When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

USCIS announced on March 16th, 2016 that they will accept FY 2017 petitions from April 1st, 2016. Read Summary of USCIS press release FY 2017 .

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

  • April 12th, 2016 – 11:50 AM CST ( Unofficial Update ) : It is reported on blog by attorney ( immigrationgirl ) that they have received about 40 email receipts of Premium Processing.   1. Hello Saurabh,

    My petition was approved last week waiting for I797 copy to apply for the consulate interview. I have been checking earliest available dates which are only in September or October. Is there an option to pay for expedited process so that I can attend the interview in July or early August ? Please let me know.

      There is no way to expedite it. You have to keep checking the availability dates on us travel docs site.

      Some people have suggested to go to neighboring countries and attend stamping in Dubai or Colombo, but I don’t know of any experience to recommend or discourage this.

    I work for Infosys and have not got the lottery selection yet. I know there are lot people writing all kind of assumptions here. But the truth is neither Infosys nor USCIS will tell you anything unless you receive a selection or rejection email. But with your experience, we are running on 24th of June today, is their any hope what so ever to get selected in the lottery now?

    • I have been through this for few years now, and have been unlucky till now.
      But I still think there is a small % of receipts which are yet to be published.
      Also I want to add to the point that when we get so desperate for something our brain starts cooking up conspiracy theories like ‘attrition’ , ‘resource management’ etc etc… What I believe is the delay can be attributed to the fact
      1- Strike by CA USCIS employees
      2 -There was a network glitch while processing forms in VT, due to which load was moved to VT

      I may be wrong, but this is from what I have experienced.

      I read some where that, this year, US consulate in India approved like 80000 F1 visas for student visa… so get ready for more competition in coming years lottery…

      Now Britain exited EU and soon Trump may become US pres… so, good luck with that too…

      USCIS is not releasing any new receipts now. However, if employer is holding on to the receipts, then it is a different story and no one knows about it except for employer.

  4. Hi Saurabh,

    I need your expert advice on client letter for H1B Visa.

    I was working for some AA client and my H1B visa petition applied through AA client and Picked in the lottery.

    Last month I moved to some other BB client (I’m in same company -TechM) as AA client project was completed and this (BB) client is not US based.

    If I will get RFE and need to submit the Client Letter to USCIS then how we will get Client Letter?

    That time client letter was not submitted while petition filling.

    Can you please suggest? I’m looking your expert advice and help on this.

    • Same case.
      Can someone plz advise on this.

      I can share my seniors case in IBM.
      He got released from the project before approval. RFE came, demanding, contract info, client info etc.
      IBM refused to give client info, since he was no more in that project. And thus his case was rejected.

      Post approval you can change as many clients as u want. Before approval If you are released or the project gets over , than there will be issue.

      My project is getting over on july 31st, so I am also sailing in the same boat.

    • Even if BB is based in the US, if they are not based in the same location as AA – it may raise a flag. Generally it is better to stick to the same client as much as possible throughout the processing.

    • This should not be a problem as the H1b was filed for a position at onsite and not at offshore from where you got released.
      The MNC will provide you the documents required during RFE. Post approval you might need to go for amendment should you have to travel for different assignment.

      In IT service MNCs, this can be a normal scenario. Any experts or veterans, please comment.

      It is very difficult to change work location while the petition is pending. If RFE is issued and employer wants to submit new client information, it may be difficult to get approval. Change in location requires new LCA which cannot be applied while petition is pending. What client information was submitted in original petition – AA? Can you get another client at same location as AA?

          Amendment can be filed only against approved petitions. So its not applicable in this case and that’s why I said that it’s very difficult.

  6. People, who applied with H1B through several H1B sponsors, could you please share your experience how you did this? Did you find several employers to apply for H1B? In this case how could you accept several employment offers at the same time? Or did you apply through some consultancies, which provide services of submitting additional H1B applications with your money and how did you find them? Just want to understand how this works, because I applied 2 consecutive years with AD degree through 1 employer and did not get selected in H1B lottery….

    • Dude, you already have 2 times more chances than regulars.
      Sorry to hear that you’ve not been picked up yet.

      Multiple petitions mostly happen through constituencies but ready for loosing a lot of money.

      In last lucky draw, my friend’s friend had bad results even though he filed 3 petitions and on top of that chances of getting an RFE is high.

    Can you do a poll asking those who applied for H1B, how many applications from different sponsors they had in the pool? While I know that the probability of H1B getting picked rises if you have more applications in the pool, I also know that in reality luck plays a huge part in the lottery. So just out of curiosity I wanted to see how probability fares in reality?

    • According to probability, 4 to 5 is good to go. again luck plays high role.

      for example, if you file 4 petitions, there are 3 possibilities.
      1) all are picked up and you loose huge amount of money since no return policy

      2) none is picked up (luck is the king), a devastating situation plus loose money in terms of attorney fees

      3) just enough petitions are picked up. enough might be 2-3 chances of receiving an RFE is high. if its just one again risky to be approved since its from consultancy.

      In every case you need to be lucky.

      go with five if you only have disposable money.

    75% of the cases in my series got response much ahead of me..

    Approval comes on a random basis and I see the guys mostly Non AD RP with WAC1614751xxx get approved much before me.

    Need your help. I work with NTT DATA. The organization filed a petition against my name as a beneficiary with USCIS on April 6. The immigration cell of our Organization circulated an email that stated so. This is the second time, that my Visa has been filed. the one filed last year was rejected.
    @Saurabh – Please guide.
    Q . How do i make it sure that the organization did file my Visa. Just based on goodwill and trust?
    Q.There has been a list with few names which my manager didnt reveal. However, he said that USCIS has not updated the second list. What does he mean by this? Are there any second list of approved petitions.

    Please help.

      Yes, there is no way beneficiary can query this information from USCIS.

      USCIS does not provide such information, the only sources of the receipts are snail mail and email (email is for premium petitions only).

      1. If selected, receipt notice will be issued w/ your name. If not selected, rejection notice is issued w/ your name. These are the official confirmations.
      2. There is no second list from USCIS. They have sent out all selected notifications. If the employer is hoarding on to names, it is a company thing.

    USCIS received response from my lawyer : June 9th (Status updated)
    USCIS Approved my case : June 15th (Status updated on : June 16th)
    Today, I got physical H1B approval copy from my lawyer office! 🙂

      I have unstamped and approved H1B visa of 2008 (Was approved on July 17, 2008). I have receipt number of the same, but NO I797 document as that was filed by my employer. Can I get Cap exemption based on this visa?

      • Time is running out, you can still get cap exemption only 6 years past your approved petition start date (so you still have time to file a new petition until Oct 1st, 2016), be really quick here. It’s OK not to have i797, you will need to give employer’s attorney the receipt number and they need to specify it on the new petition alongside with the explanation why there is no other documents and with the proves of your communications with your original employer, like emails, offer, contract – as much as you can provide.

      • Till few months back i was under the same impression of 6 yrs period. but very recently 3 of my friends got approvals.
        case 1: stamped visa in 2008 but never been to US. his went on cap exemption and got approved. case2: stamped visa in 2004, lived about 1 year, returned back, last month applied again under cap exempt, got approved , again stamped. ready to leave.
        case3: approved in 2006, no visa stamped. this year applied cap exempt petion based on expired petition. got approved. he is in US now.
        by these, we not sure about 6 yrs period from petition date. all attorneys not having same info.

        Rule of thumb is 6 years from original approval date. So it would be 2014 in your case. However, recently I have seen cases when this 6 year rule wasn’t enforced. So USCIS may have relaxed it based on internal memo etc.

        The real challenge is convincing the employer/attorney to file the petition even after 6 year period has elapsed.

  15. Dear Friends,

    I received a decision letter from USCIS about my H1b today (Attn is our HR not lawyer), saying my case is denied because I departed US on April 19, 2016 and was not maintaining a nonimmigrant status at the time of filling the I-129 petition. I didn’t leave US on April 19 and I’m sure that’s a mistake because I’m in US all the time after Feb 2016. But when I check my travel history on I-94, there is a departure history on April 19 but there is no location on that. Very strange!! Our company lawyer said first time he saw this and don’t know what to do now.

    Anyone has any suggestions on that? I appreciate your time!!!

    • Did you any return ticket while coming to USA? Last year my friend’s travel history showed departure history but he didn’t travel on that date and he didn’t call that ticket.

      • I do have the return ticket to US on Feb 9th 2016, but no idea about April 19 2016 comes from. I didn’t book any tickets out of US after that. Now case get denied just because I94 travel history. Can not believe!

      So your I-94 history shows entry in Feb and departure in April 2016? Your attorney can argue that I-94 record is incorrect as you never left US. You can submit all pages of passport to show that there is no immigration stamp after Feb 2016 date. You can also submit other documents to show that you were indeed inside US after April 2016 like letter from employer/school etc.

      Even in case you didn’t maintain non-immigrant status and left US in April 2016, they should have just denied COS from F-1 to H-1 (I assume that’s what your current status is). They should still approve 797 w/ consular processing. What’s the status on your SEVIS record?

        Yes, my I94 shows I departed US on April 19 without location details. I entered US on Feb 8 on my F1OPT visa and never left US. My SEVIS still shows F1 gap-cap and COS pending, didn’t change. When I use my receipt number to check my H1b status online, it still shows On April 11, 2016, we received your Form I-129, Petition for a Nonimmigrant Worker……
        The deny letter directly send to my employer not my lawyer with very brief words saying “The petition requesting a change of status for the beneficiary is being denied for the following reason: *CFR, sec 248.1 (a), USCIS records indicate the the beneficiary depart US on April 19, 2016. Therefore, COS is being denied. This decision may not be appealed.” It didn’t say anything about my 797 approved w/ consular processing.

        • There you go. COS is denied, not your H1B. You will have to go out of country after Oct 1 and re-enter with stamped visa to begin your H1B status.

    • Checked with GI Team. They are not revealing any details about the second list. They just told that the last year trend used to be selected list coming once in week or once in two weeks and they were coming till July 2nd week. But since this time the list came in bulk, they do not have idea on will they be any second set of selected list. They also told , once if they start receiving rejection cases, then there is no chance of receiving selected list. This time the success rate was 35% for Infosys. This was also mentioned by them. They had initiated for around 12k employees.

    I am having B.tech + Diploma – Degree in CSE and Working in The Indian MNC with 3+ Years total IT experience. While applying for H1B our local team made a typo mistake with my Diploma Board name in my Resume they put the incorrect board name. And rest all my documents having correct Diploma Board Name.

    I have provided a copy of my all documents(that contain all Diploma Marksheets and Certificates) with the all correct details.

    May I know Can I correct it now, If not what could be the impact of it?
    Please help me in understanding the role of resume for H1B.

      I don’t think it will effect the outcome. In worst case scenario, USCIS will issue RFE asking for clarification and your attorney can explain the situation to them.

  23. A co-worker of mine filed through a consultancy and then he got receipt no back in the first week of May but nothing else. they are not sharing anything else and status says “Case was transferred… ” even though he was charged PP fee.

    So stay away from consultancies.

    How many more are cheated like this?

        There are a lot of ways to cheat and pocket all the money by just being genuine. if u do not know, i’m glad to write down how easily consultancies can make money without risking their lives.

            The receipt has Receipt Number, Case Type, Received Date, Priority Date, Petitioner, Notice Date and Beneficiary Details on Page 2. If you are such a F***ing genius, get a receipt first, then get a life and then ask others to get a life – buddy.

    • @ H1BRejectionNotice, Am sorry to hear that. Hope you should have other options to appeal against the decision/filing new petition for 2018 Cap. Is the petition got rejected in the first attempt itself or it went through RFE and then got rejected. In your perspective what would be the reason for rejection. If you can explain more about the case it should be helpful for 100’s of people who are waiting for the result.

    I received mail from employer saying “Your case was not picked this year”.

    When I asked for rejection letter, they said “Rejection letters are yet to be received by the lawyers”.

    How can I conclude this situation? Is the game over, or still keep some hopes?

    • I understand the emotions, its real I have received the confirmation yesterday. Even I was the one waiting for results eagerly till yesterday, I have sent an email to bangalore FDFU team after waiting these many days and got reply from them.

      Try by Sending mail to ur location FDFU, all the best.

    I am currently on H4 and have non – ad / RP petition for h1 that got selected in lottery.
    Due to family emergency I have to travel to India.
    Let me know how approval of h1 and COS will be impacted.
    As per my understanding there will be no problem with h1 approval but COS will be considered to be abandoned. I will be able to travel to USA on h4 before Oct or can get h1 stamped and then return only after approval.

      You are correct about H-1 and COS. You will have two options:
      1. Return on stamped H-1 visa around Oct 1 or later
      2. Return on H-4 visa and file COS from H-4 to H-1. Cannot work on H-1 until COS has been approved.
