When will the H1B visa 2017 season start ? Date ?
Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016. The H1B Visa 2016 season started on April 1st of 2015. Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year. As of now, below are the H1B cap number for fiscal year 2017. The below numbers are confirmed in press release by USCIS on Mar 16, 2016.
- Regular H1B Quota : 65,000
- H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
- Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.
There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000. No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa. Unlike, if you are coming from outside US, it can be tricky. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA. Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. Also, one key change is that, there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ?
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.
- H1B Cap to be increased from 65,000 to 110,000 per year. Also have provisions to have it up to 180,000 in case of extreme demand.
- Advanced degree from US cap quota to increase from 20,000 to 25,000
- The Filing fee for H1B could go up to 10,000 USD ( Part of this came up as the fee increase in Omnibus Bill )
- Additional H1B rules to avoid H1B Visa fraud by employers
- Mandatory LCA posting for 30 days before it is certified.
The current status on all of the above are basically “No updates”, there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.
What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS. It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016. But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th. USCIS may process the petitions early as well, but officially their clock starts on that day.

Has anybody received lottery status after June first week in TCS? FDFU people are saying that they didn’t receive any updates after that. Is it possible that people might get RFE/Approval notification directly without any selection notification? Were people got selected in the month of July/August, last year?
The visa department of TCS is the worst. I can guarantee… Its fuddu not FDFU.

It is ok if you are not currently employed in India at the time of interview. You would need an updated resume, experience letters, degrees, marksheets, approved 797, I-129 copy, passport, employer/client/project docs.

Oh, so this is for the old employers and not the current one. Yes, it should be fine to use that in lieu. If asked, tell the officer that the company is closed now. If you are still in touch with old supervisor or colleagues, then carry their contact information as well. Maybe get a letter on their personal stationary confirming that you were really employed with that employer. It is quite possible that officer may not ask for any of these, but its better to be prepared for the worst.

I have a question. I am currently on F1-OPT status that expires in Nov 2017. I just got news today that my h1b was approved. I’m assuming that the h1b will be valid from Oct 1st right? I am expecting a job offer from another company next week, will that company be able to transfer my h1 befor Oct and can i start working for them before Oct or will it have to wait till after October?

What do you mean along w/ H-1 in parallel? Are you asking if she can appear for H-4 at the same time you appear for your H-1 visa stamping? That is possible.

She can appear along w/ you for H-4 stamping, or can appear at a later time. Both options are available and possible.
At the time of interview, the passport should has expiration date at least 6 in future. There is no requirement that you should have stayed at the address mentioned in the passport for at least 6 months, if that’s what you are asking.

I haven’t followed the tracking order closely, but in previous year folks have reported that xx-142-xxxxx got processed prior to xx-143-xxxxx etc. However, I have seen exceptions to this rule. So it maybe a general guideline but not a hard processed rule.

Someone earlier said theirs got approved and the number was EAC16148**** and mine hasn’t been approved and is EAC16146***** so I don’t think they are going in order. Just in my personal opinion.

The passport needs to be valid for at least 6 months when appearing for visa interview. IMO, you should get the passport renewed first and then appear for stamping. Even if you get visa stamped in the old passport, you would be issued I-94 only until Apr 2017 and would still have to go through passport renewal and I-94 extension.

Find another employer, and ask them to file cap-exempt petition (aka H-1 transfer) for you. Once approved, go for stamping through new employer and then travel to US to work for them.

If H-1 is approved w/ COS, then you need to start working on H-1 from COS effective date (typically Oct 1 or later). If approved w/ consular processing then you can continue to work on L-1 even after H-1 start date has passed.
Loosing Visa Interview

What If in the worst case if we loose the visa interview after getting visa approved ? Will there be any change again or we need to apply again as a fresh candidate again for the next coming year ? Pls confirm
Worst case scenario,
After visa is denied, consulate will send the petition back to USCIS for reconsideration. If USCIS reinstates it, then you can appear for stamping again. If USCIS revokes the petition, then that’s the end of road and you have to try again in next cap. Before USCIS revokes it, you would still have option to apply for cap-exempt petition through another employer.

My cap exempted Petiton is approved and start date is 10 June,2016. There is no requirement in my project as of now and I do not expect to travel in 2016.

Hi , today I got mail from PMSD saying:
This is to inform you that we still await the lottery results on your H-1B application from United States Citizenship and Immigration Services (USCIS). We have neither received the acknowledgement receipt on acceptance of your application in the lottery, nor received the returned H1b application from USCIS confirming non-acceptance in the lottery. Hence, we will continue to wait until end of July 2016 for an update on the H-1b application lottery status.
don’t know what this means, do we really still have chance of selection?

or

Any one from TCSers got upadate of selection/rejection/RFE/approvals?? I know even if rejected it takes times to update in VTS.
You need to submit the education evaluation report for 3rd party in US. This should be done by your employer or you can get this in online.

I am not 100% sure, but may be a professor from a reputed university in your stream would qualify as an expert. Attorney should know better about who to contact.

Returned packages got from USCIS till date has been updated. Going forward updates would be done every friday US time.
Every Friday Only Rejections will be updated or Selections also will be updated?
There are no accepted cases after the first major lot released by GICS, All cases including the selected cases received till date have been updated. If any cases of selection are received even those will be updated every friday US time.
Then We can assume 99% rejections will come hereafter. 🙁

Infy Guys…Hope you are following GICS group on Yammer. It is clearly mentioned that whatever cases have been received till date are updated in the GICS. As per my communication with GI person, in the second list there was no selected case. They are yet to get further rejected cases.
On the question of whether you still have any chance of case selected. Then, the chances are very bleak. That means – 1/10000 that can happen if you are so lucky.
So, If you want to put papers then advice is go ahead. with a month time notice. You can always take back your resignation till last date.
Just FYI, My status is still in progress and putting my papers.

Yes, you need to go out of the country.
