When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

  1. Hi Saurabh,

    I had applied for H1B visa through a company based of Illinois.
    But till now my employer has not got lottery selection/rejection notice.

    I am currently having L1B visa and would be travelling to US in the month of July.
    I am willing to take my spouse with me for this travel period.
    I want to know the process of applying/getting L2 Visa for my spouse and what would be fees.
    I tried searching this on Google but no luck.
    It would be great if you can help me on this.

    • I would say its foolish to get h1b if your spouse have plans to work in USA since H4 EAD will take min of 4 years once you land in USA.
      L2 EAD will cost around 500 $$$ and you can file on your own or with help of attorney. Its like green card no min wage or location restriction. If your are lucky get L1A and apply GC in EB1 Current and you can get GC within 6 months.. That’s the advantage with MNCs

    I got offer from CTS and need to join within 3 months, also my H1 in initiated. I have not got confirmation till now neither I got rejection notice from infy.
    Q1- If I resign now will infy let me know my visa status, if selected in coming month, if at all any new list is published?

    • Hi,
      As soon as you put down your paper, there could be 2 things, either they will withdraw your visa request as soon as you put down your papers or they will ask you to pay the visa fee which they have spent in case if your visa has been selected. However i don’t believe they will do the latter. This is just my opinion.

    • Put down your paper, your managers and HRs will start oiling ur ass so that you stay. Wait for 3 months, if your case made through lottery, cancel your esap and stay otherwise join cts.

    • It’s a risk….If you have good relations with your Manager and you think he will reduce your Notice Period, then you can wait 🙂 Personally if I wanted to take up the new job I would not wait, as I have a very low opinion on human (esp. Infy manager & DM’s ) nature….. 😛

    On 20th May, I got 3 emails stating my petition was transferred. No updates after that….

    • no update.Did u receive status update mail last week? “Dear Employee, Greetings from GIMS..! H1B lottery: The USCIS has completed the computerized random lottery selection process of H1B CAP applications. Next Steps This is in continuation of our earlier communication on your H1B Cap application. We have not received any update on your application. USCIS will start returning the applications which was not selected in the lottery starting from June onwards. We shall update you once we hear from USCIS. Status Updates As and when, we receive intimation from the USCIS on the acceptance or non acceptance of your application we would let you know. If you do not hear from us, it is because we have not heard back from USCIS on your application. Please be rest assured that we shall keep you posted as soon as we receive further information on your application from USCIS. Service requests As we would be intimating you on the status of your application the moment we hear back from USCIS, raising service tickets and/or calling the support center or any other person in GIMS, they will not be able to give you any additional information as we have not heard back on your application from the USCIS.”

        • Very less.Whoever got the above status update mail will be in rejection list.They have received selection update last Thursday according to my PM.By 1st week of June they will give bulk update which includes selection/rejection.

          • Well, ACN doesn’t files its applications directly to USICS.
            ACN contacts and pays fees to Fragomen to avail the immigration services .

            So, Fragomen receives the directly from USICS and sends it to ACN.
            So it can be so that Fragomen sends it on weekly basis to ACN or maybe all at once to 2-3 batches. No sure way to know that.

    I have a question. My OPT is expiring on 1st June and I have not received any receipt or rejection. According to the law I have read that there is an automatic CAP GAP extension till your petition is rejected. Can I work at my company till I get a rejection or do I have to stop working on June 1st? My DSO is not willing to give me an extension on I-20 till I get a rejection. Has anyone gone through this before?

      AFAIK, Cap Gap is granted if your petition has been selected in the lottery. Unless you get the notification that the petition has been selected, DSO won’t be able to grant the extension.

      What you may be referring to is rejection after selection in the lottery. For example, you are selected in the lottery => automatic cap-gap => petition denied => cap-gap ends. However, the pre-req is getting through the lottery.

      Unfortunately, you will have to stop working once OPT expires; unless you are eligible for OPT extension. You would then have 60 day grace period to leave US, or move to another visa status or enroll in another school.

  7. Don’t know what happens with my petition.
    I’ve been selected in the lottery under Regular, then employer transferred the case to Premium.
    16 days from status changing to “Case Was Received and A Receipt Notice Was Emailed” has past and no update so far.

    How is it possible?

      If it has been more than 15 calendar days since USCIS acknowledged upgrade to PP, employer/attorney should contact USCIS and follow-up.

  9. A ticket raised in CTS GSD Immigration team mentioned, that they have received last set of receipts. They confirmed if you do not get a confirmation by June 1st, then its over.

    • Is this true? I didn’t get same update when I called GSD. They said that at times we might get receipts little late and told me to wait for two more weeks but admitted that chances are very very slim.

            Actually when using acronyms and abbreviations, sound decides whether it would be “a” or “an” and not the spelling.

            MNC sounds like “am an cee” and so it would be “an MNC”

          • @Saurabh I don’t think issue is about “an” vs “a” here, you generally can only use definite article “the” with proper names, which are already specified by definition, and MNC is a proper name, there is no more than one “MNC” out there, therefore “an MNC” (as well as “a MNC”) does not make sense.

      3. You filed your H-1B petition with a postmark date of Dec. 18, 2015 or later (or if you sent it by courier services, the courier picked up your H-1B packet on Dec. 18, 2015, or later); and

      4. You filed an H-1B petition to:
      i. Seek initial H-1B non-immigrant status for a foreign national, or
      ii. Obtain authorization for an H-1B worker to change employers.

      You do NOT need to pay the additional fee for:

      • H-1B extension requests filed by the same petitioner for the same employee,
      • H-1B amended petitions, or
      • Petitions based on other employment-based visa categories (such as H-1B1, H-2A, H-2B, etc.).

    My employer informed me on April 22nd that my application is picked in lottery and awaiting receipt. Till now no information on the receipt number.
    I want to know without notice number or cheque encashed info how one can say that your application is picked in the lottery.

  12. Got selected in H1B this year. Now I have a question. I have a 8 months old baby who is not included in my dependent list as he wasn’t born at the time 2 yrs back when my petition was made. I want to know how do I add him now.

    • You can ask your employer or attorney for this. There is a way after adding your spouse or kids as your dependent once your H1 B gets approved. Your kids would be eligible for H4 based on your H1 approved application.

      Why was the petition made 2 years ago? Do you mean to say employer used a petition using data from 2 years ago instead of relying on you to provide most up to date date? Doesn’t speak very highly of the employer.

      Anyways, once petition is approved, your kid can get H-4 visa stamped. No additional step required at the moment. Whenever you appear for H-1 visa stamp, spouse and children can appear for H-4 dependent visa.

    • HCL – I have got verbal confirmation from my DU head that may name is in the list. They have received first list in which there are 217 names and as per him I am the only one who is selected. Can’t believe….

    Is EAC16148XXXXX a valid receipt number i.e. H1B non cap exempt one, by looking at the number 148 in receipt number.

      I can’t tell whether it is valid or not b/c some of the digits are masked. What’s the online status for this receipt?

        My question was is number 148 from receipt number EAC16148XXXXX is a valid number as I heard from blog that this number corresponds to the day when receipt is generated . So for FY 2016 it is number of days from Oct 1 2015.

        Valid in the sense does it falls in the range when lottery happened.

        • here is rough calculation. starts from oct 15. we should see no # working days excluding holidays.
          Oct 15 – 22 days
          Nov 15 – 21 days
          Dec 15 – 21 days
          Jan 16 – 21
          Feb 16 – 21
          Mar 16- 23
          Apr 16 – 21
          With this ,138 comes on Apr 11th.

            But lottery was conducted on April 9 and in my receipt notice Case received date is April 11 and Recipt Notice date is Apr 27,

            The receipt number may be perfectly valid. Do you have concerns that the receipt number doesn’t belong to you? Did the employer share 797C copy?

            I do have receipt copy I797C with my name on it, which employee shared with me. I just wanted to decode what does number 148 exactly signifies. Nothing that important but just out of curiosity….

      Looks like the mail was undelivered. Ask your employer to contact USCIS and confirm that they have the correct address on file. Once that is corrected, they can send the document again.

    Please respond, my H1B got picked in lottery and I am waiting for the approval, I did it through some consultancy outside, mine is NONAD/RP.
    Now the manager in my present company told me that they are gonna process L1B for me for an opportunity in the company. I can’t reveal about my H1 to them as I did it from outside.
    Please suggest me whether filing L1B also while H1B is in process will impact my H1B in any manner or they are two different things.

    Please respond, I should convey the message to them ASAP.

      L-1B and H-1B can process in parallel. One doesn’t impact the other. If you have need to travel on L-1, then go ahead and do that.

      Things could get tricky when you already have one of the two stamped in the passport and go for the stamping for the other. At that time, they may cancel the previous visa stamp (it is officer’s discretion).

      • I guess when H1B gets approved, L1B status is lost automatically on October 1st and he needs to immediately join his H1 employer on October 1.

          Not always. As I understood from his/her post, the person was outside US when H-1 was applied, and so it is consular processing not COS. Even if s/he enters US on L-1 and H-1 gets approved, status would remain L-1 and not change to H-1 until separate COS to H-1 is approved or s/he enters on stamped H-1.

          Had the person been inside US on L-1 and H-1 is applied and approved w/ COS, then what you are saying goes into effect.

          Makes sense?

    • Yes, you can check in the Documents section in Visa Details on GICS portal. They have uploaded the receipt notice.

        • If your visa record status has changed to “PetitionStatus”, you should be able to find the receipt in Documents section.

          My record’s status was changed on 25th and on the same day the receipt was made available.

      With all due respect, it is YOU who is misleading the folks here. All the mentioned receipts have receiving date of May xx. Cap-subject petitions should have a filing date of April 11 when the lottery was conducted.

      They entered information of all 236K petitions in their db when the lottery was conducted. Data entry completion notice was sent w.r.t. receipt generation.

      Tell me, how did you conclude that this is a cap-subject petition?

          How would I know how Infy handles there batch notifications. I can tell only what USCIS does and there is no second batch being issued. If Infy is holding off on notifying folks, then it is their company policy and not known to people outside the company.

          There are only 2 processing centers – VT and CA. The petitions that were selected in the lottery, have a receipt date of April 11 or something similar.

          I can’t help it if you want to live in a pipe dream and want to believe otherwise. You can continue to wait for your rejection notice. But do NOT pick random numbers and post them here and say that they are cap-subject petitions.

          I have nothing more to add.

            These are not random picked ,These receipts all are from my employer from Boston.
            And mentioned Premium Process receipt numbers are converted from Regular Processing as well
            They confirmed one check got cashed on 24th May 16

            Then your employer is playing games w/ you. If you paid money to him for H-1B filing and asking for regular updates, he is just skirting the question by sending you random numbers.

            Assuming your employer is telling the truth (which I doubt), he is saying that he received 5 new receipts in last 3 days; out of which 2 are PP.

            Doesn’t it raise red flags to you about the sample size. There are hundreds of folks on this forum who haven’t updated new receipt numbers in last several days and your employer is showing a huge success of 5 new receipts.

            Ask him to send you one of the 797 copies for these receipts. He can use white ink to remove the employee’s name and maintain privacy; but still keep receipt number and employer’s name. This will show that the receipt really belongs to your employer or not.

            Up to you who to trust.

            If its latter, then its better that I respond to him (even if his comments are w/o logic) or else his employer will continue to play w/ and make use of his ignorance.

      As per my last three years experience, i never seen people receiving receipts excepts some MNC’s those will hold receipt to control attrition (or whtvr the reasons). Moreover these MNC’s receipt update is completely irreverent to USCIS’s timeline info.
      So Plz stop misleading ppls…
      By the way, you can carry on with your false information analysis and keep on waiting for receipt…

        Last year -Data Entry was completed on May 4th and I know that some people received receipts in June.
        How can that be explained ?

        If it happened last year; it could probably happen this year too …

          There could be few reasons for this delay like employer held on to receipts until they start seeing rejection notices, the receipts are delayed in postal mail or marked as undelivered etc.

          Anyone still waiting for receipts now is grasping at straws. Anyone receiving receipts now is an exception not the rule.

          My opinion about the original post of this conversation still stands – those receipts are cap-exempt and the employer is making a fool out of the employee.

      • May Be we should not jump to calling him ignorant. The H1B program is very complicated. For people like you and me who have done it for few years, it is easy to know the rules. But if some one is applying from a different country, through a shady consultancy and paying them money for H1B, it is very difficult for them. These shady consultancies keep on telling them lies and if that is your only source of information, then you believe whatever they say.

        In any case, I think he is just naive about the process rather than being ignorant.

          To clarify, I didn’t mean ignorant in any demeaning way. I meant ignorant about H-1 rules, which even I was when I started my H-1 journey.

          Here is the thing. Today, we are in a world where anything and everything can be found on the web. If someone decides to dive into H-1 w/o doing any research and paying money upfront, then s/he is a fool. I have seen lot of people asking questions on the blog to know what the rules are, so that they can make the right choice with their money and career.

          However, even after being told that the cases are cap-exempt, if someone comes back w/ more case numbers and announces that I am passing out false information to others, he should be called out. I didn’t call him stupid or idiot or troll b/c I felt for him when he told me that his source of information is his employer.

          That is why I took the time and effort in explaining him how things work and making him aware about the things he doesn’t know. To me that is ignorance, but definitely not in a condescending way.

    My status shows as “Case Approved”. At present I am in India. Can I attend the VISA Interview now and Travel with H1? (My present status is OPT with expiry date of Jan 4th 2017)

      USCIS is yet to declare date from which they will start the visa appointments.Even if you complete the interview your visa will start only from 1st october.

      But your case clearly shows that Premium processing is over and now AD Regular Processing will start. This will be followed by NON-AD Regular processing.

        • From the above case it looks like it has started now. Infy has provided August deadline for petition to approve. Now all we can do is sit tight and relax. No perfect timeline as to whose application will processed first.
          All lottery selected candidate can enjoy some VIP treatment till then. 🙂

  20. OMG! Game is over.My employer called me and said lottery results are out and sent to all. he is just waiting for my rejection letters. 3rd time in a row, gone, time, money. This time i applied through my company and from outside, both the places i lost. I work in infy and my HR told me all the results are out and informed to candidates already rest just waiting for the official rejections confirmation before updating the candidates final status. Any one from infy?heard about this? My manager also said the same to me who is close to me. Thank you for all your support guys take care

    • But G1 team is saying second batch of result surely come in dat either select or reject result will come out. #hopes alive. Every second person of infy is giving postive or neg info. Just wait nd watch atleast first week of june.

      • GI team has holding 20% of selected petition and it will be updated along with rejection list in coming batches just to avoid attrition.

        Everyone knows here that paying for H1 is illegal, but understand the fact dude that there is nothing called free lunch here in India, dont know where are you from.
        Unless you are working in a big MNC where they file H1B free of charge….that too if you have good relation with your Manager…

        If you want to apply from consultancy, obviously they will charge some amount, which they wont say H1B fees, rather they say it as a security deposit so that in case after getting selected, you wont go to US then their hugely invested amount will be wasted…..

        Hope you understood the ground reality as why consultancy charges….
        At the end, its your wish if you want to apply from consultancy or not as they are not forcing you to apply any give money….
        I am not promoting any consultancy here, just showing you correct picture….
        Everything is done by H1B candidate/aspirant wish…..

  21. This was my second time. I spent a lot of money in a master degree. Entered in OPT. Then j1. After 3 years I have only two options to invest money or to enroll again to university and spend again money. I do not reccomend to anyone to come to the US to study with the purpose to get h1b visa. Stay away from US. I lost 3 years of my life.

    Please please please respond o my query. My employer told me 20 days back that my cheque has been encashed (they got info). But still now, they are saying that no confirmation yet. Please, let me know whether I can trust this. Is there still time to wait Non-AD RP , after encashing cheque.

      Ask employer if they can see the receipt number behind the cashed check’s copy. They should then contact USCIS and follow-up on the receipt notice and/or receipt number.
