H1B 2018, 2019 Season is over, H1B 2020 Season Starts on April 1st, 2019.  Check out H1B Visa 2020 – Start Date, Fee, Lottery – FAQs 

If this is your first year of H1B visa filing, you must read What is H1B Visa, Requirements, Process . Not to scare you, Last year, there was lottery for H1B season and for FY 2017 USCIS received 236,000 applications .

When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017. 
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017.  But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017.   If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017.  You may read USCIS Press release for H1B 2017 Start Date 

What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ? 
Update : USCIS confirmed the below quota cap numbers in latest press release for FY 2018. 
To get some background, read H1B Quota – Regular vs Masters .  There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in.  The total H1B Quota as of today is 85,000 and it is split like below.

Regular H1B Quota  65,000
Master’s H1B Quota ( Only US Masters Degree Eligible) 20,000

Out of the above 85,000 quota, 6,800 are set aside for Singapore and Chile citizens as part of the free trade agreement between them. Also, check out the article with history of maximum H1B Cap from 1990 to 2017 

H1B 2018 Lottery Predictions ? 
It used to be a speculation whether we would have lottery in previous years, but in the past 4 years, lottery has become common. It is very likely that we would have lottery aka random selection for H1B 2018 season.  We have been writing predictions over the years and all of them have been accurate so far. When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially  on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
  • Other H4, L1 Visas :  If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.

  • If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
  • If you are professional planning to arrive in US from outside America,  it can be really tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ? 

The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS.  There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary from FY 2017 quota.  If any changes, we will update this accordingly.

H1B 2018 Lottery Results – Checks Cashed, Receipts : 
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date.  To put things in perspective,  last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017…  Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018.  Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?

We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Check out USCIS New measures to report, prevent H1B Fraud  . Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. There are many speculations on how H1B program will become tougher with higher wages, quota limits, etc… but, nothing has been officially signed. We will update the article as new updates come in.

Various H1B Bills  in US House and Senate  – Will they be passed for FY 2018 ?
There are few bills that are introduced in 2017 and at various stages in both house and senate. There are many confusions regarding the same bills like the minimum wage will go up to $130,000 USD, etc.  Fact is that nothing has passed and there are very slim chances for them to get passed before start of FY 2018 season.     My H1 got picked finally in 8TH ATTEMPT, my wife in US on H1 and planning to visit her in June, i’m in dilemma to go for H4 stamping.

    from September i’m planning to stay back in US with my kid on H4 status if H1B approved or not.

    Please let me know your suggestion.

    • Hey Sri,
      Congrats!! As far as I know, You can go for H4 stamping now. Once you have your H1B approved, you can apply for change of status from H4 to H1B in US and you can start working. In case you come back before approval, then you have to get stamping and travel to US. Good luck for further process!

    • But they always suggest not to have too many travel dates on I 94 if your name is picked in the lottery…I think chances of RFE increases by doing that..you ask your lawyer or company HR once before booking tickets I ll suggest

      You can appear for H-4 stamping and then travel to US. Once your H-1 has been approved, you can either apply for COS from H-4 to H-1, or leave US and return after getting H-1B visa stamped.

    Y’day my H1b Extension has been approved. It was filled in PP and got RFE. Now finally I rec’d the approval email but yet to rec’d the hard copy. my Attorney saying that it will take 7-10 business days.

    Currently I am in India. Can I fill the DS-160 and block the visa interview schedule before to get hard copy of my petition so that I can get the interview date early.

    Seek you guidance.

    • Interview dates are readily available for all locations. I booked last week for Chennai. Even nex day slot was available. So no worries and wait for documents.

      Yes, you can block the date using the petition number. Try to use a date by which you would receive this extended petition.

      Your claims can’t be true. No single account of IBM have these many cases actually filed.
      Do check with your Case Manager. The Truth might shock you !

      The receipts have started to come in. Out of 37 nominated cases for H1B from my account, 8 were finally filed and two have received on 27th and 28th April (data as of now). !

        • Checking with case manager is futile now,if you have ur US case manager contact ,then they might be able to tell you.India team does not have much idea on the case status.When I checked with my US case manager ,I was informed that the case will be filed,that’s the last update I got during the last week of March.Now that the receipts have started to come,we need not wait more,in the coming two weeks it will be clear.

      • I am confused here on whom to trust,whether the case manager or inszoom,case manager says it will be filed,but there are no updates in inszoom whatsoever.

        • IBM generally will send any mail or update INS ZOOM only if you get receipt.
          But they will finally update INS ZOOM some time in May end or June to notify resources whose petition wasn’t picked up in lottery.
          For the time be positive as Case Manager has told that case has been files. You can even check your LCA status with basic available information on DOL site to see if your LCA was certified or not. If it was certified it means it has been filed. Just relax and wait for the good news.

      I just now got receipt. Here is my Experience. Please font loose hopes. Infact my case was not updated in inszoom once the petition filed. So i checked with my account SPOC and they confirmed me that mine is in final list of nominations. Today i got receipt.
      So guys if you already checked with your account SPOC and got confirmation that your case is filed but its not updated in INSZOOM please don’t loose hopes. They are revealing on slots basis.

  3. My friend has got his rejection document today. Its over now. Dont wait for the official announce met. They did lottery on 11th and published it on 17th. Same way..they are taking time to publish the OVER news, but they have started sending rejection notices.

    • my application has been selected under lottery system. I have been updated by my employer yesterday with case number. I have verified in USIS site with my case number . It is showing “Case Was Received” status. #Emp: Atos

    • Yeah for sure …… uscis suspend the PP because they are unable to proceed all petitions at time . But this year , MIRACLE ! They did it faster than last year. You think we are dumbs ?

  4. Saurabh, can SEVIS update be a way to check the selection or non-selection?
    Is it reliable? AD/CA. Does the DSO reply or are they reluctant to do so?

    • It is one of the way although just because it doesnt say anything mean you are not selected. It might take some time to do the data entry and update your SEVIS. I just checked today and nothing on my SEVIS. Keep your hope up till 12th May!

      SEVIS update is a good indication to confirm that you have been selected in the lottery. Whether DSO is interested in checking the status for you or not, varies from person to person. Worth a shot.

    Mine is medium size company and probably company might have filed total 300-400 petition.
    I have heard few of my friend already got receipt number. So is there any chance for us to selected in lottery now?

      Receipts are still being sent out. If some employees have received the receipt, doesn’t mean that all the selected employees have received it. There is still hope.

    I have submitted my document on April 3rd in Vermont. Waiting for the H1B lottery result. Basically how long we can wait for the result.

    • Till last year, some of my friends got receipt number in June first week too. So please wait patiently, until USCIS states that they have returned all unselected petitions.

  7. Hello – Those who have lost all hopes, receipts are still coming in from VT for AD petitions. Its not necessary that the cheque will be cashed before the receipt is sent. I checked with the lawyer last week and my cheque was still outstanding but today I got the receipt. The receipt was sent on 4/25 and I received it one week later so please don’t lose hope yet. There is a significant lag between cheque being cashed and receiving the receipt.

  8. I just saw an update in INSZoom. I have my receipt number. Have not heard from DSO/lawyers but I believe there is some time delay. Hope thats the case:) AD/CA

    • Bro as per the stats AD game will be over before Non ad and since AD is getting the receipt till this date, my guess is we (Non AD guys) have a good week before the game is over.

      • We all are buddy, just hang in there. Lottery is a game and when we applied for it we played the game and a game is not fun without risks. You can imagine how big of a satisfaction you will get when the game is near the end and you somehow won. Cheers.

  10. My SEVIS was updated last week with a receipt WAC1713.. but still no update from my lawyer. I’ve been told that SEVIS has been wrong a couple times in the past and was wondering if any of you guys have heard anything similar? A little worried about if I actually got through it or not.

    • Well match the receipt number on your sevis with the receipt number that was mentioned on the check your lawyer sent on your behalf if it got cashed. Both should be the same and i have never heard of SEVIS being updated with false information.

  11. Got my receipt from Fragomen today. AD/CA. Case was received on 04/11/2017 and Receipt notice date was 4/24/2017.

    I have mixed feelings here. I was expecting a receipt from VT but got it from CA. Could it lead to a denial later?

    • Bro sometimes one center gets flooded with more than half the percentage of application and in this scenario sometimes the cases are transferred to be evenly distributed. You got nothing to worry about. This has happened with few of my colleagues in the past. Hope this helps

    • Bro no grudge against you but since you filed twice and both got selected which means 1 spot for a candidate which could have changed his life is not a complete waste. You statement and your username contradicts each other. None the less Congrats as i know its not easy to secure two jobs and convince both of them to apply H1B.

  13. I have received the receipt number for the petition.

    I have a few questions:

    What is the next step? Is there any action to take from our side now or should we just wait ?

    How long will it take until we get the final answer?

    Our current visa classes are F1 (my wife) and F2 (me), In case i’m approved for visa class H1B, how long will it take to become effective and we no longer depend on classes F1 and F2 ?

    • Bro you just need to wait, your petition is selected in the lottery which is phase one. The next phase is the approval and no one for sure can tell you how long that will take. This year premium processing was cancelled because they need to clear the old back logs for h1’s and other petition that got rfe last year or may be year before that.

      But with all this hassle USCIS still is working at a pretty fast rate as you can see notices are being sent in the very first month of H1b. My guess is you will hear before oct 1st that your case is approved and the last step is collecting the documentation from your lawyer or company and getting the visa stamped.

    • Moksha – You cannot say good bye to this year as its only may. And yes there is still a chance until USCIS announces that the lottery is done. Chance is slim but still there.

  16. Don’t be discouraged everyone. This is my last chance, applied AD and not IT. So far Fragomen has said they didn’t receive anything.   18. I didn’t get any notification from fragomen. But I see the status as “Receive Receipt Notice; notify FN & Company Completed May 1 2017” . The receipt number is WAC17141*** Does this mean that the petition got picked up?

    • Bro i am in the same boat and the ugly truth is 114K will get denial and 85K will make it through the lottery. At this point its hard to tell but i have accepted that i am in that 114k and i am so broken that i have lost all hopes.

        • Bro i have never seen forum flooded with h1b rejected after getting picked up in the lottery. Buffer can go upto 500 to 1000 at max. I would love to keep the hopes high for all of us but today I just can’t. Already informed my mom that i did not get selected and the sadness in her voice has crushed me to my very core. I am really sorry buddy.

          • Don’t lose hope bro. This will be last attempt and I’m in OPT extn. I have a dog and a baby . We all have to leave if I don’t get picked. However I still feel the processing is little slow this year and we will get receipts until end of this month

          • MEng, is your employer only active in US? Maybe check with them to see if it’s possible to transfer to a different office where it’s easier to get/don’t need a work visa and maybe try again for H1B/L1 in the future if you really want to come back.

            This was my arrangement with my employer.

          • Thanks guys for the kind words and alternate solution. I am trying to apply for Canadian express entry. Working with my employer to secure a job offer over there. My company is huge and all over the globe but no two countries work on a project which is even remotely related so i need to go through a standard process of interview and all.

  21. I received an update from the law firm today. The check was credited today which means the H1B was picked in the lottery. There was a receipt number mentioned at the back of the check which starts with WAC17141*****. I am Non-AD. I am yet to receive the hard copy of receipt.

    Do not loose hope yet. Processing seems slower this year.

    Dont lose hope yet. my wife got her H4 receipt notice yesterday. I am yet to hear from my attorney though. Receipt notice says that Petition was received on 04/11 and processed on 04/26.

    Mine is AD/CA center second attempt.

    • secondTimeCharm, My wife got her H4 receipt as well. Similar to your case, it was received on 11-Apr and Processed on 26-Apr. I have not heard anything about mine though from the attorney. (AD/CA – Second Attempt)
