Many of you who have applied for H1B Visa for fiscal year 2014 might be wondering regarding the H1B Visa processing times. Some common questions are like below:

Let me take some time to address some of the above most commonly asked questions around H1B Visa petitions processing times and how USCIS has done in the past. What is USCIS Processing time for H1B 2014 petitions filed under Regular Processing ?

Well, the typical adjudication (decision making) time for H1B visa petitions filed under regular processing by USCIS can range anywhere from 2 months to 6 months. There are cases where the decision was mailed by USCIS in less than 2 months and there are cases where USCIS took much longer than 6 months too.  Every H1B case is different and the time taken depends on various facts and factors tied with a petition…

Is there any set SLA for USCIS to process petitions filed under H1B 2014 Regular processing ?

There is NO set SLA for USCIS that stipulates them to adjudicate a H1B petitions filed under regular processing within certain amount of time.  So, you would just have to wait for USCIS, there is nothing you can do. Unlike,  USCIS has SLA for premium processing H1B petitions, but it comes with a cost.

How long will  USCIS take for H1B Visa 2014 Premium Processing petitions ?

USCIS has a standard 15 calendar days SLA for premium processing petitions.   Typically, it starts from the day USCIS receives the petition and they issue a case number.  But for FY 2014, due to expected high volumes they have pushed the premium processing clock  for H1B petitions to start from April 15th. So, you can expect a response from USCIS on your case by April 30th.  It can be a decision or an RFE, if something was missing.  Read article: H1B Visa Statuses – Approval, RFE, Denial

How has USCIS done historically with H1B petitions processing times ?

Again, as mentioned above, it has varied from 2 to 6 months. The current national average for processing times that USCIS publishes on their website is about 2 months and it seems to be varying depending on how busy USCIS gets with processing at a particular time.  You have to remember that the reason processing times can vary a lot is because USCIS constantly receives other H1B petitions that are not part of FY 2014 quota, which are extensions and change of employers, cap-exempt petitions, etc. that they would have to process as well. If  some of these mentioned are filed under premium processing, the priority changes from USCIS perspective.

Where can I look at USCIS processing times for H1B petitions ?

USCIS publishes the processing times on their website. The only trick is that that, you have to watch for date that processing times correspond to…All you need to do is select the processing center and it will show the approximate processing times. You can check at here at USCIS website

  1. My employer has filed my H1B petition as in-house project in their company.
    My H1B is approved and am yet to go for stamping in India.

    My employer is asking me to work for a new client instead of in-house project.
    I have got client letter as well from the new client.

    Here is my question:
    1.) My H1B petition was filed as in-house project. Can I go for stamping with the new client letter? Will there be any issues?
    2.) Will there be any rejection if I go for stamping as in-house project (I mean, if I don’t have any client letter) ?

    • If you are going for another client, amendment is required. VO may reject it. Safer to go for inhouse project during stamping.

  2. Does USCIS use priority mail to send H1-B approvals or just regular snail mail? When I got my OPT approved, I got my EAD card and approval on priority mail so just wondering if they use priority for H1-B approval aswell! Just waiting for my approval notice to arrive so that I know I have official H1-B at my work!

  3. I have applied for the H1B visa 2014.. Still it is showing in IR status.. since April 8th 2013.. In between my current employer is sending me onsite for another country in long term. Can I stamp my US visa for the country where I am going in their US consulate ? or do I need to come back to my native country. If I need to comeback to native country for H1B stamping for how long I can onhold the H1B stamping once the approval comes? Guys please let me know if you have the knowledge of this kind of scenario…

        • Hi,

          I have asked my employer to check with the attorney and have asked them to raise a service request.

          They told they will get back to me shortly once they consult with the attorney.

          I cant myself check with the attorney as they dont reveal the attorney details.

      Even my case EAC13138512XX is in IR state since Apr 8th. My Organization has called up USCIS on Sep 30th and spoke with the officer. They said to wait for 15 days more for further updates. I am hoping an update by this weekend. If not we have to call them again 🙁

    Sharing my 7 months roller coaster ride..may it it will help you and just give me a relief after writing this blog..

    Process: h4 to H1
    Centre: VSC
    Processing : PP
    1st rfe: June ’13( Asking paystubs and other employer related info which my employer didn’t revealed , confirmed me its an easy one)

    I was left bit relaxed but nerved.
    To no more surprise ,I am one of the unluckiest person who recvd 2nd one.

    2nd Rfe: July 13 ( Employer-emp relationship, totally employer related query)

    Employer responded in SEP.
    Today is the 14 th day of my second rfe PP clock stopped , 4.30 hrs back…still nothing moved?
    Is this denial or approval? I dnt want third RFE here .

    A PP case started in april going till october sounds weird isn’t it. I came here on leaves from a top MNC and now i have resigned that company just few days back. …feeling pity on myself… I am planning back to go to my home country while my spouse wud be here as career matters to me a lot…

    Fingers crossed just 0.1% are the approval chances now.

    Just wanted to share a good news that after waiting since April 1 with lot of hurdles in between my H1-B was finally approved on Oct 7. My application was in RFE response review since August 9. My RFE was related to employer-employee reln as i didn’t have client letter earlier. I was also in CPT from first semester at my new school after my OPT got over. They RFEed me about my CPT and how I was manage to work and study at the same time. Attorney submited good RFE response and it got approved after 57 days. Good luck for folks who are still waiting!!

    For my H1b , RFE was issued, The it went to denial.

    My company applied for MTR, and new recipt number was generated.

    Now MTR Status shows approved

    In the USCIS website when checked :

    New receipt number : WAC1390613631 ( It shows status as below
    On October 4, 2013, we mailed you a notice that we have approved this I290B NOTICE OF APPEAL TO THE COMMISSIONER. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

    Old receipt number : WAC1313850050 ( It shows status decision as below
    On October 4, 2013, we mailed you a denial decision notice for this case I129 PETITION FOR A NONIMMIGRANT WORKER. The notice explains why the denial decision was made and the options that may be available to you.     I wanted to check if anyone could help me.

    My h1b was issued with RFE and then went to Denial
    Then my company filed a Motion to reopen and a new recipt number was generated

    My employer dint share the tracking number and my offshore immegration team kept telling me that it is IR status all the while. When it was escalated i got to know that my approved documents (approved in June 2013) are laying in US office. Now they hv initiated to send the documents to India for Visa stamping.

    Can some one please advice if this delay be an issue in any matter. Experts please respond.

    I got a RFE reg my client invite letter . I have responded for it on 4-oct . When can i expect reponse from USCIS .

    As , I noticed i can see some getting response in 5 days and some getting in 2 months .

    Actually did USCIS has some SLA for it ?

    My wife’s H1b change of status (Quota exempt since she has had h1 before) has been in Initial review since April 5th at Vermont Processing center.

    Please check this site to check the processing time frame. As per this site the date of last application they processed is Apr 10th. If your received date is prior to this you can call their 1800 number to get the status.

        Have you got your money back as you got delayed respone in premium.

        It is 15 calender days, so you should get by 27th sept max.

        Even if we calculate 15 business day, you should have got max by 3rd Oct.

        • I still didn’t get money back, but when my employer contacted USCIS on 1st OCT, they told I will get money back since they can’t meet the 15 days deadline.

          After getting approval didn’t follow up with my employer to check if he received the check for premium fees, it should be, I will check later next week. For now I am enjoying the approval 🙂

    Oct 4th Approval – Status On Oct. 4th we mailed you a notice that we have approved this I129. (18 days after status change or 3 weeks + from Response submission).

    RFE was standard Project list, Client letter, pay stubs, etc.

    Awaiting the actual document for final relief. It has been a long and tedious wait this year guys, especially after the lottery where many of us left. Hold on to hope, you never know when the tide will change! Have faith!

    No further update on the status, today is 11th day. Please advice if status would directly go to decission/post decission from acceptance or it would go through initial review again.

    15 calender days, does it mean including weekend?

          If we consider calender day then today is 13th day…in that case I should get result by tuesday (8th Oct).

          Everywhere it is saying calender day, please advice.

        I am wondering why the status is showing acceptance and not in process. Also there is no any indiaction of premium processing clock. I saw on the 24th on the premium processing clock and have the screen print of the same.

      • Sure SID. Most of my collegues here have got either approval or RFE 2 months before itself. I am the only one still pending with IR. Even RFE cases are going to approval. Not sure why they are not processing which are in IR state. Not sure what is happening 🙁

    My dreams are shattered today. Got the denial notice today after RFE on Employer-Employee relationship asking for my role in the onsite project. I have 11+years of experience in Banking BPO and presently in managerial role. Not sure why I received denial when all the documents (SOW, invite letters for a similar role, etc) were provided to USCIS after the RFE. I also have B1 valid for 10 years. I work for one of the top most employers in India. What could be the possible reason for denial?

    • Hi Priyanka,

      sorry to hear that. But dont loose your hopes. Your employer can still ask to re-open/challange the denial with appropriate documents in cap-exempt way.

      Clearly there is no issue with the documentation from your side, but maybe yours is the consulting company who could not prove your role with company and actual client.

    • Sorry, but do not worry. It depends on case to case basis. You are into technology projects or entirely management of projects in BPO ?? They might have looked for some techincal inputs, just my opinion.. Please check with your company for L1 possibility..that does not require speciality occupation..

    Took off from work after 09/30/2013 since I can’t work after 30th SEP as my CAPGAP OPT is over.

    Still waiting for decision, client is asking for joining date, chance of loosing project.
    – thinking of taking admission for MBA and get CPT so save my project and to be on safe side

    • NP. if your case is in PP then you should get a response withing 15 days. Its strange and I am seeing first time that USCIS replied with returning your premium processing fees. Did you checked with any of the USCIS customer service agent?

      • Who said you cant work post Sep 30? Yes your cap gap is over…but you CAN work till your H1B is pending. Pls read some post below to know more.

        It is confirmed by my attorney and a couple more from certain law sites that we can work post sep 30 is h1b is pending,

          I have confirmed with so many people ( College student adviser, My employer, paid fees to a lawyer, internet blogs ) all suggest the same thing, capgap opt doesn’t allows you to work after 30th sep even your H1 file is pending.

          Since, things are going wrong with me, I can believe that there might be a chance that they might have miss this point as it happens in rare cases. So, if you think even capgap OPT allows as to work after 30th SEP, please let me know(learn_sql@yahoo.com) which lawyer said that, I am ready to pay the fees to get confirmed information about this law.

          • I work for a pretty big firm in the US and their legal team confirmed me that I can work. I have no option but to believe them. My college adviser has no clue on this.
            I too cross checked with 2 lawyers, one said I cannot work, other said I can.

            There is sure some confusion here, but I got to believe my legal team.

            Thats true I can work on cap gap till sep 30, but post that the status is not called cap gap. I dont know the name, but it is opt expired and h1b pending scenario.

            Its Oct now and I am on my work!

          • Agreed with you, there is a confusion regarding this.
            I have searched as you suggested on avvo.com and their one lawyer is saying that I can work on capgap even after 30th sep with pending H1B.

            But at same time on the same site(avvo.com) there are 2-3 other forums where other lawyer are suggesting totally opposite.

            This is confirmed from my lawyer.

            If your H1B is selected and your OPT expires, you can work till your H1B adjudication is done, even if it is post 30th September.

            Also, I am quoting from the USCIS website “Once a timely filed request to change status to H-1B on October 1, 2012 has been made, the automatic cap-gap extension will begin and will continue until the H-1B petition adjudication process has been completed”

            I was confused earlier as well, but now I know I can work.

            Also, many people confuse this with (quoting USCIS website) “Once a timely filed request to change status to H-1B on October 1, 2012 has been made, the automatic cap-gap extension will begin and will continue until the H-1B petition adjudication process has been completed. If the student’s H-1B petition is selected and approved, the student’s extension will continue through September 30, 2012 unless the petition is denied, withdrawn, or revoked.”

            Which only states that if your H1B is approved before 30th Sep, you will still be in automatic CAP GAP period through Sep 30 post which your H1B will kick in.

            People think that this also applies to regular cases where H1B is pending. But that is not the case. You can work! Go drink a chilled beer now.

    RFE date – 26th June ( RFE is for Specialty Occupation, submitted expert opinion from some eveluatory firm based upone my exp , study and the position on which I got selected)
    RFE Response Done – 1st Sep
    RFE Response Review – 17th Sep
    Approval – 2nd Octo

    I am 6 year IT guy.

    I was in RFE RR since 28 August and I asked the lawyer last week to upgrade to PP. I was still waiting for confirmation from the lawyer whether the PP upgrade has been applied when I got approval email this morning (01 October Singapore Time). Now I don’t know if the PP upgrade has been applied because I have not yet heard back from the lawyer.

      • Visas and passports: The State Department says it will keep most passport agencies and consular operations open so long as it has the funds to do so, although some activities might be interrupted. (For instance, “if a passport agency is located in a government building affected by a lapse in appropriations, the facility may become unsupported.”)
        During the previous shutdown in 1995-1996, around 20,000 to 30,000 applications from foreigners for visas went unprocessed each day. This time around, the State Department is planning to continue processing visas through the shutdown, since those operations are largely funded by fees collected.       Passports: Don’t cancel that vacation just yet. Even though passport offices closed during the shutdown in the mid-90s, they will remain open this time around, according to the State Department’s current shutdown plan, since they generate enough in fees to support their operations.     Its Regular processing.. IT field

    Wait was killing but now its f.. relief…

  32. USCIS have recieved my RFE response on July 25th 2013. Its been more than 60 days,still my status is showing as ‘Request for Evidence Response Review’ . Processing centre is Vermont. My RFE is about Client Invite letter, SOW and Project details. My company is a big IT services provider (Top 3). What can I do now? Does service request really help?

    • Mine is also stuck in RFE response review for the past 3 months(since June 18th). My RFE was on educational qualification. I was told by my company HR that it could take upto 60 days + 30 days(admin processing) in some cases. Mine has exceeded all those timelines. Planning to check with the HR again and see if they can raise take it up with USCIS. And ya i took work for the top 3 cmpny in India

          Could you please let me know your processing center. The first 5 digits of your receipt number should be really helpful.If its vermont service center it might take a little more time as the average processing time in vermont has increased tp 3.7 months as per the USCIS.gov website.

Hi..IS there any one else here waiting for Petition Approved or RFE details?I Just got an email from my employer stating that my Petition is Selected in Lottery on MAY after that I did not get any updates 🙁 85% of my colleagues got either Petition Approved or RFE. I am still Waiting.Can any one tell me when I may get an update?

    I am currently on H4 and I have filed H1 thru a consultancy in April this year.My employer told me that I have been selected in the lottery but they cannot give me the Receipt number since its their policy.There has been no update as of now and my employer told me that my case is still in Initial Review from April 8th.

    Could you please advise?

    • Is your status changed to RFE response reveiw ? If so how much time it took after sending the response to go in RFE response review ?

      Is it possible that status of the case will direclty go to approval without going in RFE response review?

      • Hi Visitor,
        I am trying to give you answer from my experience and from what ever knowledge I have gained speaking to my attorney and friends. It took 1 week for me from the day my response was sent to change my status from RFE to RFE Response Review.
        I do not think it is possible for a case to directly go for approval without going through RFE Response Review. RFE response review is kind of acknowledgement for RFE response. Hopefully these information will help you.

  36. I have been following this website since April to learn from each others experience on the H1 cap for 2014. I have never commented and today is the first day that i started commenting. I was on RP previously and then bumped it too PP in Sep.. Please be patient. If you have submitted your documents and given enough justification for the request for evidence then the service center would look at it and make the appropriate decision. Mine got approved yesterday …FINALLY!! I am so Happy

    If you convert from RP to PP, your case would move in this format

    In RP if you were on REF response review and then convert to PP then your case would get updated to Initial review , then acceptance.. It takes a day to convert to acceptance from initial review. Then the wait starts.

    It can take anywhere from 3 to 10 days to move from acceptance to initial review.

    As soon as your case changes to initial review it would take a minimum of 3 hours for you to get decision. Please be patient and pray to God!! I understand the stress and the tension involved but think positively and hope for the best!! Best of luck…

    If your status is in initial review in PP. Please don’t worry reading the automated message. It can mean 2 things either positive or negative news. As soon as your status changes to initial review in a matter of couple of hours your status should change to decision. It could take anywhere from a minimum of 3 hrs for the status to change from initial review to decision. Your attorney would receive an email too indicating the decision. Please sign up for email and message alert so that you could get to know when your status changes on your case.

    Petition approved: September 25
