When will the H1B visa 2017 season start ? Date ?
Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016. The H1B Visa 2016 season started on April 1st of 2015. Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year. As of now, below are the H1B cap number for fiscal year 2017. The below numbers are confirmed in press release by USCIS on Mar 16, 2016.
- Regular H1B Quota : 65,000
- H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
- Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.
There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000. No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA. Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. Also, one key change is that, there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ?
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.
- H1B Cap to be increased from 65,000 to 110,000 per year. Also have provisions to have it up to 180,000 in case of extreme demand.
- Advanced degree from US cap quota to increase from 20,000 to 25,000
- The Filing fee for H1B could go up to 10,000 USD ( Part of this came up as the fee increase in Omnibus Bill )
- Additional H1B rules to avoid H1B Visa fraud by employers
- Mandatory LCA posting for 30 days before it is certified.
The current status on all of the above are basically “No updates”, there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.
What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS. It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016. But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th. USCIS may process the petitions early as well, but officially their clock starts on that day.

I don’t see any issues as you were in valid status when H-1 was applied. You would have submitted payslips, H-1 797 and your H-4 797 according to what was true in April. Worst case scenario is USCIS would ask for copy of new approval notice, which you can provide from new employer.

I highly doubt that RP petition would be approved so soon. Still if the employer is saying that it is, then ask for copy of approval notice to see if it is really approved. How much can you trust your consulting employer?

Do you see that status on USCIS site or your employer portal? If latter, then it is something you have to ask your employer as this would be employer-specific.

To be honest, awaiting means they have not received any acknowledgement from USCIS, but 99% receipts already must have been received by now, hence, they are waiting for your package to be received now. In short 1% chance of selection. From where did you get your status? Can you rely on that source about it’s authenticity?

I hate to say it, but I think yes. Don’t loose the complete hope but the chances are slim. Cause last year all my colleagues who received this status got Rejection after some days, somewhere in the month of July.

Actually I did reply to your query. Apparently the thread itself is not there anymore. Anyways, to be honest, I believe Accenture is waiting for your package to be received since they haven’t got your receipt. (Accenture must have received all the selected receipts by now). So we can say there are very slight selection chances. The ‘waiting’ status shall change to ‘Rejected’ once they receive your package. All the people I knew who got ‘Waiting’ status last year, got rejected eventually. Didn’t want to keep your hopes dangling so….

Thanks a lot for your response to my enquiries of whether I need a client letter or not.
As you posited, a client letter is required only if I am working in/with a consulting company.
However, I am not going to work in/with a consulting company. Rather, I will be working directly with a well-established multinational manufacturing company. So that is why I am thinking that beside all the filling documents and the Notice of Approval that my company (employer) and the company’s attorneys will give me, the employer’s offer letter could be presented, in lieu of the client letter, to the consulate at the time of the interview, or is the client letter the same as the employer offer letter?

Like you concluded, no client is needed in your case. Employer’s offer letter is always needed irrespective of whether you work for consulting company or manufacturing one.

During stamping they may ask for client letter but it depends… And after stamping, in the port of entry, they may verify about your client details such as duration of the project, history of client etc.
If possible try to take sabbatical leave from your current company and quit once you reach USA.

If u see the trends from last year, or the replies given by GI Team on AHD/ Yammer, there are some chances at least till mid-June for some ppl, maybe not many but some at least….From End-June, rejections would start getting confirmed with return of checks….So how can u say there is no 2nd list??

I just called GICS now. They are not saying anything clearly that they have recieved any reciepts or updates from uscis. But that guys is telling, that we can expect a few number of positive lottery results soon.
So nothing is clear from their end. A day back i called, and they said, they have got the results in hoards, onsite team is checking “bla bla…”
Now it’s again back to the same old story. Wait till last week of june. I am really losing hopes!

Hi, my employer told that my cheque encashed almost 2 weeks before. But no confirmation till now on lottery status. Any idea, whats the status?
I contacted the people mobility team and they said they are working on it. We might hear from them anytime. I checked with many Accenture folks across locations but noone has received. So lets wait
Accenture people check with your manager(AM and above) for your lottery results, they have it.
PMS team has shared this detail with them. I checked mine and thank god I am through this time. If you are close to your manager then only they will share it with you. My manager showed the excel sheet which has all the results and it looks like 1 out of 5 selected.

After a lot of struggle, finally got some news about TCS Hyd ppl.
When called to Hyd FDFU yesterday, the contact person very rudely replied that we know more information than them. They are getting information from us instead of them giving information to us. Bla.. bla… bla… He tried to tell me how frustrated he was (as if we are very happy 😛 )… And after five mins of talking shit, he provided some meaningful information that Hyd FDFU dont even have information regarding whose petition was filed and whose was not (dont know for what they are paid for) and asked me to contact Chennai Visa Cell.
On contacting Chennai Visa Cell, I got a very quick reply that they have shared all the information to my ISU RMG (same for all associates) and asked me to contact them.
I thought contacting ISU RMG may result in some undesired consequences and hence I checked my manager regarding whether to contact them or not. He checked with GL and told me that my GL will initiate communication to know my result. Also, asked me to wait a couple of days.
So, the summary is: Your results have come and are with your ISU RMG. If you are waiting for your results, then still hopes are on. Check with your manager and initiate a communication with ISU RMG. These guys are not sharing the results willingly. Most importantly, EXPERIENCE CERTAINTY!!!!

I still don’t get the point of trying to look for receipt numbers and assume it’s for the cap H1b applications. It makes sense if you assume the communication was delayed instead of having hope in this.

They want to keep you exited..get saddist pleasure out of your pain
coz you can change employer if you have the notice.

Sorry i do not encourage changing employers just for the sake of applying H1B.
But for your info.. in cases where even the employer is not ready to share the receipt notice and try to put you in trouble.. you can call uscis (match with the details they ask for) and they will mail you the notice…

Infosys: One of my project colleague got selected in lottery with receipt number WAC161465**** when I checked in portal https://egov.uscis.gov/casestatus/landing.do. If I start checking the serial nos by changing the last 2 digits all the receipt nos are selected in lottery. Now, I need to understand if my receipt num can somewhere be nearby? Coz infosys had applied same project code to everyone in team of 6 members. So, if receipt nos are generated in that manner. I will be selected.

after random selection.. and the data entry on the day when they entered all matters for receipt number..
Even if you are selected on the basis what you said.. suppose the data entry is finished n sat and then yours is entered into system on Monday there is a huge variation in the receipt no…
Even I do not know much of it.. but I have a better understanding than yours..

This receipt number is generated only for lottery selected candidates. It’s not based on your project code.

well let’s go with a simple equation, so the lottery algorithm is f, x represents a case, if selected it will generate a receipt number.
f(x) = y where y is the receipt number, y could be null/empty string for not selected case.
In your case, y is WAC161465****, and x represents your friend’s case
You know the value of x for 1 single y WAC161465****, if you can determine your value and outcome, you’re should be entitled with O-1 visa. IMHO

My petition was selected (Non-AD/RP/CA) and my company’s lawyer got the receipt TODAY !! I don’t have more details yet on when cheque was encashed etc. Will put up details as soon as I get them. So I guess there is still hope for RP candidates.

It seems I was not lucky enough this year and didn’t get through the lottery results.
And recently when I asked for release from the project, my manager told me to keep hope as there is one last batch yet to be notified. This is strictly for CTS people.
Anyone heard of anything like this? Or is it the false hope? Just want to know if it is all over for CTS so that can look forward for Plan B.

I have talked to my manager last week and he told me that there are no hopes hereafter to be frank and in one another forum, a fellow member of the group who is also from CTS mentioned that he talked to his director and he told him the same. I am also confused on to which one to believe, but Considering there had been no updates since the 6th of May. I am inclined to believe that it is over. And btw i have also asked for release.
