When will the H1B visa 2017 season start ? Date ?
Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016. The H1B Visa 2016 season started on April 1st of 2015. Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year. As of now, below are the H1B cap number for fiscal year 2017. The below numbers are confirmed in press release by USCIS on Mar 16, 2016.
- Regular H1B Quota : 65,000
- H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
- Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.
There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000. No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA. Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. Also, one key change is that, there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ?
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.
- H1B Cap to be increased from 65,000 to 110,000 per year. Also have provisions to have it up to 180,000 in case of extreme demand.
- Advanced degree from US cap quota to increase from 20,000 to 25,000
- The Filing fee for H1B could go up to 10,000 USD ( Part of this came up as the fee increase in Omnibus Bill )
- Additional H1B rules to avoid H1B Visa fraud by employers
- Mandatory LCA posting for 30 days before it is certified.
The current status on all of the above are basically “No updates”, there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.
What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS. It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016. But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th. USCIS may process the petitions early as well, but officially their clock starts on that day.

My attorney has received an email that my petition has been approved and there is an attached I 797 C document where they have mentioned my start date and up to which date it would be valid. Its 3 years of window between those dates. As of now i am on EAD which is valid up to Oct 2, 2016. My H1 visa would start from Oct 1, 2016. I am bit lucky in this case that i don’t need to take a break for a single day from my job which is going on right now.
I thought I would get I 94 in the email but its I 797 C which i have received. What is the difference between these two?
Currently my I 94 shows Oct 2, 2016 as an end date, when i can see the new end date here?

Your attorney should soon receive approval notice in mail. It would be 797A which would have an I-94 attached at the bottom. This I-94 will have same number as current one, and will be valid for 3 years to correspond to H-1 petition.
Yes, anytime you travel outside US after Oct, you will have to return on stamped H-1 visa.
I think RP series starts with EAC1614450001 and couldn’t find any number prior to this range. I may be wrong…

I guess receipt no was received early in may 1st week….since I did not check my company portal…on a regular basis….in may I checked on 25th only and I got the no….last I checked in April last….may be mobility team uploaded all the receipt nos together in may in portal…..but now pray that this petition is approved.

What was the need of upgrading in the middle of processing? USCIS has received higher than normal Premium petitions this year. Most of the premium petitions are drawing RFE, as USCIS is giving themselves some time to process the increased load.
When you have a denial history, upgrading at this stage is sure to result in an RFE. Are you in OPT or something which necessitated the upgrade? or is it sheer impatience? If it is the latter – it was a worst decision to upgrade as RFE is going to make it more like a regular petition.
Last year we was waiting until the end of November to get the final result (and it considering that we upgraded to Premium in the end of November). That year we don’t wan’t to wait for such long time again, it is already 3rd attempt and 3 years in total. Don’t have patience anymore.
And what is advantage of giving RFE for USCIS, considering that it is more easy and faster to give approval rather than writing documents for RFE and taking more working for themselves afterwards.
What you are saying doesn’t sound logical
It is more like the on-field umpire referring to the 3rd umpire when he is not sure if he can really give it out. As everyone is losing patience more number of people are going to premium. If USCIS has not enough man power to turn around premium applications, they can easily buy themselves more time by issuing an RFE on common aspects on applications from consultancies and IT majors. As you can evidently see, the number of RFEs for product companies are very less.

As per my interaction with GI service desk person, there is a batch on June 8th. It may contain both selected and rejected petitions.
I guess it is true because I just spoke with my PM regarding my release since my file number is still showing as “NA”. This is what he said, “Infosys has received a set of results where both selection and rejection list came up, but Infy has published selection results but not the rejection list. And one more thing is, there is a set of results which Infy has not yet received which can contain both selection and rejection as well. So it is worth to wait till June 2nd week. Aft that there is no point in waiting”

Rightly said bro.. These guys have absolutely no clue about what it is professionalism. If USCIS reads the comments section of this website – they may ban Indians from H1B program completely. No patience, no awareness about basic process of H1 flow, cannot frame a proper English sentence.

Also, it is funny to note that people frame all kinds of stupid logic and asking others’ first letter of first and last names! they also want to know the location, BU, account names of those who received the receipts. All these MNCs have a common immigration team. The upper management of their respective BU’s are involved only in the initial stages to nominate candidates for this year’s H1 Cap based on the quota allotted to each BU. After that, the BU or Supervisor or Manager or DM or Directors are NOT at all involved. The immigration teams inform candidates as receipts are received, regardless of their first letter of name, account, location (Chennai or Kochi or NCR or a remote village), BU, manager/director etc.
If the candidates are not matured enough to understand simple things, one can only wonder what they will do in the US. Patience is the key and shouting here will make no difference. Let us all behave in a professional manner!

All you idiots, let me tell you my case, i made lottery 2 times, once in 2009 and worked there and now in 2015 and already i have stamped visa and job offer from a big company. Now in India my salary/position is much bigger than what i get there. i am not very much looking to go usa now unless i get a bigger position than what i am here. I work for a telecom product development company which has it’s name in Japan and USA and another 60 countries. I am not a frog trying to come out of the well and fall back. like you. I know how you so called service based big mnc’s work and i know what talent you guys have. Don’t shout and expose your real truth. I know how your account managers work and and your client interviews done. I know how you guys go there polish client managers and leads and i know how you fool indian offshore guys. Don’t play around and expose yourself. In ALL INDIAN SERVICE BASED MNC’s out of 50 ppl in project only 4-5 are talented rest ALL goats who just follow.

As an educated youth – you know what your odds are and you should know how things work. I was told that my cheque got encashed on Apr 22nd but employer haven’t get receipt notice yet. Employer sent me cheque backside Image but I/he could not read the receipt number as one or two numbers are unreadable.
Any idea why we didn’t receive receipt notice yet? employer told me that the same situation for another 15 cases in their organization.
Is anything to be worried here? Please share me your insights on this.

as a matter of fact, you should ask your employer/attorney to follow up with USCIS on your case provided that they are willing to entertain you. No one knows why the receipt is missing. It could be thousand of reasons – up to your imagination 🙂

Could you please give me 5 most relevant reasons out of 1000?
1. Wrong address on the posted receipt.
2. May be right address but the postal company misplaced it.
3. Postal company sent it to the wrong address thinking it is the right one.
4. Postal company holding the package because it returned undeliverable.
5. May be the package was sent back to USCIS because of confusion and USCIS is still busy sending out other packages rather than taking care of returned ones.

My check has been encashed April 20th . My employer told that there are 9 other “encashed checks” waiting for USCIS receipt notices.Rest all encashed check notices have come.
Don’t understand why it is taking this long for them to receive the receipts. Couple of possibilities would be either lost in USPS transit, or some system issue because of which they were not generated.

Dude.. Do you think USCIS is enjoying from May 3 to May 12 doing nothing. Please know that the first PP approvals are before May 12. Even if the SLA is from May 12 to May 27 plus so called 7 holidays if in case as you said.. So most of them will be finished early Tuesday.

I don’t know what do you mean by this question but you can receive Receipt #/Case # only from your Attorney/Employer only when your petition has been picked up in the lottery.

My husband Recd email frm the employer on 23rd at 9pm IST. 1st timer non- ad/RP/Vermont. Threw in the towel by 18th after reading comments of many proposing to execute plan B so decided to move on further and paid first term fees fr both the kids fr the upcoming academic year commencing September ’16 and to try again next April. But by God’s grace recd the golden mail on 23rd. Since it is RP, HOPING it would take 6 months to get approved, v R in a dilemma whether to move in DEC or by next July-aug. Saurabh, Can v travel along with my husband or he has to go to US first and then process H4 visa fr myself and kids

Both options are available. H-1B holder can appear for interview first and dependents can go for interview later (before or after H-1B holder travels to US), or you can go for interview together.
If the H-1b holder travels to US and then H-4 dependents appear for interview, then you would need payslips for the period H-1B holder was inside US.

@CJ, in the email sent by the employer there was no mention of recpt details. Even we were wondering y it took almost end of May to reveal this info as they r situated in NY only. Also it is just mentioned tht they shall hv further updt in 5-6 months. ATLEAST fr nw, selection in the lottery is a huge relief, any way we need breathing space of 5-6 months as we already started executing PLAN B

Is your employer a small consultancy ?? If Yes, these are common reasons by employer to cheat people. Hope that does not happen in your case.

Till now they have give me Febx courier number. Till now no news about lottery pick up. Suspecting that consultancy is taking money and not filing.

1. If selected, receipt notice will have your name. If not selected, rejection letter will have your name and employer’s name. This is the way to know for sure that petition was applied. It is up to employer to share this w/ you.
2. Depends upon the scenario. Let’s say you are in India and paid money to ABC who said that their partner in US XYZ will file H-1 petition for you. If no petition is filed, you can file a police complaint against ABC but they would pass the blame to XYZ. XYZ would say that they don’t know who you are and have never dealt w/ you. There is no paper trail.
By law, an employer cannot ask for H-1 filing fees. If a US based employer asked for filing fees and you can demonstrate it, then you can complain against them to USCIS and DOL. But lot of such shady companies will just shut their business and open another one under different name.
That is why it is very important not to pay for H-1 filing fees for your own protection. When the fees is paid by employer (like the law says), then they would ensure that petition is filed as their wallet is on the line.
Ask for the rejection notice. For all the cases not selected in the lottery, USCIS will include a notice in the returned package. This notice says something like ” USCIS accepted cap subject petitions for h1b between April 1st to 7th. We received your petition within this time frame, however, it was not selected in the random selection process”. This notice has names of the employer and the beneficiary (you) so this is the only proof to confirm whether your employer filed h1b for you or not.
At Last After one long month wait from the day cheque got cashed till the day got the receipt yesterday!

Got selected in lottery under Regular Processing, then in end of April my employer payed for Premium and there was update on USCIS website that “Case Was Received and A Receipt Notice Was Emailed” on May 13. Today is already 25th of May, so 12 days from 15 left with no response.
Does it mean that it is going to be RFE because of such slow processing?
Please help, and pray for all of us!

I have seen instances when no action was taken on 14 days and then it was approved on 15th. So don’t panic and wait for the SLA to be completed.

I had applied for H1B through another employer in USA and got through the lottery this year. Assuming my case get’s approved, do I need to travel to India for H1B VISA stamping? The US embassy/consulates specifically say that you can attend the interview if you are a resident of the 3rd country (doesn’t have to be a permanent resident). Since you are living and working there instead of simply visiting as a tourist, I think you should be ok. However, the only thing to check are your educational qualifications. The visa officer in a foreign country may not be in a position to judge your qualifications unless your degrees were from an american university. If you don’t have a US degree, its better to go to India.
I am in a similar situation, living and working in a European country but I have a US masters so I will be attending my interview in the foreign country instead of going to India. Hope it works out .
Hi, education evaluation had been done before h1 b approval. Why consulate office again ask/validate educational documents at the time of stamping?
That is why I said its ‘better’ (not required, but better). They can ask you anything. USCIS checks the employer and client details before approval then why does the VO asks about it in the interview?.
There are lot of uncertainties associated with the interview. Attending the interview in a foreign country just adds to it. I have read a few experiences where people got stamping in a foreign country. However, each case is unique. Only you know your overall profile and you have to judge what is better for you by considering all the possibilities. For example, if you think you can be subjected to additional administrative processing (221g), its better to attend the interview in the foreign country so that you can continue your work and not be stuck in India as most likely, the consulate keeps your passport during the processing.
