When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

  • April 12th, 2016 – 11:50 AM CST ( Unofficial Update ) : It is reported on blog by attorney ( immigrationgirl ) that they have received about 40 email receipts of Premium Processing.     Any update from TCS Chennai ? As of now, I received two mails (list) from FDFU saying ‘Awaiting Lottery results’. Only two got selected from my account till now.
    Has TCS started sending Rejection Notice.

    I remember, one of my friend got selected in the fifth list last year.

      ”On checking with US onsite team, it was informed that we may not receive further case updates”

  2. Hi Saurabh, I’d appreciate if you can reply this.
    I got my H1B visa in 2013. My company applied to my visa extension in May this year. The checks were cashed on 5/31/2016.

    My status expires on 7/12/2016 (the date my old passport expires, I got a new passport while in the US). My I-797C form expires on 9/8/2016.

    If I don’t receive anything from USCIS until the date I need to leave the country, what should I do? Go to another visa interview with my original I-797C and get a visa from July until September? Then go back to my country and get another visa?

    Also, when my company applies for an H1B extension, do I get another case number? or is it the sam EAC13145*****?

    • I got the new receipt number from the back of the check: EAC16173XXXXX. USCIS site shows the status as “case was received”.

      What does the 173 means? I thought that was the day of the year but that would be 6/21/2016, an my case was received on 5/18/2016.

      As long as extension was filed prior to I-94 expiration date (which is true in your case), you can continue to stay and work in US. You can do so for up to 240 days or H-1 denial date, whichever is earlier.

      To know the corresponding date for “173”, you should count only working days from Oct 1.

        I actually need to go to my home country to several reasons now: (1) see my family; (2) need time off and (3) already bought the tickets.

        Should I be concerned to show up for the interview with my old receipt number while my new one is being processed? What if my new receipt number is approved by I’m outside the country and don’t have the I-797C form with me?

          It may be a good idea to upgrade your petition to PP. This way:

          1. If you have to appear for H-1 stamping (you will be eligible for dropbox), you can submit new petition and get visa stamp for the extended period.
          2. You can return on date beyond current 797 expiration date.
          3. You don’t have any further action required if you want to return prior to current 797 expiration date. If extension is still pending and you return on old petition, you would receive I-94 based until current 797 expiration date. So a new extension would have to be filed.

          When do you plan to return to US and what’s your home country?

        I have to go to my home country now because I already bought the tickets and I need to see my family? Should I go for a visa interview with my old I-797C? What if while I’m in my home country the new receipt get approved?

            I would suggest upgrading your petition to PP, and then continue w/ your travel. Hopefully your petition would be approved in time and there is no RFE. You can then appear for stamping in Brazil and return to US on the new visa stamp and petition and work for the employer.

            Does that make sense?

  3. The lawyer told me today that my check wasn’t cashed yet (non-AD/PP) does it mean I didn’t get selected?

    He also said I can continue working on Cap-Gap (my opt ends on June 23rd) till they hear anything back because so far they didn’t receive anything about my case.

    I thought you can only use cap-gap if you got selected in the lottery and your case is in process..Can I still work even though I didn’t get any receipt?

    • GM Confirmed that they are waiting for Rejection packages! No receipt are expected further. You may get your rejected packages from July Month. Move On!!

      Last i heard back from GIMS was on 3rd June with their generic mail. But on 25th May GIMS folks said they were waiting for onsite team for confirmation and were awaiting for second batch results.
      Will suggest to have faith till you get the confirmed Rejected in Lottery mail.

  4. Got mail from my employer with receipt number today. Hr said that they didn’t get receipt copy and wac number they got from cheque’s back side when it got encashed last week. This seems strange that cheque encashment took so long. This was my third attempt.

          Then that sounds really surprising to me. The check being cashed so late. Almost about 3 weeks after the data entry was done. Gotta keep my fingers crossed for some more time!! 🙂 🙂

        I am also in similar situation, my cheque en-cashed in April, but not yet received receipt notice. I got following receipt number from back side of the cheque.
        WAC1614XXXXXX
        When I checked through online status,it is saying that “On April 11, 2016, we received your Form I-129, Petition for a Nonimmigrant Worker, Receipt Numbe XXXXX,and sent you the receipt notice that describes how we will process your case. Please follow the instructions in the notice”.
        What does it mean , do you have any idea ?

          Maybe employer/attorney has received the receipt notice but hasn’t shared it w/ you. In any case, you have the receipt number, so even if you don’t receive the receipt notice you can still track your status online. You would still need receipt notice if you have doubts that the receipt number doesn’t belong to you.

        My employer said that my cheque got encashed but till now hasn’t shared the receipt number. Kept on asking him but no reply. Last week he replied that he would send the receipt the next day and no reply since then.

            I assume you are the same person who mentioned earlier about employer informing about check getting recently cashed. Looks like you have the receipt number. Can you share what’s the current status online. 143 looks like it was generated before data entry completion announcement.

          • Thanks Avi. So it was still something that was issued in time prior to data entry completion date, but was just delayed due to some reason.

          The receipt number should be at the back of the cashed check. The employer can access it online in his bank account. If the employer is not providing any meaningful update, then he may just be buying time and making excuses. Not judging, but did you pay for H-1? If yes, employer may be giving false hopes in order to not return the money.

  5. There are no more updates coming in for Infy. All the accepted ones are sent out already as of yesterday. Wait till July end to see that your case is rejected in lottery.
    Just spoke to my friend in GI team and received this information.

    I got picked in Lottery process this year, I have few queries.

    1) My wife and kid don’t have passport.
    2) Now I am planning to apply for them

    is it mandatory to update my passport with spouse details or else is enough if my wife passport has my name.

    Please suggest.

      Its highly recommended to update your passport as well with your spouse details to avoid any barriers may come in future. Since you are applying new passports for your family, you also should update your as well along with their passport. I am sure this is not gonna take much time.

    My petition got picked in lottery and waiting for the approval.
    My Passport will expire in August 2017. I am not in India now, working in Mexico.

    Please suggest me when should i renew my passport.

    will it affect my Visa Approval or Stamping ?

    My h1b validity is only for two years. Is it a thing to worry about? Can extension be applied multiple times(more than two times?) if the total is less than 6 years?Is any one else also in a similar situation with validity less than 3 years?

      No worries. Extensions can be filed as many times as one wants, until the person has stayed for 6 years inside US on H-1. After that extensions are dependent upon a pending green card application.

    My petition got picked in lottery and my passport will expires in another 18 months of time.

    a)Whether visa Will be provided based on my passport expiry date?

    b) whether I can renewal my passport in a month of time and if I do is there any issue in h1b processing?

    When is the right time to renew my passport in my case.

      1. Visa would be issued based on petition validity period and not impacted by passport expiration date, unless passport expires in next 6 months
      2. You can apply for passport renewal now and get the extended expiration date. it doesn’t impact the pending petition.

  10. Hi Saurabh,
    I have a question regarding H1 Stamping. I am currently in US working on L1 visa from Company A and my H1 got approved with COS from same company A.

    I am planning to visit India end of July because of a family reason, in the same trip I am planning to get stamping done. I have heard that they will cancel my existing L1 visa, Is it true ??

    I am still working in US and need to come back join office, can’t wait till October.

    Any help on this will be appreciated.

      It would be officer’s discretion whether to leave L-1 stamp intact or cancel it. You should skip H-1 stamping, and return on L-1 visa stamp. Your COS would still go into effect as long as you return to US prior to Oct 1 and will start working on H-1 from Oct 1.

HCL _Noida – I have been informed by my department that my case is selected in lottery. and USCIS will validate my documents and provide the decision on H-1B during the month of September 2016 (Whether approved or denied). Once case is approved, they will be provided receipt number for further processing.

    • Yea, there will be a lot of people supporting their case, saying that they paid the processing fee to get H1 done because of security reasons, because that it the way it is, or because of the competition and all that. If they go to the States and something like this happens with their consultancy, that is when they realize that they screwed up.

  13. Final Verdict – USCIS has finished sending accepted petitions in bulk.

    However, in the past, they have surprised the companies with sending few accepted files till October.

    No one can tell if you will get selected. Keep hopes alive until you get the rejection email.

      • Never believe TCS as far as recruitment is concern….They just do show case in media that they are recruiting the guys……Myself has gone 5 face to face interview round at TCS pune ….Got selected in every round like Technical…Manager..Hr etc… Inspite they didn’t offer me. Kept me on on hold for almost 5 months giving some reason..like we have no vacancy now..it was there in last quarter….now we will get in touch with you in next quarter…worst experience with TCS pune……HR peoples at TCS pune are just useless…I have wasted my 4 days to visit TCS campus for F2F interview. ….

          • Hey Shubhchintak…What is wrong if he said the fact about TCS….Even I am in the same boat and there are many more in the market like us…TCS keeps playing with candidates and their emotions….HR peoples calls the guys to make their quota of getting interviewed peoples..and when salary expectations are high then they keeps on hold for long….In simple word ..Agar TCS ki aukat nahi hoti candidates ki expectation full fill karne ki to ..Z…d marne ke liye bulate hai wo logo ko interveiw ke liye….???

I work for an MNC company, applied with 3 employers, got picked up with consultancy, leaving job and want to work for shi… consult… I don’t have any option, I have to go to us ..with..consult.. had applied for two clients, with second …one got picked up.. I don’t have option, instead go out and do ………..banggggggggggggggg

    this year it seems USCIS random generated process/SO called lottery has been done differently ,
    I am getting news where the Indian companies like TCS/CTS/Infy people got selecttion count is less in comparison to the US MNC.

    may be this is the result of the last year investigation that was done by USCIS to these employers ,they didn’t find any fault but they modified the codes to the lottery system appropriately .

    even i got the news that there are US MNC employers ,i mean small houses which have filed 2/3 petitions and got selected this year

    any pointers /news discussion ==open house 🙂

    • Anything can be possible. can rig or do anything after all its their system. i do not think we hold any right to blame them.

      As far as i know multiple petitions from diff employees of course got bad results too.

      Since my US MNC does not file for h1b, Have to find a position at another US MNC from now on.

    • Don’t know if it’s related but my lawyer just told me that:
      “About a week ago there was a lawsuit filed against the USCIS about this random lottery selection and only time will tell what happens with this.”

    • Thats not true. I’m from Accenture and i can tell the count is less here as well. By the way CTS is not indian company.

    • U may be correct…For Infy the initial estimate given was 3000 petitions approved…if that’s the final count, then it’s way too less considering the volume of applications made…

      • But this has been the trend for the last three years, Top recruiters from India like TCS, Infy and Wipro are given 3000 H1B every year and that’s what has already happened this year as well. Per GICS, they have received 3000 receipts and have updated all of them in the portal. So, I don’t think the number of receipts are any less this year.

          • Yes, most likely all the positive cases (with receipt #) have been updated. People in this forum have conveyed that this news is provided to them by GICS insider. But they are still saying, to wait, wait and wait. I don’t know, but most probably they are yet to receive the rejections which they will update after July 1st. This year’s process has been entirely different from last year coz, last year people were receiving receipt notices in batches that were weeks apart. But this year, every single receipt was updated on 05/18 and nothing after that.

  19. Hi Guys,
    I have been working on learning the pattern in which Vermont Petitions are getting approved. Hope it might be helpful in coming up with approx weeks it will take for approval of your respective files. On weekly basis around 450 files are getting decisions on an average. Currently the series that is in process of getting approved is EAC16138***** series. In each series there are around 4500 files. The latest that got approved is “EAC1613851054”. So you can calculate how much time it will take for your file to get a decision.

    Note: This is just my observation and I have been trying to get an approx number. Exceptions will always be there. So please don’t blame me in case it goes wrong.

      • If that is the case. it will take 630 days to get updates on your case. (147-138 = 9, 9* 4500 = 40500, 40500 / 450 = 90 weeks. 90 * 7 = 630 days.). Not realistic isnt?

    • Not sure about your algorithm but last year my consulting company’s petitions were updated in a single day with different series numbers like 15138, 15143, 15147 etc. I believe they dont update based on series numbers. more over series numbers contains H1, L1 and cap except H1 too.. Anyway you did an interesting analysis.

      Does your analysis is only applicable for cases filed under premium processing ?
      in terms of getting approved.. I have filed my case under regular processing and my receipt num. fall under the same series. So far i still see my case has been received status only.

    • Sorry guys, I guess I failed in getting the algo right.. 🙁 Looks like Premium approvals are still going on and there is no progress on Non-Premium file till now. Thanks for you queries, it helped me understanding the situation better.

    • First time I saw such a comment.

      If I were you, I would not spend my time on trying luck with receipt number, imagine if you have 85k/year * 6, the chance of getting a cap exempt receipt number is not low, not to mention whether it’s PP/RP. And btw why is there such thing as approval algo?

      TL;DR; this is for entertainment. In short, you can’t build an algo for human job LOL

      If I need to investigate an algo, I would rather go for a prediction algo to predict whether an application outcome would most likely be RFE or Approved instead.

      So for your starter, I would pick a fairly simple algo such as Naive Bayes to train on a very basic model. How would I consider the model? Well, let’s consider race, age, gender, company tier, PhD/Master/Bachelor, university tier (any ranking), degree type, salary, job title, in US or not, and so on. If the admins here are willing to share/collect such data and tracker works properly, by training on the propabilities of each and every single application in the past, the chance to predict an outcome of the application could reach as high as 80%. Then you can iterate on the model to find your optimal value. I guess this makes more sense. But well, who would be free to do that? My appologies if you don’t get my sense

    Kindly help me with following question:

    1. As I read in the above updates, on May 6th, USCIS has sent the receipts for selected cases. Does that mean, if we haven’t received any update from the employer yet, my case is not selected?
    2. This is my 2nd time in H1B. My employer is Infosys. Every one say different things. Some say that now there will not be any +ve cases received, some say we will receive cases till end of June. What is the probability of receiving positive result now?
    Does USCIS send the results in lots, as claimed by my employer? Kindly help!

    • I have the same questions, Richa. I checked with Tasha(the Infy GI team in US) and she said there is still hope.

      But nothing is for sure, I think Infosys has only received one slot till now and should receive more in the next days.

      1. There is a good chance that you didn’t make through the lottery. As you working for an Indian MNC, there is also a possibility that they are holding on to receipts and not notifying everyone. You will have to confirm w/ your employer if that is the case.
      2. From USCIS perspective, they have sent out all the notices. It is up to employer when to share it w/ employees.
