When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017.
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017. But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017. If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017. What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ?

To get some background, read H1B Quota – Regular vs Masters . There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in. The total H1B Quota as of today is 85,000 and it is split like below.

When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.
- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
- Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
- Other H4, L1 Visas : If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.
- If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
- If you are professional planning to arrive in US from outside America, it can be really tricky. If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies. The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ?
The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS. H1B 2018 Lottery Results – Checks Cashed, Receipts :
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date. To put things in perspective, last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017… Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018. Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?
We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Sorry to hear this..My case was transferred from VT to CA on 20th May 2016 and was picked for processing on 24th Jan and was issued an RFE and now still in RFE Resp received..It might be a bad news..But depends on case to case

A case is only transferred after being picked. And cases are being transferred because of lack of processing manpower in certain centers. Being transferred doesn’t mean anything bad. If you have an RFE and shit is taking too long, it can be because of cenetr incompetence and a shitty lawyer.

This is happening to a lot of people. USCIS published the statement stating the same as well. I dont think it’s a bad thing, considering it’s usual practice.

Hey transferring a case just means they are transferring the work to a different office due to lack of people for processing. It is a normal process followed by USCIS. So no worries, it happens for few cases every year.
Guys it’s not over, believe it or not this happened today:
My colleague today received the receipt AND approval notice altogether! The receipt notice date was 5/5. He actually called his school yesterday and the school told him he didn’t get selected. Today the firm gave him his RN and it’s approved already.
I don’t know what’s going on this year with USCIS. It’s a mess. But at least people at my firm are still receiving RN daily. So don’t give up there is still plenty of time left

I just received a copy of my receipt. Issue date 04/27, Receive Date 04/11.
The receipt was sitting with my employer for maybe 2 days. I had already gotten my RN from my school. The status is still case received. The check was cashed on 05/02.

You will just be loosing time. Instead of 3, you now got 2.5 yrs of your visa. You better enchance your skillet and look for an H1B transfer after premium processing resumes

Nothing is lost. You get at most 6 years on H-1B and only the time spent inside US is counted (if you get your green card process started then further extensions are allowed). So employer(s) can file extensions for you until you have spent 6 years inside US on H-1.

We do not have any update on the lottery results yet and expecting to get before Mid of June 2017. We have received very few receipts which is the confirmation of lottery pick up and that has been shared to associates and expecting more. When an information is available on your specific case, you will be contacted in a separate email and requesting your patience until then–Response from Immigration team.
Wait till June end then your manager will say its all done. So better move away from this.

I guess my employer received it a while back but got around to informing me only now.
So my dear friends, do keep up your hopes.
There is still a chance that your notice has already arrived and that your employer is yet to inform you !
And even if you did not get selected, please don’t despair. This was my second attempt. This is not the end of the world and you can try again!

All selected petitions were sent from USCIS last week itself. Its 1 in 10000 case of not getting the receipt by employer as of today.
Its purely employers wish on when to reveal them to the beneficiary. Also they might be having a process to be followed before updating you which may take 2 months also (As they dint want to reveal to you)
Put in mind — All selected petitions are sent by post to the employer last week itself (99.9999999%)

The status in “INSZoom” is “Closed-Pending Adjudication”, without the receipt number, but with the “Receipt date” & the “Approval date” updated. Really not sure, what that means.

Hi, LCAs are usually filed and gets approved in a week or max ten days. Once you get your new LCA, I think you will have to file an amendment H1B. ( kindly check with your Employer/Attorney on this part) This amendment has to be filed in normal processing as of now and takes about 5-6 months. But on receiving the receipt number of the amendment, you can start working in the new location.

it’s better to check with your Attorney. Generally they say if Amendment is in progress, it’s good to wait n get it approved and go for stamping. Or go for stamping then file amendment . Attorney will be the best person to clarify this.

I have a H1B visa which was approved and stamped in 2016. Till now I have not travelled to USA. My employer wants to change my LCA now and they are saying that I can travel to USA few weeks after USCIS issues an acknowldgement of receiving the new LCA application. Is this correct or will I need to wait until the the new LCA is approved, which could take more than a 6 months.

Hey IronMane, are you talking about LCA or H1B amendment? Both are two different things. If it’s LCA, you get it in a week.. if it’s Amendment H1B, it takes time.

LCA stands for Labor Condition Application. This is filed with Department of Labor. An employer who intends to hire a H1B candidate, needs to file LCA first. You can file an H1B application only with an approved LCA. H1B Amendment is filed every time there is a change in the address of work location or employment terms like designation or salary. In your case, I am not sure what you are talking about.

File new LCA and once certified file H-1 amendment. Then travel to US to work at the new location using previous approval notice, visa stamp and amendment receipt. You can continue to work at the new location while amendment is pending.

Just spoke to visa team member and got to know that they are in process of verifying the application as a bundle. The status will be released to candidates only when the process is complete. Meanwhile the status updates are shared to ISU head on daily basis and they must have the complete lottery results. If anyone have any contacts in higher management , pls check.

Some companies trying to hold you in the company atleast 3-4 months by saying your H1 is in process. Lucky USCIS not doing H1 process in December, if so these companies might have reduced your hike also by saying your H1 in process

For selected petitions , USCIS has put up on its website that – “If receipt is not received by May 11, call us at at xxxxxxx ”
Does this mean that all the lottery selected petitions will positively have a receipt by 11th May and there will not be any receipts at all post that? If yes, can we say that we need to wait only till May 11th for a receipt and then plan for a plan B / work on other options

Yes I agree .. if this info is there in your case status page when your case is tracked, then it denotes only to your case and not others in general. Once you get your receipt number, every case is treated individually. Every case will have its own life cycle depending on documents we submit and other verification process.

SLA for any document sent out by USCIS is 30 days. So if the sent document is not received within 30 days, employer/attorney should contact USCIS. That’s what you are referring to.

genuine candidat, you mean to say RFE? There is nothing you can do right now. Wait for the RFE notice to reach your Attorney/Employer. Then discuss with them on what the RFE is about and help (if required) to prepare the RFE response.

Can I go for stamping once I receive the hardcopy of petition ? When can I travel to USCIS once stamping is done ?
Hey Lucky, congrats on your Approval! Very happy for you. You can go for stamping once you received your approval copy. You can travel on or after October 1,2017.

You can start traveling on H1B visa 30 prior your work start date.
I am sorry Frank .. I think even if you have stamping and an approval you can’t enter in US before your petition validity date. Most of the new H1B has petition start date as October 1. So we are eligible to travel after it.
You cant enter the country before Oct 1st even you got approval or stamped. So you need to wait 4 more month to get in.

Is this 21st April the notice date on your I-797 or the notice date of the approved petition?

A person can appear for visa stamping at most 90 days prior to H-1 start date. The person can then enter US at most 10 days prior to H-1 start date. So this turns out (roughly) to be Jul 1 for stamping and Sep 20 to enter US.
Finally got receipt Number from FDFU today after so much follow up …

Hi H1B aspirant, some of them are still getting the receipt. So be positive and you would get some update by May end.
If at all you are not making through this lottery, don’t worry. You can always look for other visa categories like L1, which are given based on your skills and experience and not on mere luck.
You can also look for non profit organization who can sponsor cap exempt H1B in your field of expertise.

The USCIS states that petitions (applications) for new H1B employment are exempt from the cap if the applicant will work at the defined institutions of higher education or a related or affiliated nonprofit entities, or at nonprofit research organizations or governmental research organizations. Thus, employers may continue to file petitions for these exempt H1B categories regardless of H1B visa number availability.
So now you will have to find an employer falling under above category mentioned in your area of expertise and get the visa sponsorship.
In cap exempt H1B, if you can find an employer falling into the category explained above, you are eligible to apply for it.

I am from Non-AD and still hoping to hear that good news, but also thinking about the alternative plans.
One of my colleagues got a confirmation email yesterday. So still thin chances of getting selected. Please don’t loose all hope and always have a backup. He is from AD/VT Receipt dated 28th April. I am still with you guys in the waiting boat. I hope and pray that at least some people get the good news soon.
For some reason tcs is holding results. I think very few got selected or got applied this time. Status they updated for name shake

the chances are almost zero. Having been in the same boat (AD/VT), I have accepted the result for this year. If I do get in the next few days, I will consider that as a huge bonus lol!!
