H1B 2018, 2019 Season is over, H1B 2020 Season Starts on April 1st, 2019.  Check out H1B Visa 2020 – Start Date, Fee, Lottery – FAQs 

If this is your first year of H1B visa filing, you must read What is H1B Visa, Requirements, Process . Not to scare you, Last year, there was lottery for H1B season and for FY 2017 USCIS received 236,000 applications .

When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017. 
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017.  But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017.   If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017.  You may read USCIS Press release for H1B 2017 Start Date 

What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ? 
Update : USCIS confirmed the below quota cap numbers in latest press release for FY 2018. 
To get some background, read H1B Quota – Regular vs Masters .  There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in.  The total H1B Quota as of today is 85,000 and it is split like below.

Regular H1B Quota  65,000
Master’s H1B Quota ( Only US Masters Degree Eligible) 20,000

Out of the above 85,000 quota, 6,800 are set aside for Singapore and Chile citizens as part of the free trade agreement between them. Also, check out the article with history of maximum H1B Cap from 1990 to 2017 

H1B 2018 Lottery Predictions ? 
It used to be a speculation whether we would have lottery in previous years, but in the past 4 years, lottery has become common. It is very likely that we would have lottery aka random selection for H1B 2018 season.  We have been writing predictions over the years and all of them have been accurate so far. When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially  on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
  • Other H4, L1 Visas :  If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.

  • If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
  • If you are professional planning to arrive in US from outside America,  it can be really tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ? 

The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS.  There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary from FY 2017 quota.  If any changes, we will update this accordingly.

H1B 2018 Lottery Results – Checks Cashed, Receipts : 
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date.  To put things in perspective,  last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017…  Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018.  Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?

We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Check out USCIS New measures to report, prevent H1B Fraud  . Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. There are many speculations on how H1B program will become tougher with higher wages, quota limits, etc… but, nothing has been officially signed. We will update the article as new updates come in.

Various H1B Bills  in US House and Senate  – Will they be passed for FY 2018 ?
There are few bills that are introduced in 2017 and at various stages in both house and senate. There are many confusions regarding the same bills like the minimum wage will go up to $130,000 USD, etc.  Fact is that nothing has passed and there are very slim chances for them to get passed before start of FY 2018 season.   1. The way it’s going and an M.I.T event in Boston last week where TCS CeO said “that reliance on H1 has to be removed.” Indicate that H1b will no longer be the golden goose. More work will come at offshore. Already some clients are making mandatory offshore on-site ratio as 10:90 . In future indeed you have to be highly skilled to get into H1b category. It’s good bye for normal people like to dream the Us dream

    Most of the TLs are kicked off…….in my unit 1 out of 8 got filed others are kicked

    • There is a priority attached to each case. The employees can’t see it, dm knows about it. I came to know about priority two years back when mine was not filed. Considering the facts that last year visa lottery candidates have not travelled, USCIS is scrutinizing computer programmers strictly this year and immigration attorney fees are not refunded. I think infy might have applied higher priority cases alone.

        • HI, May I know whether you traversed all the steps in the GICS portal.. say from initiation to ready for printing – as was the case in the previous years? Because, I see my case and others where the steps didnt move after JD Review and even after repeated mails and escalations, there was no information from GICS

    • USCIS has never mentioned expecting more than 200,000 petitions. THIS IS HUGEEE FALSE. This is FAKE NEWS.

      What USCIS had said is they reached more than 20,000 applications for advanced cap (Masters cap), not 200,000.

    • There are no shipment details. But Yes, it does have the Status as :”Filed with the date” filled in my INS Zoom.

      You can check with your Case manager/ project manager, if your case was finally “Filed” or “NOT”, as for a lot of us in IBM, as in other companies, we don’t see everyone, who was nominated, had their LCA’s filed.

        • This update is coming for All IBMers whose LCA is filed including me. Although I already updated, only 6 people were picked up from the entire list of 37 people who were nominated for H1B from my account and whose LCA also showed as certified in DOL website.

      • Latest news coming is .. USCIS has mandated a fixed quota for a company. If a company goes beyond that limit there will be lottery for the company’s lot. So whoever status is showing as filed..You have hit the Jackpot ..It is confirmed that you will get H1B. Also all managers ( heads) were aware of this decision by mid-March

          I am one among the 6 who were selected from a pool of 37 people being selected from our account. So not sure what the results would be, but I am keeping my fingers crossed !

    My H1B amendment was filed on 31st March,2017,Friday in PP just before April 3rd cutoff for Premium processing.Till Date I have not received any Receipt Number or any update from Immigration Team.Can anyone tell me if any body else facing the same.

        I know there is no PP for this year but my case was filed for amendment in PP mode which is cap exhempt as it was before 3rd of April & I have a valid approved petition from FY2016.

        @Saurabh: Can you please update if you are aware of any such delay for PP filing.

            I am trying to reach my immigration Team on the PP amendment delay issue & they asked me to wait for 15 days from date of filing.I want to know what is the SAL for sending the receipt number & decision for Premium case amendment.

          There was a delay in sending out receipts for PP cases received prior to April 3. The attorney should follow-up w/ USCIS on this. The PP SLA of 15 days commences on the date it is received. So that’s why attorney wants to wait for 15 days before knocking their doors.

    My employer Company A has filed my H1 for the 2018 FY, now I’m getting better offer from Company B. Can I join Company B and if my H1 gets approved, can I transfer to Company B after October 2017?

    • You can’t decide what to do…. I get one question from my mind. A person who can’t decide himself to apply h1 from available options, USCIS should decide not to give visa and send back where he come from.

    “Patriots” keep trolling everybody, legitimate petitioners are worried about the body shop candidates, body shop candidates are worried about USCIS, everyone is worried about duplicate filings, no one cares about those who file cap exempt petitions like professors or whatever, everyone is waiting for a lottery announcement and # of petitions filed.

    You guys need to chill out a bit.

  19. Hey guys, the iCert website currently has a notice about server down due to maintenance from 21st 8pm till 24th 6am. Could that possibly due to a massive updates to LCA data? My guess that in 24th we might know the results whether LCA was filed or not. But my point is, I’m going to move on and keep my visits to this site down to one per day…lols, cuz it seems like they going to keep their door shut for a while and its just a waste of time checking on them every hour.

    • Your company is legally required to provide you a copy of LCA as soon as it’s certified. That they haven’t, alone, proves what a company you’re working for. I truly do pity you.

      • Sam, I dont know why you pity for me, but regardless, I’ve worked for my company off-site for last 10 years (all because I wanted to), and now I wanted to move on to work on-site and they approved it on my request first try, so nope, I dont feel pity at all, they treat me well. I dont have LCA in hand because I dont quite communicate with their lawyer on this stuff because I know when they say they’re on it, they mean it. For that I feel pity for you as well for being arrogant assuming you know everything man.

  20. I am reading a lot of comments from people from different companies, on their doubts on the fact, if their LCA was filed or NOT.

    Its pretty simple, you have got all rights, to have this question raised, to your Case Manager and he is responsible for answering, if your case is filed or NOT. As simple as it. There are no two ways to it.

    Ask this question to them ! If they say to check with your Account/ Project Manager, in case they have send the updated nomination list or NOT, then do check with your Account Executive / Account Manager /Project Manager (based on the recent turn of events – less experience people not being considered / average salary more than 60000 US $/ the multiple other factors, known to all in this forum).

    Be vocal and ask the right people. Its your Right to ask them and your right to get the answer. I don’t see a reason, why the above can’t be confirmed. In fact, this is the only thing, you can get the clarity from your respective companies !

    Why to live in figments of imagination, when your LCA might not have been actually been filed. You may feel a little bad, as I did feel for my experienced and deserving colleagues (I am talking about a very big MNC, where even people above 8 years experience have been left out, based on some other factors 🙁 )

    The converse is also true. Why not get the clarity, and feel a little more motivated, when your LCA might have been actually been filed & keep Your Fingers Crossed for the results (Just as all the above steps were followed by me and my status currently in INS Zoom shows as “Filed”) 🙂 !

    [NOTE: The TRUTH is out of all people from my Account who were nominated for H1b, and for whom, the LCA was showing as “Certified”, only for 20 % people, the LCA has been “Filed” !
    So this goes for one account in a company. Try to figure out yourselves, how this would have transcended down to the company as a whole and all other companies ! Shocking Facts ! 🙁 ]

  21. This year odds of getting picked for master’s cap vs regular should be nearly the same. Despite getting two chances, the probability has been worsening for ones with masters degree from US.

    1. There are several people that were not selected in last 2 year’s lottery, and are still trying their luck.
    Those in US might have seen how number of people from different classes received their visa. For example at my graduate school everyone got the visa in 2013 and 2014, 90% got their visas in 2015 and 60% got their visas in 2016.
    2. Number of duplicate filings- several candidates are filing multiple applications through small bodyshops. Most of these people filing multiple petitions are from masters pool and are already in US. Sometimes their multiple petitions get picked up and that just wastes opportunities for others.

    The odds for people with master’s degree are worsening simply because number of people in the pool is increasing due to rollover applicants as well as multiple petitions.

    Now for regular pool, despite what we have been reading in comments every year, companies like infy, tcs, wipro, HCL, accenture and cognizant have filed 10s of thousands petitions each year in recent past. since there is no cost involved with unselected petitions they can take the chance and build bench strength. There are several people i personally know who won lotteries in last few years and havent flown to US yet as they dont have any projects. On the other hand there are several people already in US on student visas or in jobs that are on the verge of going back because of lack of visas. To top that, body shops that take money from people for filing visas make the entire situation worse.

    Merit based, salary based or job based doesnt matter but there needs to be some sort of visa reform. At the very least the fee for petition must not be returned that way people will avoid paying for multiple filing and companies will avoid unnecessary filings.

  22. On 7th April morning, USICS Announced that USICS has received sufficient number of applications for FY 2018 H1B quota.

    7th April was 5th working day of the month April 2017. What happens to the applications that USCIS received on 7th April? Will it reject or it will accept the applications?

    I am asking this question because USICS announced the news on 7th morning itself so not sure whether it will accept applications on 7th or not?

      I am also worrying for same…When i checked my fedex status ,it shows as my application has delivered on 7th April 2017 local time 11.45am at ST.Albans VT,US…and it shows as delivered.

  23. There should be a stand alone H1B category for certain countries just like green card. Set aside the eligibility, most of the IT jobs can literally be done remotely, which means ya’ll can sit at home wearing your underwear and still get the job done. The US and the rest of the world should not be penalized by the population crisis some country have. Regardless how much you can make when you get to the US. A lot of them probably easily make $100,000+ per year but do not spend one extra penny to help local economy. Instead, they send most money home. That does no good at all.

    I know this is really bias and does not change anything. I’m just talking nonsense like most of you here. Good luck.

    • Stand alone for H1b – Are you joking. Well it may suit for Green Card which requires time for a country to decide respective individual for Residency. H1b is just a work visa issued for 2to3yrs initially, It has lot of. Limitations. Well you may say work from home option rather than presence of a h1 resource on-site, Practically not possible. Your ignorance and don’t know that We Indians pay Taxes whatever White-collar job does.

          Your opinion really sucked. When you talk about a country that is not able to control its population or about people who send money home, you insult other and put yourself on some sort of pedestal just because you come from a tiny, non-relevant country with practically no ties to family backhome.
          Second – the role of immigrants in any economy is very well documented. US is called land of opportunity because its a country of immigrants where people come to fulfill their dreams of making it big. Even those who come temporarily on H1b contribute to both economy and culture. Read before you talk/write.

        • You can have your opinion and I can have mind. I wouldn’t get out there and tell people their idea sucks just because I disagree. Some countries do have population issues and that is a fact. Truth is ugly whether you like it or not. If you think there are more people than food in the country you come from, and people are trying everything possible to get out, then that is an issue. And if you don’t deal with it, sooner or later that would become someone else’s issue. Having a dream and work hard to make it happens is incredible, but that doesn’t mean you can leave the issue pretend it is none of your business. At the end, everyone suffers. Also, when you said immigrants, I am not sure why you even mentioned it. Lastly, the country I am from is the 10th trading partner with the US in 2016, by dollar amount. It is a tiny country I will grant you that, but irrelevant? Depends on how you look at it. H1B numbers? Yes we are only less than 1% of the total number of H1B petitions.

  24. Is it possible that they suspend premium processing because they already thought to no lottery? It will be hard to go into each application in two weeks so they just remove premium processing.

        Lot of other things contribute from non immigrants like GDP
        Universities will be on verge of massive losses if not mediocre universities filing for bankruptcy if international students stop coming to states.
        They are the major contributors for university revenue with out state tuition doubled

  29. Not sure whether there will be lottery or not but it will be foolish on the part of USCIS if they do a random lottery again without any prescreening especially when they want to reject junior/low skilled applicants later.
    If they go with the lottery approach without any filtering then that means all they want is to reduce number of h1b visa holders entering the USA knowing very well that they will reject many candidates selected in the random lottery.
    In this case happiness will be short lived for many candidates!

    • I am from a leading MNC and just have got the status as “Filed” and have got the “Filed On Date” in my “INS Zoom” reflected. No other details updated so far !

      Do post, if any of you have got any other updates. But this year the numbers are extremely low of the people, whose LCA was actually filed. I would suggest you all to confirm with your Case Manager (provided if you can), if your case was finally “Filed”or “Not”.

      There are high chances, you may be welcomed with a “GOOD NEWS”, or a “BAD NEWS”! As per the intermittent updates, “NOT ALL THE PEOPLE, WHO WERE NOMINATED FOR H1B, HAVE THEIR LCA’s ACTUALLY FILED” !

      A Shocking piece of news, but TRUE to the CORE !

  30. I have decided to do a tremendous favor to all genuine candidates. I am reporting desi consultancy details to USCIS on the H1B fraud e-mail id. Over the weekend, I’ve drafted and sent almost 10 mails. If your a desi consultancy candidate, I’ll make sure the authorities don’t just punish but go Nuclear!
    Be smart and save yourself or else the consequences. I appreciate the work done by the admin of this site.

      • I’m maintaining secrecy. This weekend I’ve focused on desi consultancies in TX, NJ & VA. Few of my American friends are also supporting me with this. There is an advantage to this process as they are citizens. Apart from written complaints, we are also calling USCIS and letting them know.
        We don’t want our efforts to go waste. Its being planned and executed in a way where we get substantial results. The good part is these consultancies have filed and hence records are already available.
        Last nail in the coffin for these folks !

    By saying you’re not an Indian does not increase your chances.

    BTW majority of Indians make more than your “more than double” income on H1B visa be mindful of that fact.

    Have been reading this forum for the past few days and it seems quite informative.
    I am an applicant this year through one of the top tech companies in the US with an offer more than double the minimum required for h1b and I am not Indian.
    Like everyone else I have been trying to figure out how many applications there will be this year. Here is what I found.
    Based on the following website (select Occupations), there were 81,814 LCA for Computer Programmer last year. I assume this was for all new and extension/change applications. This is the category that will likely be most affected this year. The average salary for this category is less than 70k which I assume is Level 1. So if we subtract about 50k-60k from the total number from last year., we are at 170k-180k. Also based on some news reports that the largest Indian IT companies have not filed as much as last year, it is possible that the total number could be around or under 150k.

    Assuming 150k total, 20k for Masters categories, then you have 130k for 65k remaining spots. This is 1 in 2 if there is a lottery. This seems to be better odds than the last few years.

    Do I have any issue with recent USCIS policy or I am fine here. Please need your comments

      You can go to https://icert.doleta.gov/. There is a section named “Search by prevailing wages”. Here you can select all the relevant entries and see the prevailing wage in the area for your occupation title and code.

    • There won’t be any problem if you are filing through different employers. Multiple employers can sponsor your H1B and you can decide which employer to pick later. This is completely legal. Filing multiple applications through same employer is going to be a problem. That’s illegal.

  37. These are my speculations:
    There are many lawyers claiming they filed same or more no. of applications as compared to last year. Fairly possible. However, because of high scrutiny there are high chances of declining applications even before considering for lottery. This year they didn’t mention about lottery or #s of applications, probably because they want to make sure that applications going for lottery are legit. This sounds like a lot of labor time and expensive, but this could be one of the possibility.

    • premium processing brings lot of revenue for uscis as lot of companies use it to know the result earlier. Why will an agency like uscis loose this golden opportunity to make money without any reason?

      But suspension of premium processing gives them the flexibility to complete the h1b selection before October instead of may and the government also gets time to think of a permanent solution for h1b high skilled program.

          The argument that USCIS has very few resources is not correct. Irrespective of whether there is a lottery or not, USCIS is going to open all petitions.
