H1B 2018, 2019 Season is over, H1B 2020 Season Starts on April 1st, 2019.  Check out H1B Visa 2020 – Start Date, Fee, Lottery – FAQs 

If this is your first year of H1B visa filing, you must read What is H1B Visa, Requirements, Process . Not to scare you, Last year, there was lottery for H1B season and for FY 2017 USCIS received 236,000 applications .

When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017. 
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017.  But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017.   If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017.  You may read USCIS Press release for H1B 2017 Start Date 

What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ? 
Update : USCIS confirmed the below quota cap numbers in latest press release for FY 2018. 
To get some background, read H1B Quota – Regular vs Masters .  There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in.  The total H1B Quota as of today is 85,000 and it is split like below.

Regular H1B Quota  65,000
Master’s H1B Quota ( Only US Masters Degree Eligible) 20,000

Out of the above 85,000 quota, 6,800 are set aside for Singapore and Chile citizens as part of the free trade agreement between them. Also, check out the article with history of maximum H1B Cap from 1990 to 2017 

H1B 2018 Lottery Predictions ? 
It used to be a speculation whether we would have lottery in previous years, but in the past 4 years, lottery has become common. It is very likely that we would have lottery aka random selection for H1B 2018 season.  We have been writing predictions over the years and all of them have been accurate so far. When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially  on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
  • Other H4, L1 Visas :  If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.

  • If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
  • If you are professional planning to arrive in US from outside America,  it can be really tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ? 

The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS.  There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary from FY 2017 quota.  If any changes, we will update this accordingly.

H1B 2018 Lottery Results – Checks Cashed, Receipts : 
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date.  To put things in perspective,  last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017…  Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018.  Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?

We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Check out USCIS New measures to report, prevent H1B Fraud  . Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. There are many speculations on how H1B program will become tougher with higher wages, quota limits, etc… but, nothing has been officially signed. We will update the article as new updates come in.

Various H1B Bills  in US House and Senate  – Will they be passed for FY 2018 ?
There are few bills that are introduced in 2017 and at various stages in both house and senate. There are many confusions regarding the same bills like the minimum wage will go up to $130,000 USD, etc.  Fact is that nothing has passed and there are very slim chances for them to get passed before start of FY 2018 season.   1. Guys, I just got informed by attorney that my check just got cashed out! This is not over yet! Don’t lose hope! (or probably your attorney is holding the news until later to share with you)

    However, I have a question now: I just checked with my school and my current OPT got extended to Sep. 30th (my current OPT ends on June 30th), which brings frustration to me:
    With that being the case, should I apply for STEM OPT Extension now? (just in case my H1-B doesn’t get approved for any reason). Does that 90 day to apply rule apply on my old OPT ending date, June 30th OR the new one, Sep 30th?), Will they reject my application now saying I applied too early?

      I agree w/ the other comment that you should apply for OPT extension as back-up. Consider the original OPT end date as threshold date for filing the extension.

  5. guys my friend had a H1b receipt no as EAC 17-143-XXXXX. Does 143 day mean April 30 in this case? He was notified on May 3 from his attorney. MAy be and just may be we still have hope of getting good news this week.

    • 143 refers to 143rd working day of USCIS from October 1… if you have your receipt notice, your receipt date will mostly correspond to 143rd working day. Kindly verify and let this forum know, so that it Ll send out positive energy to people who are still waiting for result.

      I have seen from my own eyes for one of the girl in my team in INSZoom, Receipt updated in INSZoom on 3rd MAY. I am pretty sure, hopefully, other people also received it in IBM whoever got lucky, but not updating in Redbust2us or they dont know about redbus2us..

      • There are no updates in Assignment Pro. Data Entry was done on 3rd May, so in this week all the lottery winners details should reach to their respective attorneys including CG FS BU. Brace yourself for the results in next week.

  9. Is there any order in which the cases are reviewed and approved?

    Also what is the significance of the date part in the RN. The format is WAC-XX-XXX-XXXXX. So, on what idea the part ‘XXX’ is selected?

    Lets say XXX is 136, can we assume RN with date part as 136 will be reviewed before 137 ?

    I went through some random RN and checked their status. Some say the case was received on March 30, some say April 11. Since lottery was conducted on April 10, can we assume the case received on or after April 11 is eligible for this year cap / Fresh H1b Visa?

    • There is no order in which the cases are reviewed. It’s highly random and only USCIS know the way they process it..

      Simultaneously USCIS receives request for various visas and for various purpose. Hence don’t get confused on seeing random numbers.

      • On April 11 or after it, new H1B is not the only visa the USCIS said it would work on. It can be extension or transfer or an amendment of existing H1B or completely different Visa. Hence do not make any assumptions. If you want to track, overall processing percentage of application, there are different sites to do so. Some of them are

    First of all, I would like to say thank you for all useful information and sharings on this website.
    I am one of the lucky guys who got picked on the lottery. I have received receipts for my H1B (from the law firm) as well as my dependents’ (wife and kids) (sent to my home address). However, what I am worried about is I have received 2 H4 receipts with different receipt numbers from USCIS: One with Notice Date of 04/24/2017 and one of 04/28/2017.
    I wonder if there is any mistake from USCIS while issuing the receipts.
    If anyone has experience or related information, please help to share!
    Good luck to those who are still waiting, the receipts are still coming as I just received the second H4 notice on May 6th.

      Are the H-4 receipts for same person or different person? It is possible that one is for wife, and the other is for kid. If not, let employer/attorney know and they would follow-up w/ USCIS.

  13. Hello All-My attorney didn’t receive hard copy of Receipt but online petition status shows RFE,May 5th.Is there some thing wrong?? Has anybody got RFE or approvals??

      They don’t send soft copy of receipt number anyways for regular processing

          • talk to your attorney clearly. Without Receipt notice you won’t know the receipt number. He would have told he didn’t receive the RFE notice, as it has gone to RFE only on may 5. It takes 15-20 days for RFE notice to come to Attorney.

          • I don’t understand how you got the receipt number without the receipt notice. Even if you didn’t get it now, it doesn’t matter, your Attorney can always request and get it from USCIS.

    I’m currently using CPT under F1. If I apply for COS to H4 and file H4 EAD concurrently, will there be a gap in my work authorization?

    I understand my F1/CPT will be voided upon the approval of H4. So the question is will the EAD get approved with H4 at the same time? I see mixed answers from attorneys and people who had went through the process. Anyone could help please? Thank you!

    • If you are filling for new H4 EAD, I think you will have to file for COS first and get it approved. Receive the approval copy and then apply for EAD. This is how process is.

      You can file H-4 COS and EAD together. Usually they are processed at the same time when filed together.

  17. Will the executive orders passed in 2017 will have impact on the petitions filed in 2016 ? Since the guys who have applied in 2016 were not aware of the new rules and clauses been into effect with the executive orders passed in 2017 and got denied in 2017. Had they been known about these new orders, they would of been aware that they are not eligible and stopped going further and lost the precious time .

    • Iam the victim of that .Its not me alone, there are 2 along with me where both of us did B.sc Chemistry(non-computers) and did MCA later got rejected notices from USCIS to our employer according to the violation of a particular clause in the executive orders passed . So I think yours would have been approved before those orders been passed. We need to wait till I get the exact clause getting violated from the official denial notice. As of now we have only abstract information with us.

    • Impact of Executive orders,

      Your attorney can file an appeal to say that the petition was filed properly back in 2017 and the rules were changed later. Based upon how they argue and USCIS’ discretion, it may still get approved.

        Thanks for your answer eventhough u took some time. Typo in your answer . We applied that in 2016 and you mentioned that as 2017. However we don’t have any other option except to challenge. But even if we challenge iam not sure they would argue that everyone will come under the orders passed irrespective of when we applied. And have u come across any clause in those executive orders passed which they said we violate (as b.sc chemistry guys are not allowed eventhough we completed master in computer application MCA) or have you any of the cases similar to us so far.

    • They might as well group all receipts for a particular company and send them all together in a batch. The company names will not be in any order though. Sending one receipt at a time is an unnecesaary overhead and which I think USCIS would avoid.

    • Receiving of receipt notice isnt a VISA approval. ITs clear cut written on that too… Read it carefully. There will be lots of scrutinizing and once they found the issues or repetitive petitions, they raise RFEs.. If you get lucky there, then only you can travel

As per IMIGIRL, it seems this year AD took credit for filing multiple app or should have filed more than last year or USCIS would have selected NON AD apps with high salary compared to AD with less salary . The nos almost matches with AD for non AD . In BIG MNCs, only apps with high min wage are getting receipts as of now.

      Screw this assumption dude.. this is all luck… I am in one of the biggest MNC in US… Top 5 software giant.. CTC 200k+… and still didn’t get into lottery for 4 years… Every time one genuine application from my Company…
      I wish what you said is true but all this Stupid and idiotic lottery is pure luck based…

  23. Hi Sourabh, My petetion was selected last year and got rfe in october. USCIS received the response for rfe in Jan 2017. From Jan 2017 there is no change in the status. Please suggest what should I do.

      Did u try to contact USCIS..on every status they give a timeline right..I mean if u don’t hear by then,you should contact a particular email address or number I believe..do u see similar thing on your status

    • Hi Shaik, I can understand your situation. Unfortunately, there are no clear cut deadlines for a new H1B application. There are loads of people in the same situation as yours? You can speak with your Attorney/Employer and discuss with them on what to do next. Probably they can raise a service request for you and try to get an answer for you.

      Nothing you can do except to wait. Employer/attorney can contact USCIS to follow-up but not many other options. If PP is reinstated in future, then you can opt for it.

    • Yes, there might be tighter scrutiny this year, specially if your employer is H1B dependent. Even before the EO, the immigration agency accounced there will be tighter scrutiny.

      If you have good work experience in your area and you are actually filling a ‘gap’ in the US team, which was earlier difficult to fill in by an american worker, and you are paid well for that, you should not worry.

      And if, you are just getting an ‘onsite opportunity’, regardless of experience, skill or salary, (yes that’s what happens in indian MNC’s), you may have a reason to worry.

      I would suggest you to hang on there, if everything goes well, you get your visa and will work in US very soon.

      BTW, I left Infy 10 years ago because I didn’t get an ‘onsite opportunity’ 😉

    • Hi Mahesh, you can initiate a transfer to new employer. Since H1B premium processing is currently suspended, it’s gonna take 6-8months for getting the decision. Once you get the decision, you can travel to US with the stamping you have already if it’s not expired. Salary terms, talk to your employer buddy.
