When will the H1B visa 2017 season start ? Date ?
Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016. The H1B Visa 2016 season started on April 1st of 2015. Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year. As of now, below are the H1B cap number for fiscal year 2017. The below numbers are confirmed in press release by USCIS on Mar 16, 2016.
- Regular H1B Quota : 65,000
- H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
- Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.
There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000. No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA. Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. Also, one key change is that, there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ?
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.
- H1B Cap to be increased from 65,000 to 110,000 per year. Also have provisions to have it up to 180,000 in case of extreme demand.
- Advanced degree from US cap quota to increase from 20,000 to 25,000
- The Filing fee for H1B could go up to 10,000 USD ( Part of this came up as the fee increase in Omnibus Bill )
- Additional H1B rules to avoid H1B Visa fraud by employers
- Mandatory LCA posting for 30 days before it is certified.
The current status on all of the above are basically “No updates”, there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.
What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS. It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016. But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th. USCIS may process the petitions early as well, but officially their clock starts on that day.

Good question, I would like to know this as well. Past applicants, how soon after lottery?
For pp, you will know immediately after lottery by email. For regular, I just can say that my husband received notification for receipt number from employer on 04/23/2016. He got RFE on 06/29. Only 3 days after he responded with adding PP, he got approved.
If you are on F1, you can call your school to know if there is pending COS on I-20 immediately after lottery.
Also, to see if check encashed.

April 23 is quite quick for regular processing ? Believe, it moves faster than the timelines USCIS provides, which is May 16.
I believe that the date of 05/16 is the date for pp clock starts (15 days). However, we may get receipt notice for pp before that day if lottery done before that day.
It is correct that SEVIS record gets updated even before the applicant is informed about the selection result. This is more applicable in case of RP than PP, as the emails are sent out pretty quickly while snail mail is sent after few weeks.
Lot of folks were able to know about their selection this way in the past.
We can call the school immediately after lottery is finished and check SEVIS for change of status? Is this true ?
Believe me that it is true because I did last year, emailing my husband’s school to check for me. How long is for the immediate time frame I am not very for sure. However, a couple of days are enough after lottery for you to check your school.
But, some schools refuse to check for you.
How quickly is quickly in regards to pp?
We should stop speculating figures and simply wait for the official announcement regarding the H1b petitions filed.

Was curious to know what happens to the cap that remains unfilled if a person get selected twice. Technically, he will go for only one visa so what about the cap which remains infilled? or if a person get thru lottery but was rejected during processing/visa interview because of incorrect/fraud documents. Guys, TCS, Wipro, HCL, IBM, Infi are not filling H1 in bulk like last year as an average they filled approx 25k. This year they have filed aprrox 3500. I believe that H1 aspirant will reduce this time and hopefully 100K less than last year. So this year total filling will be 133K. This is my assumption. Let us hope for better.

Petitions from top billion dollar US firms do not go into the lottery, thanks to lobbyists and connections in Washington.

You are wrong. I saw people (myself included) losing in the companies like Google / Facebook / Twitter. Some had to be relocated outside of US. According to the recruiters the odds more or less correspond to the expectations.
These companies place employees outside US for one year, and bring them back either through H1B or L1. Talent is hard to come by for these amortizations and don’t let go of them. because of visa issues.
All the fake ‘consultancies’ are crowding out the high skilled workers. It’s a tough lottery. It deserves merit. I know enough fake institutions in New Jersey personally. Perhaps it’s time to report them.

Good luck guys. This is gonna be a tough year and almost impossible with 1 petition. We have together 4 petitions- me and my wife. One petition each from our current employer and one each from a consultancy.
All we need is one petition out of these four to get selected and other person can live as a dependent or enroll in university for CPT.
Both (me and my wife) original employer are ready to file green card as soon as we get H1b so after 2-3 years one can work on H4 dependent.

I wonder how they will handle the expenses for attorneys and filing fees if multiple petitions get picked up in the lottery.
As for me, 4 petitions, from totally different individual employers.
If more than 2 petitions get picked up, I hardly can afford to pay all the fees.

I believe you expecting 1:2 probability for this year. if you and wife are in regular cap and if total cap petitions are around 260000 then each person probability will be around 1:4 so both your wife and you might be rejected in lottery .
If we consider probability for your household, then it will work as you said.. But chances are there that all four can be rejected if cap count comes to 260 K . I have solid reason , last year we applied 13000 visas and overall we got 4000 plus visas. In my account, my manager nominated 8 person and other manager nominated 10. finally my manager got nothing and other manager got 2 visas which is less than my company chance..
if you are with big guys, get L1A and get greencard within a three yrs.. in H1B it will take min of 7 yrs 3 yrs to get 140 approval.. infy , cts , wipro already doing for offshore and tcs have started a year or two back.. hope next year wont be any lottery for h1b

UN-confirmed sources say that count is around 190 K, Stay tune people, they most probably gonna announce the exact number some time tomorrow or Next Monday.

RedBus2US has reached the admin mandated comment cap for fiscal year (FY) 2017. It is more than the limit allowed by the current servers. RedBus2US will use a computer-generated process, also known as the lottery, to randomly select the comments needed to meet the cap of server capacity.
RedBus2US will first randomly select comments for the advanced degree exemption. All unselected advanced degree comments will become part of the random selection process for the general cap. The agency will reject and return apology for all unselected cap-subject comments that are not duplicate filings.
Due to the high number of comments, RedBus2US is not yet able to announce the date it will conduct the random selection process.
On 04/07/16 RedBus2US conducted a computer-generated lottery and selected everyone.
RedBus2US is glad to inform all the applicants that everyone except non-commentators is selected. They are open for new applications for next one week. Anybody commenting here will get selected and will get a ‘Commentator Of The Year’ award.
The award ceremony will be held at award winners home and they are legally bound to arrange for the arrangement.
‘Term Of Use’ section of the website clearly lays out this clause where all selected applicants will have to pay $100 for each comment they post along with bearing the expenditure for the award ceremony.

Hi Guys my lawyer sent the H1-b packet by USPS postal service. I have read in this forum that it is mainly sent by fedex. What will happen now ? Will my packet be rejected because it was not sent by FedEx?

Even in whopping 233000 applicants for fy2016 , there are only few comments in redbus2us forum , but now many are commenting and very active
I dont think redbus was not famous last year or people being active this year, but am really afraid on the total count now

That means they are going to put those bar codes or whatever on the packages and put all the applications in their system to conduct the random computer based lottery. Thats what initial intake is all about.
The part I don’t understand is “ended April 7th”. April 7th not finished yet, why the statement will use “ended April 7th”?
it means, it will continue intake/receiving applications till end of day 7th April.
First point – they will need to bundle duplicate and multiple applications before conducting lottery and then release the number, cap reached is their only initial observation.

They are saying they will accept all petitions received until April 7 EOD and do their data entry to include them in the lottery.

– This means that those who does not come under 65000 cap can still apply for H1 this year . People who has their H1 approved previously but their visa expired due to no extension applied does not come under 65000 cap. They can still apply H1 this year .
Too many applicants. Too many double triple applications. I believe they should set a special visa category only for you guys from India/China or only for IT and keep the original H1B formula for all other applicants.

Where did you read that it reached on April 5 last year? By their own ruling, USCIS accepts petitions for 1st 5 business days and doesn’t break down petitions received on each day.
After reading the release note from USCIS , does it look like only advanced degree reached more than the limit ? I don’t see nowhere they mentioned general cap reached more than the limit.

It did say that. They reached the H-1B cap and then it says “also” the 20,000….
The applications received are around 300,000. I counted them myself.

214(b) is not applicable to H-1B as it allows immigrant intent.
You will only be rejected if the nature of work, documentation is fraudulent or if you have bad history of deportation or some severe screwed up government history
