When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

  1. Hello Saurabh,

    I recently attended an H1B visa interview. I work full time for a legitimate US consulting firm. The visa interview went well but the officer issued a yellow form 221g.

    The form does not have any boxes checked off. Do I just need to wait until further administration review is complete? Or am I supposed to submit the additional documents mentioned on the form? I am confused because none of the boxes are checked off.

    Appreciate your help in advance.

      If no checkboxes are checked, then just wait for them to complete the processing. It is possible to issue 221g and not ask for additional documents.

    • Yes, you can go ahead and book it. Also please carry return ticket print with you for the visa interview. They will be glad to issue visa, based on return flight ticket.

    My receipt number looks different from all as per what I see here from different applicants. It starts with EAC16139XXXXX while rest off all have EAC1614XXXXXX series. However, I see the same status as everyone else waiting for their updates, saying the application received on April 11 as below. Is it possible that they may have numbered some receipts differently? Or could be something else?

    2014: Applied, missed lottery.
    2015: Applied, missed lottery, left US end of the year and started working from Europe office.
    2016: Applied, picked in the lottery.

    April 11, 2016: Petition received
    May 13, 2016: Approved
    June 02, 2016: Received documents from employer
    July 12, 2016: Visa interview (US embassy in Europe). Just basic questions. Got 221g and was asked to submit CV. I was expecting it as my masters major falls under TAL and I have been through 221g for F1 visa.
    August 10, 2016: Received passport with visa valid for 2 yrs, even though the petition was approved for 3.

    My last year petition is expiring by Sep 30, 2016. I got my visa stamped last week but the onsite openinig got closed and due to that will not be able to travel. In this scenario my visa and petition will expire next month. Will I have an option to extend the same in future? Or I need my company to extend the petition before it expires? Please suggest the option.

  11. By reviewing the few series on https://worktheme.com/tracker/ I can see that all of the 5 series being shown here have mostly everything in RECEIVED status or Transferred status. We are 2 months away from October and at this pace they will for sure not end. I guess the rest of the series look similar. So is there a due date to finish processing them all? I though it was October, but clearly that is not the due date or the progress would be much better.

    • As far as I know USCIS never committed to processing all the applications by October, there is no hard and fast deadline, although they process most of the applications by then. There are still some applications in processing from the last year, check the 2016 forums, of course this is because of multiple RFEs etc.

    • 99% of new applications will be responded with either approval or RFE by the end of September. If tracker automatically parses data from USCIS, there is no way to distinguish which I-129 petitions are for new H1B Cap 2017, hense there is no point looking at the numbers to see when it is going to end.

    • Unfortunately there is no deadline. There is no compulsion that all applications have to be completed by October. H1B and US visa is just “luck”. Chill.

    I saw few comments from CTS folks regarding the expired SOW. My case is same as well. The SOW attached during the filing process expired on March 31st 2016. But we have an extended SOW now until Dec 2018. In this case will i get a RFE??

      If incase you get RFE and if u submit the manager letter and the new 2018 SOW it will get approved without any issues. I don’t see any problem in your case.

  15. My case was received by USCIS in april (EAC16144*****)

    The file has not moved yet (no RFE/Approved as yet)

    The project end date mentioned in the Onsite Manager Letter is 12/31/2016. I had submitted this along with the initial set of documents for H1b filling before 8 months. Would this be an issue now? if so can it be corrected? Please help

    • Check the recent comments on this forum, cases similar to yours from CTS ran into RFEs, I am not saying same will happen with your case but, don’t have high hopes.

      On a side note, looks like CTS doesn’t have valid requirement after all. The MNC visa madness, uff

      • Actually when I submitted my documents last year the SOW was till dec 2016 but now it is extended and I can provide the end date as dec 2018 if it runs into RFE.

        But the problem is, the onsite letter that I had submitted in Dec last year for H1B filling has dec 2016 has project end date. so not sure what USCIS would do to this case. Any idea? thanks

    In my H1B application, the start date is mentioned as 1st Oct, 2016. But, I haven’t got the status change yet and looking at the appointments slots, I don’t think I will have my visa approved until Nov-Dec. So, is there any problem in visa interview if my interview is in Nov and VO asks the start date is already gone.

    I am currently working as a consultant to US based company. Another company has filed an application for me with start date as Oct 1st.

      The approved petition will have a validity period of 1-3 years. You can appear for stamping anytime during the validity period as long as you have valid job offer and supporting documents. It is NOT necessary to get the visa stamped prior to start date.

    I have got status changed in USCIS website, whereas I didn’t get any email as I have registered in USCIS with my case and have made email alerts Yes. This should be some technical glitch, has this happened to anyone else?

    • Even online status updates are not reliable. Last year my status did not change from “case was received” till December and finally got updated as” decesion was mailed” . The case was rejected saying my consultant had failed to revert to RFE.
      I was monitoring case status on daily basis and didn’t see RFE status even fr a single day.

      Can anyone on this forum suggest any alternative to keep ourselves updated.

    • its takes 3 months for RP to resolve rfe, in this time its USCIS wish they can give anytime.
      Is RFE a matter to worry? for this question they can simply decline your visa directly showing some security reason,
      this month i have seen directly rejected petitions almost 6 in this forum.
      RFE is a hell, i can say 99% visa denial chances 1% visa approval chances, thats the power of rfe.

    I have one doubt regarding DS160. does the client address mentioned in I-129 and DS160 need to match exactly?. though the city,state and the lane are same , building is different(just opposite)

      If you have not received the Receipt number in the HCM portal then do not keep any hope now.
      They are not going to share the Lottery Rejection letters.

      You can take actions on alternate plans. (Update resume on Naukri and Monster ;-))

  26. I am Happy to share that My Case was Approved yesterday.

    Thank you Saurabh and everyone contributing to this Blog. It helped me to understand lot of things and resolving all doubts related to H1. (As this is my First time for H1).

    For those who would like to know my Receipt# is EAC1614455***. Earlier status was “Case Transferred to Other office”

      • Hi CG folks,
        Can you please share the dates when RFE was sent, responses were made and time USCIS took to review and approve?
        I’m also in same boat – RFE was sent June4 and last date of response is Aug end. To the best of my knowledge CG has not yet uploaded the responses.

        It will help to understand how much processing time USCIS takes after the responses are uploaded.

          It’s not that every petition will go to RFE. Mine was directly approved. Couple of my teammebers petition is also directly approved.

          So I can’t comment on the time lines for RFE.

          Mine was Regular processing.

          Do you think Capgemini will spend that much money to file under PP?

          If that will happen then, to compensate they will remove Coffee vending machines; Like they stopped Biscuits in pantry to bring the Caffe coffe day Coffee vending machines and compensate increased cost from Normal company vending machines. 🙂

            I am from Capgemini Pune and completely agree with your comments. Only exceptions are GFM people, who have every facility on thr floor.
