H1B 2018, 2019 Season is over, H1B 2020 Season Starts on April 1st, 2019.  Check out H1B Visa 2020 – Start Date, Fee, Lottery – FAQs 

If this is your first year of H1B visa filing, you must read What is H1B Visa, Requirements, Process . Not to scare you, Last year, there was lottery for H1B season and for FY 2017 USCIS received 236,000 applications .

When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017. 
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017.  But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017.   If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017.  You may read USCIS Press release for H1B 2017 Start Date 

What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ? 
Update : USCIS confirmed the below quota cap numbers in latest press release for FY 2018. 
To get some background, read H1B Quota – Regular vs Masters .  There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in.  The total H1B Quota as of today is 85,000 and it is split like below.

Regular H1B Quota  65,000
Master’s H1B Quota ( Only US Masters Degree Eligible) 20,000

Out of the above 85,000 quota, 6,800 are set aside for Singapore and Chile citizens as part of the free trade agreement between them. Also, check out the article with history of maximum H1B Cap from 1990 to 2017 

H1B 2018 Lottery Predictions ? 
It used to be a speculation whether we would have lottery in previous years, but in the past 4 years, lottery has become common. It is very likely that we would have lottery aka random selection for H1B 2018 season.  We have been writing predictions over the years and all of them have been accurate so far. When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially  on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
  • Other H4, L1 Visas :  If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.

  • If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
  • If you are professional planning to arrive in US from outside America,  it can be really tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ? 

The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS.  There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary from FY 2017 quota.  If any changes, we will update this accordingly.

H1B 2018 Lottery Results – Checks Cashed, Receipts : 
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date.  To put things in perspective,  last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017…  Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018.  Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?

We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Check out USCIS New measures to report, prevent H1B Fraud  . Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. There are many speculations on how H1B program will become tougher with higher wages, quota limits, etc… but, nothing has been officially signed. We will update the article as new updates come in.

Various H1B Bills  in US House and Senate  – Will they be passed for FY 2018 ?
There are few bills that are introduced in 2017 and at various stages in both house and senate. There are many confusions regarding the same bills like the minimum wage will go up to $130,000 USD, etc.  Fact is that nothing has passed and there are very slim chances for them to get passed before start of FY 2018 season.     I am AD. Checks have not been encashed. No response from lawyer or employer. No Sevis change till Friday. Should I keep hopes? I am super anxious.

  2. My employer has filed H1b (non-AD) and I am yet to receive any update. Good number of my colleagues already received confirmation of their H1B. Any idea, Uscis is done with communication to ppl who received their H1’s

        • AD is close to the end, but there is still some hope, especially if you filed at CA service center. Give it another week or two.

    • If you’re ad then there is still hope but not too much, especially if you filed at Vermont. If you’re non ad, then there’s a good week or two.

  3. Still any chance for Non AD? I applied from 2 consultancies and 1 from my MNC company..My wife applied from 1 consultancy..total 4 chances..none of the check encashed till now..

    • Is it fair that it should be picked after you are ensuring that no one else gets picked because you are greedy with your applications? What’s the desperation about? Notice you said “I applied..” and not that it was filed on your behalf meaning you are the one pushing for multiple applications and not a merit based application. May you never get picked this year. It is evident there are no jobs for you to come and fill, you simply want to come into the US to transfer to someplace else. Please stop jamming the h1b for all others.

  5. It’s been a week and none of us got notice. My team is working for a company which just have been mentioned a lot recently and almost all of us are seniors with hardly below $180K. Even the lowest might be $130k+.
    But guess what?
    This sucks badly.

      When its lottery, doesnt matter who you are, what you earn, where are you from and what have you stadied… only and only luck works there… its like just imagine they have 200K chits and they throw all of them to ceiling and those who stick at ceiling..got the visa….

  6. Finally dream come true was in USA on H4 -2nd attempt , one application , regular cap -check cleared today confirmed by employer .
    Yet to get receipt from USCIS mail.
    can anyone tell when will I get receipt ????

    • H4 to H1B,

      The employer/attorney should receive it within 1-2 weeks (SLA is 30 days). At times, the receipt number is also mentioned on the back of the cashed check. If the employer has access to view check images online, then they can look at it.

  7. Both my applications got picked up- different employers. Realistically speaking , will they receive rfe or is it possbile that they both can get approved without rfe. All documents are proper for non IT position. Or is it advisable to ask one employer to withdraw the application. I am just worried that what if i ask one to withdraw and then the other one gets rejected.

      • hahaha… really.. skill skill… i read it as silk … silk… ( heroine) and salary. i guess some of the ADs seriously lack the real time exp.. and some of them really lack skill as well. Just coz you have spent money to go to US and studied, doesn’t really put in a priority list. Actually, it looks like , you guys are the one who wanted the american dream before Non-ADs in the 1st place, its quite funny ADs talk too much. 😀

        I am a software professional working for a major Indian outsourcing company based out of “Namma Bengaluru” for the past 7 years. I have worked very hard to learn and increase my knowledge base in the field that I chose to master. I proudly say that I work for a major Indian outsourcing company.

        Stop being self obsessed. Just because you have an American Degree it does not mean you are patented to have an intelligent brain. You were lucky to have the finances to support your education. For heaven sake stop generalizing your accusations by blaming these Indian companies. I know many of my own friends who just go to the US to get some random degree from a US university and portray themselves to be Einsteins and Newtons. Then they shamelessly brag about being superior to the equally hardworking Indians working here in India looking for a brighter future.

        There are many here in the Indian Outsourcing companies who are full of intellect in their respective domains.These companies do not make billions of dollars just by chance or by luck. They just don’t land up with projects worth billions of dollars. There have to be some really smart people who make it happen and majority of such work gets stream lined to the ground level.Give them their due credit.

        • I agree and all your points are valid but what about people who invest in fields besides IT. Worked for 4 years to earn my degree 7 years of Indian and overseas experience. Got my H1 on the 4th attemp. With 15 years of experience I still had to loose against someone who had fake Indian experience no advance degree but was just lucky to get selected in the lottery.

          The entire world does not only run on IT there are other fields and people who are experts should be given a fair chance.

            I completely understand your point. The whole lottery process is just not right. In my opinion visas should NOT be granted only on the basis of luck. All deserving candidates miss out because of this.

            But when someone says that big outsourcing companies have illiterates and don’t deserve to get this visa, then I have a problem with this baseless statement of theirs.

            What USCIS can do is to find out a way to filter out all false and duplicate applications;
            may be manually – tedious and time consuming process,I agree. They can also include stringent eligibility criteria for applying. They will then be able to bring down the numbers. If the applications are still exceeding the congress mandated 65k, then there is no other option left than to conduct the lottery.

            We all need to go through this as there is no other option.Every one [deserving candidate only] is on the same boat. This way we can at least make sure that these visas do not land in the hands of undeserving and false candidates.

    Non-AD / CA centre.
    Reputed US company. Her salary will be above 110K+ for sure.

Nothing has been finalized…please DO NOT have a feeling that today is the last day of receiving receipt notices…last year till May end very much people kept receiving receipt notices..No math No prediction works for receiving receipt notices as no one has the actual figure that how many total got the RN s till now
    I know you all know all these but still feeling restless..Please eat healthy and stay healthy;you all genuine and deserving one going to get it..

  16. Still waiting!!! Do we have any chances left 🙁 It’s Friday & USCIS will announce data entry is completed by earlier next week.. One more year of struggle to maintain our status here.. My OPT will expire end of this year.. Not sure wat I’m going to do next 🙁

    • Same situation buddy. But I have hope for next year. I work in Research (AD/OPT), big American firm. Hopefully next year, consultancy Golti crowd is hit on the ass. Indian body shops and american desi consultants body shoppers will not reap as much benefits as they have this year.

      Next year all deserving genuine, non-fake degree ppl. Who have the guts to speak about their domain and field of work to any immigration or USCIS person will def be at advantage.

    • Same here. I do not have any more shots at this. This is the last time for me. My first thought this morning was- ” Its either today or I’ll need to re-evaluate my family’s future”. Its almost lunch time here in CA and the CA SC would be closing for the week soon.

        • I was actually thinking more about the check being cashed than receiving receipts today. Cashed check reflects immediately. If that doesn’t happen in the next 3-4 hours (CA SC work hours) then ……. I don’t know what then.

    • Yes there is still hope, especially for non-AD and AD/CA. And we don’t k ow when the data entry will be complete. USCIS never announced a timeline about that.

  17. So I finally decided to make peace with lottery results. I thought AD game is over and I was on my way. Although this was my 4th attempt, but honestly I was now less worried and concerned, and this was helping me feel better. But just received a call stating cheque was cashed today. So the game is still ON and I was told that we can continue to expect receipts until end of 1st week of May.

    All we need is to feel better and relaxed. Luck will certainly favor you !

    Will the SEVIS status change to pending only if you are in OPT extension or is it for all OPT students .
    Mine says active and i am NOT in OPT Cap Gap extension yet.
    its my 1st OPT.

      If petition was filed w/ COS from F-1 to H-1 and is selected, only then SEVIS status would be updated to cap-gap extension.

  20. My SEVIS was just updated with receipt number WAC171435**** . AD/CA .
    Does this mean I was picked in the lottery? From the what I’ve been reading here, I think I am! But wanted to make sure.

    • Same, I tracked my receipt number through the USCIS website and it says that my case was received. So pretty positive that we are in.

    • Yes, don’t lose hope. My check was cashed 10 days ago, today, I just got the physical receipt from the HR. They are soooooooooooo slow, I strongly believe MORE ARE COMING!

  23. I am non-AD and my DSO just mentioned that there was no update with my SEVIS record. My lawyer and company didn’t mention whether check was cashed or not. Does that mean I am not selected?

  24. Just got my receipt a moment ago. My petition was filed in Vermont and having seen so many VT petitions come back over the past 2 weeks I was losing hope but if anything this has taught me that there is absolutely no identifiable methodical process in how these receipts get sent.
    Literally all you can do is wait for that email. I never asked my lawyer or DSO (that would have stressed me a little too much if they gave me an answer that wasn’t clear).
    1st time applicant, finance field and currently on OPT. Not sure if I got selected AD or non AD since I have a B.A and M.A from the US.
