If this is your first year of H1B visa filing, you must read What is H1B Visa, Requirements, Process . Not to scare you, Last year, there was lottery for H1B season and for FY 2017 USCIS received 236,000 applications .

When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017. 
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017.  But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017.   If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017.  You may read USCIS Press release for H1B 2017 Start Date 

What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ? 
Update : USCIS confirmed the below quota cap numbers in latest press release for FY 2018. 
To get some background, read H1B Quota – Regular vs Masters .  There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in.  The total H1B Quota as of today is 85,000 and it is split like below.

Regular H1B Quota  65,000
Master’s H1B Quota ( Only US Masters Degree Eligible) 20,000

Out of the above 85,000 quota, 6,800 are set aside for Singapore and Chile citizens as part of the free trade agreement between them. Also, check out the article with history of maximum H1B Cap from 1990 to 2017 

H1B 2018 Lottery Predictions ? 
It used to be a speculation whether we would have lottery in previous years, but in the past 4 years, lottery has become common. It is very likely that we would have lottery aka random selection for H1B 2018 season.  We have been writing predictions over the years and all of them have been accurate so far. When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially  on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
  • Other H4, L1 Visas :  If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.

  • If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
  • If you are professional planning to arrive in US from outside America,  it can be really tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ? 

The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS.  There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary from FY 2017 quota.  If any changes, we will update this accordingly.

H1B 2018 Lottery Results – Checks Cashed, Receipts : 
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date.  To put things in perspective,  last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017…  Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018.  Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?

We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Check out USCIS New measures to report, prevent H1B Fraud  . Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. There are many speculations on how H1B program will become tougher with higher wages, quota limits, etc… but, nothing has been officially signed. We will update the article as new updates come in.

Various H1B Bills  in US House and Senate  – Will they be passed for FY 2018 ?
There are few bills that are introduced in 2017 and at various stages in both house and senate. There are many confusions regarding the same bills like the minimum wage will go up to $130,000 USD, etc.  Fact is that nothing has passed and there are very slim chances for them to get passed before start of FY 2018 season.   2. Slowness of receipts indicates something else going on, else by now we would have heard much more on the number of selected candidates.

    • Not really.
      In other years, there is the option of premium processing which makes sure you find out sooner. Not possible this year.

      For regular cases, it is usually near the end of the April to mid May where the main chunk of the entire volume or receipts is received.

      So far the only cases in this thread are AD and these are by definition represent a small subset of the total number of applications. So the low number of cashed cheques are also normal. Also this thread is mostly frequented by Regular applicants (based on the comments). So you wouldnt see too many of their cheques cashed yet as AD is always done before REGULAR.

      The only difference this year is the announcement which USCIS has not done. No premium processing means they do not have to start REGULAR processing until the AD applications are in process already.

      • if you look at the H1b tracker for 2018 on this site itself, the number of AD and non-AD are evenly divided.

        Probably several of us sitting in india are more exited to go to US than ones already there (with AD), which could be a reason for more comments by non-AD.

    • Dude , I do not think no one over here works for USCIS so u will only get nonsensical or assumptive answers .I hope they scrutinize every applications and specifically those who had filed multiple ones with different employers .

    I just called my DSO and they confirmed that on April 12th my SEVIS status got updated from student to Pending. Does this mean my application was selected in the lottery ? Im in AD category, 2nd attempt and my current opt status is good until jan 2018. Please reply

      • @@Hope – Most of the DSO’s tell you the present SEVIS status. I tols them its for my H1B visa status and its my last chance. So they checked and and just gave me the updated status.

    • My DSO said that they can’t reveal the information if it’s regarding an H1B application.
      Like they will not inform me if my status is changed or not. Only my employer can inform me anything about it.
      And of course my employer can’t see my SEVIS.

  5. Does anyone check got cashed from St. Albans, Vermont location? MY AD Application reached on 4/03/2017 at 4:13 am (As per FedEx). Today checked with my Employer (No luck). I am working in a Start up company as a Full Time employee. LCA filed in Software Developer, Application category.

    May I know the timeline I should be looking at to see if my H1 has been selected in lottery. Is it within this week ? this month? Can someone provide clarity?

    Employers may not file multiple or duplicative H-1B petitions for the same employee. To ensure fair and orderly distribution of available H-1B visas, USCIS will deny or revoke multiple or duplicative petitions filed by an employer for the same H-1B worker and will not refund the filing fees.

  16. It’s good that people on this forum have started reporting the fake desi consultancy’s. It’s only because of them misusing this H1b thing all these years that we have this debate of H1b today. The general perception of most Americans today is H1b is cheap and low skilled labour. This is all thanks to those desi consultancy filling up the job market with fake resumes and desperate people who just want to be in the US come what may, especially people from Andhra Pradesh. I don’t know why but there is something terribly wrong with these guys coming in from Andhra and opening these fake body shops.
    We need to get rid of these posers and scammers fast. Because of these cheaters the image of an Indian engineer in the US is stained and people start looking upon us at just some semi skilled IT worker.
    Down with the consultancies…!!!!!!!!!

    • Mr. Stop the Desi Consultancies, I guess you are feeling like an IIT. 99% Andhra(Telugu) engineers have great logical thinking which is a best quality of an IT guy. You are keep saying fake fake resumes, If you think about it few people here and their using those but they are providing that kind of production in work environment even if they don’t have that much experience. So Just think they are intelligent engineers or not. If you are a nice human Keep in mind before you spread something out mind your word and your business. Words can not be taken back. Every filed AP people have awesome knowledge ether good or bad. No one can beat their calculations. Not even today they were far ahead of technology from olden days. Check the historical ranks in any comparative exams 50% of the ranks(NO:1) is AP. You can check in all IITs howmany Andhra engineers are coming out each year. one of our friend mentioned about Satya Nadella, Check Microsoft drastic growth after became a CEO. People from different parts of India is coming to Hyderabad any learning professional courses to grow in their career. So please mind your words Mr. Intelligent.

  17. i came to know of a consultancy which fakes experience for freshers by at least 6 to 7 years. They use a sister concern to deal with h1b and other immigration matters. looks fraudulent through and through. The consultant is Softnyc and spyka llc.

      Please go through each and every message on this forum and then, your statements will 100% change.

      You seem to be posting only a web link, without even having the time to go through the hard work of so many people, who have put in all there efforts to collect the valuable information of there individual companies/consultancies (I am not considering the comments, people have posted on this forum for defaming each other’s state/country in the name of “FUN”)

      As per the history of 1900+ comments, the only thing that is pretty clear, Mr Qoura Answers, is that;

      1. There are 100% chances of the LCA’s filed for the this year dropping by a big margin, due to a multitude of reasons ( the recent turn of events in US, the requirement being very particular on the entry-level programmers constraints, and the different companies having filed almost 20-30% of the LCA’s certified for their individual companies -(THESE ARE FACTS & NOT FIGMENTS OF MY IMAGINATION). So, please don’t be surprised if the actual number (when the USCIS publishes the results, provided if they do that, would be
      “SURPRISE !!! SURPRISE !!!, AROUND 1,00000 to 1,11000). Yes, you read it RIGHT!
      Later on when the Results are OUT & the reasons are PUBLISHED , then you Will know IT FOR SURE, WHAT AM I POSTING NOW, ARE TRUE. TOUCH WOOD !

      2. The USCIS is definitely going to take its sweet time to publish the results, as unlike previous years, there has not been any press releases as of last week ending. And moreover there is no Premium Processing these 6 months, so the USCIS has ample amount of time to publish their results, as there is no burden on them.

      3. Remember, the USCIS is only obligated to perform the LOTTERY, if the number of LCA’s filed (all the valid ones – a. who have the checks filed in properly, b. non-duplicate filings, c. may be the “entry-level programmer be a screening criteria( even though there is nothing new about it), d. the fake consultancy generated LCA’s could be eliminated for sure).

      5. The USCIS is doing things very DIFFERENTLY this time, and surprising each one of us. So the statistics gurus can keep their analysis form PRIOR years under there beds, as these are of NO USE THIS YEAR. This year everything has CHANGED (circumstances, scenarios, conditions, impact). The ONLY thing which is constant is the 65000 +20000 Master = 85000 Total Count.

      Now, how the USCIS is going to come down to this 85,000 magic number, THATS A GUESSING GAME! Nowhere in the rulebook of USCIS, is it mandatory for the USCIS to publish the results on a particular date. its only that they have been following these dates for the past many years. they can OBVIOUSLY change this YEAR. They can take their time and as just reported last week, starting with (MAY BE) review of the Master Quota cases, as Immigration Girl just reported, a few checks being cashed.
      So, (MAY BE), they are reviewing each of the LCA’s filed THIS YEAR and based on their review criteria (base wages, entry level programmers, etc), will have their FINAL LIST of 85000 ready. If the Final list prepared by USCIS exceeds the 85000 mark, then they WILL GO FOR LOTERRY (which is 100% according to the rule book )!

      So, HAPPY READING, AND IF STILL YOU HAVE DOUBTS, then “KEEP GUESSING” ! 🙂

    Please don’t encourage fake resumes. I have come across resumes of consultants with 6-8 experiences. All were below age 24 and raises suspicion. Our firm have reported these consultants individually and scanning consultanties across Texas and NJ.
    Please report fake candidates.

  24. 3 genuine indications that filings are less that I have know from reliable sources:
    1. Friend working for TCS in TX. Out of team of 20, only 12 filings have been done.
    2. Friend working for Syntel on client site in Portland. Company has changed strategy and going for locals this time.
    3. An acquaintance working for Microsoft. Fewer applications from his team.

    Its surely a different ball game this time. If Trump can use ICE to crack down illegal activities and increased number of ICE officers, why won’t he scrutinize visa applications?
    If you are a desi consultancy, go ahead and close your gates next 3 years.

      Get your self experienced and then apply. You might get an rfe this time even if you are selected.

      Also double check whthr your consultancy really filed for you this year.

  26. Dont trust these Desi consultancy employers, This time its gone be different even its picked in lottery there is going to be lot of scrutiny before they approve. No more multiple application and fake jobs. Friendly don’t get panic, there is no need for all attorneys to tell you right a way that your cheque was cashed, Most law firms report after they get confirmation and USCIS don’t cash all cheques on same day. Just relax and be positive.
    Last year I got my cheque cashed in july 2016, Mine is AD and my application is still processing with UCSIC so they really do take time.

      • If employer needs you – he will file premium processing and you will start ASAP.

        If your employer doesn’t need especially you and just need some bodies – he will wait and he doesn’t bother that you waiting so long.

        This is simple. So think who are your employer if you are still waiting.

    • If your case was filed and u got an email on that, then don’t expect any update before may.
      If you didnt get any email saying your case was filed, that means your application was dropped and they are not going to send you any email informing that.

  29. I’m very sure guys. There is no lottery this year. If there would be lottery, USCIS would have mentioned it earlier. A merit based selection is happening and USCIS is going through all the petitions.

    That’s why they cancelled PP. USCIS might have had communicated to nasscom that Indian companies should file limited petitions.

    My MNC employer filed around 200 LCA’s for my account alone. But in the last moment they filed very limited petitions. May be due to nasscom’s influence.

    All AD and experienced petitioners no need to worry. Only entry level programmers will be in trouble.

      Were they all cap h1b? India based employer? Mechanical or computer stream? Any idea on chaque cashed employee salary level? 1 2 or three level guys??

            All the 29% non AD picked guys have 3 to 4 external certifications.

  32. It’s 5 PM EST and I assume USCIS is closed for the week now. No more updates for the week. If we were to hear anything about any details about the CAP subject H-1B petitions, I would assume it would come only next week now. It’s really STRANGE why USCIS would encash checks but not come out with a notification! While they are not obligated to update us at every step, at least that’s how it has been in past. Just this digression from the norm alone suggest that they may be some surprises for us next weeks! Wrap up your thoughts on H1B and have a great weekend!
