When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

USCIS announced on March 16th, 2016 that they will accept FY 2017 petitions from April 1st, 2016. Read Summary of USCIS press release FY 2017 .

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

  1. Anyone in EAC16141**** series still waiting ? Looking at status of other receipt numbers in my series, I am worried. In a bunch of 100 cases, nearly 80 are approved/in RFE. My case has fallen in the remaining 20. Not sure what is wrong with my case and why it is in the same status still.

      I got RFE last week, and i am required to give the client letter, 3 last SOW.,And contract.
      I just wanted to know that the PRD that i shared before the lottery had a section of onsite managers name, i stated that as suppose Mr.X
      Now when i have to share the end client letter as per the RFE, can i change the manager’s name?
      Will it effect? Or i should not change the manager’s name

        Well, personnel can change. So as long as the new person is the new point of contact or manager, you can use their name.

I got an RFE back in late July and besides of proving the specialty occupation they are asking how am I going to work if I’m a full time student (currently F1) obviously I am a full time student to be legal in the country and my plan was to get a H1B sponsor which I did, how am I going to reply to that, or should I say that now that I got a job I will be studying only part time, if anyone has heard or worked on this type of RFE I would really appreciate your response

    • Unlucky RFE,

      If the H-1 was applied w/ COS, then the expectation is that you will become full-time worker after its approval and no longer be the student. That looks like a rhetorical question, and I would defer to your attorney to provide the legal text to this.

    Greetings!!!

    I have few question, can anyone give me the answer of the below questions.

    1. I have to apply the H4 (dependent) visa of my wife, my son (6 Year old) and my daughter (8 months old). What will be the cost of H4 (dependent) visa? It’s mandatory to visit kids for h4 stamping.
    2. I don’t have marriage certificate but my wife’s name is added in my passport and my name is added in my wife’s passport. Still it is require marriage certificate for h4 visa.
    3. My all education certificates my name is Raj Kumar but at my experience letter and my passport my name is Raj Verma. But I have both passport with the name of Raj Kumar and Raj Verma. Recently, I changed my name. It might be any issue while I will be going H1B stamping. It’s mandatory for educational certificate.
    4. There is any online link to know the stamping date for H1B visa. So that I can idea that, what waiting is going on.
    5. I am living in Pune from last 4 years, I will go for stamping in Mumbai or I can go anywhere for H1B stamping

      1. Each dependents needs to pay his/her own H-4 visa fees. I think its around $190 and the Rupee equivalent would be available on US travel docs site. The kids are exempted from making personal appearance, and the parent can carry their documents.
      2. Should be fine if the names are mentioned in each others’ passports. Carry wedding card and wedding album as well. Maybe a family photo of all4 family members also.
      3. It should be ok. In DS-160 form there is a question asking if you have ever been known by any other names. There you can mention the old name.
      4. I don’t think they provide available dates without logging in to US travel docs site and trying to schedule the interview (but I maybe wrong as I haven’t used this in a while). Still typical wait time for H-1 and H-4 is 2-3 months these days.

        It was Regular Normal processing only, had to wait for a long time before it finally got approved.

        FYI : Case was received April 11th 2016
        Case approved August 12th 2016 (Normal Regular processing)

    I’m currently on l1b visa with exp date sep 2017(same exp for i94)
    My h1b is approved and I have the below questions
    1. How do I know if my case was filed as cos or cp
    2. My case is approved per USCIS website ( it does not tell me whether is cos or cp) does it mean its approved regardless of type( cos or cp)
    3.if its applied as cos I don’t have to go to India for stamping purpose- correct?
    4.if its applied as cp how long can I be in the USA without stamping considering the fact that my current i94 expires in sep 2017
    5.is it possible that employer had applied as cos but USCIS has denied the cos part only by approving h1b
    6.my preference is not to leave the us at this moment.. Are there any suggestions

      1. Look at H-1 approval document. If there is an attached I-94 at the bottom, then it COS
      2. Yes, approved regardless of the type
      3. Yes
      4. You can stay as long as your L-1 visa allows
      5. It is possible. But this usually happens when USCIS is not certain that you maintained legal status before COS was applied
      6. First see whether it is COS or CP, and we can then talk about options

As mentioned earlier my preference is to not to go to India for stamping now.. Can you please suggest what are the possibilities of me going to India just for stamping..         • L1B to h1b,

          If COS is approved, and you want to work on H-1, then no further action is required. You will be on H-1 from COS effective date.

          If COS is denied, and you want to work on H-1, then ask employer to file a separate COS for you (after correcting the reasons for which COS was denied).

    Filed H1B application from Consultancy this year and my application got picked in lottery and got the receipt number also. But case is not approved yet. So my current employer is planning to send me to US on B1 for current project requirements.

    Could you please suggest me shall i go ahead for B1 stamping before getting approval for H1B from USCIS?

    • Ask your employer the petition receipt number. You can track the status online. If your employer is a desi consultancy and it doesn’t share it, they may be playing games…

      Receipt is not mailed to you. Receipt is mailed to the company that filed petition for you. If you want to know your case # or have a copy of the receipt you need to call the company that filed your application.

    I am currently on H-4 and got picked up in the H-1 lottery and waiting for approval. My case is in “Case was received” status. Can I plan for a vacation to India and be back by mid September? What are the risks if I do so? Will USCIS abandon my petition in that case?

    • If you go to india and come back to usa , in your i 94 entry date will change , so i94 you submitted to uscis will mis match to your new one. So my suggestion is Dont go.

      may be uscis will abandon your petition . I heard from my employer they said surely uscis will abandon your petition. So unless it is emergency dont go .

        • It is okay. You can travel. If you re-enter in H4, you will get new i-94 and the i94 you get with h1b COS will get invalidated automatically. that doesn’t mean your h1b got invalid.

          If you are traveling to India, you can travel, but wait till your h1 approved, get it stamped and travel back to US in H1 itself.

    • It depends on whether you applied as change of status or counsellor notice. If cos, and you were in India on the day of approval, it might get abandoned and you will be in h4 and not able work. If it is cn, you will any way need h1b stamp to start your work.

  15. Got My approval notice however it says valid from 10/01/2016 – 09/30/2017. The stamping dates are only in the month of November. So what would be the visa dates in the passport?

    I have received RFE on employer employee relationship. My company plans to reply with the SOW of the client mentioned at initial petition that starts at 1st April 2016 and ends at Dec 31st 2016, Also Onsite Manager letter stating that I would be in direct employment with my company and not clients and that I can serve into multiple projects, Also the reasons why company enter into short term SOW which can be extended once the current one expires.

    Is this enough..what are my chances of H1B Visa Approval..???

    • IMO, If you give all necessary documents asked in RFE, you must be in good shape. The end date of petition will be based on LCA and client letter.

    Just wanted to let you know that my petition finally got approved.Non AD/RP CTS EAC1614855***. The wait since April is over at last. I came to onow of lottery selection from my employer on May 7.This was my third attempt.- Just Sharing this info if it cools down some of your nerves or if any cue u can take this.
    My heartfelt thanks to Saurabh, other admins and each member of the group. The information shared in this forum by everybody had really been very helpful, specially during tense times and wen u had questions abt the process or any issue on general regarding any aspect of the H1. Just scrolling thru the pages in itself gives u a lot of insight.

      • Nope it was not a transferred case. From Day1 the status was “Case Recieved”.
        Got the approval on Aug 14 by checking in with the receipt number in USCIS website.Have not recieved the approval copy. Normally it takes around a week to 10 days to come to your employer and then they notify you thru their internal mechanisms.

      You can take the print out of online 797 document and appear for the interview. Ask your employer if they plan to share the hard copy w/ you or not.

  19. Hello Saurabh,

    I recently attended the H1B visa interview. I work full time for a legitimate US consulting firm. The visa interview went well but the officer issued a yellow form 221g.

    The form does not have any boxes checked off. Do I just need to wait until further administration review is complete? Or am I supposed to submit the additional documents mentioned on the form? I am confused because none of the boxes are checked off.

Can anyone suggest if I can initiate H4 for my spouse who is currently working in a different organization in India, alongwith my H1b.Is it necessary for her to leave her job before the PAI or can she take a leave approval from her organization for the time she stays with me in US and go for the stamping.

      Yes you can initiate H4 for ur spouse along with ur H1. It is not necessary for her to quit the job, leave of approval is enough.

      Spouse can attend H-4 interview along with your H-1 interview. It is not required for her to resign from current job when appearing for H-4 interview. If the employer agrees, they can grant her long leave of absence while she is inside US on H-4.

    My H1B application is picked in lotttery and the status show case received.In mean time I was forced to change job from company X to Company Y in india.Will this act hampers my visa approval or rejection at the time of Visa interview.

    Can you guide me how to handle this situation.I applied through consultancy for H1B it’s not company sponsored.

    • Your indian employment has got nothing to do with the H1 as it was filed by third company.
      For the US visa interview officer, what matters is your employment with the visa sponsor and whether they have legitimate position open for you.

      In short: you’ll do just fine, relax.
