What is the H1B Visa 2019 season start date ?
Update : USCIS will start accepting H1B Petitions starting from April 2nd, 2018 as per their official update on their website. In general, USCIS starts accepting applications for the next fiscal year exactly 6 months before the start of the next fiscal year. USCIS fiscal year for 2019 starts from 1st October 2018, which means they should accept applications for FY 2019 from April 1st, 2018. As April 1st is a Sunday, USCIS should accept applications for H1B 2019 season from April 2nd, 2019.

What is H1B visa 2019 Quota for Regular and Masters filings ?
As of the date of writing of article, the H1B quota is as below. This is also called the H1B Visa Cap. You can read more at What is H1B Cap ? Regular vs Masters quota ?

  • H1B Regular Quota : 65,000 visas
  • H1B Master’s Quota : 20,000 visas. ( only US Masters eligible)

Also, of the overall 85,000 visa cap, every year 6,800 visas are set aside for the citizens of Singapore and Chile as part of the Free Trade Agreement with them. There were few bills part of Comprehensive Immigration Reform that are not active in Senate that were proposed from Obama administration days to change the cap count to 110,000 and Masters to 25,000, including potential to make H1B cap extend up to 180,000. But nothing has moved and all are dormant. Nothing new has been proposed by the new Trump Administration regarding changing cap count. Will there be Lottery for H1B 2019 season ? Lottery Predictions ? Filing Numbers ?
Update : USCIS had lottery for FY 2019 quota and received 190,098 petitions.
Looking at the historical trend of H1B filings, cap reach dates, it is quite possible that we would have lottery for FY 2019 quota.  We have written a detail article looking at historical data, Trump administration new policies like ‘Buy American, Hire American’, students on OPT, H4 EAD removal rule, etc. factors. When is H1B Visa 2019 Lottery Date ? 
Update : USCIS Conducted Lottery for FY 2019 on April 11, 2018.
There are two things, one is when the H1B petitions are accepted for the lottery and second is when the actual lottery is done. H1B visa petitions for next fiscal year would be accepted by USCIS from April 2nd, 2018 for 5 working days until April 6th, 2018 to be part of the lottery. Now, the actual lottery date depends on various factors depending the volume of petitions and USCIS load. It can be anywhere in second week of April. For FY 2018, the actual H1B Lottery was done on April 11th, 2017 . We can expect anywhere around the same date like April 11th or April 13th.

How to find H1B visa 2019 Sponsors ? 
It can be very hard to find a good employer and convince them to sponsor H1B to work in US with major unknown like H1B Visa lottery. Anyways, you would be in one of the three scenarios, if you are seeking a H1B Sponsor. 

  • F1 Student in US : You can find an internship or co-op at an employer who can sponsor H1B visa and ask them to sponsor your H1B. You can continue to work on OPT once you graduate as well. You find the list of H1B Sponsoring companies using the tool
  • International Professionals  : If you are outside of US, it can be tricky with all the latest rules by Trump administration. Your best bet is to find an multi-national company ( MNC) and work through them to sponsor H1B visa. You may have hurdles inside the company with all the internal process, many waiting, etc. But, it is up to you to negotiate and ask them to take a chance. Many try the IT body shop route, where they ask them to file H1B. Rules have changed in the last few years and it is very risky move and can jeopardize your US hopes. What is H1B 2019 Filing Fee ? 
H1B visa petition filing involves USCIS fee towards certain things and attorney fees, which varies by company size, and attorney involved for the case.  As of FY 2018 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee.  In year 2016, for FY 2018, the H1B base filing fees, increased from  $325 to $460.   1. Non-AD. Hadn’t heard back after the lottery so assuming that I’ll be receiving a rejected petition in the next few days/weeks.
    However, I noticed that there was a change made by SEVIS in my “relation to field” last week in the SEVP Portal. Any idea why that might be? I’d rather not get my hopes up.

    • AD. I also noticed same SEVP update on July 3. But not sure what it is related to. May be for rejection also they are updating SEVP portal. Haven’t heard back anything yet. Did you get any udpate?

          • I know a friend with Wage level 4 got RFE questioning his background on his h1b transfer and then got approved.
            Last year I got RFE with wage Level 3 for Computer System Analyst and I got declined. In RFE they asked me how my background in Industrial Engineering is related to programming.

            Of course it depends on what the officer is looking for. But I feel it’s completely random.

            This year I applied again hopping for better lock.

            I am AD – Second timer- Senior Analytics Engineer.

        • Yeah, if the background is industrial engineering, then obviously for Programming related job you should get an RFE. You just got into that field because it pays more. This ain’t good man.

    I have applied H1B through some consultancy from US and it got picked in lottery, online status shows Case was Received’, currently I’m working in India..this year most of the petitions falling under RFE’s not sure when it will clear ….now I’m thinking to change my job in Indian it self..for monitory benefit..can you please pass some suggestions, if i change my company in Indian ..will there any impact to my H1B petition..?is it safe to change company after h1b picked( Through US consultancy) in lottery…could you please shed some lights on it..

    • Your current employer might withdraw the petition once you quit. You would have to try lottery one more time next year as this lottery cannot be reused.

      • I wouldn’t compromise h1b for monitory benefits in India…

        Unless its a significant jump in salary and you really don’t aspire to be in US earning multiple folds of what you make in India currently.. dont know your compensation in India, but most commanly thats the case.

        Staying with current employer, coming to US and then switch in the US… i would personally do that….

        In case current employer withdraws the petition.. not only you loose your own chance but also someone else’s who might have got picked instead of you….

        • If you are not working for the company who sponsored your visa at the time of filing and now then it will not affect your visa approval process. However, if you are working for the same company at present who sponsored your visa then it is every chance that the company may withdraw the petition. If that happens then you have to go through the lottery all over again.

  4. Earlier I was happy my case has been transferred to WAC, but surprisingly this year Vermont processing times are faster. It is 1 week to 4 months on the other hand it is 2.5 months to 4.5 months at California SC. (Checked at usc is website)

    • H1B processing is random even though there are time lines listed in USCIS. If your case is still pending on September and the PP is open then that is better to upgrade and done with it.

    • wouldn’t rely too much on this information. Until last week it was showing up to 15 months for EAC. Sometimes a few outliers can affect these timelines and inflate these numbers.

      Frankly processing time in any of the centers is pretty random. In my company several students were hired for the same job profile from the same class/same school. Everything on the petitions was same including title, salary, education and experience but some got RFEs while other received direct approvals. probably duration and approval both depend on what kind of day the reviewer is having.

  6. Does anyone have issues tracking the case using Case Status? I have an account created in https://myaccount.uscis.dhs.gov/, which seems to be accurate, but Case Status is still not pulling up my receipt. Should I be worried?

  7. USCIS My Account History Tab shows “We received your case” twice with the same information , same submited date, everything is same buy twice, two “Plus sign”. I am checking everyday, this happened today. Case Status tab have just single entry as always. Anyone noticed similar thing in History tab?

    I am on cap gap and I have got an RFE. So what happens if the RFE does not get cleared by October 1?

    • I had a similar question so I did my research elsewhere and this is what i found

      You can legally stay in the country but you cannot officially work.

      See the link below and check the FAQ. I tried finding USCIS link but i don’t think they have mentioned the same info on USCIS. If any one finds, please post below

      • Mr. frustrated person.. bring your frustration level down.. your cap gap extends only until sep 30… your F1 is done on that.. you can not work and you are on the clock to leave the country from next day. you can call uscis to confirm this or do some research instead of calling other names or accusing someone of spreading rumor and hysteria. Be informed.. and dont shout and blame others before knowing your subject.

        • A cap-gap extension is a regulatory provision which extends an eligible F-1 student’s status to bridge the gap between the end of F-1 status and start of H-1B status, thereby allowing the student to remain in the US during the “gap.” The cap-gap extension is available to students who, as of April 1st (the beginning of each fiscal year) were either on approved OPT or in their 60-day grace period and have a pending or approved change-of-status October 1st H-1B petition with the USCIS that was filed prior to the expiration of their OPT or 60-day grace period. Those filing for H-1B via consular processing (link is external) DO NOT qualify for the Cap-Gap Extension. You must confirm with your employer if the H-1B will be filed as a change-of status or via consular processing. You may be eligible for one of two cap-gap extension benefits:

          If the employer filed your H-1B (change-of-status) petition and it is received by USCIS prior to your post-completion OPT expiration date, you qualify for an extension of your OPT employment authorization.
          If the employer filed your H-1B (change-of-status) petition and it is received by USCIS after your post-completion OPT expires but during your 60 day grace period following OPT, your F-1 status and permission to remain in the US are extended but you are not eligible to work.

    • With receipt number its bit difficult as the USCIS website would always point to lottery date only. With receipt notice, you can get to know this!

    • Rand is making 200k.. he can give some to you.. with his attitude he wouldnt have a life or friends.. so its probably unused anyway..

      btw.. 4yrs in .Net should get you over 120k.

  14. Sheez guys. I just got an RFE today stating that my pay stub doesn’t match the Wage Level listed on my LCA. I am highly surprised I got this RFE. Can anyone say if they got any RFE similar to mine? I did not apply for my STEM Extension since I got picked up in the lottery. Can someone throw some light on what I should do next?

  16. Case was received on April 12th.
    Got an update on 6/22 online saying they Require More Evidence.
    On Monday 6/25 my lawyer confirmed that the RFE states that Page 1 of my LCA was missing in the documents but she says she did send it as she checked the copy of documents she sent to USCIS. She is resending it either ways. That was the only reason for the RFE (I checked the RFE document myself).

    Vermont Center, Doing my second Masters, Applied as CPT, Full Time Employee, Level 1 Wage.

    Lets hope they approve it 🙂

      No wonder so many people are against the H1B program, so many wages are simply ridiculous

      • Wage level is not depends on the education level but the position available. Almost all of the specialty occupation in US requires 4 year degree and not Masters or PHD as per DOL.

          That’s why a recent undergrad should make WL 1 or 2. And someone with more education should make more.

          • I agree H1B should be allowed to be filed for a person with Wage Level 2 and above. The companies are just abusing it by giving Wage level 1 to Master’s candidates. This should STOP!!

          • Not really. If I am a hiring manager and the job requires 4 years deg, 2 years or less exp and someone applying with Masters and PhD with more than 4 years exp then I gladly takes the second guy. It’s supply and demand. However, for USCIS they determine the applications based on the position not the applicant. This is my observations based on last several years of H1 trends.

          • 2 Possibilities:

            1. The position is undergrad entry-level and the guy is a loser for taking a low-wage job he is overqualified for
            2. The position is advanced and the LCA has a lower Wage Level in order to exploit the worker

            Either way the guy is a loser being abused

            So, when a suitable job is not available it is wise to take a job and move later once good position open up. However, everyone free to choose the decision as they see fit. Also, not many get WL4 jobs in their first job or just right out of the college. So, congrats for your achievement.

      • I am doing my second Masters from Harrisburg! Day 1 CPT. I started this while I was working at my company. I have been here for a couple of years now and did not get my H1B picked those years.

        The company I work for on a average pays less regardless if I am on H1B or a citizen. Wages also depend on location, position and company size. Anyways thanks for the concern. Best of luck with your WL4 🙂

        Are you full-time or one of those fake profiles?
        How much experience do you have? Do you own a company? Or are you one of CEO, COO, CTO?

        • Sorry for calling you loser, this process is very stressful and makes me angry all the time

          I had 2 years of work experience before coming to the US to do my Master’s. I’m now on my first year OPT.

          I’m based in the bay area working for a large tech company (Full-time). I don’t work remotely. I don’t know the CEO of the company. I didn’t know anyone at my company before applying for a job

          I’m a mathematician/statistician.

          • Are you sure you have WL4 in bay area? that doesnt sound right for a fresh grad. I hope you are not comparing WL from another smaller part of california.

            Yes I am sure, I checked the LCA myself. It is a WL4. I graduated with a full-merit scholarship from a top school in the country. And large tech companies in the bay area pay well

            Not all H1B’s are cheap labor you know. And some of us actually worked hard to get where we are, instead of trying to cheat the system like so many here

          • I am curious why admin deleted some of the posts here. there was nothing obscene, or derogatory to anybody. There were only arguments, which is technically still there.

            It was funny how Mr WL4’s ego was hurt and he replied with multiple posts. These posts also showed how big his ego was when he boasted about his $210k salary and scholarship and getting lottery in one attempt. But again nothing was offensive or against any religion, case, creed etc

            This was disappointing admin. Should have respected freedom of speech for those who didnt violate forum rules.

      • Rand you don’t really understand wage levels in the LCA do you.
        1. If you consider the bay area in california, a level 1 wage would be around 95k- 115k
        2. If you go to the mid-west areas a level 1 wage would be around 50k -60k or so.
        3. A person making 110k in the bay area is probably doing better than a person making 72k in the midwest. Your logic is that because 72k in the midwest is wage level 3 so that is better than 110k in the silicon valley with a wage level 1.

        Secondly the LCA wage levels need not be the same as what the employee is actually paid. The employee might be paid higher than the LCA wage as level determined using federal databases like flc datacenter, which just determines the prevailing wage for that role in that area. Majority of the times the employees get paid far higher than that.

          I would argue the opposite is true. Considering the extreme level of corruption (fake in-house projects, wages being confiscated, workers paying for their petitions, benching without pay) I would guess most the employees are paid less.

          In my case, I’m paid a lot more than WL4 given my bonus and stock based compensation

      Your case is giving me a tiny bit of hope. I am also on day 1 CPT at HU and have also received an RFE. My lawyer’s office said they will review it and get back to me about it today. Super nervous as I feel it is about CPT but lets see, maybe I will get lucky and it’s like yours.

    I currently live in the U.S. and am waiting for H1b approval (my petition got picked up on April 19th – AD). I would like to visit my country if I get the approval notice before the end of August. If I get the approval, what should I do once I visit my country? Do I need to make an appointment with the the US Embassy in my country and then get the H1b stamp? The official approval letter is needed? Thank you.

    • If you come back to the US after October 1st on H1B status, you needs to attend an interview at US embassy & YES, APPROVAL NOTICE IS REQUIRED FOR ANY VISA INTERVIEW. (what kind of the question is this?)

    Need your quick opnion. I have a stamped H1B VISA and I am still at India. I got offer from USA consulting company with MNC company as end client. Consulting comapny is going start my VISA transfer, mostly on Premium mode, Once Transfer is initiated a USCIS application number is generated, And I read with application number Candidate is eligble to work for new employer. Since I am at India,
    1) Am I eligible to travel with new Petition transfer (USCIS) Application number and old stamped VISA while transfer is in progress?
    2) If my transfer gets approved while I am in India (as case being Premium), Do I need to go for Stamping again with new Petition?

    Please help providing on this scenario and how people are travelling from India. Thanks in advance.

      Then why people say you can travel from India with old valiid stamping and new petition.

  27. After USCIS started issuing NOIR for multiple petitions, people have started to remove duplicate petitions.. seems like fraudsters are one step ahead of USCIS. there will be now only one approved petition.

      1. Multiple Petitions means “different End client” ( one or more picked in the Lottery) right ?
      2. Duplicate petitions means “Same End client” ( these anyway USCIS remove before Lottery starts ) right?..

  28. The numbers are for the bottle and not the beer inside. Once it is capped the expiry date and batch number is printed later !

    USCIS generates receipt numbers first and then processes applications using humans and not a for loop in a computer….

      say you have 10 bottles – 1 through 10 and you give these to three workers X,Y,Z

      X: 1,2,3 , Y: 4,5,6, Z: 7,8,9,10

      Now lets talk about Z. In 10 days say he dispatched 2 bottles. Those will be 7 and 8 right? Or he is putting all bottles in a bowl and randomly picking 8 and 10 first?

      • Join USCIS spend your whole life sorting 90k applications by hand… Stack them up and allocate those stacks sequentially to n employees… Force the employees to only work on applications in the sequence they received….

        It’s a bloody damn manual process…

  29. USCIS petition process prder – I didnt see any sequence in the approving WAC receipt numbers. Few receipts have already been approved which are coming after my receipt numeric order. If its manual process, there should be an order. Waiting for the status.

    • If you print numbers(sequentially) on 90000 bottles and distribute it amongst 200 workers to manually put a cap on each bottle and dispatch it… The dispatched bottles will loose the sequence…
      The sequence will be lost depending each person’s speed and how the bottles were distributed amongst those 200 workers….

  30. Not Sure what process uscis follows to process the cases(i mean the order),,, but lot of people are in the same boat…

    No need to keep checking status everyday as uscis account will notify u of any change….

    • I would hope their system would inform me, but reading comments in this blog, it seems like not everyone gets the email/phone notification ..which kinda adds to the frustration and paranoia! haha

    AD, Vermont center, Wage level 2, Full time
    Got my pickup notice very late on 4th June with receipt notice date of 24th May but got the approval within 1 month. Finally I can relax now.

    Never loose hopes.

      • I did get the pickup notice on 4th June as I said earlier which is very late compared to other folks who usually receive it in April but thankfully I got the approval in 15 days

  34. Is Master Degree mandatory for the people who are trying for H1B from India location? One of my friend told me that with Bachelors degree its tough for the petition to get approved even with 10+ years of experience.

It’s just a simple question if anyone heard any news about returned petitions even in their friends circle just to keep myself informed as am trying h1b for the 4th time waiting desperately to receive some updates – positive or negative.. there is nothing wrong I see in my question.. sorry if you feel if it’s offending..

  36. Anyone from IBM-US got updates on their application? Mine was submitted through Fragomen, but haven’t heard back from anyone. There are also 3-4 friends with me who are still waiting for the update. Is there any hope?
