H1B 2018, 2019 Season is over, H1B 2020 Season Starts on April 1st, 2019.  Check out H1B Visa 2020 – Start Date, Fee, Lottery – FAQs 

If this is your first year of H1B visa filing, you must read What is H1B Visa, Requirements, Process . Not to scare you, Last year, there was lottery for H1B season and for FY 2017 USCIS received 236,000 applications .

When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017. 
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017.  But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017.   If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017.  You may read USCIS Press release for H1B 2017 Start Date 

What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ? 
Update : USCIS confirmed the below quota cap numbers in latest press release for FY 2018. 
To get some background, read H1B Quota – Regular vs Masters .  There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in.  The total H1B Quota as of today is 85,000 and it is split like below.

Regular H1B Quota  65,000
Master’s H1B Quota ( Only US Masters Degree Eligible) 20,000

Out of the above 85,000 quota, 6,800 are set aside for Singapore and Chile citizens as part of the free trade agreement between them. Also, check out the article with history of maximum H1B Cap from 1990 to 2017 

H1B 2018 Lottery Predictions ? 
It used to be a speculation whether we would have lottery in previous years, but in the past 4 years, lottery has become common. It is very likely that we would have lottery aka random selection for H1B 2018 season.  We have been writing predictions over the years and all of them have been accurate so far. Update : USCIS Received 199,000 H1B petitions for fiscal year 2018.  H1B Lottery was conducted on April 11th, 2017.

When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially  on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
  • Other H4, L1 Visas :  If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.

  • If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
  • If you are professional planning to arrive in US from outside America,  it can be really tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ? 

The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS.  There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary from FY 2017 quota.  If any changes, we will update this accordingly.

H1B 2018 Lottery Results – Checks Cashed, Receipts : 
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date.  To put things in perspective,  last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017…  Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018.  Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?

We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Check out USCIS New measures to report, prevent H1B Fraud  . Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. There are many speculations on how H1B program will become tougher with higher wages, quota limits, etc… but, nothing has been officially signed. We will update the article as new updates come in.

Various H1B Bills  in US House and Senate  – Will they be passed for FY 2018 ?
There are few bills that are introduced in 2017 and at various stages in both house and senate. There are many confusions regarding the same bills like the minimum wage will go up to $130,000 USD, etc.  Fact is that nothing has passed and there are very slim chances for them to get passed before start of FY 2018 season.     This is my last chance and I didn’t have good luck for the last 2 years. Haven’t gotten anything…I’m STEM master and never thought it would be so hard.

      It should not be an issue. As long as the job responsibility doesn’t change more than 50%, you can work on previous LCA and 797. Always a good idea to get the application reviewed by your attorney who can determine the % change.

    Finally I made it after a long wait.This is my third attempt.I just received a email subject with “Receipt Notice Received” at 10.45 PM IST.

    I could also see the INSZoomSite updated with receipt number.

    I wish you all the best for (all)deserving guys who is in waiting mode.I know the pain of waiting and I have gone through the same situation 2 times already.

      Just a email from our US immigration team with subject as “Receipt Notice Received”.I think at the same time they are updating INSZoom site with the receipt number.There was no intermediate updates/info from any one.I was also literally waiting for the updates.

    I have received the receipt notice for H1B.

    My info:
    2nd attempt, Tier 1 company (FB/Google/Microsoft), regular quota (though I’m AD (but, outside USA) and an IIT alumni).

        • @Vicky Nothing personal about IIT people, but I guess their college has less fees due to rest amount being payed out of tax payer’s money. Also VERY FEW IIT guys serve the country (neither do I, but I did not get my fees payed by others). I believe its not that hard to get into IIT or Stanford, its just that I am too lazy. Nothing personal guys. Chill…

      • The main reason behind trump bringing strict regulations in H1B is to stop it’s abuse by fake consultancies and fake candidates.

        If some geniune candidates make through the current lottery process at least don’t troll him.

          If it’s your 4th attempt, you have around 75% chances of winning this type. Pretty good, I would say.

          (In my original comment/post) by ‘genuine applicants’, I mean people who are misusing H1B lottery system through fake consultancies by paying themselves for payroll, etc.

      • If you see the old posts, people want to know more about the person who won the lottery. Like – the type of company, number of years of experience, AD/non-AD. I mentioned my info because of that. Since USCIS didn’t mention “lottery” word in 3rd April’s announcement, there are many who think it was not a “pure” random lottery.

        I mentioned that info because of that. Once you join a company, your degrees doesn’t matter.
        Apologies if you thought reason to be something else.

  9. My wife’s lottery is picked finally after a long stressful wait. (Non-AD, VT).
    I am an AD, VT (3rd attempt), still waiting.
    Heard from my employer that 6 was picked today. out of which 5 are AD, VT and one Non-AD, VT (my wife’s lottery).
    Yesterday one Non-AD, CA check was cashed also.
    Don’t loose the hope guys. I am also thinking at least this time I will be picked along with my wife.

    Also, how can I tell if my petition was AD or regular? I can’t seem to see any indication on the notice I got.

    • There is no such certainty. It is indeed uncertain. USCIS will first check your background, job-education match, employer, and all the other details. If everything’s okay, only then they will approve your visa.

    • Bro AD means advance degree. IF you did masters or PhD from US then your petition is under AD category. If you only have bachelors you are non AD. And it will not say that on the notice. Be glad that you have received a notice. Most of us are still waiting.

      If you get picked in lottery you are certain to get a visa unless you application and stuff you mentioned is really shady.

    • I think this year we might get delayed updates as Premium processing is suspended. At this time all we can do is wait patiently. Normal processing doesn’t have clear deadlines. Until USCIS informs that all unselect petitions have been sent back, we all have hope.

    This year 5 were filed from my team (4 Chennai & 1 Hyd) (3 second attempt & 2 first attempt).

    Two guys from my team (including me) received mail around 2.15PM IST.
    CTS – Both of us are 2nd attempt – NonAD – CA
    I am in Chennai and another selected team member is in Hyd.

      • Final package they had uploaded last time when I filed H1,I had the same question and when I checked with my US case manager,she told me that the case is ready to be shipped..it all depends on the case manager i think to do updates in ins-zoom.

    • I don’t see anything like “Final application package” in supporting documents section for me. “Petition Submitted to USCIS” status step still showing me as “Not Started”. Not sure, it was not submitted really or submitted but not yet updated in INSZoom. Clueless.

      • At this point of time its very difficult to determine what the status in the tool means,as you said it can be that the case is filed but the tool is not updated.Earlier version of the tool showed a trail of last access ,that is who all accessed your docs and all that,the present version does not have a provision for seeing a last update trail.There is no real update from immigration as well,they are only responding with standard copy paste text.Only I update which I received was during the last week of march where a US case manager responded to my query and confirmed that the case is ready to be shipped out.

      Last year rejection notices started to be received around mid-June. Wait for USCIS to make the announcement on completion of data entry. Until then, petitions are still being generated and posted.

      • One guy from my project in IBM from Bangalore location got it. Receipt number number starting with WAC*. Its updated in INS Zoom. Feeling very happy for my friend, who truly deserved it. It was his 2nd attempt !

        He got an e-mail yesterday at 9:30 PM yesterday.

        I am the other guy, who case was filed (status updated in INS ZOOM), waiting for the lottery results ! 🙁

      If the petitions are filed by truly independent employers then all selected petitions will be processed and may get approved. You can then decide which employer to join.

      If the petitions are filed by related employers, then most likely USCIS will issue RFE asking for clarification. If they determine that employers are related, then all petitions will be denied. If not, they will be processed and you can pick an employer to join later.

      Now that I have responded to your question, I am going to be tagged as fraud enabler.

        • Hi, I work in Cisco too. Did they notify you about the your H1B petition status? I was told by Fragomen that they would likely notify me in May or early June. Guess they send out email to all selected candidates at once, not sure though.

  20. Few of my coworkers already got the confirmation that they have been selected in the lottery by tuesday. All of them are non AD. Is there a chance for me still or is it over? I’m a non AD

    • U Anonymous be practical , Non-Ad u r taking about , there are still have to update SEVIS and Cash enchashed poeple waiting because its completed 60 percent only for AD, and u came here for non-AD, still up to May 3rd week we have a time, until watch IPL and do ur hard Work cooool guy, and be patience 🙂

  21. u sheep creep corp u r illegal i think, creep applied more then 60 percent 110000 selected from opt and cpt which have 1 year exp…studied in local colleges after BTECH, with fake experience applying with 6 yrs exp is illegal and who are coming from infosys, tcs, wifpro and cst taking jobs, first they interview with citizens and T.R who have to give 130k salary ignoring and importing from India and taking fake interviews in local USA candidates taking our time to conduct are illegal, which will be blocked in 3 years . these fake consultancies i know (TCS, infosys, wipro, Gemini, CTS, and top Indian fake consultancies.), taking interviews at h1b time and exporting from India to give 80K salary.. u know that there are people who have exp. in local , and citizens, EAD and h1b lot more..u morel ethics less people.. wants to still export with fake people…go u Big IT consultancies……

  22. I posted this on IG’s weblog. I’ll post it here again, maybe it’ll be useful to some other people.

    Since a lot of you guys seem to be frustrated I decided to do a probability analysis for you to see what are the chances left.

    Assumptions:
    Total applications: 199000
    AD applications: 100000 (per Emily’s estimation)
    Applications from Emily’s firm: 2500

    A priori:
    Probability of winning lottery as AD: 20k/100k + (80k/100k)*65k/179k = 49.3%
    Probability of winning lottery as N-AD: 65k/179k = 36.3%

    Considering Emily’s sample size, the margin of error for 95% confidence is <2%. Meaning the probability that the percentages posted above are more than 2% different from what their actual number is is less than 5%. So I will assume they're correct.

    Chances right now:
    AD at Vermont: (49.3-45)/(100-45) = 7.8%
    AD at Cal: (49.3-24)/(100-24) = 33.2%
    N-AD at Vermont: (36.3-7)/(100-7) = 31.5%
    N-AD at Cal: (36.3-5)/(100-5) = 32.9%

    To recap:
    If you're Non-AD you almost have as much chance of receiving a receipt as you had when the lottery started, ~32% vs ~36%.
    If you're AD at Cal you almost have as much chance of receiving a receipt as the Non-ADs.
    If you're AD at Vermont, well, 7% is not that low, you'll see what happens after a couple of weeks.

      • Well based on the information available to us that is the probability of you being one of the selected. There are a few assumptions here:
        1. The proportion of AD vs None-AD is the same in Vermont and Cal.
        2. The ratio of selected cases vs rejected cases are equal in Vermont and Cal.
        3. etc.

        These assumptions are fairly reasonable, however all of them contribute some error in the calculations.
        So I would say probability of you receiving the receipt if you’re AD Vermont is somewhere in 5%-10%.

        All this aside, you should note that whoever’s selected is selected and that’s done. Your fate was sealed when the lottery took place. All of these calculations are just to make sense of how much hope you should have of being of the lucky cases.

  24. My DSO said there has been no changes in my SEVIS status.
    I am based in CA.
    Does that mean my H1B was not picked up in the lottery?
    Also, my lawyer has not received any receipt yet.

    • Congrats. I am AD/First Attempt/ResearchEngineer/LargeAmericanFirm , no reply from Fragomen.

      I hope next year the rules favor merit and AD, along with firm and role.

      Desi consultants are having a field day this year. I knw ppl who filed 3 h1’s simultaneously. Hopefully, this is the last time desi consultants can do this crap.

          • u sheep creep corp u r illegal i think, creep applied more then 60 percent 110000 selected from opt and cpt which have 1 year exp…studied in local colleges after BTECH, with fake experience applying with 6 yrs exp is illegal and who are coming from infosys, tcs, wifpro and cst taking jobs, first they interview with citizens and T.R who have to give 130k salary ignoring and importing from India and taking fake interviews in local USA candidates taking our time to conduct are illegal, which will be blocked in 3 years . these fake consultancies i know (TCS, infosys, wipro, Gemini, CTS, and top Indian fake consultancies.), taking interviews at h1b time and exporting from India to give 80K salary.. u know that there are people who have exp. in local , and citizens, EAD and h1b lot more..u morel ethics less people.. wants to still export with fake people…go u Big IT consultancies……

      • If they do merit based, I would hope they consider the deserving (highly skilled or highly paid) candidates CAP exempt. The wait for 1 year is heavy and again after all speculation and expectations, they say “Guess What?? It’s lottery again!!! Surprised!!!”

  25. I requested my i-20 on April 17th and again today April 26th to check if h1b Change of status is listed on i20. So on the I-20 form that i received today,the date issued on it is April 17th 2017 which is the replica of i20 what i received on April 17th. So is it the updated i-20 or they have sent me the same one?
