If this is your first year of H1B visa filing, you must read What is H1B Visa, Requirements, Process . Not to scare you, Last year, there was lottery for H1B season and for FY 2017 USCIS received 236,000 applications .

When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017. 
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017.  But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017.   If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017.  You may read USCIS Press release for H1B 2017 Start Date 

What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ? 
Update : USCIS confirmed the below quota cap numbers in latest press release for FY 2018. 
To get some background, read H1B Quota – Regular vs Masters .  There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in.  The total H1B Quota as of today is 85,000 and it is split like below.

Regular H1B Quota  65,000
Master’s H1B Quota ( Only US Masters Degree Eligible) 20,000

Out of the above 85,000 quota, 6,800 are set aside for Singapore and Chile citizens as part of the free trade agreement between them. Also, check out the article with history of maximum H1B Cap from 1990 to 2017 

H1B 2018 Lottery Predictions ? 
It used to be a speculation whether we would have lottery in previous years, but in the past 4 years, lottery has become common. It is very likely that we would have lottery aka random selection for H1B 2018 season.  We have been writing predictions over the years and all of them have been accurate so far. When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially  on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
  • Other H4, L1 Visas :  If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.

  • If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
  • If you are professional planning to arrive in US from outside America,  it can be really tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ? 

The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS.  There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary from FY 2017 quota.  If any changes, we will update this accordingly.

H1B 2018 Lottery Results – Checks Cashed, Receipts : 
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date.  To put things in perspective,  last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017…  Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018.  Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?

We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Check out USCIS New measures to report, prevent H1B Fraud  . Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. There are many speculations on how H1B program will become tougher with higher wages, quota limits, etc… but, nothing has been officially signed. We will update the article as new updates come in.

Various H1B Bills  in US House and Senate  – Will they be passed for FY 2018 ?
There are few bills that are introduced in 2017 and at various stages in both house and senate. There are many confusions regarding the same bills like the minimum wage will go up to $130,000 USD, etc.  Fact is that nothing has passed and there are very slim chances for them to get passed before start of FY 2018 season.     Have you ever seen any case got denied due to educational qualification (MCA) so far ? And if so, would it happen due to the latest executive order ? And will the MTR works if the reason is due to this ?

    • In my husbands firm there are many MCA s..common you have 6 years of proper education…no problem regarding the degree

    • If your graduation comes under regular course ( not part time or correspondence ) then you’re absolutely in the game.

    • You can do an educational evaluation and submit it as a part of MTR and challenge the decision if that’s the reason. The new executive order doesn’t have any relation to education I hope. H1B visa is for highly skilled people, if you prove that you have specialized skills then you are eligible for H1B

  3. If check is not cashed by now, does it mean it is not selected? What does data entry mean completely?

      • Data completion indicates that nearly all petition’s check has been encashed and receipt notices are sent out.. Many companies don’t keep track of mapping of check to petition and they rely only on the receipt notices. So it’s better to wait and see what is in store for us.. we will either get receipt notice or the denial notice

    One week would be mix of selected and rejected notices..then only and only rejected docs will be in mail..

      • Try different country.. Canada or London.. work there for an year or two then you can come back to US on L1.. no need of any H1 lottery.. or if rule changes next year, you might get through next year.

  6. For those with H1b process; when USCIS releases the completion of data entry does it mean that it is over or persons are still expected to receive the positive news? I ask because my attorney said till end of May and according to what i have read, end of May is final

    I know a lot of people still waiting for their receipt notice. My employer informed me today after much persistence. Many employers are holding back on declaring receipts for their candidates. Reasons are unknown. Probably waiting for data entry completed news from uscis which came in today.
    Yes there are receipt notices coming in yet. So there is time till end of 2nd week.

    For those who haven’t got through, sorry about it. I know most of you may have multiple attempts and still have not succeeded but thats life. I am in the US for last 4 years and this was my first attempt at h1b which I cleared. But doesn’t mean I haven’t had my share of struggle.

    All I can say is keep trying and don’t give up on life. But remember life is not h1b. Rejections are a big part of life…. accept it and move ahead. Never give up or stop trying.

      • Yes, I heard from fragomen today about my petition.
        Though they received it on 4/25. They told me about it only today 3/5, so I think they take their own time in letting us know.
        And my sevis is still active, so sevis is not a valid indicator of selection all the time

      • Bro receipt will keep coming. My understanding is by data entry they meant they updated their system which would have updated out status in sevis. So i believe if sevis change did not happen till now it wont. I can be wrong too. Just my opinion.

          Look for exempt jobs …. San Antonio has tons of them .. just google and see … they pay less ~60k .. but its cheaper there anyways …

          If you are/have been consultant all this while stuck with desi consultancy … pls try to change asap …

          some things i can think of …

          it was my 1st attempt this year and i was not lucky … next year there is going to be overhaul of the system …

          but seeing cases like yours i get cold feet and am scared …

          • Thanks for the advice bro. I am a mechanical engineer at a fortune 500 company which is not important. The important part is i am not a consultant or related to any consultant/consultancy by any means. i report directly to my company and that’s a German company.

            Plan B is to look for a non profit mechanical engineering jobs. So i can apply for a cap exempt H1B as of now.

  10. USCIS have just announced that they have completed the H1B lottery selection and data entry process.

    If you have not been informed that your application was successfully picked, given this news, it’s safe to say that you have not been picked this year.

    If this was your last attempt, condolences. If you have another try, be prepared for some significant changes to the H1B selection process. My advice would be:

    1. If you are working for an H1B dependant employer, start looking for another job ASAP. Find a job at a smaller company. One that isn’t going to be targeted and heavily scrutinized next year.

    2. Question if you’re truly ready for what next year’s H1B process brings. It’s going to get much, much harder. Is all of this pain and torment really worth being able to live and work in another country but your native one?

    3. Work for a University or non-profit. They’re cap exempt and you can apply anytime of the year.

    If you didn’t get the H1B, and have to return home, don’t be consumed by resentment, or anger. Return home and make it your own. Build a better life there. The grass isn’t always greener on the other side.

      • It’s not the case, mails may be received later too. They are probably on the way depending on the location of embassy and Attorney office. Unless you get a denial notice, you still have hope

  14. I just got my receipt notice today 05/03. Notice date: 04/22. 3rd time Non-AD/VT. My lawyers didn’t disclose when the check got cashed. Wait for another 2 weeks, don’t lose hope guys!

    • Like I said before, it is not fair that the rest of the world needs to suffer from one country’s mistakes and issues. Those who call themselves “Skilled” workers are completely jokes. Some of them are doing HTML email templates coding for a living and they consider themselves IT professionals. Some can not even read English properly, nor figure out some simple probability questions.

      Seeing all those so called skilled IT professionals claiming they have X years of experience just makes me laugh and reminds me the experience I have in that country. Every time I got in a cab going from A to B, the driver purposely take a longer route so he makes more money just because I obviously look like a foreigner. He would keep ensuring me that he is being honest and telling me the truth, which normally is a good indication that he is lying to you. Don’t get me wrong, there are great people. But when there are 5% of the people beg, steal, lie, and cheat, we all suffered.

      Sorry that is off the topic. You know who you are and you are out of luck.

  17. Just checked my SEVIS and got a print of I-20 doesn’t say anything about the change of status or status pending. My attorney said that he hast said anything and the notices are just slowly coming in. I know it doesn’t entirely mean that I am not selected and they might have not yet updated my SEVIS, but what do you guys think about still there being a chance?

    Also I am AD/VT. looks like a lot of receipt are coming from CA? Does that mean vermont is pretty much done notifying? Thanks all. Keep the positivity.

    • Raj – CA is pretty much done and there is a still good chance if you filed at VT. As per my calculation and stats they still have to send 12-15% receipts of the cases that got approved in VT. Please don’t ask about the calculation as its a very complicated algorithm.

  18. I received my receipt number but apparently the received notice has my last name spelled wrong. The lawyer says they will call uscis and fix it. Wanted to know what are the implications?

    • It can be corrected easily by the Attorney. The Attorney would notify USCIS of the correction and once done the status of your case goes to “the name has been updated”. It will not affect the approval process in anyway. Don’t worry.

    My wife got her H4 receipt. It was received on 11-Apr and processed on 26-Apr. I have not heard anything about mine though from the attorney/law firm. (AD/CA – Second Attempt).

    That implies mine got selected right?

  21. Seeing all these comments from Indian MNCs and IBM, here is a thought. I see many comments like 35 nominated from an account, finally 8 filed etc. That means the h1b filing is often for motivational purpose / rewards, rather than to fill a real position / need. This precisely is the problem that results in the excess of petitions and lottery. If the big companies a) tried to first fill a position locally and b) failing that went for h1b as and when needed, the quota will last well into the last quarter of the year. USCIS should really change the system to an open any time of the year one, where the visa gets cancelled and put back in the pool if the person actually does not lnd here and start working in the position within 2 months of approval or something like that.

    • Totally wrong. Applications are filed in bulk in order to address the contingency. H1B is issues only once a year, so in order to address future contingency, companies are required to file lot more applications that they actually need.

    • Nope it doesnt… It will obviously be different as the package will be built differently with rejection notice and the pacakge’s to and from address would be reversed. Hence please wait patiently, until you hear something from Attorney.

  25. Basically everyone’s fate was sealed on April 11th when the lottery was conducted. Now all the talks of being positive, and keep fighting is worthless. Whatever was destined has already happen.
    So sit tight and wait for response, nothing else can be done….
    As far as being positive is concerned…. its a good thing… but it wont change what has already happened on 11th

    I got the Receipt Notice (EAC1714……), AD/Non-IT. My lawyer sent me the notice this morning at 2.30 AM (Eastern Time- New York). Guys I wish a very good luck to all of you.
    One more think, I have been following this form from long time, and most of you questioned that “Should I loose the hope now?” because it is too late. From my experience, you should definitely stay optimistic until end of June, 2017, unless you get notification from USCIS that you been not selected in the lottery.

    Stay positive and keep fighting.

      My wife got her H4 receipt. It was received on 11-Apr and processed on 26-Apr. I have not heard anything about mine though from the attorney/law firm. (AD/CA – Second Attempt).

      That implies mine got selected right?

  28. I contacted Seyfarth Shaw LLC and they told me they anticipate receiving notices in the next few weeks and when they do receive any information they will let me know or keep checking my profile online…..It’s some kind of news sort of. So, i still have hope:)

    • Hexaware is one among big MNC who are totally fraud, especially Hexaware Chennai based, they bring in all their own folks who know jackshit and clients have repeatedly complained of lack of skillsets.

      After Infy, TCS, Cognizant, Wipro, Hexaware should be added to the list

  29. Finally picked in third attempt. Got my receipt dated 25-04-2017 yesterday. Non AD/VT. Guys please don’t get frustrated and hold patience. I know it is not as easy to implement as easy to say, but always remember that if you lose something then something better might be waiting for you! All H1Bs are not successful and all others are not failures! So always have a Plan B. Good luck to all the guys who are still waiting.
