When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

  • April 12th, 2016 – 11:50 AM CST ( Unofficial Update ) : It is reported on blog by attorney ( immigrationgirl ) that they have received about 40 email receipts of Premium Processing.     • The VRF website was updated on 21st may and Many people i know received a confirmation mail on 25th may . Have you checked with the immigration team on this ? Am not from the same department but i know people from other department who had received the updates in the same timeline.

        • The immigration team has directly sent mail to the people who had got selected . Mangers have no inside view to the H1b results . It was done the same way last year as well when the results were published online in june 2nd week . good luck.

  2. I have got an update fro Accenture PMSD, stating below –

    “This is to inform you that we await the lottery results on your H-1B application from United States Citizenship and Immigration Services (USCIS). We have neither received the acknowledgement receipt on acceptance of your application in the lottery, nor received the returned H1b application from USCIS confirming non-acceptance in the lottery. Hence, we will have to wait until end of June 2016 for an update on the H-1b application lottery status”

    Anyone from Accenture received any other update ?

    • I got the exact same mail. 99% it means our application is rejected, since Accenture is yet to receive the rejection package. If we were selected, Accenture must have got receipt by now. What’s your plan ‘B’ now? 🙂

    hi even i have applied for h1b . my case was filed on last moment on April 7 but still I didn’t received anything my law firm says we have not received anything yet we r still waiting . is that only on my case or some more people are sailing in the same boat .the draw has been declared on 16th of may y is that taking so much time I am worried for myself . weather my file has been selected or or not . is that usual time they are taking or should I assume that my file has not been selected . or my file has been that is y its lot of time . please advice me ,should I keep my fingers crossed.

      You have the wrong dates.

      The application needs to be filed by 1st April. Filing it in the last moment April 7th sounds a bit fishy. USCIS reached its cap on 7th April and the window was closed. So if you applied through a consultancy by paying money, and they told you that they filed it on 7th April, then most likely you are being pushed around.

      The draw happened on 11th April, not May 16th. If you went through a consultancy and if they told you that the draw was on May 16th, then it is a sure shot that they are playing you. Or if you yourself picked up that date from somewhere, it is wrong.

      If you didn’t hear anything about your application, there are minute to no chances of getting a positive response. Although I believe it was not even filed in the first place.

  5. I am a first time applicant and got selected in lottery. Can someone tell me:

    1. By when do we receive the visa approval?
    2. What are the chances of not getting approval even after getting picked up in lottery.

    Mine is first time, RP, single application through a consultancy in Seattle.

      1. RP, there is no set time window for approvals. But you can expect it any time in the next couple of months.
      2. If you have a project, and the client letter is solid, and the if the consultancy has not had any previous black marks, you should not have to worry about the approval. If there is a glitch in any of the above, you will most likely get an RFE. Then it will be up to the consultancy’s law firm to send proper detailed documentation. But as long as the consultancy’s project and client letter are genuine, you should not be worrying.

    I have received the receipt no from Vermont Service Centre on 22nd April and was shared by my employer Cognizant the next day.

    After that there is no update and whenever i check on uscis, it states as below.

    Can you please suggest for how long I need to wait for further updates. Mine was a “regular” filling process.

    On April 11, 2016, we received your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number EACXXXXXXXXXX, and sent you the receipt notice that describes how we will process your case. Please follow the instructions in the notice. If you do not receive your receipt notice by May 11, 2016, please call Customer Service at 1-800-375-5283. If you move, go to www.uscis.gov/addresschange to give us your new mailing address

  7. My Consultant just told me to be done with the lottery. There is no chance no more. Thank you all for the inputs! All the very best for the people who got the receipts and those who dint don’t give up better luck next time. We will have to wait another year for the frenzy! 😀

  8. No hopes for those who haven’t received the receipt so far? Asking because the company rarely miss a visa but this year they didn’t receive for any of the eleven petitions they applied for. It’s a small company. If anyone has received the receipt recently please share because it’s gonna help with my plan B

    • Small company, big company, last year Visa count, this year Visa count – all these factors are mutually exclusive. None of them are dependant on the other. If you haven’t heard of a receipt in your case till now, you should know that there are very little to no chances of hearing it. So you should start planning your “B”. If there is a miracle waiting, you will surely be notified.

    Anyone has got the update post to the first set of results or everyone is on same page? I am not sure how long they will keep us waiting. GI insiders are not disclosing any news. They could just say if we can still hope for any good news or there is no hope.

    My case status didn’t change till date , mine was AD/PP. Now my employer checked with USCIS and got response that case has been administratively closed. Does this mean a denial ? I didn’t even get a RFE.

    • Hi Sai, i’m also from CTS but still no response from GM team and they are saying we need to wait up to June end..but not sure whether we can take it postitive or negative response..Lets hope for the best.

  12. Hi all!

    I got selected in the lottery and saw online that my case was approved. However, I emailed my law firm (Fragomen) because I haven’t heard from them since the lottery notification and they said they are going to email me next steps once they received the approval in the mail. When does this usually happen?

    My OPT expire Jul 5th (this year), does anyone know what I would need to do to continue working till my h1b gets effective October, 1st?

    • You are in Cap=Gap if you see your H1B is approved in USCIS website. What does it mean – it means you do not have to do anything else now. You are automatically considered to have a work authorization which is post OPT and pre H1B (famously called Cap-Gap). Remember you are under cap-gap till Sep 30 as your H1B kicks in on Oct 1.

    • No Its over this year. Wait for rejection letter in end of June till Mid July.
      If I remember correctly, last year it was May 6-8 when the last set of receipts rolled over.

    My OPT STEM expires this year: July 20th 2016

    1] Can I still apply for OPT STEM extension based on new rule ?
    2] Even though it wouldn’t extend up-to Next year April H1B season. Would it still fetch me time.

    Could you please provide me with some advise. I haven’t received any updates from my lawyer nor HR nor DSO based on my H1B lottery so far. I have another month and a half. Please do advise if I am eligible to extend my OPT for another 7 months based on the new rule.

    • Your question has the answer in itself. They start coming in from June. But you might have to wait till August. They start processing applications one after another and since these are RP, they might not be very quick in getting them applications processed.

    I am in below situation now, It would be great help if you can suggest me best path,

    Company A processed H1B and it got picked in lottery, Waiting for petition approval., Company B processing L1A for me.

    Request you to answer below questions,
    1) Is it fine to process both petitions parallel, Then can able to choose one(either h1/l1)
    2) Should I need to withdraw my h1b, If I need to go with L1
    3) Which is the best option cooperatively h1b/l1a

    • Hi Visa Aspirant,

      It doesn’t matter if you apply for both H1 and L1 simultaneously. However if you travel on L1 before your H1 gets approved, you H1 will be cancelled automatically (CWP (Cancelled without prejudice))

          Chances of getting rejected in L1 is more than H1.
          L1 is bound to the same company, you can change the job once you in the US. H1 has flexibility to change your job if needed.
          Whichever you opt, once approved the other one will automatically be rejected.

    • Visa Aspirant,

      1. Yes, both can happen in parallel. Let’s say you have L-1 or H-1 visa stamped in the passport, and then appear for the other visa category stamping. At this time, officer has the option to cancel the other older visa stamp w/o prejudice. It is NOT automatic, but the officer has to specifically do that.

      2. No need to withdraw anything

      3. H-1 is preferred as it provides more freedom to change jobs, better pays, H-1 extensions beyond 6th year for some etc

      I was in USA from Feb 2013 to January 2016 on L1b visa and return india after L1 extension denied. My company filed H1b in April 2016 and my application has been picked in lottery in May 2016. I have couple of questions.
      1. My L1b extension denied will not create any problem?
      2. Assuming my H1b approved, If i travel after January 2017, will i get the full term of 6 years on H1b or my previous 3 years of L1b will be counted?
      3. Also i checked my travel history on US customs and border protection site and i see they have my arrival date only updated, no Exit date? any idea why and how i can get it updated?

      I would appreciate your response on my queries.

      • 2. You have to be physically out of US territory for a year and that resets your counter i.e. if you travel in Feb 17, you will get total duration of H1

        2) U will get only 3 years 1 month. To get full term u need to apply H1 in 2017 (April 2017) or apply L1 after Feb 2017. U need to apply only after physically being out of the country for 1 year.
        3) u will have port of entry stamps in you passport stamped in India. U need to provide those copies as proof when required.

          I agree w/ IBMBuddy’s response. The H-1 clock is not reset as your H-1 was applied and approved before you stayed outside US for more than 1 year.

        I am also in the similar condition. When i checked with my company, they told me that we’ll get 6 years if we stay outside of USA for 1 year. Also i’ve seen one of my friends with the same scenario and recently his H1 extension got approved also. Below link also has some promising information about the same and it’s USCIS link.   22. Post stamping, if I wish to change my company would my H1 be still valid ?
    I am from IBM and I have heard that IBM can create some issues in this. But i doubt what can a company do in this case once your petition is approved and stamped. ?

    • A company can do anything after the petition is approved and stamped. If it chooses to revoke your H1, you do not have a valid VISA to enter the States and if you are in the States, you are bound to exit the country. So even if you have plans of shifting the company, don’t let them know yet. You need to ask the new company you are thinking of shifting to, to file a H1 transfer on your behalf and you need to wait until it gets approved. You might think that H1 is dependant on the person holding it but no, your H1b will be valid only if there is a sponsoring company attached to it – always. You lose your job, or if your company revokes the H1, your status would not be valid.

    I have following question. I went to Sweden last year for one month on work permit. When I submitted my details to my employer for H1B visa I have sent the passport with balnk page by mistake (Passport details sent before Sweden travel) .

    Note: Since it was work permit for Sweden there no stamping on passport. only arravial and departure informtion avialable on passport.

    Will it be any issue during visa interview?

  24. Anyone got written communication from HCL team about H1b, any news when they will notify, as managers are not willing to tell anything about this……

        • Look, I don’t know who told u this but a GI Senior Lead has said on yammer chances are ‘very bleak’… Even more important, on this very page only someone claiming to be GI Insider is saying ‘we do not expect more receipts’…I think it’s time to lose hope and move on 🙂 If u get ur receipt even after this, then it’d be a pleasant surprise rather than more and more disappointment…

          • If that guy was transparent enough he would have declared the number of receipts they received. He can never be trusted.

  25. Hi Saurabh,

    With you experience in previous cycles, please suggest when AD/RP should expect H-1B approval notice. I understand, it can span through Sep-end, but which month, most of the approvals come through.

      RP should start seeing movement on their applications in June and most of them would be processed by Oct.

    • I don’t know what’s more funny – that you said Hi Gays, or that you passed through interviews and got an offer with this level of English. But it’s not an insult, you have another year to learn the language so that when your application is picked up next year, you also get visa without problems. Good luck!
