have any such mandate. It seems like a logical date as Oct 1st is start date for many, but USCIS does not have any such SLA for regular processing petitions

    I got lottery acceptance in Mid May for regular processing, But still my status shows “My case was received” . Service Center assigned is Boston.I haven’t been asked to submit additional documents too.
    This anxiety is killing me. Shouldn’t I be getting Approved Status as of now(August Beginning), if nothing is wrong?

      I got my lottery acceptance back in April and am still on ‘case received’ too. Vermont, RP. I think there must be a lot of PPs getting looked at ahead of us. Suspense is killer and I don’t see how I can be ready to move by October 1st given the long wait time.

          Real Scenarios purely depends upon the Officer who is handling the case on a day to day basis. What I have heard is that they will carefully go through the docs and they will not Deny unless if the documents are fishy…

          Ohh Yea Pray that the Officer should not have a Fight with his wife on the same morning before he starts verifying the cases. Just Kidding – Good Luck!

    Can anyone please tell me whether it is possible to find out what documents have been requested when the case is in RFE state. My consultant is not responding when I ask him what documents have been asked for.

      Who is your consultant ?

      USCIS mails them what documents they need in order to proceed further.

      Its not same for everyone.

    In any way can we know the receipt number which we got from our employer is tagged to my name or not i.e by raising case in uscis website.

      No you can’t, even if you try to call USCIS – they will inform you to ask ur attorney or emloyer to contact them.
      The only receipt which gives the proof is I-797C which employer would have got already and you can ask them to share.

        i did, but they are not willing to share.The status for that recept is still in “Case was recieved” , its been already 3 months. When i ask employer abt this , they said we need to wait thats it , nothing can be done.

      It an take anywhere from few weeks to few months…So, there is NO deadline as such. It all depends on your case and complexity of it. You can upgrade to premium to get decision in 15 days.

        @Kumar .. is this something to worry about. I know you have been telling this ..the status change takes anywhere between from few weeks to few months. But 3.5 months is too much.

            Hi PJ,
            Even i was in the same position as yours few days ago. I was so impatient, I created a profile in USCIS and added around 100 cases around my number…my case number ends with EACXXXXX322″ i added case numbers from EACXXXX001 to EACXXXX400 and i enabled email notification. So I used to get notification of any change happens on any of the cases.
            I used to get updates on many cases like Approved or RFEs. One fine day I got update on mine as Approved. And now i removed all the other cases.
            Before I removed other cases, the trend is 64 still in Initial review status or RFEs. So the trend seems to be only 36% were approved inclusive of Premium processing till now. So dont loose hope, still time is there. Sorry for long post, I just want to help u to calm ur nerves.

          PJ, Not to scare you, I do know some cases have taken almost 8 months or more for getting to approval. Read some of the visa stamping experiences, they highlight some of that info on how long it took to process. I would not worry much. If you really are curious and cannot wait, I suggest you upgrade it to premium processing for decision in 15 days.

    My Case was selected in the lottery but after two month I get a call from my employer Visa Cell that the receipt Number you got is not belong to you.It belongs to some other hemant Kumar whose name as well as date of birth is same .I checked in My company there is no other Hemant with same date of Birth .

    Can you please tell me who give the receipt number and is possible that such mistake happen at USCIS office .

          Then you cant be sure about their claims in the first place, that this receipt number belongs to Hemant Kumar and DOB is same too. The probability of you two working in same company is very rare 1 in million may be.
          I feel like your employer is duping you, if there is portal to escalate this, you can do or else you cant do anything.

      Usually at what time in a day you get to know that case status got changed? Is it in the day time(working hours) or after working hours?

        I got to know about my status changing to RFE early in the morning on 28th July . You can set up an alert for the change of status so that you don’t have to keep checking it everyday and every hour of the day. All the best!

      VG, as it reads, it tells that for some reason it was probably filed to wrong service center and they have moved the another office. I suggest you speak to your attorney and look at the letter you get from USCIS to understand more.

    My application was filed under normal processing and I was informed around 30th june that it got picked in the lottery also I got a receipt number. All this while the status on USCIS website used to say “Case was received” and now from 15th July onwards it says “On July 14, 2015, we made the decision to refund the fee for your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number WAC15xxxxxxxx. We will mail your refund to the address you gave us. This refund does not affect the processing or location of your case. You should receive your refund within 30 days”
    When I call on the number it also says your form I-797 has been sent and we’ll update you once we make a decision on your application, earlier it used to say form I-797 has been approved. But this fees will be reutrned thing has made me really worried.
    Any updates would be much appreciated or if anyone else has faced similar situation.

        I am from India but my employer is in US n filed from there. I am B.E. computer science and Engineering and have 9+ years of experience. And mine was regular processing I know this kind of thing happens with premium processing at times but not sure ehats with my case. Please help if there are any views I am getting worried now.

          Applying from US or Your Home Country doesn’t really matter. I see your Qualification cannot raise any questions since your Degree is a BE in CS ( 4 Years ) so that’s ruled out as well. I am just suspecting that this has something to do with your Employer. Go through this site you will explore your questions / thoughts.

            I spoke to my brother in law (who is in U.S for past 16 yrs).
            Based on the information so far shared with me, he thinks there is perhaps nothing is wrong on your side, however the company who has filled your papers is not reliable (does not have good record .. unfair practices).

            Mind you this is purely our assumption and based on available information.

            I just hope and sincerely wish for the best.

      Abhinav, PJ, If you read the status message, it clearly tells that it does not affect the processing of your case. Fee refund could be done for a host of reasons, it could be that your employer included extra fees that is not required…It is hard to tell that, unless you speak to employer and know what they included. You do not need to panic much, just speak to your employer, it should be fine.

        Thanks all for your thoughts on this. To answer PJ’s question, yes I have all authenticated experience certificates and no gap in employment too and have given all the details and the companies I have worked with so far are all top notch Investment Banks, Consultancies and Technology companies, mostly in fortune 100 so I don’t think that should be an issue.
        However, if you are suspecting that there might be some issue with Employer’s code of conduct, so does that mean my H1 lottery would be treated as null and void or I would still be considered out of cap in case this doesn’t make through the approval process through this employer.
        Although I have checked with employer and this status is something new to him too and he is going to check with his attorneys on this. Meanwhile I also called USCIS customer care to inquire and the moment they took my receipt number they said sorry sir we can’t tell you anything about your case please ask your employer to get in touch with us and we can discuss only with them. They were not even ready to confirm if my application made it through lottery and any further updates too. Not sure why so secretive approach, is this normal…making me worried further.

I have not been able to get any further update on this either from employer or USCIS…still waiting and very confused what is going on…no change in status and no update either.             My employer said my application was rejected. I don’t really believe it, because I have done research, even for rejection, the fee for I-129 form would not be refunded. My employer and I had other problem and I kinda believe that he failed to fix the problem on purpose.

            I don’t think you need to worry about your case. I don’t believe fee refunded means “denial.” There can be many reasons for process free to be refunded.

            But I suggest you contact your immigration attorney, for a quick explanation.

            Some people said it is because the lottery was selected by mistake, so they correct mistakes by refunding applicants same way as they returned materials to those who were unselected.

          Abhinav, Well, I can only think of calling USCIS to know more. Sometimes the system does not show correct status due to some clerical errors. You may call USCIS or ask your employer to do the same. Also, this has nothing to do with denial, it is all pure speculation.

            I have contacted my employer again n again and he is saying we have forwarded to attorney n lets wait but I don’t believe that during 1 whole month they aren’t able to get any answer. However I did call USCIS again yesterday and this time the agent was very helpful she told methis is still under process and this status doesn’t mean denial however she was also referring to the line that this will not effect processing of ur case. So I think she was not much sure apart from whatever shewas reading on screen. However she asked me if I can provide further details on form I 129 then she can see further details which obviously only employer or attorney can provide so same road block again. However I did check with someone else also and he said he is suspecting this to be a case on waitlist n now USCIS might have decided to not clear this waitlist. Will update if I get to know anything else. You also please keep posted if you come across anything.

BTW with the person who is saying his got rejected, did you get to know any further details why it was rejected or any specific reason.

            That person has not updated since early August.

            Can you verify with your immigration specialists friends whether case can be selected in lottery by mistake? Rejection is different from denials. Rejections means unselected while a denial is a decision rendered after case is processed. And only cases are unselected will be refunded the filing fee.

            Has your employer received the refund check? What is the amount?

            When did you find out your case status? And how did the immigration attorney explain?

            I got the same status on June 22nd and I have been contacting my employer and she says my case got rejected which makes no sense, however I tried contacting my attorney but he has not confirmed anything yet. I did my MS and have genuine experience and it was applied in premium processing. I even asked the HR to forward me to denial or rejection notice if there is any but she hasn’t gotten back yet.

            I have been checking the case status every day and it is the same. I asked the HR about the refund amount but she isn’t disclosing the amount and she says my case is denied. If it is denied then the fee is not refunded and it will be explicitly mentioned about denial. Also I have been asking her to email the denial notice but no reply again. I doubt that a case can be denied without incurring rfe. The attorney is not replying to my emails and he has not confirmed that the case is denied. I feel some glitch happened which they are hiding from me.
            Just keeping my fingers cross for the best to happen. Good Luck to you too and please keep me posted if there is any change on your case.

            If your employer saying that your case was denied..doesn’t itmean that the full fee will be refunded?? Had it been rejected then only USCIS doesn’t return the fees. Moreover the status itself says fee will b refunded. Moreover I don’t think USCIS can reject a case without putting it in RFE or any such status. I also haven’t got any further updates..my employer saying they haven’t got the fee and the attorney has sent an email to USCIS for which the reply is still awaited. But one thing is for sure that something is fishy otherwise it shouldn’t take so long for them to get clarity.

            The fee is refunded only if h1b is not picked in the lottery. The fee will not be refunded if the case is approved or denied. Will share with you guys if there is any information from the attorney.

            Maybe your employer was trying to say “reject,” like you said, no refund to petitioners whose case were denied. My employer said my case was selected in lottery by mistake. I think the immigration attorney he hired just never had a situation like this thus could not explain. If the status says that case is still under processing, I believe so.

            Maybe your attorney is able to find out something. All petitions should be processed by September 30.

            I finally got reply from attorney, I am extremely mad at him. he said your case was rejected and we got the check back but in April he sent me the confirmation email that the case was picked in the lottery and I asked him why and obviously he has no answer. I came to know today that an early start date was used to apply for my case instead of October 1 which jeopardized my case. I am told about this today!!Really mad at these people, so you and Abhinav get in touch with your respective HR’s and attorney’s and find out if they have been hiding something of this sort.

            Thanks Kumar, I feel it was done on purpose but he has not been sending me a proof of denial and whenever I ask he says I haven’t received any denial notice from USCIS. Unnecessarily so much time and money were invested. Atleast I am on cap exempt h1b but this was for a new job with a profit based company. This is the only way I can pacify myself.

            rinally I got a reply from my employer and its not much different than yours. They don’t have any idea on why and how it happened…its just that they got the fee back and saying USCIS considered it as not selected in lottery. However he also mentioned that USCIS even encased the cheque in my case n its very unfortunate to gave this now. Although they haven’t received the packet back yet, but more or less its over for me.

      contact ur employer with all these questions and they have to send u the original approval notice, then you can schedule the interview with consulate with all necessary documents. It may take a minimum month time to get an interview.

      You may want to call your attorney and check back with him what exactly are they asking for.

        Hi, It is basically an NOID(notice of Intent to Deny). If you have received this after submitting RFE documents, then it says that after reviewing those documents USICS intend to Deny petition because they were not able to establish valid proof that you are eligible for H-1B classification. However, do not panic. It is not a denial. But like a last chance to submit evidences to USICS to make cancel this NOID. Typically this NOID has to be submitted within 30 days of notice. You have limited time to send a response. Failure to submit additional Evidence will result in denial. I am not sure on what is the NOID that you might have got as it differs from case to case. Please review your RFE and you will have an idea on what it can be. NOIDs have to be carefully responded. I would suggest you to take guidance from an experienced immigration attorney to overcome NOID provided you have valid reasons.

    I have received any update on my application, and according to the employer, he hasn’t received any update until now.

    We are not aware, whether the application was picked or rejected. As per the employer the cheque is not encashed yet.

    Can any one suggest on the reason for the delay.

      If the Cheque that was included the Application Form was NOT Encashed Then I am deeply sorry to say that your file could not have made it in the Lottery Selection… It is July now and USCIS has started returning all the Unselected Files from JUNE to all the Employers! Your Employer should receive the Return Package anytime from the USCIS if they have not received it already…

    When I requested for I-797 copy got below reply from employer
    As of now we got only the receipt notice number from the Attorney – As this is a legal document they will share us only once they have a approved I-797 copy.

    Is there any other possibility to validate the receipt number with my name.

      I-797-C which is also called the RECEIPT NOTICE is the only way you can validate your NAME / DOB / Receipt Number. Your Employer is Obliged to give you a Copy of this Notice… Are you Applying from US ?

        I agree with Seeker, especially when we browse the site from Andriod phone’s Chrome browser, the date is not getting displayed for most of the pages. It’s working fine on laptop browsers.
        Given the great service that Admin is providing, this is not a big issue for viewers though.
