When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

  1. Hi, I haven’t got any update from Accenture after 1st june where they mentioned “we await your lottery result , but no update from USCIS”. Is still chance there for selection or this is rejected finally?

    My cap exempted Petiton is approved and start date is 10 June,2016. There is no requirement in my project as of now and I do not expect to travel in 2016.

    Suppose I travel on 1 Jan,2017 . Now as maximum validity of H1B is 6 years.

    So, when will 6 years period will start? Will it be 10 June,2016 or 1 Jan,2017

      • INFY should update people immediately once they have the info that one got selected/rejected. Sending in batches (if true) does more harm than good. It prolongs the agony of waiting and it affects the productivity of people. Instead of moving on if one is not selected what we do is follow rumors here, some checks with GI staff thru mail or PM and some even log tickets just to check status. I really do not understand what is the point of releasing the results at once.

    Case Transfer to California Center: 20th May 2016
    Case Approved: 29th Jun 2016.

    • Yesterday I raised AHD with GI team and they said they have not received the 2nd batch yet from ONSITE Infosys office. There is no ETA for that 2nd list yes but still there is hope for getting selected As they said from 2nd list 90 % would be rejected ones and 10 % would be selected ones.

      Believe me this is what I got from GI team.

    • Yes you can travel on B1 to the US. however if your h1b is approved, is best to get your new h1b stamped and travel subsequently.

      Normally you can only have one status each time, however with Consulates do not cancel B1 visas while you go for new H1 Stamping.

      Same here i haven’t heard anything after 17th may.No selection notice, no new list,no rejection notice not even RFE/Approvals too. Worst thing is that they dont even share receipt number if gt selected. If they are holding it with them then there is a possibility that we will gt all the selected/not selected/rfe/approval at once nxt month.

  9. Hello Saurabh, thanks for responding to my previous query. I want to check that if I want to go back to F1 status (currently my STEM OPT is expired on May 30th 2016 and so is work authorization), what are my options? I hold a PhD degree so definitely another MS or PhD are not good options for me. Do certificate programs of 4-6 semesters qualify for F1? How about online programs? I have been in USA for about 6 years now, so GRE is expired. In case I plan to go for another MS (-____-) do I have to give GRE TOEFL again? Thank you.

    • Depends on the school you plan to enroll for further studies. There are certain schools that provide a GRE Waiver for students with better GPA in graduate school.

      Certificaion programs don’t hold good for a F1 Status. You can always pursue another masters program if interested, and will be eligible for student benefits to work/study and maintain your F1 Status.

  11. I guess its time to stop believing that my receipt notification will come. I have been following this site and checking my horoscope and tarot in so many sites for the past 2 months. I just want to get over with it and start acting on my plan B i.e going to a college here so as to atleast get a CPT.   12. Interesting question (perhaps). My H1 app for AD/RP/Vermont is picked. OPT expires Oct 31’16. My company did not sponsor my wife’s H4. I plan to do that on my own. When should I do it? Now? Wait for my approval?

    • Ajeeb_Dastaan,

      Usually employer files it along w/ original H-1 petition to avoid such scenarios. H-4 COS can now be applied after H-1 COS has been approved. I would suggest wait till mid-Aug to see if petition gets approved. If not, upgrade to PP, get the approval and file H-4 COS after that. On F-2, your wife can stay only until Oct 31, 2016.

My employer & client wants me to report to work in the US no later than 15th October 2016. Looking at the pace at which the applications are being processed I doubt I will be able to report to work by that date. Is it advisable to upgrade to Premium Processing at this stage. My application is pending for over 60 days from the receipt notice. Kindly advice.

    To file a cap-exempt petition for this unused, un-stamped and with the new employer condition. (With only the Receipt Number availability)
    Do we have any timeline period to which it should be done or it can be done in point of time.
    Above query is related to the followup of the below Questionnaire:

    I have my H1B case approved on January 21 2011 with my previous employer and now the Case has expired on August 2013. Please clarify my below doubts
    Is there any way to renew the Visa Approval with my receipt number and Travel with my current employer? Please let me know the procedure to do the same.
    Please note: till now i didn’t travel with the H1 Visa which i got approved.

    Your current employer can file a cap-exempt petition using the previous petition as reference. They would need copy of previous approval notice, or at least the receipt number for this. Once approved, appear for visa stamping and then travel to US to work for the new H-1 employer.

  18. I worked for an employer during my OPT, missed H1 lottery twice and left US end of last year. I have been working remotely as a consultant for this employer (but as an employee of a different company outside US) and now I am going back to the same employer in US on H1.

    My question is, do I need a new offer letter from my employer for the visa interview?. I only have payslips until I was in US and also have an old offer letter which I signed 3 yrs back at start of my employment. FYI, its clearly mentioned in the I-129 that I have worked for the US petitioner before, during OPT, and it also has my job description and salary details.

    • Well, in my opinion, until Congress passes a Legislation in this regards or there is an executive order directly from the President, this would be as a proposal in discussion. I have also heard of another proposal where they are working to double the count of H1 visas issued . not sure of anything till it is materialized.

    • I am working with tcs and i got a notification from my manager on may 19 that my name have been selected in the lottery.
      But i got no confirmation mail or no status have been shared regarding approved petition/RFE.

      did any one got any mail or status in tcs??

    I haven’t got any news on my H1b (neither receipt nor a rejection package). Is it a good idea to push my employer to raise a request with USCIS to know my status or still wait?
    What i meant is… can we still expect return packages or is it a good time to take it up with USCIS?

      Rejection packages are still being sent out. You should receive yours in next few weeks. There is no point following-up w/ USCIS yet on this.

    • I had raised a request with GICS to know my update. GICS team says that chances are very minimal now. But, wait till we get return check or receipt number for you. There is nothing like second list. The results are updated on case to case basis by onsite GICS team. I also haven’t received any update on my case yet.

  28. My H1B is approved in 2015 but as my company lost the project they did not send me for the stamping.

    My H1B petition Expiry Date is – 09/31/2017

    I am presently serving notice period and and my present Employer has said that they will cancel the petition. In that case, i will join my new employer with a UNUSED, UNSTAMPED AND CANCELLED PETITION.

    Will my new employer be able to Transfer the petition of file a new one under CAP EXEMPT????

    • You are cap exempt. You need to find an employer (consultant) to file for a cap exempt h1b petition (aka transfer) and search for job in US. Best of luck. Check with a imm attorney.

      Yes, you should be able to get cap-exempt petition in your case. If possible, keep at least copy of previous approval notice for future use.

    I was picked in lottery and preparing myself for further processes. For that I corrected address in my passport and including wife’s name (under process with PSK). I’ll be getting new passport in few days. Will that create any problem in further processes as in my petition, passport # would be different?

  30. Hello Saurabh, first of all I really want to thank you for taking out time and updating the details and patiently responding to queries. I have been following your blog from quite few months now and found it very useful and accurate. My petition (looks like since haven’t got officially the packet back) has not been selected for H1B this year. It was my last chance and OPT 17 month extension expired end of May. I am however still working for the employer as they have filed some document to have me employed until get the final rejection letter. I am looking for opportunities in Canada and have gotten a call for the on-site interview. My question is: Am I eligible to travel to Canada at this point and stage? Is it visitor visa that I need to apply for? How long does it take if I apply it soon and what documents to carry? Any precautions to take since I am technically out of status. Thanks a bunch.   31. Usually how much time does it take to change h1b petition status from “How much time does it take for status change of an H1b petition from “Case Was Transferred And A New Office Has Jurisdiction” to either RFE or approval?

    • USCIS does not process the applications from a particular Friends group at the same time. Your friends’ and your application are one among the 85000 petitions USCIS received, and they may be processed by any random officer at any random time.

    I have applied thru a consultancy in the US, in April they mailed me saying that my case got picked by the cheque encashment. This month when I asked for the receipt notice they are saying your case is not picked and have not received any notice from USCIS till date.
    Is there anyway I can reconfirm if the cheque got encashed or not?
    Or is it like the cheque got encashed but the receipt notice hasn’t received?

      You are dependent on your employer to provide the truthful information. If the check was really cashed, then you have made through the cap and employer should follow-up on the receipt number, if not already known. If no check was cashed, and employer was mistaken earlier (or lied), then you didn’t make through the lottery.

          Usually the receipt number is behind the cashed check. If the employer cannot access it then they should have followed-up w/ USCIS about the receipt number. If they are just sitting idle but stating that the check has been cashed, then something is not right.

  34. Hello Saurabh, first of all I really want to thank you for taking out time and updating the details and patiently responding to queries. I have been following your blog from quite few months now and found it very useful and accurate. My petition (looks like since haven’t got officially the packet back) has not been selected for H1B this year. It was my last chance and OPT 17 month extension expired end of May. I am however still working for the employer as they have filed some document to have me employed until get the final rejection letter. I am looking for opportunities in Canada and have gotten a call for the on-site interview. My question is: Am I eligible to travel to Canada at this point and stage? Is it visitor visa that I need to apply for? How long does it take if I apply it soon and what documents to carry? Any precautions to take since I am technically out of status. Thanks a bunch. Appreciate your response. Regards.

      If you leave US now, you may not be able to return as your OPT has expired. I don’t know what “steps” your employer has taken you grant you extended work employment, just make sure that your attorney has received it and has provided their blessings.

    I applied H1B Visa via Desi and recently update me that

    Your application got picked up and your uscis reference number is : EAC 16 XXX YYYZZZ(not exactly). When i check the status on line the status says that ”

    “On April 11, 2016, we received your Form I-129, Petition for a Non-immigrant Worker, Receipt Number EAC 16 XXX YYYZZZ, and sent you the receipt notice that describes how we will process your case. Please follow the instructions in the notice. If you do not receive your receipt notice by May 11, 2016, please call Customer Service at 1-800-375-5283. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.”

    When i checked recently with consultant, he says that “You have to wait till it gets approved.”

    Could some say approximately, How much time it takes to approve petition. AND is there any why i can see my details with uscis reference number.

    • @Rama Krishana, You are not alone. There are hundreds of people waiting for the update from USCIS, it may happen in any moment with no ETA. Register for auto email alert for your case and sit on your hands until you hear from them. Else upgrade to PP @ 1225 USD.
      You cannot see any details like the petition has been applied for Mr. Rama krishana from Bangaluru…so on so on….

    I know optimism should have it’s limits but we have to hope for the best till we see the rejection mail! It’s last week of June so maybe something happens in last week, miracles do happen!
