H1B 2018, 2019 Season is over, H1B 2020 Season Starts on April 1st, 2019.  Check out H1B Visa 2020 – Start Date, Fee, Lottery – FAQs 

If this is your first year of H1B visa filing, you must read What is H1B Visa, Requirements, Process . Not to scare you, Last year, there was lottery for H1B season and for FY 2017 USCIS received 236,000 applications .

When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017. 
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017.  But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017.   If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017.  You may read USCIS Press release for H1B 2017 Start Date 

What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ? 
Update : USCIS confirmed the below quota cap numbers in latest press release for FY 2018. 
To get some background, read H1B Quota – Regular vs Masters .  There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in.  The total H1B Quota as of today is 85,000 and it is split like below.

Regular H1B Quota  65,000
Master’s H1B Quota ( Only US Masters Degree Eligible) 20,000

Out of the above 85,000 quota, 6,800 are set aside for Singapore and Chile citizens as part of the free trade agreement between them. Also, check out the article with history of maximum H1B Cap from 1990 to 2017 

H1B 2018 Lottery Predictions ? 
It used to be a speculation whether we would have lottery in previous years, but in the past 4 years, lottery has become common. It is very likely that we would have lottery aka random selection for H1B 2018 season.  We have been writing predictions over the years and all of them have been accurate so far. When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially  on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
  • Other H4, L1 Visas :  If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.

  • If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
  • If you are professional planning to arrive in US from outside America,  it can be really tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ? 

The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS.  There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary from FY 2017 quota.  If any changes, we will update this accordingly.

H1B 2018 Lottery Results – Checks Cashed, Receipts : 
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date.  To put things in perspective,  last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017…  Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018.  Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?

We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Check out USCIS New measures to report, prevent H1B Fraud  . Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. There are many speculations on how H1B program will become tougher with higher wages, quota limits, etc… but, nothing has been officially signed. We will update the article as new updates come in.

Various H1B Bills  in US House and Senate  – Will they be passed for FY 2018 ?
There are few bills that are introduced in 2017 and at various stages in both house and senate. There are many confusions regarding the same bills like the minimum wage will go up to $130,000 USD, etc.  Fact is that nothing has passed and there are very slim chances for them to get passed before start of FY 2018 season.   3. I have asked HR several times about the results but still got nothing. One from my company got the notice that showed he got selected in April but I don’t even have the receipt number. What does that mean? Do I still have a chance?

  4. Hopes will be alive mainly for guys from companies like Capgemini, Infosys, TCS, IBM etc. where the internal immigration team delays communicating the lottery results to employees. Communication are sent in slots for different accounts. They wait till they start getting receipt numbers. They never provide any update based on check been cashed.

    Getting checks cashed could be a rare thing happening now. Receipt documents might still come in for a week or two. I have no clue how AD works. My comment is for Non-AD

  6. I was told that the H1B time for South Koreans, especially for RNs and IT professionals is 12 months and a preferred country for professionals. How much of this is true?

    I’m considering starting a staffing company to bring these folks in but want to understand the issues.

    I went through the thread and some people said “Got my receipt”, or “Lawyer informed me about receipt” yesterday. Noone said “My check got cashed” yesterday/today.

I think it is time to stop asking rhetorical questions like – ” I played it fair, but many others didnt, why didnt I get it and they did”, or “What did I do wrong”.
        I’ll talk to my company and lawyers and start thinking about other options now.

I can absolutely understand the feeling when you see people who have broken the law from day 1 they entered this country getting picked and grinning and bragging abt wht all they did the JD they drank all night .. cheated in exams just to pass … faked exp .. got consultancy gigs are minting decent money … now hv h1’s and here are we … thesis/publications/hackerrank tests / gruelling on-site whiteboarding interviews …. you land your dream job in cutting edge only for h1’s not to be picked … only ppl who hv seen the flip side of the coin can understand…. its noy TCS/Infy …. i worked for one of these for 4 yrs prior to landing here for my MS .. (fully funded btw) with a research assistantship at one of the best state universities in this nation …. its the desi consultants ….

          Just think a guy from andhra heartland who comes to a XYZ univ here to do MS … by taking loan … big dowry dreams … starts gas station work from day1 … then cheats and plagiarises to get through univ .. cant code for shit …. cant speak for shit …. pays a consultant to beef up his resume …. worst comes he will call come ask his Appa for 5lakhs to apply 5 h1’s … and my friend its crowd like tht who has fcked everything …. not Infy/TCS etc …

          • I am equally pissed (if not more) at all these reasons as you are.
            My Other Options:
            1) My OPT extension expires Feb 2018. So I will continue working till then. I might be able to stay (unemployed ) in the US till the next lottery. If it gets picked, awesome.
            2) Look at other Visa options- I just did my Masters. No Phd, so there is less hope there.
            3) Look at other Country options
            4) Go back to India and get a job there till my application is picked in the lottery. I do not want to do this but I will if I don’t have any other option left.
            Basically, I can convince my company to do anything legal for me. Like apply for other visas if we are able to, rehire me once I get H1, etc.
            I am actually hoping to find an option where I can bust my ass to get stuff but I dont have to rely on my luck (replace L with F, thats what I feel about my luck). I am pretty sure that if I leave anything upto my luck, it wont work out in the end. I am one of those people who HAS TO work EXTRA hard to get something I deserve.

    Does it mean anything?

  9. Hey guys – i cannot get my dso to give me all the information but my sevis is still active. What is meant by this ? I can figure this out by myself too but too broken at this point to even do a google search.

    • It just means that your SEVIS is active. It doesn’t give any information as to if your H1B is pending or not. You can get that by actually knowing what your SEVIS status is!
      My DSO wont give me that information and I am guessing yours is doing that same. I have requested them to issue me an I20 and I hopefully will get it this week. You can do the same.

  10. Last year I applied for MTR and got I290B filed. Now on my old I129 application status got updated to “Case is approved”, but I290B still shows “Case is Reopened”. What does that mean? is my H1B approved or not?

      • Bro there is no way an attorney can get the information you published. It is not over until the data entry announcement is done by USCIS. I know the hope is little and i too am clinging on that tiniest piece of hope. Haven’t slept in a while but hang in there guys.

    I have checked with Bangalore SPOC Abhijit, He told, By May End Only Immigration team start updating INSZoom and sending emails..If he is saying like this then No IBMer should be getting updated as they come to know the status about their applications and commenting in redbus2us.

    Please let me Know about other location what they are saying?
    Do you guys really recieiving mails or INSZoom updates?

      IBMers have already started getting the receipts. Two out of the 9 filed from my account have received it. Both WAC* initials (California center). This is the data from one of the accounts in Bangalore location.

      One got it on 27th April, and the other one on 28th April !

      So, this obviously is in deviation to your statement. It has already started coming for IBMers. So don’t go by anyone’s words. And keep your fingers crossed for the coming 2-3 weeks, which is definitely crucial.

      NOTE: I am on 3rd attempt, one among the left 7 people, eagerly waiting for the results! 🙂

          Sorry for the late response. These two friends of mine got the mail directly. No status was updated as “Filed” in INS Zoom.

          But, for me, it is showing “Filed” and the “date filed” as well. But no receipts so far. a long wait of 3 years now.

          These two friends go their mails as “Receipt Notice received” from IBM US immigration team.

          • Thanks my friend,as some of other colleagues mentioned then inszoom updates and the receipt notice is directly handled by US immigration team.We have to wait for some more days,this week more receipts are going to come,if we follow trends in the past few years.

    • better not to go by udpates from immigration team,its true that receipts have started to come..and the coming two weeks will see lot more receipts being send out.Has any one seen any updates in the tool with a filing date,I am hearing for some guys its updated as filed.Not very sure if there is no filed update in the tool,we need to wait or what ,does it mean its not filed at all? In the past years they were not really updating the tool properly,so cant be sure.

      • receipt date is updated in ins zoom only for those who got selected in lottery.
        There is mail from us immigration (ibm) when you receive receipt.
        the mail itself generated from ins zoom hence ins zoom is updated first and then mail comes. receipts will attached in ins zoom only after 10 pm ist, so check for updates in ins zoom only after 10 pm. Thanks

    • IBM INDIA Immigration team won’t have any latest update. They are just used for data entry related work and they are not aware of any true immigration process.

      As far as I know receipt numbers are directly sent to resources from IBM US Case Managers as and when they receive the hard copy. The updates to INSZoom are not happening on timely basis.

      Last year resources received updates till 22-May. In my account out of 15, 4 got receipt numbers already.

      • Thanks Thomas …there is a intermediate update which happened in inszoom with filing date but it has not happened for all …looks like inszoom updates are not really happening regularly and it depends on case managers ..

      • As far as i know, applications are opened only after lottery is done and receipt numbers are assigned. Scrutiny of applications selected in lottery starts around mid of May.

      • Who said.. Next year only merit based selection. It does not mean TCS n infosys sending more applications abusing the visa policy. What about ADs and other companies also filing more. So dont blame tcs and infosys. Go and do your F.. K

    My h1 got picked my dso said my sevis record shows pending my employer said he did not receive receipt my opt ended on Apr 30 i applied for stem opt but i applied for withdrawal but status is still pending my university says they require receipt to apply cap gap but I have heard cap gap is automatically extended i want to know whether my opt is extended to sep 30 or not but without receipt my university is not telling anything

    Today, my employer emailed me my receipt number, on USCIS website it shows below message:

    On April 11, 2017, we received your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number EAC17148XXXXX, and sent you the receipt notice that describes how we will process your case. Please follow the instructions in the notice. If you do not receive your receipt notice by May 11, 2017, please call Customer Service at 1-800-375-5283. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

    Does this mean that my case has been selected in lottery ? I am currently in US on F1 visa. I have still two semester left to complete my graduation. Will this scenario hamper my petition by any chance this year ? Can I continue my graduation if my status changes to H1B ?

      Even Mine was picked and i received my Receipt number through my i20 and then my emploer told me my cash was checked.

      Yes, it has been selected in the lottery. You can continue to study on F-1 until your H-1 is approved. If H-1 gets approved w/ COS, then you need to work full-time as per the terms laid down in your H-1 petition. You can study part-time but your main focus should be on H-1 once your status changes to H-1.

    • A word of advice for PhDs with good publishing track record and citation count (say 45-50) don’t waste your valuable time on H1B madness. Look for alternatives EB1 A/B or O1 VISA.
      I applied for 2014/2015 H1B and was unlucky both times hence started working on my EB1-A application. Took me 1 year to thoroughly prepare my profile for EB1 application but after applying I got my green card in less than 6 months.

      • Well, if you have a PhD with many publications and references, you are probably working for a university that is exempt from quota anyway. If you work for a for-profit, then how exactly do you publish? I’m not sure.
