When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

  • April 12th, 2016 – 11:50 AM CST ( Unofficial Update ) : It is reported on blog by attorney ( immigrationgirl ) that they have received about 40 email receipts of Premium Processing.   1. INFOSYS Guys……Believe me.. 🙂

    Do not loose hopes….Today our manager went to GICS dept and asked for an update for all our team mates for whom H1B was applied. Initially they were not saying anything but after giving some Project requirement, like in case some one is not got selected in H1B lottery they would be initiating L1 immediately because of onsite requirement for project delivery. 🙂 Finally they said some good news …They are holding total 650 Selected petitions receipt with them and would be updating in coming days. As Our manager was in hurry ..he did manged to check the status for all our guys with the help of employee numbers…. 🙂

    So request you all to please keep waiting…. You never know if you are part of that 650 selected ones…..

    Note : This is not any rumor…I am telling you truth..Believe me..

    I wish you all very Best luck….for sure there would be some good news for the ones who all are there in 650 🙂

        In first slot none of your team mates got the update ? we are also in the same boat our manager initiated for 6 and none of us got the update in 1st slot.

          Yes..Whatever I mentioned above is ture…
          The reason for holding confirmations with employer is unknown to us…But there are many factors behind that…If you see the old comments by Admin “Saurabh” he also mentioned many times that Big Giants like TCS and INFY keeps the confirmation on hold with them and disclose in the form of batches…..
          If you have time..please go through the last year forum h1b-visa-2016 and check the comments from Infosys guys..many of them received their confirmation on 30th June and first week of july… …as per past trend…Infosys really discloses some selected petitions along with rejected ones. …Thats why everybody talking about second list. 🙂

          Second list is always from Employer and not from USCIS…

          • I start thinking that big companies like Infosys withholding some selected petitions from beneficiaries because they just didn’t expect such high number of selection. An the end it is really hard to plan when you deal with lottery, and I think that’s how they deal with it – just cut some people from the deserved petitions.

      • When it was checked to them…They just said that we would be announcing 650 selected ones along with rejected ones…so they are waiting for more rejected mails to be received …so that the GICS update activity would be done altogether for all remaining petitions. Though they didn’t tell any specific date..the way they were talking ..hopefully it would be released by last week of this month…

        BTW..I am from Pune – CISRUN

          Did they tell your manager in person they will update selected ones along with rejected petitions.. Don’t bluff ok. I can understand them withholding some petitions but not statements like update and bla blah.

  2. guys is it possible that USCIS does a second lottery and that’s why some people get their receipt notice in June or early july sometimes? This is my last chance for H1B. My OPT expires this year and I don’t want to go back to India 🙁
    My life depends on this. Don’t know what i will do with my life in India. It’s so bad there.

    • I heard, DHS has extended OPT Stem period from 17 moths to 24 months, effective from 10th May.. I guess , dat might give you some peace..

    Good Morning.
    Non-AD/RP/WAC XX XXX XXXXX
    Currently my husband is in India and his H1B got selected in lottery. We are now applying for Premium Processing to know his application status ASAP.
    His H4 stamping is already done and he is planning to travel as my dependent due to personal reasons, after his H1 approval.
    My question here is after H1B got approved if he travel on H4 does his approved H1B will have any problem or no. Can we apply for COS from H4 to H1 after October and can start working after COS gets approval or any hidden problems will arise if he travel on H4 after his H1B got approved.

    I don’t have clear knowledge on COS process, I read few blogs but cases are varying, hence wanted to check with you.

    • Good Morning Veena,

      He can appear for H-4 stamping even though he has H-1 approved. He can then travel on H-4, and file COS from H-4 to H-1 later. There are no additional problems related to this and should be simple. When applying for COS, your husband can decide to move to current H-1 employer or a different employer (in which case it would be H-1 transfer + COS).

    My petition Non-AD/RP was picked in the lottery but an RFE was issued. Below is the case status on the USCIS websire

    Request for Additional Evidence Was Mailed
    On May 14, 2016, we mailed a request for additional evidence for your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number WAC*********. The request for evidence explains what we need from you. We will not take action on your case until we receive the evidence or the deadline to submit it expires. Please follow the instructions in the request for evidence.

    The additional evidence required is regarding the company’s business and clients. My company’s lawyer will submit all the required documents by this Friday.

    How long does USCIS usually take to approve/reject such cases ?

    I got selected in H1B lottery in non AD/RP/CA. But it is not yet approved. Also my project is over in my company. So need to search for a new project.I have few questions-

    1) I am BE in ECE branch. I heard non-computer science background will get an RFE. Is it true?
    2) After the approval is done, how long can we have a cap-exempt H1 without stamping?
    3) If i find a new project which is for a different location in US, what are the formalities needs to be taken care?
    4) After the approval, can i search for oppurtunities in US for my job profile for stamping or need to stick with same employer.

    • 1) If your documents were not clear any one get an RFE , i know some CSE guys who got RFE
      3) Your Company will take care
      4) That depends on your interest

      1. Not always. RFE is issued if USCIS isn’t sure that you qualify for the offered position based on your education and work experience.
      2. The petition itself will have a validity period of 3 years (or less), but a cap-exempt petition can be applied in future during next 6 years. You can go for stamping anytime while the petition is still valid.
      3. A new LCA needs to be applied followed by H-1 amendment.
      4. You can approach other employer, who can file cap-exempt petition (aka H-1 transfer) for you. Once approved, you can work for them in US.

  6. Mine case has been selected in H1B. Now I am in Belgium for 1 year project assignment.
    Could you please help me to answer following questions ?
    Q1 . Can I do stamping from Belgium, once petition has received ?
    Q2. Can I fly from Belgium to USA, OR do i need to take flight from INDIA only.

    Is there any update on second list of h1b lottery result in TCS?
    I have heard that each company have their own quota within 65000 h1b overall quota. If this is the case than I think all the tcs applicant will be selected as TCS applied only for few.
    Any update on TCS h1b 2017 status will be highly appreciated.

      US doesn’t provide any company specific quota for H1B. I dont know from where you heard that each company have their own quota within 65000 for H1B. If you have any links to prove that then please provide me so that next year whichever company has maximum quota, i will apply through that…:)

    I am on F-1 Optional Practical Training (OPT) and currently working for company A. Company A file the H1b and got approved. I have a offer from company B.

    Can i transfer my H1 and join company B before oct1?

    • Do you invested on yourself or employer does , how do you take the decision until you are part/working for the company, ?? you can move if company B already filled and approved your h1b. >>>>>>>>>>>>>>meanwhile work for company A, or take risk 2 percent chances are there.

      I have seen mixed reviews/option on this. Some say it is possible, while others don’t. Discuss the case w/ B’s attorney and get their opinion. If they are willing to file, then let them do so. However, don’t leave A until your H-1 w/ B is approved; so that you have at least 1 concrete H-1 job opportunity in hand.

          You need to have H-1B approved through B in order to work for them in US. If you have have that approval, then yes you can travel and work for B.

    I’m from IGATE, still did not get any updates as my application got picked in lottery or not but many of my colleagues/friends in IGATE got updates. Is still there any hopes/chances to get positive result? or only rejection cases are yet to come?

      USCIS is issuing only rejection notices now. However, some employers like TCS, Infy hold on to receipt notices and inform in batches. So if your employer is one of those firms, then there is still hope if they are holding on to the selection results.

    • Only rejection cases are yet to come. I believe they would’ve updated the comment at least if not the status of VRF. More than a month back sent the confirmation mail to the resources whose H1B got pickedup in the lottery.

    My employer asks me to wait till they get updates from USCIS. They also say nothing is confirmed still you get the update. Are there chances to get selected still or it is a false hope given?

  13. I was told by my employer that my H1B petition[ Non AD/RP] got picked up in the lottery. However they refused to share my receipt number and conveyed they would share it only during September once my case gets approved.Is there a way to know my status/get my receipt number?

  14. Infy folks still waiting for H1b lottery results, just called GI team and they mentioned that 2nd list will be updated on July 1st. They will update the selected cases in the 2nd list. Rejection list will be updated later.

    • I think they are just throwing ballpark dates here. when I called sometime back, they 1st said it will be released on 06/08 and when I called on 06/08, they said it will be on 06/10.. Just dragging.. helpdesk info cannot be trusted.

That is the same kind off update they gave me too. first said June 8th. later when i called they said they are yet to get update from USCIS. next day when i called they said today morning only we got update. 2nd batch results has come and US onsite team is collating details and results will be rolled out on June 10th confirmed. Now after June 10th when i called back they are saying they dint get any update at all (totally misleading)

    • Guys, Please stop bluffing around here. GI doesn’t pick calls at all. Even if they pick they will tell that they haven’t received our results yet. They doesn’t tell anything about the dates. You cannot get any information from GI. And if you raise an AHD the automated same reply will appear which says that “We are still yet to receive your status from USICS”. So please don’t post this kind of replies and make people wait. There will be only rejection list coming up. There is nothing called as second list.

    I have a H1b petition approved from 2006, but when i attended for the interview the visa officer issued 221g. Now I am in USA on H4 visa, is there any possibility that I use the 2006 petition and apply for COS?

      There have been recent experiences shared where the person was able to use such old petitions to apply for cap-exempt petition. So worth a try if the employer agrees.

    Currently I am on L1 Visa in USA. My H1 got picked in lottery. So hopefully it gets approved and i will get COS(L1 to H1) from 01-Oct-2016.

    Here comes the issue. I haven’t verified interview dates before and sent my family to India. I was expecting them to go for L2 stamping and come back by end of July. But, unfortunately, they got appointment for Sep 27th.

    Now, my concern, should they come on L2 or H4? If H4, can i somehow utilize that date for H4 stamping rather than L2?

      If you will be on H-1 from Oct 1 (assuming it gets approved w/ COS), there is no point for them to return on L-2. They should appear for H-4 stamping instead, but they your petition should be approved by that time. The same date cannot be rescheduled for different visa category. They have to complete another DS-160 form(s) definitely. Maybe they can call consulate help desk after that and see if the same date and fees can be repurposed.

      They aren’t eligible for dropbox?

        Thanks for your feedback. They are not eligible for Dropbox. My L1 visa was expired on Mar-2015. They say that, it should be lessthan one year for dropbox eligible.

        Suresh, don’t worry, since you are from US, just show some attitude in the flight so that folks would realize that you are from US. Once you land do the same till you come back from India, try to buy mineral water and use some accent dude, if you aren’t married, take a pic in front of your car and ur home to show a good potential for ur bride 🙂

        Jokes apart, B1 already in Visa, its not good, there may be questions since your intent has already been flagged in the minds of the Visa Offier, however its a 50 50% chance, you should get it man, chill.

      Having B-1 approved doesn’t impact much. I know of cases where B-1 was approved but H-1 ran into background issues. The main checks for H-1 is your profile, your employer’s profile and offered job position – most of which is not covered by your B-1.

        Does it mean – applying H-1b and B1/B2 simultaneously is there any problem?

        I had some bad experience in this regard, and would like to share:

        I applied for h-1b 2016, and received receipt number on June 1st 2016 saying I am one of the fortunate to get picked in lottery. I felt excited and happy.

        In June 2016, due to some urgent requirement/KT, my employer proposed to apply for B1/B2 for a short visit.

        I double checked with management will there be any issue to my H-1b if I apply for B1/B2 in parallel. I got answer not at all and go ahead.

        By mid of June B1/B2 interview is cleared, and visa ready by end of June. I collected my passport on July 1st.

        On the same day – I received mail from employer with attached H-1b rejection letter, saying my petition is not picked in lottery. [stamped on June 28]

        It was a shocking news for me. After checking with employer, got answer that – it was clerical error from attorney/lawyer, and apologizes for the same.

        It was really surprise to me and not sure what went in background.

        Applying more that one visa is now allowed at same time frame?

          What I mean to say is that just b/c one has B-1 doesn’t mean H-1 stamping would be a cake-walk. It could still run into issues. So having previously approved B-1 doesn’t give much additional advantage.

          Applying B-1 didn’t cause your H-1 petition to be not selected. People can always have multiple visas in their passport, but they can have only 1 visa status after entering US – it would be based on the visa they use to enter US.

    i am Non AD/CA/PP and still my attorney didn’t receive any updates from USCIS. Neither selection in lottery nor rejection notice. Any idea, by when i can hear something back from USCIC? I know selection chances are not there anymore but still if i get the confirmation from attorney, i would start working on my plan B

      • I received mail from employer saying “Your case was not picked this year”.

        When I asked for rejection letter, they said “Rejection letters are yet to be received by the lawyers”.

        How can I conclude this situation? Is the game over, or still keep some hopes?

    • USCIS is still contemplating what to do with your petition
      They find it hard to say Yes/No
      To show your pro activity you may directly approach USCIS with a 500 words essay titled “mujh main hai dum,loonga H1”
      It may bring them out of their dilemma

      Majority would know by Oct, but some may face longer delays. If RFE is issued, then those cases will get delayed as well.

    I have my H1B case approved on January 21 2011 with my previous employer and now the Case has expired on August 2013. Please clarify my below doubts

    Is there any way to renew the Visa Approval with my receipt number and Travel with my current employer? Please let me know the procedure to do the same.

      Your current employer can file a cap-exempt petition using the previous petition as reference. They would need copy of previous approval notice, or at least the receipt number for this. Once approved, appear for visa stamping and then travel to US to work for the new H-1 employer.

      Attorneys have started reported receiving rejection packages today. So you may receive closure in next few weeks. If you haven’t heard anything until now, most likely you would receive the rejection package soon.

      1. You should track the date availability online on ustraveldocs site. I think it currently shows appointments for Aug.
      2. The entire process is on untraveldocs site. There are experiences shared on redbus as well (you can search for them). At a high level you need to complete DS-160 form, pay the fees, schedule the interview, go for biometrics and appear for in-person interview.
      3. Yes, you have to pay the fees. Last I checked, it was $190.00.

  31. Hi all, I was approved for my H1b visa and need now to update my I 9 form, as I was present and working in the US for the last year on OPT. What expiration date would I write down on the new I 9 form? The expiration date of my new I 20 with cap gap, which would be 9/30/2016 or the expiration date from my I 797A approval?

    • i believe your new expiration date is the latest one which you might have received in your i797A along with attached i94 at bottom. You can show that document as a proof anywhere its needed.

      The petition is of no use to you until it gets approved. If the employer withdraws a pending petition (b/c you left them or any other reason), then it is as good as petition has never been applied. Once approved, your future employer can use it as reference to file their own cap-exempt petition.

    My petition is selected in lottery, but I have a problem in my passport. My Mother’s name is missing in it, and my father’s name is printed twice instead. Will this call for an RFE?

    • i am curious to know since you were planning for H1B, why didn’t you take necessary steps to correct your passport first?

      I don’t think this will result in RFE. However, you may want to get the passport fixed before appearing for H-1 interview. Name issue won’t impact the H-1 stamping as well, but in long term if you are planning to get passport fixed, it is better to do that before the stamping.

  35. Infoscians – who are still waiting for good news :

    We all know that chances of getting selected are very less now…almost negligible BUT still we should hope for better….Check last year forum “h1b-visa-2016”
    Some of the INFY guys had received confirmation about selection on 30th June and 6th July.
    Though the headcounts were very less……
    We never no ..who has good luck… ? so be patient and wait until final update..
