H1B 2018, 2019 Season is over, H1B 2020 Season Starts on April 1st, 2019.  Check out H1B Visa 2020 – Start Date, Fee, Lottery – FAQs 

If this is your first year of H1B visa filing, you must read What is H1B Visa, Requirements, Process . Not to scare you, Last year, there was lottery for H1B season and for FY 2017 USCIS received 236,000 applications .

When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017. 
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017.  But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017.   If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017.  You may read USCIS Press release for H1B 2017 Start Date 

What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ? 
Update : USCIS confirmed the below quota cap numbers in latest press release for FY 2018. 
To get some background, read H1B Quota – Regular vs Masters .  There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in.  The total H1B Quota as of today is 85,000 and it is split like below.

Regular H1B Quota  65,000
Master’s H1B Quota ( Only US Masters Degree Eligible) 20,000

Out of the above 85,000 quota, 6,800 are set aside for Singapore and Chile citizens as part of the free trade agreement between them. Also, check out the article with history of maximum H1B Cap from 1990 to 2017 

H1B 2018 Lottery Predictions ? 
It used to be a speculation whether we would have lottery in previous years, but in the past 4 years, lottery has become common. It is very likely that we would have lottery aka random selection for H1B 2018 season.  We have been writing predictions over the years and all of them have been accurate so far. When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially  on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
  • Other H4, L1 Visas :  If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.

  • If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
  • If you are professional planning to arrive in US from outside America,  it can be really tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ? 

The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS.  There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary from FY 2017 quota.  If any changes, we will update this accordingly.

H1B 2018 Lottery Results – Checks Cashed, Receipts : 
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date.  To put things in perspective,  last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017…  Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018.  Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?

We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Check out USCIS New measures to report, prevent H1B Fraud  . Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. There are many speculations on how H1B program will become tougher with higher wages, quota limits, etc… but, nothing has been officially signed. We will update the article as new updates come in.

Various H1B Bills  in US House and Senate  – Will they be passed for FY 2018 ?
There are few bills that are introduced in 2017 and at various stages in both house and senate. There are many confusions regarding the same bills like the minimum wage will go up to $130,000 USD, etc.  Fact is that nothing has passed and there are very slim chances for them to get passed before start of FY 2018 season.     The cheque for my petition was encashed today. I asked my university to check, and my sevis has also been updated today. My company/lawyer has not received anything from USCIS till now, but I know its on its way. Mine was AD/CA.

    I received an email from my university’s DSO after I requested a new I-20, saying that “I think I see a pending change of status in SEVIS, but I will need a copy of your receipt notice to issue any CAP GAP I-20 if you need one.” I just want to make sure that does it means that my petition was picked in the lottery?

  3. I didn’t get a receipt yet but my DSO said a cap gap extension was applied until 07/30. Is this a sign that my petition was picked up? Anyone has this experience ?

  4. Got mine some days back. Manager told me I was selected like a week before the lawyers email came. Not sure why lawyer was withholding the information.
    OPT AD- California center last chance. OPT expiring in coming January. 3rd time lucky. Working as full time for a big bank since last 2 years.

      Do we still have hope for NonAD VT? It is the 3rd attempt for me.

      A small sized company applied for me.

      Now that USCIS has announced about completion of date entry what are our chances in the next 5 to 10 days?

      Is there a time in a day before which the company will receive receipts(like before 11 AM ET) or it may arrive anytime until 5 PM?

      • No specific time of the day. It may arrive anytime, depending on when the delivery happens in the area of location of company/Attorney. They will be sending selection receipt and also rejection notice to the respective applicants.

  6. my consultancy told me tht only 17 people got there receipt.. I am not one of them is there any chance for me to get the receipt h1 regular 1 st attempt.. feeling sad

  11. Finally, i get through lottery. Second attempt, lost year i was not lucky. This time it went through CTS NonAD/VT. Feel relaxed, but now need to see if it gets approved or not. Anyway, till yesterday i was so much worried and decided not to apply next year again. Request all of you to keep hope for one more month. what else we can do anyway, it is lottery after all.

    Seems Chugh Law Firm is not disclosing anything about the receipts or checked being cashed.

    • Yes, my company applied through chugh law firm and they did inform about the checks being cashed and after a week received receipts for the selected applicants but the sad part is that I have not received mine.

    • Don’t lose hope until you receive your rejection package. The chances are slim now but still you never know. I am not bs but last year one of my friend received his notice in September and got the approval in December.

  15. Anyone still hearing form Vermont for AD cases? Please if you or your friend have heard anything comment on this. Also mixed reaction as to some saying wait till mid May and some confident that its over. I am hoping till coming Monday and if not by then I think its definitely over.

    Also my friend got his check cashed yesterday! If that helps anyone.

  16. As you know USCIS announced that Data entry is complete.

    I have not heard from my employer about check cashed/receipt notice of my petition. Does it mean I am not selected or I can still hope?

    • Have hope till like mid May I would say. At-least that’s what I am doing. And that does not mean that you are not selected. Receipts are still on its way.

  21. So far it seem CTS, IBM & CapG started declairing their results. Since USCIS is done with cheque encashments, MNCs will start notifying their employees very soon (in bulk).
    It was my 2nd attempt, 6yrs IT exp, non-AD, mid scale company, got selected. All d best fellas.

  25. Finally it happened in 3rd_attempt.. Non AD/VT/EAC1714XXXXXXX – Cognizant Chennai.

    Most of my friends got receipt only by today. So waiting is not over.

  27. With data entry completed, does that mean I was not selected if I haven’t heard by now?
    NO, receipts will continue to arrive over the next 7 to 10 days.

    With data entry completed, when will petitions that weren’t selected be returned?
    Last year, we started receiving the petitions back in the mail in mid-June. I will post about it when our office starts receiving them.

    My checks have not been cashed/I haven’t received a receipt notice/SEVIS doesn’t show any update – does this mean I did not get selected?
    NO, that does NOT mean you were not selected!!! The process of sending out receipt notices, updating systems, etc. takes time – remember: it’s only been a few DAYS! This entire process of notifying selected applicants will take WEEKS to complete. It’s still very early on, so don’t worry if you haven’t heard anything about your petition yet.

    Yes, USCIS only cashes checks/sends receipts to those that were selected.

    Have you ever seen any case got denied due to educational qualification (MCA) so far ? I have done B.sc Chemistry(3 yrs) and later completed MCA(3 yrs) . And my attorney says I got denial because of my educational qualification. Can u confirm me am I not eligible for H1B ? And if so, would it happen due to the latest executive order ? And will the MTR works if the reason is due to this ? I don’t understand why didnt they do this at the beginning itself ?

    I am from Cognizant Technology Solutions. One of the associate received receipt number yesterday (05/03/2017). When he checked in USCIS, it said “Case is Approved”

    What a lucky guy he is.

    By this, can we say they have started to process all cases?
    Whether anyothers came across like this before or now?

    • Yes I believe. Yday I was going through some case numbers around my case and found that the case was approved for a petition. Wondering whether it’s for H1b cap or something else?

      • No, case numbers are no all H1B cap ones…. it may be H1b extension as well or some other petition all together…. like L1b.. where premium processing is still on…..

      • H1B is the not only visa application that goes to USCIS. There are different kinds of visa being applied at same time. They can be even H1B extension or transfer petitions. So please hold on and wait for updates.

        Petition status means waiting for status. Not mean that u selected in lottery. For all whose application is filed, it is petition status/with status team .

    • Yes, it’s true that infy received the first batch of receipts.. confirmed by calling also I was not one of the lucky. Not sure if this was the last batch as last year there was only one batch of selected receipts… cheers to all start on plan B.

  33. This is my third year and last try. Almost given up hope and getting mentally ready to head back to India..Spent 7 years in this country, no regrets!! Will go back and stay in India for a year and come back again on L visa…Good luck everyone
